MINUTES OF A REGUlAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD OCTOBER 5, 1971 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE. VERNON. CALIFORNIA.
COUNCIL PRESENT: Anderson, Furlong, Malburg, Ybarra
COUNCIL ABSENT: Mailliard
The meeting was called to order by Mayor R. J. Furlong.
It was moved by Ybarra, seconded by Anderson, that minutes
of the meeting of September 21, 1971 be approved as written and
submitted. Motion carried.
Copy of Resolution No. 7559 of the City Council of the City
of Monterey Park urging passage of United States Senate Bill 1427
relating to disaster relief, was presented. (Copy to each member of
the City Council)
It was moved by Malburg, seconded by Ybarra, that
Resolution No. 7559 of the City Council of the City of Monterey Park
be received and filed. Motion carried.
Communication from C. H. McGovern, City Attorney, dated
September 20, 1971, with reference to Lt. J. L. Morrison's decision
to apply for a disability retirement, recommending that pursuant to
Section 4850 of the Labor Code, Lt. Morrison be paid his salary for
a period of not to exceed eight months and three weeks or until his
date of retirement, whichever is sooner, was presented. (Copy to
each member of the City Council)
It was moved by Ybarra, seconded by Anderson, that the
recommendation of the City Attorney, dated September 20, 1971, be
approved. Motion carried.
Communication from the City of Pacifica, California, dated
September 21, 1971, transmitting a copy of its Resolution No. 94-71
endorsing statewide apportionment of sales and use taxes on the
basis of population and opposing the manner of distribution prescribec
by the Bradley-Burns Uniform Local Sales and Use Tax Law, was
presented. (Copy of communication and resolution to each member of
the City Council)
It was moved by Malburg, seconded by Anderson, that communi-
cation from the City of Pacifica, California, dated September 21,
1971, together with transmittal, be received and filed. Motion
carr ied.
Communication from R. H. Bockhacker, Police Chief, dated
September 23, 1971, advising that he has suspended Officer T. R.
I,indsey for six days without pay for violation of Sections 400.16
and 400.17 of the departmental Manual of Policy and Ethics, was
presented.
It was moved by Anderson, seconded by Ybarra, that the
action taken by the Police Chief be approved. Motion carried.

Communication from R. H. King, Director of Public Works,
dated September 23, 1971, transmitting an agreement prepared by
Union Pacific Railroad Company relative to widening Bandini Boulevard,
Crossing No. 2-146.15-C; and recommending that the agreement be
approved and that the Mayor and the City Clerk be authorized to
execute the agreement, was presented.
It was moved by Ybarra, seconded by Malburg, that the
recommendation of the Director of Public Works, dated September 23,
1971, be approved; and that the Mayor and the City Clerk be
authorized to execute Agreement No. C.L.D. No. 16630 between Los
Angeles & Salt Lake Railroad Company and its Lessee, Union Pacific
Railroad Company, The Atchison, Topeka and Santa Fe Railroad Company
and the City of Vernon relative to widening Bandini Boulevard,
Crossing No. 2-146.15-C. Motion carried.
Communication from R. H. King, Director of Public Work:3~
dated September 29, 1971, transmitting Contract No. 364 for Pavement
Marker Installation of Bandini Boulevard, Downey Road to Atlantic
Boulevard; and recommending that this contract be approved and that
authority be granted to advertise for bids, was presented.
Resolution No. 4070 - A Resolution of the City Council of
the City of Vernon, approving Contract No. 364 for Pavement Marker
Installation on Bandini Boulevard, Downey Road to Atlantic Boulevard,
in accordance with Contract No. 364 of the City of Vernon, was
presented.
It was moved by Ybarra, seconded by Anderson, that
Resolution No. 4070 be approved and adopted. Motion carried.

Communication from R. M. Eatherly, Fire Chief, dated
September 29, 1971, requesting that Fireman Robert F. Salisbury be
reimbursed the amount of $11.50 from the Education and Training
Appropriation budget as he has satisfactorily completed two courses
required for an Associate of Arts Degree in Fire Science, was
presented.
It was moved by Malburg, seconded by Ybarra, that the
request of the Fire Chief, dated September 29, 1971, be approved
and authority granted to issue warrant in the amount of $11.50 to
Robert F. Salisbury. Motion carried.
Communication from C. E. Nemethi, M.D., Health Officer,
dated September 27, 1971, requesting authority for Louis Hauger to
attend the Executive Committee Meeting, California Conference
Directors of Environmental Health at Fresno, California, on October
7 and 8, 1971, with an expense allowance of $103.77, was presented.
It was moved by Anderson, seconded by Ybarra, that the
request of the Health Officer, dated September 27, 1971, be approved
and authority granted to issue warrant in the amount of $103.77 to
Louis Hauger. Motion carried.
Activity Log of the Police Department for the period
September 16 - 30, 1971 inclusive, was presented.

It was moved by Ybarra, seconded by Malburg, that Activity
Log of the Police Department be received and filed. Motion carried.
Copy of Resolution No. 2355 of the City Council of the
City of Upland opposing the enactment of Assembly Bill No. 2294
prescribing fixed lot sizes and development standards within mobi1e-
home parks, was presented. (Copy to each member of the City Council)
It was moved by Malburg, seconded by Ybarra, that copy of
Resolution No. 2355 of the City Council of the City of Upland be
received and filed. Motion carried.
Copy of Resolution No. 2591 of the City Council of the
City of Downey,Ca1ifornia, opposing attempt to alter the method of
levying, collecting and distributing the Uniform Sales and Use Tax
l,aw under the Bradley-Burns Uniform Local Sales and Use Tax Law, was
presented. (Copy to each member of the City Council)
It was moved by Anderson, seconded by Malburg, that copy o~
Resolution No. 2591 of the City Council of the City of Downey,
California, be received and filed. Motion carried.
Communication from R. H. King, Director of Public Works,
dated September 29, 1971, advising that Sully-Miller Construction
Co. has completed the work for Fruitland Avenue Improvement - Santa
Fe Avenue to Soto Street, 57th Street Improvement - Alameda Street
to Santa Fe Avenue and Heater Remixing and Asphalt Resurfacing of
Certain Streets in accordance with Contract No. 357; and recommending
that the work be accepted and that authority be granted to pay the
contractor in accordance with the agreement, was presented.
The Director of Public Works requested that his communi-
cation dated September 29, 1971 be withdrawn, so no action was taken.
Communication from R. H. King, Director of Public Works,
dated September 29, 1971, requesting authority to attend the 52nd
Annual Conference of the California Section of American Water Works
Association in Fresno, California from October 26 to 29, 1971, with
an expense allowance of $206.30, was presented.
It was moved by Anderson, seconded by Ybarra, that the
request of the Director of Public Works, dated September 29, 1971,
be approved and authority granted to issue warrant in the amount of
$206.30 to R. H. King. Motion carried.
Communication from R. H. King, Director of Public Works,
dated September 29, 1971, requesting authority for Lewis R. Adams
to attend the 52nd Annual Conference of the California Section of
American Water Works Association at Fresno, California from October
26 to 29, 1971, with an expense allowance of $206.30, was presented.
It was moved by Anderson, seconded by Ybarra, that the
request of the Director of Public Works, dated September 20, 1971,
be approved and authority granted to issue warrant in the amount of
$206.30 to Lewis R~ Adams. Motion carried.
Communication was presented fram R. H. Bockhacker, Police
Chief, dated September 29, 1971, recommending that the following
personnel be reimbursed in the amounts indicated from the Education
and Training Appropriation budget for Police Science courses at East
Los Angeles College, Cerritos College and Rio Hondo College:

It was moved by Malburg, seconded by Ybarra, that the
recommendation of the Police Chief, dated September 29, 1971, be
approved and authority granted to issue warrants in the amounts as
indicated. Motion carried.
''Warrant Register No. 342" covering claims and demands
presented during the period September 16 to 30, which includes
Demands Nos. 1-2425 to 1-2509 (both inclusive) drawn on the United
California Bank, totaling $161,472.28 (Light and Power Warrants
$3,379.22) (Accounting Period October 1971), was examined and audited.
It was moved by Anderson, seconded by Ybarra, that ''Warrant
Register No. 342" be approved and payment authorized for Demands Nos.
1-2425 to 1-2509 (both inclusive), with no exceptions. Motion
carried.

Communication from Guild Moccasin Corporation, dated
September 30, 1971, commending the Vernon Fire Department, was

It was moved by Malburg, seconded by Ybarra, that communi-
cation from Guild Moccasin Corporation, dated September 30, 1971, be
received and filed. Motion carried.
Communication from the Law Offices of Gillette & pagter,
dated September 23, 1971, transmitting Complaint, Stipulation and
Acknowledgement of Service in Maywood Mutual Water Company No. 3
vs. County of Los Angeles, et a1 and naming the City of Vernon as a
Co-Defendant, was presented.
It was moved by Anderson, seconded by Ybarra, that communi-
cation from the Law Offices of Gillette & Pagter, dated September 23,
1971, together with transmittals, be referred to the City Attorney
for necessary action. Motion carried.
Communicatio~from R. H. Bockhacker, Police Chief, dated
October 1, 1971, requesting authority for Lt. A. E. Chrisman and
Sgt. J. R. Tucker to attend the 1971 Law Enforcement Intelligence
Unit Northwestern/Southwestern Bi-Zone Conference at San Diego,
California from October 13 to 15, 1971, with an expense allowance
of $97.50 each, was presented.
It was moved by Anderson, seconded by Ybarra, that the
requests of the Police Chief, dated October 1, 1971, be approved
and authority granted to issue warrants in the amount of $97.50
each to A. E. Chrisman and J. R. Tucker. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
October 1, 1971, requesting authority for Lt. L. F. E1y to attend
the Polygraph Examiner Course at California State College, Los
Angeles, commencing November 15, 1971, with a tuition fee of $675.00
for the course, was presented.

Resolution No. 4072 be approved and adopted. Motion carried.

Communication from Gibson, Dunn & Crutcher, Lawyers, dated
September 24, 1971, addressed to the City Attorney, transmitting
Memorandum of Agreement between the City of Vernon and Southwest
Forest Industries, Inc. relative to property at the southwest corner
of Santa Fe Avenue and 25th Street, was presented by the City
Attorney.
Councilman Malburg disclosed that he is the owner of the
property located at the southwest corner of Santa Fe Avenue and
25th Street.
It was moved by Anderson, seconded by Ybarra, that the
Mayor and the City Clerk be authorized to execute Memorandum of
Agreement between the City of Vernon and Southwest Forest Industries,
Inc. relative to property at the southwest corner of Santa Fe Avenue
and 25th Street. Motion carried.

Communication from Fireman David W. Perkins, dated
September 16, 1971, addressed to the Fire Commission, requesting a
meeting in executive session to propose a possible solution to an
extremely difficult situation currently existing in the Fire
Department relative to his current and future capacities with the
City, was presented.
At this time, 2:53 o'clock p.m., Mayor Furlong called the
City Council into executive session pursuant to Section 54957 of
the Government Code for the purpose of discussing certain personnel
matters with Fireman David W. Perkins as requested by him in his
communication dated September 16, 1971. All persons, with the
exception of the City Attorney, the City Clerk and Fireman Perkins,
were excluded from the executive session.
Discussion was held with Fireman Perkins relative to
matters covered in his communication dated September 16, 1971.
At 3:05 o'clock p.m., Mayor Furlong excused Fireman Perkins
from the Council Chamber.
The City Council discussed and considered Fireman Perkins'
current and future capacities with the City.

At 3:21 o'clock p.m., Fire Chief Eatherly was called into
the executive session.
Atter discussing with the Fire Chief possible solutions
to the existing situation, it was moved by Malburg, seconded by
Ybarra, that Fireman David W. Perkins be reclassified from Admini-
strative Assistant Chief, Grade 3, to Captain, Grade 1, effective
November 1, 1971. Motion carried.

At 3:52 o'clock p.m., Fireman Perkins was recalled to the
executive session and was notified of the City Council's decision.
There being no further business to come before the meeting,
it was moved by Anderson, seconded by Ybarra, that the meeting
adjourn. Motion carried.
