IN THE COUNC IL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE. VERNON. CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Malburg, Ybarra COUNCIL ABSENT: Mai1liard The meeting was called to order by Mayor R. J. Furlong. It was moved by Ybarra, seconded by Anderson, that minutes of the meeting of November 16, 1971 be approved as written and submitted. Motion carried. Communication from Mr. Joseph Freed, dated November 22, 1971, petitioning the City Council for a variance on a Fire Depart- Incnt ordinance concerning the storage of smokeless powder, was presented. (Copy to each member of the City Council) The City Clerk advised the City Council that Mr. Joseph Freed telephoned on December 3, 1971 requesting that his petition, dated November 22, 1971, for a variance on a Fire Department ordinance concerning the storage of smokeless powder, be withdra,;..;rn from the Agenda. It v7as moved by Anderson, seconded by Ybarra, that communi- cation from Mr. ,Joseph Freed, dated November 22, 1971, be recei'H;;c and filed. Motion carried. Communication from Southern California Edison Company, dated November 26, 1971, with reference to SCE Resale Rates FPC Docket No. E-76l8, advising that billings subsequent to November 14, 1971 will reflect the effect of such increases in rates for service rendered on and after that date, was presented. (Copy to each member of the City Council) Communication from Paul P. Hendricks, Consulting E1ectr:Lca,1 g1igi.n~er, dated December 1, 1971, with reference to the increase in the R-2 Resale rate charged Vernon for electrical power, was presented. (Copy to each member of the City Council) Communication from C. H. McGovern, City Attorney, dated November 29, 1971, with reference to the effect of Phase Two of the President's Wage and Price Freeze on Ordinance No. 828, which Lncreased the electrical rates within the City of Vernon in accord- A.nce with the new electrical rates approved by the Public Uti.1ities Comrrtission for the Southern California Edison Company, making certain reconnnendations in connection therewith, 1:,vas presented. (Copy to each member of the City Council) After reviewing and discussing communications from southern California Edison Company, dated November 26, 1971, the Consulting Electrical Engineer, dated December 1, 1971, and the City Attorney, dated November 2~, 1971, it ,;<]a8 moved by Malburg, seconded by Ybarra., that the City Council determines that the increase in electrical rates within the City of Vernon pursuant to Ordinance No. 828 is non-inflationary, but reflects a long-standing pattern of the City of Vernon in the adoption of Edison rates, and that the increase in v~lolesa1e rates justifies an increase in retail rates; and that the previously approved and adopted Ordinance No. 828 be implemented, and that the implementation of the same be communicated to the Southern California Edison Company to take effect as soon as possi.b1e. I I ~2- 12 7 71 Claim for Damages (No. 827195), dated November 12, 1971, filed by the Interinsurance Exchange of the Automobile Club of Southern California on behalf of Ignacio and Rosa Maria Mora, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Anderson, that Claim for Damages (No. 827195), dated November 12, 1971, filed by the Interinsurance Exchange of the Automobile Club of Southern CalifornLa, be denied and referred to the City Attorney and the City's insurance carrier for necessary action. Motion carried~ Communication from the City of Monrovia, dated November 16, 1971, with reference to excessive pay increases to police and fire personnel by the Board of Supervisors of Los Angeles County, was presented. (Copy to each member of the City Council) Resolution No. 4079 - A Resolution of the City Council of the City of Vernon urging the County Board of Supervisors of Los Angeles County to submit to the electorate a proposed charter amendment deleting Article 10, Labor Section 47 of the Los Angeles County Charter, was presented. It was moved by Malburg, seconded by Anderson, that Resolution No. 4079 be approved and adopted. Motion carried. King, Director of Public Works, dated November 19, 1971, transmitting an Easement from Santa Fe Land Improvement Company covering District Boulevard between Downey Road e.nd Atlantic Boulevard; and recommending that the easement be accepted and the grantor be advised of the official recorda.tion, 'I:,vas pr~'sented. It was moved by Ybarra, seconded by Anderson, that Easement be accepted from Santa Fe Land Improvement Company; and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated l'~cvem.ber 25, 1971, with reference to .LlS caliber Colt Pistol, Serial Number 307984-C, 'I:"fhich was issued to Officer G. G. Skalsky on Nay 1, 1969, recommending that the City of Vernon bill Mr. Skalsky for the fair market value of this pistol in the event he is unable to locate it within a reasonable time, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Malburg, that the recommendation of the Police Chief, dated November 25, 1971, be approved. Motion carried. Copy of Resolution No. 71-369 of the City Council of the City of Hayward urging the Federal and State Legislatures to enact legislation granting tax relief to owner-occupied residential property~ was presented. It was moved by Malburg, seconded by Ybarra, that copy of R,~solution No. 71-369 of the City Council of the City of Hayward be received and filed. Motion carried. Claunch be reimbursed the sum of $18.00 from the Education and Training Budget H.ppropriation for Fire Science courses, was presented. It was moved by Ybarra, seconded by Anderson, that the request of the Fire Chief, dated November 24, 1971, be approved and authority granted to issue warrant in the amount of $lQ.OO to Fr.~nk A. Claunch. Motion carried. Communication from R. H. King, Director of Public Works, dated November 18, 1971, transmitting a Grant Deed from Fred S. Kahn and Evelyn N. Kahn covering a portion of 37th Street at the N.E. corner of 37th Street and Santa Fe Avenue; and recommending that the Grant Deed be accepted and that the grantors be advised of the official recordation, was presented. It was moved by Malburg, seconded by Ybarra, that Grant Deed be accepted from Fred S. Kahn and Evelyn N. Kahn; and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Activity Log of the Police Department for the period November 16 - 30, 1971 inclusive, was presented. It was moved by Ybarra, seconded by Anderson, that Activity Log of the Police Department be received and filed. Motion carried. ''Warrant Register No. 346" covering claims and demands presented during the period November 16 to 30, which includes Demands Nos. 1-2889A, 1~2890 to 1-2982 (both inclusive) dra~m on the United California Bank, totaling $85,634.88 (Light and Power Warrants $5,160.28) (Accounting Period December, 1971), was examined an(~ audited. It was moved by Ybarra, seconded by Anderson, that "vJarrant Register No. 346" be approved and payment authorized for Demands Nos. l-2889A, 1-2890 to 1-2982 (both inclusive), with no exceptions. Eatherly, Fire Chief, dated December 3, 1971, requesting authority and funds to purchase three E & J Lyt-Port Resuscitators at an estimated total cost of $1,500.00, ,-,,][is presented. It was moved by Malburg, seconded by Ybarra, that the request of the Fire Chief, dated December 3, 1971, be approved. Motion carried. The City Clerk advised the City Council that Councilman Charles H. Hailliard passed away December 5, 1971. Resolution No. 4080 - A Resolution of the City Council of the City of Vernon extending its condolences on the passing of Charles H. Mai11iard, a Resident and Councilman of the City of Vernon, '\vas presented. I I -4- 12 7 71 It was moved by Malburg, seconded by Ybarra, that Resolution No. 4080 be approved and adopted. Mai1liard on the City Selection Committee pursuant to the Southern California Rapid Transit District Law. It was moved by Malburg, seconded by Anderson, that the City Attorney be instructed to draft a resolution appointing Robert J. Furlong as a member of the City Selection Committee pursuant to the Southern California Rapid Transit District Law. Motion carried. Discussion was held with reference to the appointment of a replacement for Councilman Charles H. Mailliard as an alternate member of the Board of Directors of County Sanitation District No. 2 of Los Angeles County. It was moved by Anderson, seconded by Ybarra, that the City Attorney be instructed to draft a resolution appointing Leoni.s C. Malburg as an alternate member of the Board of Directors of County Sanitation District No. 2 of Los Angeles County. Motion carried. Due to the vacancy caused by the death of Councilman Charles H. Mail1iard, Mayor Furlong made the following appointrneIits to serve on various Committees until further order of the Chair: Finance Committee - Thomas A. Ybarra Fire and Police Committee - Thomas A. Ybarra It was moved by Anderson, seconded by Malburg, that the appointments made by Mayor Furlong to serve on various Committees be approved. Motion carried. Ayes: Anderson, Furlong, Malburg, Ybarra. Noe s : None Absent: Mai11iard At this time, 2:32 o'clock p.m., Mayor Furlong called the City Council into executive session pursuant to Section 54957.6 of the Government Code for the purpose of meeting with Mr. Harry J. Keaton, Municipal Employee Relations Representative, in order to review the City's position relative to the meeting and conferring process between the Vernon Firemen's Association and the Municipal Employee Relations Representative; and pursuant to Section 54957 of the Government Code for the purpose of discussing the appointment of a person to the City Council to fill the unexpired term of Council- man Charles H. Mai11iard, now deceased. All persons, with the exception of the City Attorney, the City Clerk, the Municipal Employee Relations Representative, the Fire Chief and the Assistant Fire Chief, were excluded from the executive session. Mr. Harry J. Keaton, Municipal Employee Relations Repre- sentative, reviewed the results of various meetings with represen- tatives of th~ Vernon Firemen's Association; and presented the following executed documents: I I -5- 12 7 71 (1) Settlement Agreement; (2) Memorandum of Understanding between the Municipal Employee Relations Representative of the City of Vernon and the Vernon Firemen's Association (Employee Group 1); and (3) Memorandum of Understanding between the Municipal Employee Relations Representative of the City of Vernon and the Vernon Firemen's Association (Employee Group 4). It was moved by Anderson, seconded by Ybarra, that the Settlement Agreement, the Memorandum of Understanding between the Municipal Employee Relations Representative of the City of Vernon and the Vernon Firemen's Association (Employee Group 1); and the Memorandum of Understanding between the Municipal Employee Relations Representative of the City of Vernon and the Vernon Firemen's Association (Employee Group 4), as presented by the Municipal Employee Relations Representative, be approved; and that the City Attorney be instructed to draft a resolution approving the Settlement Agreement, the Memorandum of Understanding between the Municipal Employee Relations Representative of the City of Vernon and the Vernon Firemen's Association (Employee Group I), and the Memorandum of Understanding between the Municipal Employee Relations Repre- sentative of the City of Vernon and the Vernon Firemen's Association (Employee Group 4). Motion carried. Representatives of the Vernon Firemen's Association were recalled to the executive session and advised of the action taken by the City Council; and the executive session continued after the representatives of the Vernon Firemen's Association were excluded. Discussion was held with reference to the appointment of a person to the City Council to fill the unexpired term of Councilman Charles H. Mailliard, now deceased. After discussion, it was moved by Malburg, seconded by Anderson, that the City Attorney be instructed to draft a resolution appointing Mrs. Martha F. Tavernelli to the City Council to fill the unexpired term of Councilman Charles H. Mailliard, now deceased. Motion carried. The executive session adjourned at 3:03 o'clock p.m. session. Mayor Furlong called the City Council back into regular Discussion was held relative to letter from Fire Chief R. M. Eatherly, dated October 18, 1971, addressed to the Board of Fire Co~missioners, in which he made certain recommendations for reorganization of the Fire Department. No action was taken pending supplemental letter from the Fire Chief relative to this matter.
