19720502 Regular City Council Meeting - Minutes I MINUTES OF A REGUlAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD MAY 2, 1972 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE 1 VERNON~ CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Malburg, Tavernelli, Ybarra COUNCIL ABSENT: None The meeting was called to order by Mayor Furlong. It was moved by Anderson, seconded by Ybarra, that minutes of the meeting of April l8, 1972 be approved as written and submitted. Motion carried. The City Clerk reported that this was the time and place for the public hearing pursuant to Vehicle Code Section 21l07.5 to determine whether certain privately owned and maintained roads are generally held open for the use of the public for vehicular travel, and which so connect with highways that the public cannot determine that such roam are not highways, as recited in Resolution No. 4107 adopted by the City Council on April 18, 1972. The City Clerk reported that a certified copy of Resolution No. 4107 was sent by registered mail (return receipt requested) on April 19, 1972 to Santa Fe Land Improvement Company; and was received by a representative of Santa Fe Land Improvement Company on April 20, 1972. The City Clerk reported that no written communications were received relative to this matter. The Mayor asked if anyone from the floor wished to protest or comment on the matter before the City Council. No one protested. Resolution No. 4112 - A Resolution of the City Council of the City of Vernon declaring that there are privately owned and maintained roads located within the City of Vernon generally held open for the use of the public and determining that the provisions of the Vehicle Code shall apply to such roads, was presented. It was moved by Malburg, seconded by Tavernel1i, that Resolution No. 4112 be approved and adopted. Motion carried. King, Director of Public Works, dated April 20, 1972, transmitting a fully executed easement from National Can Corporation granting to the City an Easement over a portion of their property at the southwest corner of 26th Street and Bonnie Beach Place; and recommending that the Easement be accepted and the grantors be advised of the official recordation, was presented. It was moved by Anderson, seconded by Ybarra, that Easement be accepted from National Can Corporation; and that the Mayor and the City Clerk be authorized tQ execute Certificate of Acceptance. Motion carried. I I -2- 5 2 72 Copy of Resolution No. 7609 of the City Council of the City of Monterey Park urging additional State financial aid to school districts, was presented. It was moved by Ybarra, seconded by Taverne1li, that copy of Resolution No. 7609 of the City Council of the City of Monterey Park be received and filed. Motion carried. Copy of Resolution No. 3126 of the City Council of the City of South Gate, California, opposing Assembly Bill No. 206, was presented. (Copy to each member of the City Council) Resolution No. 4lll - A Resolution of the City Council of the City of Vernon opposing Assembly Bill 206 and any similar type bill, was presented. It was moved by Malburg, seconded by Ybarra, that Resolution No. 4111 be approved and adopted. Motion carried. Ayes: Anderson, Furlong, Malburg, Tavernel1i, Ybarra Noes: None Absent: None Communication from R. H. Bockhacker, Police Chief, dated April 19, 1972, advising that he has suspended Officer T. R. Igyarto without pay from April 17 through April 30, 1972, inclusive, for violation of certain sections of the Department's Manual of Policy and Ethics, was presented. (Copy to each member of the City Council) It was moved by Tavernelli, seconded by Anderson, that the action taken by the Police Chief be approved. Motion carried. Communication from R. H. King, Director of Public Works, dated April 25, 1972, transmitting an Easement from Federal Ice and Cold Storage Company covering a portion of their property on the southwest corner of District Boulevard and Maywood Avenue; and recommending that the Easement be accepted and the grantor advised of the official recordation, was presented. It was moved by Taverne11i, seconded by Ybarra, that Easement be accepted from Federal Ice and Cold Storage Company; and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Communication from C. E. Nemethi, M.D., Health Officer, dated April l8, 1972, requesting authority for Louis S. Hauger to attend the Western Safety Congress at Anaheim from May 9 to 11, 1972, inclusive, with an expense allowance of $40.00, was presented. It was moved by Taverne11i, seconded by Ybarra, that the request of the Health Officer, dated April 18, 1972, be approved and authority granted to issue warrant in the amount of $40.00 to Louis S. Hauger. Motion carried. "Warrant Register No. 356" covering claims and demands presented during the period April 16 to 30, which includes Demands Nos. 2-952 to 2-1037 (both inclusive) drawn on the United California Bank, totaling $58,474.38 (Light and Power Warrants $4,072.65) (Accounting Period May, 1972), was examined and audited. I I -3- 5 2 72 It was moved by Anderson, seconded by Ybarra, that "Warrant Register No. 356" be approved and payment authorized for Demands Nos. 2-952 to 2-l037 (both inclusive), with no exceptions. It was moved by Malburg, seconded by Taverne11i, that Activity Log of the Police Department be received and filed. Motion carried. Report No. 7171 prepared by Gage-Babcock & Associates, Inc. on a study of the Fire Department services for the City of Vernon, California, was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Taverne11i, that Report No. 7171 prepared by Gage-Babcock & Associates, Inc. on a study of the Fire Department services for the City of Vernon, California, be received and referred to the Finance Committee for study. Motion carried. Communication from R. M. Eatherly, Fire Chief, dated April 28, 1972, advising that de1iv~ry of the 1972 Mack Fire Truck was made on April 21, 1972 by Motor Truck Distributors, was presented. (Copy to each member of the City Council) It was moved by Malburg, seconded by Ybarra, that communi- cation from the Fire Chief, dated April 28, 1972, be received and fi.led. Motion carried. Communication from L. S. Hauger, Director of Environmental Health, dated April 28, 1972, with reference to community noise complaint from residents in the vicinity of Gifford Avenue and E. 52nd Street, Maywood, was presented. (Copy to each member of the City Council) It was moved by Taverne11i, seconded by Anderson, that communication from the Director of Environmental Health, dated April 28, 1972, be received and filed. Motion carried. Resolution No. 4110 - A Resolution of the City Council of the City of Vernon opposing Assembly Bill 452 and Senate Bill ll6 and other similar bills, was presented. It was moved by Malburg, seconded by Taverne1li, that Resolution No. 4110 be approved and adopted. Motion carried. There being no further business to come before the meeting, it was moved by Anderson, seconded by Taverne1li, that the meeting adjourn. Motion carried.
