19721017 Regular City Council Meeting - Minutes I I MINUTES OF A REGUlAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD OCTOBER 17, 1972 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE 9 VERNON 9 CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Taverne1li, Ybarra COUNCIL ABSENT: Malburg The meeting was called to order by Mayor Furlong. It was moved by Ybarra, seconded by Anderson, that minutes of the meeting of October 3, 1972 be approved as written and submitted. Motion carried. The City Clerk reported that this was the time and place for the hearing relating to the adoption of Ordinance No. 835 of the City of Vernon in accordance with notice dated September 19, 1972. Proof of Publication in the Los Angeles Daily Journal on September 27 and October 4, 1972 of "Notice of Public Hearing" was duly acknowledged as being on file. The City Clerk reported that no written communications relative to this matter had been received. The Mayor asked if anyone in the audience wished to comment or protest. No one responded. It was moved by Anderson, seconded by Ybarra, that Ordinance No. 835 receive a second reading by title. Motion carried. Ordinance No. 835 - An Ordinance of the City of Vernon adopting a Uniform Fire Code prescribing regulations governing conditions hazardous to life and property from fire or explosion, and establishing a Bureau of Fire Prevention and providing officers therefor and defining their powers and duties, was read for a second reading by title. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that Ordinance No. 835 receive and pass a second reading. Motion carried. Ayes: Anderson, Furlong, Tavernel1i, Ybarra Noes: None Absent: Malburg It was moved by Anderson, seconded by Ybarra, that in accordance with Government Code Section 36934, the reading of Ordinance No. 835 in full be waived; and that Ordinance No. 835 receive a third and final reading by title. Motion carried. Communication from Richard W. Hilton, dated October 10, 1972, advising that he will vacate the apartment at 3378 E. 50th Street effective December 1, 1972, was presented. It was moved by Taverne1li, seconded by Ybarra, that communication from Richard W. Hilton, dated October 10, 1972, be received and filed. Motion carried. Report of Health Department Activities for the month of September 1972, was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Tavernel1i, that Report of Health Department Activities be received and filed. Motion carried. Communication from R. H. King, Director of Public Works, dated October 5, 1972, advising that the work for 26th Street Improvement (Downey Road to Atlantic Boulevard), Indiana, Bonnie Beach and Ayers Improvement (26th Street to Bandini Boulevard) under Contract No. 354, has been completed; and recommending that the work be accepted and that authority be granted to pay the contractor, Sully-Miller Contracting Company, in accordance with the agreement, was presented. Resolution No. 4129 - A Resolution of the City Council of the City of Vernon accepting the work of Sully-Miller Contracting Company for the work for 26th Street Improvement (Downey Road to Atlantic Boulevard), Indiana, Bonnie Beach and Ayers Improvement (26th Street to Bandini Boulevard), in accordance with Contract No. 354 of the City of Vernon, was presented. It was moved by Anderson, seconded by Ybarra, that Resolution No. 4129 be approved and adopted. Motion carried. Yee, dated October 10, 1972, requesting that his resignation as Engineering Aide I with the City of Vernon be accepted effective October 26, 1972, was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Tavernel1i, that the resignation of Jerry J. K. Yee be accepted. Motion carried. Activity Log of the Police Department for the period October 1 - 15, 1972 inclusive, was presented. It was moved by Ybarra, seconded by Tavernelli, that Activity Log of the Police Department be received and filed. Motion carried. I I -4- 10 17 72 "Payroll r4arrant Register No. 183" covering claims and demands presented during the period September 1 to 30, which includes Demands Nos. 1941 to 1950 (both inclusive), drawn on the Crocker National Bank, totaling $359,135.54 (Accounting Period September 1972), was examined and audited. It was moved by Ybarra, seconded by Tavernel1i, that "Payroll Warrant Register No. 183" be approved and payment authorized for Demands Nos. 1941 to 1950 (both inclusive), with no exceptions. It was moved by Ybarra, seconded by Tavernelli, that "Warrant Register No. 367" be approved and payment authorized for Demands Nos. 2-2227 to 2-2367 (both inclusive), with no exceptions. King, Director of Public Wo~~ks, dated October 11, 1972, transmitting Contract No. 366, Violet Alley Improvement between 27th Street and 30th Street, and 37th Street at Santa Fe Avenue Intersection Improvement; and recommending that this contract be approved and that authority be granted to advertise for bids, was presented. ~esolution No. 4128 - A Resolution of the City Council of the City of Vernon approving Contract No. 366, Violet Alley Improve- ment 27th Street to 30th Street and 37th Street at Santa Fe Avenue Intersection Improvements, in accordance with Contract No. 366 of the City of Vernon, was presented. Eatherly, Fire Chief, dated October 12, 1972, submitting a progress report relative to problems involved at Clougherty Packing Company's main building complex located at 3049 E. Vernon Avenue, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Tavernelli, that communication from the Sr. Building Inspector and the Fire Chief, dated October 12, 1972, be received and filed. Motion carried. Communication from the Finance Committee, dated October 11, 1972, making certain enumerated recommendations with reference to the Major Medical Group and Life Insurance Plan, was presented. (Copy to each member of the City Council) It was moved by Tavernel1i, seconded by Anderson, that the recommendations of the Finance Committee, with reference to the Major Medical Group and Life Insurance Plan, be approved as enumerated in communication dated October 11, 1972. Simon is being suspended one shift without pay, October 18, 1972, for violation of the Rules and Regulations of the Vernon Fire Department, General Rules, Sections 3, 9 and 57, was presented. It was moved by Tavernelli, seconded by Ybarra, that the action taken by the Fire Chief be approved. Motion carried. Communication from R. M. Eatherly, Fire Chief, dated October 12, 1972, requesting authority for Richard F. pavlovsky to attend the California Fire Chiefs North-South Fire Prevention Officers' meeting at Fresno from October 20 to 21, 1972, with an expense allowance of $81.00, was presented. It was moved by Anderson, seconded by Taverne11i, that the request of the Fire Chief, dated October 12, 1972, be approved and authority granted to issue warrant in the amount of $81.00 to Richard F. Pav10vsky. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated October 12, 1972, requesting that L. J. Ebelt and L. B. Retmers be advanced to Policeman, Grade 3, effective November 1, 1972, was presented. It was moved by Ybarra, seconded by Taverne11i, that the request of the Police Chief, dated. October 12, 19i2, be approved. Motion carried. l -6- 10 17 72 Communication from R. M. Eatherly, Fire Chief, dated October 13, 1972, requesting authority for F. H. Colvin and R. M. Eatherly to attend the Western Fire Chiefs' Association-Annual Conference in Anaheim from October 29 to November 2, 1972, with an expense allowance of $108.00 each, was presented. It was moved by Tavernel1i, seconded by Ybarra, that the request of the Fire Chief, dated October 13, 1972, be approved and authority granted to issue warrants in the amount of $108.00 each to F. H. Colvin and R. M. Eatherly. Motion carried. Discussion was held with reference to Sections 12.5 and 12.6 of Chapter 12 of The Code of the City of Vernon, California, 1959, relative to vehicles transporting slaughterhouse and other refuse over City streets. It was moved by Tavernelli, seconded by Anderson, that the City Attorney be instructed to draft an ordinance repealing Sections 12.5 and 12.6 of Chapter 12 of The Code of the City of Vernon, California, 1959. Motion carried. Communication from Kerner Trucking Service, Inc., dated October 16, 1972, requesting permission to store trailers behind Fire Station No. 3 at 2800 So. Soto Street, was presented. It was moved by Ybarra, seconded by Anderson, that the request of Kerner Trucking Service, Inc., dated October 16, 1972, be denied. Mot ion carried.
