19721219 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD DECEMBER 19, 1972 AT TWO O'CLOCK P. M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. COUNCIL PRESENT: Anderson, Furlong, Malburg, Tavernelli, Ybarra COUNCIL ABSENT: None The meeting was called to order by Mayor Furlong. It was moved by Anderson, seconded by Tavernelli, that minutes of the meeting of December 5, 1972 be approved as written and submitted. Motion carried. It was moved by Ybarra, seconded by Malburg, that Ordinance No. 838 receive a second reading by title. Motion carried. Ordinance No. 838 - An Ordinance of the City of Vernon deleting certain portions of Ordinance No. 835 of the City of Vernon, was read by title for a second reading. (Copy to each member of the City Council) It was moved by Tavernelli, seconded by Ybarra, that Ordinance No. 838 receive and pass a second reading. Motion carried. Ayes: Anderson, Furlong, Malburg, Tavernelli, Ybarra Noes: None Absent: None It was moved by Anderson, seconded by Tavernelli, that in accordance with Government Code Section 36934, the reading of Ordinance No. 838 in full be waived; and that Ordinance No. 838 receive a third and final reading by title. Motion unanimously carried. Bockhacker, Police Chief, dated December 4, 1972, with reference to a police training officer's program which Sgt. B. A. Bunker attended, requesting that expense monies in the amount of $95.00 be returned to Sergeant Bunker when the City receives it from P.O.S.T., was presented. (Copy to each member of the City Council) It was moved by Taverne1li, secoqded by Ybarra, that the request of the Police Chief, dated December 4, 1972, be approved and authority granted to issue warrant in the amount of $95~00 to B. A. Bunker when the money is recei.v~d from P.O.S. T. Motion carried. I I , .. -2- 12 19 72 Communication from R. H. Bockhacker, Police Chief, dated December 6, 1972, requesting that Sgt. R. N. Graham be authorized to attend the 1973 Training Institute for Auto Theft Investigators at San Jose, California from February 5 to 9, 1973, with a regis- tration fee of $80.00 and $120.00 for expenses, was presented. (Copy to each member of the City Council) It was moved by Anderson, seconded by Tavernelli, that the request of the Police Chief, dated. December 6,1972, be approved; that authority be granted to issue warrant in the amount of $80.00 to California State University; and that authority be granted to issue warrant in the amount of $120.00 to R. N. Graham. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated December 8, 1972, advising that he has received a letter of resignation from Officer G. o. peay stating that his resignation is to be effective as of the close of business on December 7, 1972, was presented. It was moved by Malburg, seconded by Ybarra, that the resignation of Officer G. O. peay be accepted. Motion carried. Communication from R. H. King, Director of Public Works, dated December 11, 1972, advising that he has submitted his appli- cation for retirement to the Public Employees' Retirement System to be effective March 1, 1973, was presented. (Copy to each member of the City council) It was moved by Malburg, seconded by Anderson, that communi- cation from the Director of Public Works, dated December 11, 1972, be received and filed. Motion carried. Communication from R. H. King, Director of Public Works, dated December 11, 1972, with reference to bids received for District Boulevard Sewer Reconstruction in accordance with Contract No. 370, recommending that the contract be awarded to George Miller Construction Company on the basis of their bid of $8,831.73, was presented. Resolution No. 4135 - A Resolution of the City Council of the City of Vernon accepting the bid of George Miller Construction Company for District Boulevard Sewer Reconstruction in accordance with Contract No. 370 of the City of Vernon, was presented. It was moved by Malburg, seconded by Ybarra, that Resolution No. 4135 be approved and adopted. Motion carried. Morgan be reimbursed the sum of $30.00 from the Education and Training Budget appropriation for an "Executive Development II Short Course", was presented. It was moved by Ybarra, seconded by Tavernelli, that the recommendation of the Director of Public Works, dated December 12, 1972, be approved and authority granted to issue warrant in the amount of $30.00 to Fred L. (Copy to each member of the City Council) It was moved by Anderson, seconded by Ybarra, that Report of Health Department Activities be received and filed. Motion carried. Communication from R. H. King, Director of Public Works, dated December 13, 1972, requesting authority to advance certain personnel as listed, effective January 1, 1973, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Tavernelli, that the request of the Director of Public Works, dated December 13, 1972, be approved. Motion carried. Declaration and Order to appear and answer claim (Case Number 55076) filed by Charles J. Foisy vs. City of Vernon in the Small Claims Court of San Antonio Judicial District, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Tavernelli, that Declaration and Order to appear and answer claim (Case Number 55076) filed by Charles J. Foisy vs. City of Vernon in the Small Claims Court of San Antonio Judicial District be referred to the City Attorney. Motion carried. Communication from R. M. Eatherly, Fire Chief, dated December 13, 1972, requesting permission to advance Naomi Jean Hoffman from Clerk-Typist, Grade 4 to Grade 3, effective January 1, 1973, was presented. It was moved by Anderson, seconded by Ybarra, that the request of the Fire Chief, dated December 13, 1972, be approved. Motion carried. Activity Log of the Police Department for the period December 1 - 15, 1972 inclusive, was presented. It was moved by Malburg, seconded by Tavernelli, that Activity Log of the Police Department be received and filed. Motion carried. "Warrant Register No. 371" covering claims and demands presented during the period December 1 to 15, which includes Demands Nos. 2-2692 to 2-2844 (both inclusive) drawn on the United California Bank, totaling $1,090,557.57 (Light and Power Warrants $1,046,519.49) (Accounting Period December 1972), was examined and audited. It was moved by Ybarra, seconded by Tavernelli, that "Warrant Register No. 371H be approved and payment authorized for Demands Nos. 2-2692 to 2-2844 (both inclusive), with no exceptions. It was moved by Ybarra, seconded by Tavernelli, that "Payroll Warrant Register No. 185" be approved and payment authorized for Demands Nos. 1962 to 1970 (both inclusive), with no exceptions. Motion carried. Ayes: Anderson, Furlong, Malburg, Tavernelli, Ybarra Noe s : None Absent: None Communication from Mr. Walter Klein of the Law Offices of Levy & Van Bourg, dated December 18, 1912, submitting an original and copy of Notice of Claim, dated December 18, 1972, on behalf of Ulysses Watson vs. City of Vernon, was presented. It was moved by Malburg, seconded by Ybarra, that Notice of Claim, dated December 18, 1972, submitted by Walter Klein of the Law Offices of Levy & Van Bourg, on behalf of Ulysses Watson vs. City of Vernon, be denied and referred to the City Attorney and the City's insurance carrier for necessary action. Motion carried. Communication from V. R. Bush, Superintendent of Building, dated December 14, 1912, with reference to paragraphs numbered 3, 4 and 5 of the Finance Committee Report of December 11, 1972, protesting this action and requesting a hearing when the Finance Committee Report is heard by the City Council, was presented. (Copy to each member of the City Council) In accordance with the request of the Superintendent of Building, Mayor Furlong called the City Council into executive session at 2:13 o'clock p.m. pursuant to Section 54957 of the Government Code for the purpose of discussing communication from the Superintendent of Building, dated December 14, 1972; and for the purpose of discussing the recommendations of the Finance Committee as outlined in communication dated December 11, 1972. All persons, with the exception of the City Clerk, the Superinten- dent of Building, the Director of Public Works and the City Attorney were excluded from the meeting. Communication from the Finance Committee, dated December 11, 1972, making certain enumerated recommendations to the City Council, was presented. (Copy to each member of the City Council) The City Council met in executive session and discussed with the Superintendent of Building enumerated paragraphs 3, 4 and 5 as outlined in the communication from the Finance Committee dated December 11, 1972. The Superintendent of Building orally supplemented his comments contained in communication dated December 14, 1972; and requested that he be granted an extension of time until June 30, 1913 to obtain another position. Mr. V. R. Bush, Superintendent of Building, Mr. R. H. King, Director of Public Works, and Mr. C. H. McGovern, City Attorney, excused themselves at 2:45 o'clock p.m. I I -5- 12 19 72 The City Council discussed the recommendations of the Finance Committee as outlined in communication dated December 11, 1972; and discussed the written communication from the Superintendent of Building, dated December 14, 1972, and his oral comments. It was moved by Tavernelli, seconded by Malburg, that Mr. V. R. Bush, Superintendent of Building, be given an extension of time until March 31, 1973 to obtain another position. Motion carried. Ayes: Anderson, Furlong, Malburg, Tavernelli, Ybarra Noe s : None Absent: None It was moved by Anderson, seconded by Tavernelli, that the recommendations of the Finance Committee as outlined in enumerated paragraphs one (1) and two (2) of communication, dated December 11, 1972, with reference to the Public Works Department, be approved. Motion carried. Ayes: Anderson, Furlong, Malburg, Tavernelli, ybarra Noes: None Absent: None It was moved by Anderson, seconded by Tavernelli, that the recommendations of the Finance Committee as outlined in enumerated paragraphs three (3), four (4), five (5), six (6) and seven (7) of communication, dated December 11, 1972, with reference to the Building Department, be approved effective April 1, 1973. Motion carried. Ayes: Anderson, Furlong, Malburg, Tavernelli, Ybarra Noes: None Absent: None It was moved by Malburg, seconded by Tavernelli, that the recommendations of the Finance Committee as outlined in enumerated paragraphs one (1) and two (2) of communication, dated December 11, 1972, with reference to city-owned houses, be approved. Motion carried. Ayes: Anderson, Furlong, Malburg, Tavernelli, Ybarra Noes: None Absen t : None Mr. V. R. Bush, Superintendent of Building, was asked to return to the executive session. Mr. Bush returned at 3:00 o'clock p.m. and was notified of the decision of the City Council. The executive session ended at 3:03 o'clock p.m. There being no further business to come before the meeting, it was moved by Malburg, seconded by Tavernelli, that the meeting adjourn. Motion carried.
