19730529 Regular City Council Meeting - Minutes I I MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD MAY 29, 1973 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. COUNCIL PRESENT: Furlong, Malburg, Tavernelli, Ybarra COUNCIL ABSENT: Anderson The meeting was called to order by Mayor Furlong. It was moved by Ybarra, seconded by Tavernelli, that minutes of the meeting of May 15, 1973 be approved as written and submitted. Motion carried. Pursuant to a recommendation of the Planning Commission, Resolution No. 4160 - A Resolution of the City Council of the City of Vernon regarding the Open Space Element of the General Plan, was presented. It was moved by Malburg, seconded by Ybarra, that Reso- lution No. 4160 be approved and adopted. Motion carried. Ayes: Furlong, Malburg, Tavernelli, Ybarra Noes: None Absent: Anderson Pursuant to a recommendation of the Planning Commission, Resolution No. 4161 - A Resolution of the City Council of the City of Vernon approving and adopting an Open Space Plan, was presented. It was moved by Tavernelli, seconded by Ybarra, that Resolution No. 4161 be approved and adopted. Motion carried. Ayes: Furlong, Malburg, Tavernelli, Ybarra Noes: None Absent: Anderson Communication from R. H. Bockhacker, Police Chief, dated May 14, 1973, requesting authority for Lt. L. S. Rosenkrantz to attend the California Arson Investigators Conference (Bomb Training) at Palm Springs, California from June 18 to 22, 1973, with an ex- pense alLowance of $217.00, was presented. It was moved by Malburg, seconded by Ybarra, that the re- quest of the Police Chief, dated May 14, 1973, be approved and au- thority granted to issue warrant in the amount of $217.00 to L, S. Rosenkrantz. Motion carried. Copy of Resolution No. 73-1559 of the City Council of the City of South El Monte opposing the legalization of the use of marijuana, was presented. It was moved by Tavernelli, seconded by Ybarra, that copy of Resolution No. 73-1559 of the City Council of the City of South El Monte be received and filed. Motion carried. I I -2- 5 29 73 Communication from the Southern California Edison Company, dated May 17, 1973, with reference to leasing from the City of Vernon approximately 40,000 barrels of fuel oil storage capacity in two existing tanks at 2715 E. 50th Street, outlining the terms and con- ditions of the proposed lease; and requesting that the City Council authorize acceptance of the lease if it approves the terms and con- ditions as outlined, was presented. (Copy to each member of the City Council) The Consulting Electrical Engineer commented on enumerated paragraphs one (1), seven (7) and eight (8) relative to the terms and conditions of the proposed lease of fuel oil storage capacity in two existing tanks at 2715 E. 50th Street; and suggested certain changes therein. It was moved by Malburg, seconded by Ybarra, that communi- cation from the Southern California Edison CompanY, dated May 17, 1973, with reference to leasing from the City of Vernon approximately 40,000 barrels of fuel oil storage capacity in two existing tanks at 2715 E. 50th Street, be referred to the Consulting Electrical En- gineer and City Attorney for the purpose of discussing with Edison certain changes desired by Vernon in the terms and conditions of the proposed lease; and for the purpose of clarifying certain enumerated paragraphs of the terms and conditions of the proposed lease. Motion carried. Copy of Resolution No. 73-41 of the City Council of the City of Lynwood requesting the State Legislature to enact a bill re- qU1r1ng the mandatory imposition of capital punishment upon anyone convicted of first degree murder, was presented. It was moved by Malburg, seconded by Taverne11i, that copy of Resolution No. 73-41 of the City Council of the City of Lynwood be received and filed. Motion carried. Notice dated May 21, 1973 that a hearing has been set be- fore the Local Agency Formation Commission on June 13, 1973 on the application to initiate proceedings to incorporate certain territory to be known as East Los Angeles, was presented. It was moved by Tavernelli, seconded by Ybarra, that Notice dated May 21, 1973, relative to hearing before the Local Agency For- mation Commission on June 13, 1973, be received and filed. Motion carried. Communication from R. H. Bockhacker, Police Cbief, dated May 23, 1973, requesting authority to employ Mr. Dean Edward Bates as Policeman, Grade 4, effective as of June 1, 1973, was presented. It was moved by Tavernelli, seconded by Ybarra, that the request of the Police Chief, dated May 23, 1973, be approved. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated May 23, 1973, transmitting a proposed Encroachment Li- cense Agreement between the City of Vernon and MYers Drum Company, Subsidiary of Kaiser Steel, covering a 4" gas line across 54th Street and recommending that the Encroachment License Agreement be approved and cthat the Mayor and the City Clerk be authorized to execute on be- hale of the City, was presented. I I -3- 5 29 73 It was moved by Ybarra, seconded by Malburg, that the rec- ommendation of the Director of Public Works, dated May 23, 1973, be approved; and that the Mayor and the City Clerk be authorized to exe- cute Encroachment License Agreement between the City of Vernon and Myers Drum Company, Subsidiary of Kaiser Steel. Motion carried. Communication from F. H. Colvin, Assistant Fire Chief, dated May 24, 1973, requesting that M. T. Mello and R. F. pavlovsky be reimbursed the sum of $15.00 each for C.P.R. training received at U.C.L.A., was presented. It was moved by ~lburg, seconded by Ybarra, that the re- quest of the Assistant Fire Chief, dated May 24, 1973, be approved and authority granted to issue warrants in the amount of $15.00 each to M.T. Mello and R.F. Pavlovsky. Motion carried. The City Clerk reported that Councilwoman Genevieve Ander- son is temporarily unable to attend the ..d.ngs of the City Colincil due to illness. It was moved by Tavernelli, seconded by Malburg, that pet:'- mission be granted to Councilwoman Genevieve Anderson to absent her- self from re&ular meetings of the City Council until she is physi- cally able to attend said meetings. Motion carried. There being no further business to come before the meeting, it was moved by Ybarra, seconded by Tavernelli, that the meeting adjourn. Motion carried. ON TUESDAY, MAY 29, 1973, IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA FOR THE PURPOSE OF ALLOWING THE GENERAL PUBLIC TO COMMENT OR OBJECT TO THE PROPOSED OPEN- SPACE PLAN OF THE CITY OF VERNON. PLANNING COMMISSION PRE$ENT: PLANNING COMMISSION ABSENT: Furlong, Malburg, Tavernelli, Ybarra Anderson The hearing was called to order by Chairman Furlong. The City Clerk stated that this was the time and place for the hearing of the City Council sitting as a Planning Commission of the City of Vernon for the purpose of allowing the general public to comment or object to the proposed open-space plan of the City of Vernon. The City Clerk reported that Notice of Hearing was posted in accordance with Section 65854 of the Government Code of the State of California; and presented Affidavit that Notice of Hearing was posted on May 16, 1973. Mr. James M. Hinzdel, Chief Planner of Koebig.& Koebig, Inc., Planning Services Contractor for the City of Vernon, appeared before the Planning Commission and distributed copies of the pro- posed Open Space Plan as prejared for the City of Vernon, California. Mr. Hinzdel read the proposed Open Space Plan for the City of Vernon, California, and commented on the plan. He also displayed a large map of the proposed Open Space Plan and pointed out the areer designated as open space in the City of Vernon. Chairman Furlong asked if any written communications had been received relative to this matter. The City Clerk reported that no written communications had been received. Chairman Furlong asked if anyone wished to make an oral comment with reference to the proposed open-space plan. No one responded. It was moved by Tavernelli, seconded by Ybarra, that the Planning Commission approve the Open Space Plan as presented and make a determination that the Open Space Plan will not have a signif- icant effect on the environment; and that the Planning Commission recommend that the City Council approve the Open Space Plan as pre- sented and make a determination that the Open Space plan will not have a significant effect on the environment.
