19730619 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD JUNE 19, 1973 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANl'A FE AVENUE. VERNON. CALIFORNIA. COUNCIL PRESENT: Furlong, Malburg, Taverne11i, Ybarra COUNCIL ABSENT: Anderson The meeting was called to order by Mayor Furlong. It was moved by Ybarra, seconded by Taverne11i, that minutes of the meeting of June 5, 1973 be approved as written and submitted. Motion carried. Mr. C. H. McGovern, City Attorney, presented a fully executed Memorandum of Understanding between the Municipal Employee Relations Representative of the City of Vernon and the Vernon Firemen's Association (Employee Groups 1 and 4). The City Attorney commented on the document and recommended that the City Council approve it. Resolution No. 4163 - A Resolution of the City Council of the City of Vernon approving a Memorandum of Understanding between the Municipal Employee Relations Representative of the City of Vernon and the Vernon Firemen's Association (Employee Groups land 4), was presented. It was moved by Tavernelli, seconded by Ybarra, that Resolution No. 4163 be approved and adopted. Motion carried. Ayes: Furlong, Malburg, Tavernelli, Ybarra Noes: None Absent: Anderson The City Attorney reported that the Municipal Employee Relations Representative of the City of Vernon had been unable to reach an agreement with the Vernon Police Officers Benefit Associ- ation and made no recommendation regarding wages and benefits at this time. Memorandum from the Purchasing Agent, dated June 4, 1973, addressed to the Finance Director, with reference to sealed proposals received for providing maintenance services for specified items of City's radio equipment, making certain recommendations in connection therewith, was presented. (Copy to each member of the City Council) It was moved by Malburg, seconded by Tavernelli, that the current radio maintenance agreements (MA-60l37-545 covering police and fire radios and MA-l-Ol14-39 covering public works radios) between the City of Vernon and Motorola Communications & Electronics, Inc., be cancelled effective July 31, 1973; and that the Purchasing Agent be authorized to issue a purchase order to Microwave Radio Communications for maintenance of radio equipment as specified in City Request for~otation No. 790, in accordance with that company's proposal effective August 1,1973; but with 'the under- standing that for a period of 90 days thereafter should the services provided prove unsatisfactory to the City, that the Purchasing Agent be authorized to cancel the purchase order and issue purchase order to Mobile Radio, Inc. in accordance with the terms of their proposal. Eatherly, Fire Chief, dated June 11, 1973, recommending that the following personnel be advanced as indicated effective July 1, 1973: L. R. Burdett to Autofireman, Grade 1 A. J. deBoer to Engineer, Grade 2 J. F. Stickel to Engineer, Grade 1 It was moved by Ybarra, seconded by Tavernelli, that the recommendation of the Fire Chief, dated June 11, 1973, be approved. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated June 11, 1973, advising that Arley M. Barnes, Utility Man IV, has submitted his resignation effective at the close of business on June 29, 1973, was presented. It was moved by Tavernelli, seconded by Malburg, that the resignation of Arley M. Barnes be accepted. Motion carried. Communication from R. M. Eatherly, Fire Chief, dated June 12, 1973, requesting that Assistant Chief F. H. Colvin be reimbursed the sum of $20.00 for expenses incurred while attending "Fire.. Earthquake'Seminar on June 5, 1973 at Anahefm Convention Center, was presented. It was moved by Ybarra, seconded by Tavernelli, that the request of the Fire Chief, dated June 12, 1973, be approved and authority granted to issue warrant in the amount of $20.00 to F. H. Colvin. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated June 12, 1973, requesting that Officer L. J. Ebelt be reimbursed the sum of $40.75 from the Education and Training Budget appro- priation for Police Science Courses at Cerritos Junior College, was presented. It was moved by Malburg, seconded by Ybarra, that the request of the Police Chief, dated June 12, 1973, be approved and authority granted to issue warrant in the amount of $40.75 to L. J. Ebelt. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated June 12, 1973, requesting that Lt. L. F. Ely and Lt. L. S. Rosenkrantz be reimbursed the sum of $54.00 each from the Education and Training Budget appropriation to cover cost of credits for the Police Middle Management Course they are presently attending at California State University, Long Beach, was presented. It was moved by Malburg, seconded by Tavernelli, that the request of the Police Chief, dated June 12, 1973, be approved and authority granted to issue warrants in the amount of $54.00 each to L. F. Ely and L. S. Rosenkrantz. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated June 12, 1973, requesting that certain personnel as listed be advanced as indicated, effective July 1, 1973, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Tavernelli, that the request of the Police Chief, dated June 12, 1973, be approved. Motion carried. Nelson, Jr., Director of Public Works, dated June 14, 1973, advising that the Phase lB application for Civil Defense Funds for the Emergency Operating Center in the new City Hall and Police Facility is currently pending with the Office of Emergency Services in Sacramento; and recommending that City representatives be authorized to participate in necessary meetings at Sacramento and that actual expenses be reimbursed, was presented. It was moved by Tavernelli, seconded by Ybarra, that the recommendation of the Director of Public Works, dated June 14, 1973, be approved. Motion carried. Activity Log of the Police Department for the period June 1 - 15, 1973 inclusive, was presented. It was moved by Ybarra, seconded by Malburg, that Activity Log of the Police Department be received and filed. Motion carried. ''Warrant Register No. 383" covering claims and demands presented during the period June 1 to 15, which includes Demands Nos. 3-1060 to 3-1201 (both inclusive), drawn on the United California Bank, totaling $1,166,522.35 (Light and Power Warrants $1,101,206.78) (Accounting Period June 1973), was examined and audited. It was moved by Ybarra, seconded by Tavernelli, that ''Warrant Register No. 383" be approved and payment authorized for Demands Nos. 3-1060 to 3-1207 (both inclusive), with no exceptions, Motion carried. Ayes: Furlong, Malburg, Tavernelli, Ybarra Noe s: None Absent: Anderson "Payroll Warrant Register No. 191" covering claims and demands presented during the period May 1 to 31, which includes Demands Nos. 2018 to 2026 (both inclusive), drawn on the Crocker National Bank, totaling $356,066.70 (Accounting Period May 1973), was examined and audited. It was moved by Ybarra, seconded by Tavernel1i, that "Payroll Warrant Register No. 191" be approved and payment authorized for Demands Nos. 2018 to 2026 (both inclusive), with no exceptions. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Malburg, that Report of Health Department Activities be received and filed. Motion carr ied. Communication from A. E. Nelson, Jr., Director of Public Works, dated June 14, 1973, recommending that Raymond R. Rich be reimbursed the sum of $50.00 from the Education and Training Budget appropriation for a course entitled "Electroplating Training Course", was presented. I I -4- 6 19 73 It was moved by Malburg, seconded by Ybarra, that the request of the Director of Public Works, dated June 14, 1973, be approved and authority granted to issue warrant in the amount of $50.00 to Raymond R. Rich. Motion carried. Communication from A. E. Nelson, Jr.., Director of Public Works, dated June 14, 1973, requesting authority to advance certain employees, effective July 1, 1973; and requesting authority to reclassify certain employees, effective July 1, 1973, was presented. (Copy to each member of the City Council) It was moved by Tavernelli, seconded by Ybarra, that the requests of the Director of Public Works, dated June 14, 1973, be approved. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated June 14, 1973, transmitting Contract No. 372, Manhole Bottom Reconstruction; and recommending that this contract be approved and that authority be granted to advertise for bids, was presented. Resolution No. 4162 - A Resolution of the City Council of the City of Vernon approving Contract No. 372 for Manhole Bottom Reconstruction in accordance with Contract No. 372 of the City of Vernon, was presented. It was moved by Ybarra, seconded by Malburg, that Resolution No. 4162 be approved and adopted. Motion carried. Ayes: Furlong, Malburg, Taverne11i, Ybarra Noe s : None Absent: Anderson Communication from Mr. Arley Barnes, dated June 15, 1973, with reference to working conditions in the Street Department, was presented. (Copy to each member of the City Council) It was moved by Taverne11i, seconded by Ybarra, that communication from Mr. Arley Barnes, dated June 15, 1973, be received and filed. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated June 15, 1973, advising that Officer C. J. Kemp is resigning effective as of the end of his tour of duty on June 30, 1973, was presented. It was moved by Malburg, seconded by Ybarra, that the resignation of Officer C. J. Kemp be accepted. Motion carried. Communication from R. M. Eatherly, Fire Chief, dated June 15, 1973, requesting permission to proceed with installation of seven new fire alarm boxes on District Boulevard between Downey Road and Atlantic Boulevard, was presented. It was moved by Malburg, seconded by Tavernel1i, that the request of the Fire Chief, dated June 15, 1973, be approved. Motion carried. I I -5- 6 19 73 MemorandUtll from the Purchasing Agent, dated June 18, 1973, addressed to the Finance Director, requesting authority to give 30 days notice of termination of existing purchase order/agreement with Allstate Building Maintenance Company and to solicit bids for the purpose of contracting with another maintenance company to provide janitorial service for the city hall building, was presented. It was moved by Tavernelli, seconded by Ybarra, that the Purchasing Agent be authorized to give notice to Allstate Building Maintenance Company that the existing purchase order/agreement will be terminated effective as of July 31, 1973; and that the Purchasing Agent be authorized to solicit bids for the purpose of contracting with another maintenance company to provide janitorial service for the city hall building, effective August 1, 1973. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, and R. M. Eatherly, Fire Chief, dated June 15, 1973, advising that the automatic fire sprinkler installation at Clougherty Packing Company, 3049 E. Vernon Avenue, is continuing to progress in a satisfactory manner, was presented. It was moved by Malburg, seconded by Ybarra, that communi- cation from the Director of Public Works and the Fire Chief, dated June 15, 1973, be received and filed. Motion carried. Communication from C. H. McGovern, City Attorney, dated June 19, 1973, with reference to Miller Construction Co. v. City of Vernon, advising that it is his recommendation and the recoounendation of the law firm of Musick, Peeler & Garrett that settlement in the amount of $800.00 be accepted, was presented. (Copy to each member of the City Council) It was moved by Malburg, seconded by Tavernelli, that the recommendation of the City Attorney and the law firm of Musick, Peeler & Garrett, with reference to settlement of the case of Miller Construction Co. v. City of Vernon in the amount of $800.00, be approved. Motion carried. It was moved by Ybarra, seconded by Tavernelli, that the meeting adjourn until Tuesday, June 26, 1973, at 2:00 o'clock p.m., in the Council Chamber of the City Hall located at 4305 Santa Fe Avenue, Vernon, California. Motion carried.
