MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD AUGUST 21, 1973 AT TWO O' CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE. VERNON, CALIFORNIA.
COUNCIL PRESENT: Furlong, Taverne11i, Ybarra
COUNCIL ABSENT: Anderson, Malburg
The meeting was called to order by Mayor Furlong.
It was moved by Ybarra, seconded by Taverne1li, that
minutes of the meeting of August 7, 1973 be approved as written and
submitted. Mot ion carried.
It was moved by Ybarra, seconded by Tavernel1i, that
Ordinance No. 839 receive a second reading by title. Motion carried.
Ordinance No. 839 - An Ordinance of the City of Vernon
fixing certain rates to be charged for electrical energy distributed
and supplied by said City of Vernon, within its boundaries, was read
for a second reading by title. (Copy to each member of the City
Council)
It was moved by Tavernelli, seconded by Ybarra, that
Ordinance No. 839 receive and pass a second reading. Motion carried.

Absent: Anderson, Malburg
It was moved by Ybarra, seconded by Tavernelli, that in
accordance with Government Code Section 36934, the reading of
Ordinance No. 839 in full be waived; and that Ordinance No. 839
receive a third and final reading by title. Motion unanimously
carried.

Ordinance No. 839 - An Ordinance of the City of Vernon
fixing certain rates to be charged for electrical energy distributed
and supplied by said City of Vernon, within its boundaries, was read
by title for a third and final reading.
It was moved by Taverne1li, seconded by Ybarra, that
Ordinance No. 839 receive and pass a third reading and be adopted.
Motion carried.

Communication from A. E. Nelson, Jr., Director of Public
Works, dated August 8, 1973, transmitting an Easement from Union
Pacific Railroad Company covering a new grade crossing of 26th
Street across Union Pacific San Pedro Branch tracks crossings No.
2-l44.53-C and 3A-3.2; and recommending that the Mayor and the City
Clerk be authorized to execute the document, was presented.

It was moved by Tavernelli, seconded by Ybarra, that the
recommendation of the Director of Public Works, dated August 8,
1973, be approved; and that the Mayor and the City Clerk be
authorized to execute Easement prepared by the Union Pacific Railroad
Company. Motion carried.
Communication from R. M. Eatherly, Fire Chief, dated
August 10, 1973, recommending that Captain Richard C. Zindel be
removed from the payroll effective August 26, 1973 and that Fireman
Dale L. Brittingham be removed from the payroll effective August 29,
1973 as both will have been off duty one year, was presented.

It was moved by Tavernelli, seconded by Ybarra, that the
recommendation of the Fire Chief, dated August 10, 1973 be approved.
Motion carried.
Resolution No. 4172 - A Resolution of the City Council of
the City of Vernon commending Richard C. Zindel upon his retirement
from the Vernon Fire Department, was presented.
It was moved by Ybarra, seconded by
Resolution No. 4172 be approved and adopted.

Communication from Captain Richard C. Zindel, dated August
14, 1973, requesting that he be allowed his four weeks vacation in
addition to the one year he has been off duty, was presented. (Copy

It was moved by Tavernelli, seconded by Ybarra, that the
request of Captain Richard C. Zindel, dated August 14, 1973, be
denied. Motion carried.
Communication was presented from R. M. Eatherly, Fire Chief,
dated August 10, 1973, requesting that the following personnel be
advanced to the grades as indicated, effective September 1, 1973:
R. N. D~itt to Captain, Grade 3
R. M. Eatherly to Fire Chief, Grade 2
D. E. Podlas to Captain, Grade 3
L. D. Schultz to Captain, Grade 3
It was moved by Ybarra, seconded by Tavernelli, that the
request of the Fire Chief, dated August 10, 1973, be approved.
Motion carried.
Communication from R. M. Eatherly, Fire Chief, dated
August 10, 1973, recommending that Fireman Robert E. Rosprim be
appointed to the position of Captain, Grade 4, effective September
1, 1973, to fill the vacancy left by Captain Richard C. Zindel, was
presented.
It was moved by Tavernelli, seconded by Ybarra, that the
recommendation of the Fire Chief, dated August 10, 1973, be approved.

Connnunication from the Finance Conunittee, dated August 13,
1973, reconnnending that the city-owned apartment located at 3378 E.
50th Street be leased to William J. Davis, was presented.
It was moved by Tavernel!i, seconded by Ybarra, that the
recommendation of the Finance Committee, dated August 13, 1973, be
approved; and that the city-owned apartment located at 3378 E. 50th
Street be leased to William J. Davis. Motion carried.
Connnunication from Southern California Edison Company,
dated August 9, 1973, transmitting two copies of a Union Pacific
Railroad Company extension rider, identified as Railroad's document
CLD No. 451-8, covering the City of Vernon power line along the
east side of Downey Road between 50th Street and Fruitland Avenue,
was presented.
It was moved by Tavernelli, seconded by Ybarra, that the
Mayor and the City Clerk be authorized to execute Extension Rider,
identified as document CLD No. 451-8 of the Union Pacific Railroad
Company, which extension is from August 1, 1973 to July 31, 1983.

Communication from A. E. Nelson, Jr., Director of Public
Works, dated August 14, 1973, requesting authority to attend
Strengths and Styles (a one day course in self-improvement and
learning about leadership) at UCLA, University Extension, at North
Hollywood on September 25, 1973, with an expense allowance of $50.00
for registration fee, was presented.
It was moved by Ybarra, seconded by Tavernelli, that the
request of the Director of Public Works, dated August 14, 1973, be
approved and authority granted to issue warrant in the amount of
$50.00 to A. E. Nelson, Jr. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated August 16, 1973, requesting authority for F. W. Sumner
to attend the 51st Annual Business Meeting of the International
Conference of Building Officials at Seattle, Washington from October
7 to 13, 1973, with an expense allowance of $556.00, was presented.
It was moved by Ybarra, seconded by Tavernelli, that the
request of the Director of Public Works, dated August 16, 1973, be
approved and authority granted to issue warrant in the amount of
$556.00 to F. W. Sumner. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated August 16, 1973, requesting authority for F. A.
Tachovsky to attend the 1973 International Association of Electrical
Inspectors - Fall Section at Phoenix, Arizona from October 8 to 12,
1973, with an expense allowance of $323.00, was presented.
It was moved by Ybarra, seconded by Tavernelli, that the
request of the Director of Public Works, dated August 16, 1973, be
approved and authority granted to issue warrant in the amount of
$323.00 t. F. A. Tachovsky. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
August 16, 1973, requesting that Patricia L. Ricks be promoted to
Transcriber-Typist, Grade 2, effective September 1, 1973, was
presented.

It was moved by Tavernelli, seconded by Ybarra, that the
request of the Police Chief, dated August 16, 1973, be approved.
Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
August 16, 1973, requesting that Officer D. J. Tavernelli be
reimbursed the sum of $20.00 to pay for the repair charges on his
wrist watch which was damaged during an arrest on July 17, 1973, was
presented. (Copy to each member of the City Council)
It was moved by Furlong, seconded by Tavernelli, that the
request of the Police Chief, dated August 16, 1973, be denied.
Motion carried.
Activity Log of the Police Department for the period
August 1 - 15, 1973 inclusive, was presented.
It was moved by Ybarra, seconded by Tavernel1i, that
Activity Log of the Police Department be received and filed. Motion
carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, and R. M. Eatherly, Fire Chief, dated August 16, 1973,
reporting that the installation of the required automatic fire
sprinkler system for Clougherty Packing Co., 3049 E. Vernon Avenue,
has reached the final stage, was presented.
It was moved by Ybarra, seconded by Tavernelli, that
communication from the Director of Public Works and the Fire Chief,
dated August 16, 1973, be received and filed. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated August 16, 1973, with reference to bids received for
the Santa Fe Avenue and 25th-26th Street Intersection Reconstruct:ion:p
Federal Aid Project T-304l (196) LA-DOT (H)-7-73-257-07-LA-O-VERN,
in accordance with Contract No. 332; recommending that the contract
be awarded to Vernon Paving Company, subject to approval of the
Federal Highway Administration, on the basis of their bid of
$91,501.00, was presented.
Resolution No. 4173 - A Resolution of the City Council of
the City of Vernon accepting the bid of Vernon Paving Company for
25th-26th Street Intersection Reconstruction in accordance with
Contract No. 332 of the City of Vernon, was presented.
It was moved by Taverne1li, seconded by Ybarra, that
Resolution No. 4173 be approved and adopted. Motion carried.

"Payroll Warrant Register No. 193" covering claims and
demands presented during the period July 1 to 31, which includes
Demands Nos. 2038 to 2047 (both inclusive), drawn on the Crocker
National Bank, totaling $370,245.38 (Accounting Period July 1973),
was examined and audited.

It was moved by Ybarra, seconded by Tavernel1i, that
"Payroll Warrant Register No. 193" be approved and payment authorized
for Demands Nos. 2038 to 2047 (both inclusive), with no exceptions.
Motion carried.

''Warrant Register No. 387" covering claims and demands
presented during the period August 1 to 15, which includes Demands
Nos. 1633 to 1794 (both inclusive), drawn on the United California
Bank, totaling $1,189,564.00 (Light and Power Warrants $1,102,722.91)
(Accounting Period August 1973), was examined and audited.
It was moved by Ybarra, seconded by Tavernelli, that
''Warrant Register No. 387" be approved and payment authorized for
Demands Nos. 1633 to 1794 (both inclusive), with no exceptions.

Communication from A. E. Nelson, Jr., Director of Public
Works, dated August 16, 1973, requesting authority for Lewis R.
Adams to attend the 54th Annual Conference California Section,
American Water Works Association at Oakland, California, from
September 26 to September 28, 1973, with an expense allowance of
$155.24, was presented.
It was moved by Tavernelli, seconded by Ybarra, that the
request of the Director of Public Works, dated August 16, 1973, be
approved and authority granted to issue warrant in the amount of
$155.24 to Lewis R. Adams. Motion carried.
Report of Health Department Activities for the month of
July 1973, was presented. (Copy to each member of the City Council)
It was moved by Ybarra, seconded by Tavernel1i, that Report
of Health Department Activities be received and filed. Motion
carried.
Communication from C. H. McGovern, City Attorney, dated
August 16, 1973, with reference to request from Captain James Jordan
for vacation compensation, recommending that the request be denied
and that any further requests by other personnel for such similar
additional vacation pay also be denied, was presented. (Copy to
each member of the City Council)
It was moved by Taverne1li, seconded by Ybarra, that the
recommendation of the City Attorney, dated August 16, 1973, be
approved; and that the request of Captain James Jordan for vacation
compensation be denied. Motion carried.
Communication from the State of California, Department of
Health, dated August 15, 1973, transmitting four copies of Contract
No. 121 relating to the Radiation Control Program for the fiscal
year July 1, 1973 through June 30, 1974, was presented.

It was moved by Tavernelli, seconded by Ybarra, that the
Mayor and the City Clerk be authorized to e:-;:ccute Contract No. 121
with the State of Cc.lifornia, Department of Health, relating to the
Radiation Control Program for the fiscal year July 1, 1973 through
June 30, 1974. Motion carried.
Communication from X. J. Padilla, Assistant Civil Defense
Director, dated August 17, 1973, requesting authority and necessary
funds to replace two city-owned portable radios which were either
lost, stolen or damaged during City service, was presented. (Copy
to each member of the City Council)
It was moved by Ybarra, seconded by Tavernel1i, that the
request of the Assistant Civil Defense Director, dated August 17,
1973, be approved; and that the Purchasing Agent be authorized to
issue the appropriate purchase order. Motion c~rried.
Resolution No. 4170 - A Resolution of the City Council of
the City of Vernon fixing the amount of money necessary to be raised
by taxation upon the taxable property within said City as a revenue
to carryon the various departments of such municipal corporation for
the fiscal year commencing July 1, 1973, and to pay the bonded or
other indebtedness of said City of Vernon, or any portion or district
thereof, was presented.
It was moved by Tavernelli, seconded by Ybarra, that
Resolution No. 4170 be approved and adopted. Motion carried.

Resolution No. 4171 - A Resolution of the City Council of
the City of Vernon fixing the rate of taxes and levying the taxes
for the fiscal year beginning July 1, 1973, was presented.

Resolution No. 4171 be approved and adopted.

Communication from Gamm-Tech Incorporated, dated August 14,
1973, transmitting a formal bid in the amount of $37,500.00 from
Monarch Management, Ltd., together with insured check 4;1257 from
Monarch Management, Ltd. in the amount of $3,750.00, for five diesel
electric generators with auxiliary equipment, was presented.
It was moved by Tavernelli, seconded by Ybarra, that the
bid of Monarch Management, Ltd. be rejected; that check in the
amount of $3,750.00 be returned to Gamm-Tech Incorporated; and that
Gamm-Tech Incorporated be advised to return the check to Monarch
Management, Ltd. Motion carried.
There being no further business to come before the meeting,
it was moved by Tavernelli, seconded by Ybarra, that the meeting
adjourn. Motion carried.
