MINUTES OF A REGUlAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD NOVEMBER 6, 1973 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE.. VERNON. CALIFORNIA.
COUNCIL PRESENT: Malburg, Taverne1li, Ybarra
COUNCIL ABSENT: Anderson, Furlong
The meeting was called to order by Mayor Pro Tempore
Malburg.
It was moved by Ybarra, seconded by Taverne11i, that
minutes of the meeting of October 18, 1973 be approved as written
and submitted. Motion carried.
It was moved by Taverne11i, seconded by Ybarra, that
Ordinance No. 842 receive a second reading by title. Motion carried.
Ordinance No. 842 - An Ordinance of the City of Vernon,
fixing certain rates to be charged for electrical energy distributed
and supplied by said City of Vernon, within its boundaries, was read
for a second reading by title. (Copy to each member of the City
Council)
It was moved by Ybarra, seconded by Taverne1li, that
Ordinance No. 842 receive and pass a second reading. Motion carried.,
Ayes: Malburg, Tavernelli. Ybarra
Noes: None
Absent: Anderson, Furlong
It was moved by Taverne11i, seconded by Ybarra, that in
accordance with Government Code Section 36934, the reading of
Ordinance No. 842 in full be waived; and that Ordinance No. 842
receive a third and final reading by title. Motion unanimously
carried.

Ordinance No. 842 - An Ordinance of the City of Vernon,
fixing certain rates to be charged for electrical energy distributed
and supplied by said City of Vernon, within its boundaries, was read
by title for a third and final reading.
It was moved by Ybarra, seconded by Taverne11i, that
Ordinance No. 842 receive and pass a third reading and be adopted.
Motion carried.

Communication from the Los Angeles County Board of Super-
visors, dated October 12, 1973, transmitting a copy of the legal
description and a copy of the map of the area proposed to be
incorporated as the City of East Los Angeles, was presented.
It was moved by Taverne11i, seconded by Ybarra, that
communication from the Los Angeles County Board of Supervisors,
dated October 12, 1973, together with transmittals, be received and
filed. Motion carried.

Communication from the Public Employees' Retirement
System, dated October 16, 1973, transmitting two copies of
Resolution of Intention, Form 122, with a copy of the proposed
amendment, Form 702, attached to each resolution to provide 2% at
50 benefits for firemen, together with other documents, was presented.

Resolution No. 4184 - A Resolution of the City Council of
the City of Vernon of intention to approve an amendment to contract
between the Board of Administration of the Public Employees' Retire-
ment System and the City Council of the City of Vernon, was presented
It was moved by Tavernelli, seconded by Ybarra, that
Resolution No. 4184 be approved and adopted. Motion carried.

The City Clerk-Director of Finance reported orally that
the City Council has the option to permit employees attaining age
60 with less than 20 years of service to continue in employment in
accordance with the provisions of Section 20980.1 of the Government
Code.
It was moved by Ybarra, seconded by Tavernelli, that the
City Council not exercise its option to permit firemen attaining
age 60 with less than 20 years of service to continue in emplo~nent
in accordance with the provisions of Section 20980.1. Motion
carr ied.
The City Clerk-Director of Finance reported orally that
the contract amendment shall not be approved unless an election has
been held to permit the employees proposed to be included in the
system to express by secret ballot their approval or disapproval
of the retirement proposal; and recommended that the election be
held on December 11, 1973 at Fire Station No.1, 3375 Fruitland
Avenue, from 7:00 o'clock a.m. to 3:00 o'clock p.m. to allow the
Firemen to vote on the proposed contract amendment.
It was moved by Tavernelli, seconded by Ybarra, that the
recommendation of the City Clerk-Director of Finance be approved.
Motion carried.
Communication from F. H. Colvin, Assistant Fire Chief,
dated October 23, 1973, transmitting Specifications No. 374 for new
Rescue Truck; and requesting that the specifications be approved
and that formal bid invitations be initiated, was presented.
Resolution No. 4185 - A Resolution of the City Council of
the City of Vernon approving Specifications No. 374 for the furnishin~
and delivery to the City of Vernon of one Rescue Truck and Equipment
in accordance with Specifications No. 374, was presented.
It was moved by Ybarra, seconded by Tavernelli, that
Resolution No. 4185 be approved and adopted. Motion carried.

Communication from George Burgess, Civil Engineering
Associate, dated October 25, 1973, requesting reimbursement from the
Education and Traintng Budget appropriation in the amount of $95.00
for certain engineering courses, with approval of same noted by the
Director of Public Works, was presented.
It was moved by Taverne1li, seconded by Ybarra, that the
request of George Burgess, Civil Engineering Associate, dated
October 25, 1973, be approved and authority granted to issue warrant
in the amount of $95.00 to George Burgess. Motion carried.
Notice that a hearing has been set before the Local Agency
Formation Commission of Los Angeles County on November 14, 1973,
on the Application by the City of Maywood to initiate proceedings
for the annexation of certain territory, was presented.
It was moved by Tavernelli, seconded by Ybarra, that Notice
of hearing before the Local Agency Formation Commission of Los
Angeles County be received and filed. Motion carried.
Communication from the Los Angeles County Board of Super-
visors, dated October 19, 1973, with reference to the growing number
of crimes of violence occurring at public transportation and public
assembly facilities in the County, was presented. (Copy to each
member of the City Council)
It was moved by Ybarra, seconded by Taverne1li, that
communication from the Los Angeles County Board of Supervisors~ dated
October 19, 1973, be received and filed. Motion carried.
Communication from James C. Jordan, dated October 25, 1973,
filing a claim and demand for vacation pay due and unpaid as provided
by Section 910 of the California Government Code as a prerequisite
to legal action, was presented. (Copy to each member of the City
Council)
It was moved by Tavernelli, seconded by Ybarra, that claim
and demand for vacation pay due and unpaid, filed by James C. Jor.dan,
dated October 25, 1973, be denied. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
October 26, 1973, requesting that certain Police Department personnel
be reimbursed the amounts as indicated from the Education and
Training Budget appropriation for Police Science courses, was
presented. (Copy to each member of the City Council)
It was moved by Ybarra, seconded by Tavernelli, that the
request of the Police Chief, dated October 26, 1973, be approved
and authority granted to issue warrants in the amounts as indicated.
Motion carried.
Conm!unication from Southern California Edison Company,
dated October 23, 1973, transmitting a billing for stationery and
office supplies for the Vernon District Office and the Vernon Diesel
Plant covering the years 1970 and 1971, was presented.
It was moved by Tavernelli, seconded by Ybarra, that
communication from Southern California Edison Company, dated October
23, 1973, with reference to billing for stationery and office
supplies, be referred to Special Counsel for the Light and Power

D2partment and to the Consulting Electrical Engineer for investi-
gation and recommendation. Motion carried.
Communication from Southern California Edison Company,
dated October 30, 1973, transmitting a corrected additional billing
in the amount of $5,650.74 for meters purchased through the Edison
system during the period from September, 1962 through July 1, 1973,
was presented. (Copy to each member of the City Council)
It was moved by Tavernelli, seconded by Ybarra, that
communication from Southern California Edison Company, dated October
30, 1973, with reference to additional billing for meters, be
referred to Special Counsel for the Light and Power Department and
to the Consulting Electrical Engineer for investigation and recom-
mendation. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, and R. M. Eatherly, Fire Chief, dated October 29, 1973, with
reference to the request of Aluminum Company of America for
permission to continue to utilize two trailers for temporary
facilities at their plant location at 5151 Alcoa Avenue, recommending
that Alcoa be permitted to continue use of the two units in accord-
ance with Ordinance No. 819 subject to certain conditions, was
presented. (Copy to each member of the City Council)
It was moved by Tavernel1i, seconded by Ybarra, that the
recommendation of the Director of Public Works and the Fire Chief,
dated October 29, 1973, be approved; and that Aluminum Company of
America be permitted to continue use of the two units in accordc:;nce
with Ordinance No. 819 subject to the conditions as outlined in the
communication from the Director of Public Works and the Fire Chief,
dated October 29, 1973. Motion carried.
Communication from Policewoman Leah M. Benson, dated
October 26, 1973, addressed to the Chief of Police, advising that
she is submitting an application for Service Retirement to the
Public Employees' Retirement System to be effective March 1, 1974,
was presented.
It was moved by Tavernelli, seconded by Ybarra, that
communication from Policewoman Leah M. Benson, dated October 26,
1973, addressed to the Chief of Police, be received and filed.
Motion carried.
Communication from F. H. Colvin, Assistant Fire Chief,
dated October 30, 1973, recommending that Fireman William R. Meth:tson
be suspended for a thirty day period, without pay, for violation
of Fire Department Rules and Regulations, General Rules Numbers:
3, 9, 29, 44 and 57, was presented. (Copy to each member of the
City Council)
It was moved by Tavernelli, seconded by Ybarra, that the
recommendation of the Assistant Fire Chief, dated October 30, 1973,
be approved. Motion carried.
Activity Log of the Police Department for the period
October 16 - 31, 1973 inclusive, was presented.
It was moved by Ybarra, seconded by Tavernelli, that
Activity Log of the Police Department be received and filed. Motion

"Warrant Register No. 392" covering claims and demands
presented during the period October 16 to 31, which includes Demands
Nos. 3-2332 to 3-2442 (both inclusive), drawn on the United
California Bank, totaling $72,424.12 (Light and Power Warrants
$3,501.85) (Accounting Period November 1973), was examined and
audited..
It was moved by Ybarra, seconded by Tavernel1i, that
''Warrant Register No. 392" be approved and payment authorized for
Demands Nos. 3-2332 to 3-2442 (both inclusive), with no exceptions.
Motion carried.

The City Clerk reported orally that Mayor Robert J. Furlong
is temporarily unable to attend the meetings of the City Council due
to illness.
It was moved by Tavernel1i, seconded by Ybarra, that
permission be granted to Mayor Robert J. Furlong to absent himself
from regular meetings of the City Council until he is physically
able to attend said meetings. Motion carried.
There being no further business to come before the meeting,
it was moved by Tavernelli, seconded by Ybarra, that the meeting
adjourn. Motion carri.ed.
