MINUTES OF A REGUIAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD DECEMBER 4, 1973 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANrA FE
AVENUE.. VERNON.. CALIFORNIA.
COUNCIL PRESENT: Malburg, Tavernelli, Ybarra
COUNCIL ABSENT: Anderson, Furlong
The meeting was called to order by Mayor Pro Tempore
Malburg.
It was moved by Ybarra, seconded by Tavernelli, that
minutes of the meeting of November 20, 1973 be approved as written
and submitted. Motion carried.
Communication from Paul P. Hendricks, Consulting Electrical
Engineer, dated November 30, 1973, recommending that the five (5)
diesel engine generator assemblies, auxiliaries and spare parts be
sold to Amerkor, Inc. for the price of $275,000.00 in accordance with
the terms and conditions of the Contract of Sale (copy attached)
between the City of Vernon and Amerkor, Inc., was presented. (Copy
to each member of the City Council)
Resolution No. 4188 - A Resolution of the City Council of
the City of Vernon accepting the bid of Amerkor, Inc., for the
purchase of five (5) 7,000 H.P. diesel engine generato~ assemblies,
auxiliaries and spare parts, was presented.
It was moved by Tavernelli, seconded by Ybarra, that
Resolution No. 4188 be approved and adopted. Motion carried.

Communication from A. E. Nelson, Jr., Director of Public
Works, dated November 21, 1973, transmitting a fully executed
Easement for 26th Street across Union Pacific tracks and right of
way crossings Nos. 2-144.53C and 3A-3.2; and recommending that the
Easement be accepted, was presented.
It was moved by Tavernel1i, seconded by Ybarra, that
Easement be accepted from Los Angeles & Salt Lake Railroad Company
and its Lessee, Union Pacific Railroad Company; and that the Mayor
and the City Clerk be authorized to execute Certificate of Acceptance.
Motion carried.
Communicat ion from Fishman and George, Attorneys at Law,
dated November 23, 1973, transmitting a Cla~ for Damages on behalf
of their clients, Miguel Valea, Sara Va1ea, and Miguel Valea, Jr.,
as against the County of Los Angeles (Los Angeles Flood Control
District) and as against the City of Vernon, arising out of accident
of October 28, 1973, at approximately 5:45 p.m. on Downey Road just
south of Bandini Boulevard, Vernon, was presented.
It was moved by Ybarra, seconded by Tavernelli, that C1atm
for Damages, dated November 23, 1973, filed on behalf of Miguel
Valea, Sara Va1ea, and Miguel Valea, Jr., as against the County of
Los Angeles (Los Angeles Flood Control District) and as against the
City of Vernon, arising out of accident of October 28, 1973, be
denied and referred to the City Attorney and the City's insura~ce;'
carrier for necessary action. Motion carried."'"

Communication from the City of Rosarito, B.C., Mexico,
dated November 17, 1973, with reference to purchasing one of Vernon's
obsolete fire units, was presented. (Copy to each member of the
City Council)
It was moved by Taverne11i, seconded by Ybarra, that the
City of Rosarito, B.C., Mexico, be notified that the City of Vernon
does not have any fire units for sale; and that if and when the City
of Vernon has any fire units for sale the City of Rosarito, B.C.,
Mexico be so notified. Motion carried.
Communication from the Southern California Rapid Transit
District, dated November 23, 1973, with reference to the District's
actions related to the energy crisis, was presented. (Copy to
each member of the City Council)
It was moved by Ybarra, seconded by Taverne11i, that
communication from the Southern California Rapid Transit District,
dated November 23, 1973, be received and filed. Motion carried.
Communication from F. A. Ziemer, City Clerk-Director of
Finance, dated November 29, 1973, recommending that A. E. Nelson, Jr.,
Director of Public Works, be authorized and instructed to attend a
public hearing on December 7, 1973 at the Environmental Protection
Agency offices in San Francisco, and that Mr. Nelson be reimbursed
for actual expenses incurred, was presented. (Copy to each member
of the City Council)
It was moved by Ybarra, seconded by Taverne1li, that the
recommendation of the City Clerk-Director of Finance, dated November
29, 1973, be approved. Motion carried.
Communication from the Vernon Police Officers' Benefit
Association, dated November 29, 1973, requesting permission to hold
their annual Children's Christmas Party in the Public Works facility
lunchroom on Saturday, December 22, 1973, at 1:00 p.m., was presented.
It was moved by Taverne11i, seconded by Ybarra, that the
Vernon Police Officers' Benefit Association be granted permission
to use the Public Works facility lunchroom on Saturday, December 22,
1973, for the purpose of holding their annual Children's Christmas
Party, provided that certain measures are taken to insure the safety
of the children as the Director of Public Works deems necessary.
Motion carried.
Activity Log of the Police Department for the period
November 16 - 30, 1973 inclusive, was presented.
It was moved by Ybarra, seconded by Taverne1li, that
Activity Log of the Police Department be received and filed. Motion
carried.
''Warrant Register No. 394" covering claims and demands
presented during the period November 16 to 30, which includes Demands
Nos. 3-2630 to 3-2713 (both inclusive), drawn on the United California
Bank, totaling $86,334.57 (Light and Power Warrants $3,683.95)
(Accounting Period December 1973), was examined and audited.

It was moved by Tavernelli, seconded by Ybarra, that
''Warrant Register No. 394" be approved and payment authorized for
Demands Nos. 3-2630 to 3-2713 (both inclusive). with no exceptions.
Motion carried.

Communication from R. H. Bockhacker, Police Chief, dated
November 29, 1973, requesting that Sgt. T. L. Miller be authorized
to attend the 1974 Auto Theft Investigators Institute at California
State University at San Jose, California from January 21 - 25, 1974
inclusive, at a total cost of $346.50, was presented. (Copy to each
member of the City Council)
It was moved by Ybarra, seconded by Taverne11i, that the
recommendation of the Police Chief, dated November 29, 1973, be
approved; that authority be granted to issue warrant in the amount
of $135.00 to California State University, San Jose Foundation; and
that authority be granted to issue warrant in the amount of $211.50
to T. L. Miller. Motion carried.
Communication from Paul P. Hendricks, Consulting Electrical
Engineer, dated November 29, 1973, recommending that Vernon make a
one-time payment of $2,741.41 for past office and stationery expenses
claimed by Edison, provided it is understood and agreed by Edison
that such payment by Vernon shall not constitute a waiver of the
requirements of the Operating Agreement and that henceforth Vernon
will pay only those actual costs billed in accordance with the
provisions of the Operating Agreement, was presented. (Copy to each
member of the City Council)
It was moved by Tavernelli, seconded by Ybarra, that the
recommendation of the Consulting Electrical Engineer, dated November
29, 1973, be approved. Motion carried.
Communication from F. H. Colvin, Assistant Fire Chief,
dated November 29, 1973, requesting that the bid of Superior Western
Company, for furnishing and delivery of One Rescue Truck and Equip-
ment pursuant to Specifications No. 374 in the amount of $14,280.00,
be accepted, complete with gold lettering at an additional cost of
$100.00; and requesting that the Purchasing Agent be authorized to
issue Purchase Order for same, was presented.
Resolution No. 4189 - A Resolution of the City Council of
the City of Vernon accepting the bid of Superior Western Company for
furnishing and delivering to the City of Vernon One Rescue Truck
and Equipment in accordance with Specifications No. 374, was
presented.
It was moved by Ybarra, seconded by Taverne1li, that
Resolution No. 4189 be approved and adopted. Motion carried.

Communication from R. M. Eatherly, Fire Chief, dated
December 4, 1973, amending his letter of June 8, 1973, regarding
the termination of salary for Mr. Richard C. Zindel, was presented..

It was moved by Ybarra~ seconded by Taverne11i, that
communication from the Fire Chief, dated December 4, 1973, be
received and filed. Motion carried.
Resolution No. 4186 - A Resolution of the City Council of
the City of Vernon requesting the Board of Supervisors of the County
of Los Angeles to permit the Registrar of Voters of said County to
render specified services to the City of Vernon relating to the
conduct of a General Municipal Election to be held in said City on
March 5, 1974, was presented.
It was moved by Ybarra, seconded by Tavernelli, that
Resolution No. 4186 be approved and adopted. Motion carried.

Resolution No. 4187 - A Resolution of the City Council of
the City of Vernon, California, calling and giving notice of the
holding of a General Municipal Election to be held in said City on
Tuesday, the 5th day of March, 1974, for the election of certain
officers of said City as required by the provisions of the laws of
the State of California relating to General Law Cities, was presented.
It was moved by Ybarra, seconded by Taverne1li, that
Resolution No. 4187 be approved and adopted. Motion carrieJ..

Resolution No. 4190 - A Resolution of the City Council of
the City of Vernon amending Resolution No. 4019, was presented.
It was moved by Taverne11i, seconded by Ybarra, that
Resolution No. 4190 be approved and adopted. Motion carried.
