IN THE COUNCIL CHAz.1BER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE. VERNON. CALIFOR.NIA. COUNCIL PRESENT: Malburg, Tavernelli, Ybarra COUNCIL ABSENT: Anderson, Furlong Malburg. The meeting was called to order by Mayor Pro Tempore It was moved by Ybarra, seconded by Taverne1li, that minutes of the meeting of December 18, 1973 be approved as written and submitted. Motion carried. Communication from the Los Angeles County Board of Super- visors with reference to resolution adopted on December ll, 1973 regarding the current energy crisis, was presented. (Copy to each member of the City Council) It was moved by Taverne11i, seconded by Ybarra, that communication from the Los Angeles County Board of Supervisors with reference to resolution adopted on December 1l, 1973 regarding the current energy crisis, be received and filed. Motion carried. Communication from the Los Angeles County Board of Super- visors, dated December 13, 1973, transmitting a copy of a resolution with reference to transportation, was presented. (Copy to each member of the City Council) It was moved by Taverne11i, seconded by Ybarra, that communication from the Los Angeles County Board of Supervisors, dated December 13, 1973, together with transmittal, be received and filed. Motion carried. Communication was presented from R. H. Bockhacker, Police Chief, dated December 14, 1973, requesting that the following be reimbursed the amounts as indicated from the Education and Training Budget appropriation: L. A. Espinoza S. E. Putman E. W. Roady $ 32.50 32.10 22.00 It was moved by Ybarra, seconded by Taverne11i, that the request of the Police Chief, dated December l4, 1973, be approved and authority granted to issue warrants in the amounts as indicated. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated December ll, 1973, recommending that Officer E. G. Smith be removed from the City Payroll effective as of January 19, 1974 as he will have been absent from duty for one year as of that date, was presented. (Laid over at the meeting of 12!l8/73) It was moved by Taverne1li, seconded by Ybarra, that the recommendation of the Police Chief, dated December 11, 1973, be approved. Motion carried. I I -2- 1 2 74 Communication from the Public Employees' Retirement System, dated December 13, 1973, with reference to the disability retirement application for Eldon G. Smith/Motor Officer, was presented. (Copy to each member of the City Council) Discussion was held with reference to disability retirement application filed by Eldon G. Smith/Motor Officer. The City Council reviewed the medical records of Motor Officer Smith and reviewed the "Findings and Award" document of the Workmen' s Compensation Appeals Board, dated August 28, 1973. Resolution No. 4194 - A Resolution of the City Council of the City of Vernon, California, pursuant to Section 21023.6, Government Code of the State of California, was presented. It was moved by Ybarra, seconded by Taverne1li, that Resolution No. 4194 be approved and adopted. Motion carried. Ayes: Malburg, Tavernelli, Ybarra Noes: None Absent: Anderson, Furlong Communication from the Office of City Attorney, City of Los Angeles, dated December 17, 1973, with reference to bringing a taxpayers' action seeking, by way of injunction, mandate and declaratory relief, to compel the County to continue to charge those cities receiving contract services on a full cost basis for such services, despite the enactment of Government Code Section 51350, was presented. It was moved by Taverne1li, seconded by Ybarra, that communication from the Office of City Attorney, City of Los Angeles) dated December 17, 1973, be received and filed. Motion carried. Summons in connection with Case Number C 74883 filed in the Superior Court of California, County of Los Angeles by Mary Alcoser, by and through her Guardian Ad Litem, Elena Avina, Christina Eileen Garcia, by and through her Guardian Ad Litem, Elena Avina and Elena Avina vs. County of Los Angeles, State of California, City of Los Angeles, City of Huntington Park, City of Vernon, and Does I through L, for wrongful death, was presented. It was moved by Ybarra, seconded by Tavernelli, that Summons in connection with Case Number C 74883 filed in the Superior Court of California, County of Los Angeles, by Mary A1coser, by and through her Guardian Ad Litem, Elena Avina, Christina Eileen Garcia, by and through her Guardian Ad Litem, Elena Avina and Elena Avina vs. County of Los Angeles, State of California, City of Los Angeles, City of Huntington Park, City of Vernon, and Does I through L, for wrongful death, be referred to the City Attorney and the City's insurance carrier for necessary action. Motion carried. Communication from Supervisor Ernest E. Debs, dated December 17, 1973, with reference to recommended modifications made to the 26th Street Bridge over Downey Road to minimize the effects of major earthquakes within Los Angeles County, asking if the City would like this work done by the County, was presented. (Copy to each member of the City Council) I I -3- 1 2 74 It was moved by Ybarra, seconded by Tavernelli, that the City Clerk-Director of Finance be instructed to notify Supervisor Debs that the City of Vernon would like to have the work done on 26th Street Bridge over Downey Road by the County on behalf of the City of Vernon to be financed by the County and that the County secure the necessary jurisdiction to undertake this work. Motion carried. Activity Log of the Police Department for the period December l6 - 31, 1973 inclusive, was presented. It was moved by Ybarra, seconded by Tavernelli, that Activity Log of the Police Department be received and filed. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated December 20, 1973, advising that the Central Basin Water Association has developed a Cooperative Well Water Monitoring Program; and recommending that the City participate in this program and that the Director of Public Works be authorized to sign "Letter of Intent to Share Costs", was presented. (Copy to each member of the City Council) It was moved by Tavernelli, seconded by Ybarra, that the recommendation of the Director of Public Works, dated December 20, 1973, be approved. Motion carried. Communication from R. M. Eatherly, Fire Chief, dated December 26, 1973, advising that Fireman Jack E. Anderson has been off duty since May 4, 1973; and transmitting a communication from Martin D. Goldfarb, M.D., dated August 29, 1973, addressed to William T. Hays, Attorney at Law, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Taverne11i, that the City of Vernon make application to the Public Employees' Retirement System for a disability retirement for Jack E. Anderson/Fireman to be effective the date that the Workmen's Compensation Appeals Board determines that his condition is permanent and stationary; and that the City Attorney be instructed to draft a resolution requesting the Workmen's Compensation Appeals Board pursuant to Section 21023.6 of the Government Code of the State of California to make a deter- mination as to whether Jack E. Anderson, a Local Safety Member, has received a work-incurred disability, and whether the same is permanent and stationary and, if so, the date when said disability became permanent and stationary. Motion carried. Communication from F. A. Ziemer, City Clerk-Director of Finance, dated December 26, 1973, requesting authority for Brooks Carden, Purchasing Agent, to attend the 1974 Conference of the California Association of Public Purchasing Officers at Pasadena, California from January 23 to 25, 1974, inclusive, with an expense allowance of $84.00, was presented. It was moved by Tavernel1i, seconded by Ybarra, that the request of the City Clerk-Director of Finance, dated December 26, 1973, be approved and authority granted to issue warrant in the amount of $84.00 to Brooks Carden. Nelson, Jr., Director of Public Works, dated December 27, 1973, requesting authority to reclassify the following employees effective January 1, 1974: L. Bloch to Utility Man II, Step 2 F. MUniz to Utility Man II, Step 2 E. Saenz to Utility Man II, Step 2 It was moved by Ybarra, seconded by Taverne11i, that the request of the Director of Public Works, dated December 27, 1973, be approved. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated December 27, 1973, advising that it is necessary for the City Council to determine if the new Vernon City Hall and Police Facility and Fire Service Garage Project will have a significant effect on the environment; transmitting a preliminary environmental impact assessment study prepared by Marion J. Varner and Associates, Architect; and recommending that plan checking for the project be obtained from Melvyn Green, Consulting Structural and Civil Engineer, and that he advise the City regarding compliance of the plans with th. City's present code and also the 1973 Uniform Building Code, was presented. (Copy to each member of the City Council) It was moved by Tavernelli, seconded by Ybarra, that the recommendation of the Director of Public Works, dated December 27, 1973, be approved; that the City Hall and Police Facility and Fire Service Garage Project be approved; and that it be determined that the City Hall and Police Facility and Fire Service Garage Project will not have a significant effect on the environment. Motion carried. Communication from the Los Angeles County Board of Super- visors, dated December 26, 1973, with reference to the designation of Los Angeles County by the California Commission on Aging as the Area Agency on Aging, and the administrator of programs funded under the Federal Older Americans Act in Los Angeles County, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Tavernel1i, that communication from the Los Angeles County Board of Supervisors, dated December 26, 1973, be received and filed. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated December 27, 1973, advising that he has suspended Officer R. D. Gott for two days, without pay, effective January 6 & 7, 1974, and Officer R. C. Bertz for one day, without pay, effective January 4, 1974, for violation of Section 400.24-4 of the Department's Manual of Policy and Ethics, was presented. It was moved by Tavernelli, seconded by Ybarra, that the action taken by the Police Chief be approved. Motion carried. Communication from the City of Covina, dated December 27, 1973, transmitting a copy of its Resolution No. 3224 urging the California Coastal Zone Commission to rescind its previous decision to deny expansion of the San Onofre Nuclear Generating Plant and grant immediate approval for the further development of this generating station, was presented. ''Warrant Register No. 396" covering claims and demands presented during the period December 16 to 31, which includes Demands Nos. 3-2878 to 3-2940 (both inclusive), drawn on the United California Bank, totaling $74,608.24 (Light and Power Warrants $2,797.59) (Accounting Period January 1974), was examined and audited. It was moved by Ybarra, seconded by Taverne11i, that ''Warrant Register No. 396" be approved and payment authorized for Demands Nos. 3-2878 to 3-2940 (both inclusive), with no exceptions. Ebe1t be promoted to Policeman, Grade 2, effective January 1, 1974, was presented. It was moved by Taverne11i, seconded by Ybarra, that the request of the Police Chief, dated December 31, 1973, be approved. Motion carried. Discussion was held with reference to the disability of Richard C. Zindel, Fireman. It was moved by Tavernelli, seconded by Ybarra, that the City of Vernon make application to the Public Employees' Retirement System for the disability retirement of Richard C. Zinde1/Fireman to be effective the date that the Workmen's Compensacion Appeals Board determines that Richard C. ZiDde1's condition is permanent and stationary as requested by Resolution No. 4193.
