19740305 Regular City Council Meeting - Minutes I I MINln'ES OF A REGUlAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD MARCH 5, 1974 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE. VERNON. CALIFORNIA. COUNCIL PRESENT: Gonzales, Malburg, Tavernelli, Ybarra COUNCIL ABSENT: Anderson The meeting was called to order by Mayor Leonis C. Malburg. It was moved by Ybarra, seconded by Tavernelli, that minutes of the meeting of February 19, 1974 be approved as written and submitted. Motion carried. The City Clerk reported that this was the time and place for the hearing relative to the adoption of Ordinances Nos. 844, 845 and 846 of the City of Vernon in accordance with notice dated February 5, 1974. Proof of Publication in the Los Angeles Daily Journal on February 13 and 20, 1974 of "Notice of Public Hearinglf was duly acknowledged as being on file. The City Clerk reported that no written communications relative to this matter had been received. Mayor Malburg asked if anyone in the audience wished to comment on this matter. No one in the audience wished to comment on this matter. It was moved by Gonzales, seconded by Ybarra, that Ordinance No. 844 receive a second reading by title. Motion carried. Ordinance No. 844 - An Ordinance of the City of Vernon regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equip. ment, use, height, area, and maintenance of buildings or structures in the City of Vernon, State of California, and providing for the issuance of permits and collection of fees therefor; declaring and establishing fire districts; providing penalties for the violation thereof and adopting, in part, the Uniform Building Code, 1973 Edition, including Appendices, Chapters 23, 38,48 and 57, promulgateri by the International Conference of Building Officials, and repealing all ordinances and parts of ordinances in conflict therewith, was read for a second reading by title. (Copy to each member of the City Council) It was moved by Tavernelli, seconded by Gonzales, that Ordinance No. 844 receive and pass a second reading. Motion carried. (Copy to each member of the City Council) It was moved by Tavernel1i, seconded by Gonzales, that Ordinance No. 845 receive and pass a second reading. Motion carried. (Copy to each member of the City Council) It was moved by Tavernelli, seconded by Ybarra, that Ordinance No. 846 receive and pass a second reading. Motion carried. Wilson to attend the Fire Prevention Officers Academy at Palm Springs, California from March 11 to 15, 1974, inclusive, with an expense allowance of $192.50, was presented. It was moved by Ybarra, seconded by Taverne11i, that the request of the Fire Chief, dated February 15, 1974, be approved and authority granted to issue warrant in the amount of $192.50 to William R. Wilson. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated February 19, 1974, requesting that Section 4 of the "Lease of Personal Property" be amended to read as outlined, was presented. (Copy to each member of the City Council) It was moved by Tavernelli, seconded by Gonzales, that the request of the Police Chief, dated February 19, 1974, be referred to the Finance Committee for study and report. Motion carried. Communication from City of Pico Rivera, dated February 14, 1974, transmitting a copy of its Resolution No. 1778 stating opposition to the S.C.R.T.D. proposal to relieve current traffic congestion and promote further fuel savings by expanding public transportation, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Gonzales, that communi- cation from the City of Pico Rivera, dated February 14, 1974, together with transmittal, be rec.eived and filed. Motion carried. I I -5- 3 5 74 Communication from the Los Angeles County Board of Supervisors, dated February 14, 1974, urging all incorporated cities within the County of Los Angeles to adopt an Ordinance similar to the Urgency Ordinance enclosed, which was adopted by the Board to protect consumers by the establishment of certain requirements for vendors of gasoline or other motor fuel, was presented. (Copy to each member of the City Council) It was moved by Tavernelli, seconded by Ybarra, that communication from the Los Angeles County Board of Supervisors, dated February 14, 1974, be received and filed. Motion carried. Communic~tion from A. E. Nelson, Jr., Director of Public Works, dated February 20, 1974, transmitting a letter dated January 11, 1974 from the Department of Housing and Community Development and a copy of the State Relocation Guidelines adopted by the Commission of Housing ~ld Community Development on October 17, 1973; and recommending that subject to the epproval of the City Attorney, the State Relocation Guidelines be adopted, was presented. It was moved by Gonzales, seconded by Tavernelli, that the recommendation of the Director of Public Works, dated February 20, 1974, be approved; and that the State Relocation Guidelines adopted by the Commission of Housing and Community Development on October 17, 1973, be adopted without amendments by the City of Vernon. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated February 22, 1974, requesting authority for Victor H. Vaits to attend the Transportation and Public Works Conference at Oakland, California from March 27 to 29, 1974, with an expense allowance of $164.00, was presented. It was moved by Tavernelli, seconded by Ybarra, that the request of the Director of Public Works, dated February 22, 1974, be approved and authority granted to issue warrant in the amount of $164.00 to Victor H. Vaits. Motion carried. Communication from Sav-Mor Oil Co., dated February 22, 1974, objecting to the plan approved by the County Board of Super- visors for a rationing and/or distribution plan for the retail sales of gasoline in the unincorporated areas of the County of Los Angeles; and requesting consideration of this letter, if and when, the City of Vernon takes some action on a gasoline distribution plan, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Gonzales, that communi- cation from Sav-Mor Oil Co., dated February 22, 1974, be received and filed. Motion carried. Communication from R. M. Eatherly, Fire Chief, dated February 25, 1974, requesting that certain personnel be reimbursed the amounts as indicated from the Education and Training Budget appropriation for Fire Science Courses, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Tavernelli, that the request of the Fire Chief, dated February 25, 1974, be approved and authority granted to issue warrants in the amounts as indicated. Nelson, Jr., Director of Public Works, dated February 26, 1974, transmitting a fully executed Easement for water distribution system purposes for property east of the Los Angeles River north of Bandini Boulevard from Royal Wholesale Cigar Company, Limited; and recommending that the Easement be accepted, was presented. It was moved by Tavernelli, seconded by Gonzales, that Easement be accepted from Royal Wholesale Cigar Company, Limited; and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated February 26, 1974, transmitting a fully executed Easement for water distribution system purposes for property south of 45th Street west of St. Charles Street from Grant Oil Tool Company; and recommending that the Easement be accepted, was presented. It was moved by Ybarra, seconded by Tavernelli, that Easement be accepted from Grant Oil Tool Company; and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated February 27, 1974, transmitting Contract No. 378, Traffic Signal Installation, Santa Fe Avenue at Vernon (E) Avenue; and recom- mending that authority be granted to advertise for bids, was presented. Resolution No. 4217 - A Resolution of the City Council of the City of Vernon approving Contract No. 378 for Traffic Signal Installation - Santa Fe Avenue at Vernon (E) Avenue in accordance with Contract No. 378 of the City of Vernon, was presented. It was moved by Ybarra, seconded by Tavernelli, that Resolution No. 4217 be approved and adopted. Motion carried. Nelson, Jr., Director of Public Works, dated February 27, 1974, transmitting Contract No. 377, City Hall Sewer, Storm Drain and Frontage Improvement; and recommending that authority be granted to advertise for bids, was presented. Resolution No. 4218 - A Resolution of the City Council of the City of Vernon approving Contract No. 377 for City Hall Sewer, Storm Drain and Frontage Improvement in accordance with Contract No. 377 of the City of Vernon, was presented. It was moved by Gonzales, seconded by Ybarra, that Resolution No. 4218 be approved and adopted. Motion carried. "Warrant Register No. 400" covering claims and demands presented during th,(\~eriod February 16 to 28, which includes Demands Nos. 4-405 to 4-413v(both inclusive), drawn on the United California Bank, totaling $67,558.05 (tight and Power Warrants $6)982.47) (Accounting Period March 1914), was examined and audited. It was moved by Ybarra, seconded by Taverne11i, that ''Warrant Register No. 400" be approved and payment authorized for Demands Nos. 4-405 to 4-41~* (both inclusive), with no exceptions. Hendricks, Consulting Electrical Engineer, dated March 1, 1974, submitting a summary in connection with Edison's Rule No. 14.1 entitled "Prohibitions and Curtailment Provisions" to the Vernon Electric System customers if adopted by the Vernon City Council; and recommending that the Vernon City Council consider adopting Edison's Rule No. 14.1 as changed, added to and amended by this review summary, was presented. (Copy to each member of the City Council) It was moved by Tavernelli, seconded by Ybarra, that communication from the Consulting Electrical Engineer, dated March 1) 1974, be tabled until it can be determined whether or not a voluntary compliance with a suggested curtailment of the use of electrical energy will produce the necessary results. Ordinance No. 841 - An Ordinance of the City of Vernon amending The Code of the City of Vernon, California, 1959, by inserting therein Ordinance Nos. 844, 845 and 846 and renumbering certain sections of said Code, was read by title for a first reading. It was moved by Ybarra, seconded by Tavernelli, that Ordinance No. 841 receive and pass a first reading. Motion carried.
