19740521 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD MAY 21, 1974 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. COUNCIL PRESENT: Gonzales, Malburg, McCormick, Ybarra COUNCIL ABSENT: Keebler The meeting was called to order by Mayor Leonis C. Malburg. It was moved by Ybarra, seconded by Gonzales, that minutes of the meeting of May 7, 1974 be approved as written and submitted. Motion carried. The Clerk announced that this was the time and place for opening of bids received for the construction of Pacific Boulevard Median, Santa Fe Avenue to Atchison, Topeka and Santa Fe Railroad, in accordance with Contract No. 373. It was moved by McCormick, seconded by Ybarra, that the Clerk be instructed to open and read the bids submitted. Motion carried. The Clerk opened and read the following bids: Sully Miller Contracting Company J. B. Crosby Co., Inc. Crowell and Larson Damon Construction Company $ 9,782.75 8,983.00 10,198.20 9,430.00 It was moved by McCormick, seconded by Gonzales, that bids received for the construction of Pacific Boulevard Median, Santa Fe Avenue to Atchison, Topeka and Santa Fe Railroad, in accordance with Contract No. 373, be referred to the Director of Public Works and the City Attorney for checking and report. Motion carried. It was moved by Ybarra, seconded by McCormick, that Ordinance No. 849 receive a second reading by title. Motion carried. Ordinance No. 849 - An Ordinance of the City of Vernon, fixing certain rates to be charged for electrical energy distributed and supplied by said City of Vernon within its boundaries and repealing certain Ordinances of the City of Vernon, was read for a second reading by title. (Copy to each member of the City Council) It was moved by Gonzales, seconded by McCormick, that Ordinance No. 849 receive and pass a second reading. Motion carried. It was moved by Ybarra, seconded No. 849 receive and pass a third reading carried. Ayes: Noes: Absent: by Gonzales, that Ordinance and be adopted. Motion Gonzales, Malburg, McCormick, Ybarra None Keebler Communication from R. H. Bockhacker, Police Chief, dated May 8, 1974, requesting that D. E. Bates be promoted to Policeman, Grade 3, and R. E. Olson to Policeman, Grade 2, effective June 1, 1974, was presented. It was moved by McCormick, seconded by Gonzales, that the request of the Police Chief, dated May 8, 1974, be approved. Motion carried. Communication from R. M. Eatherly, Fire Chief, dated May 6, 1974, requesting authority for M. T. Mello to attend the Scott Breathing Apparatus Repair School at Lancaster, New York from approxi- mately June 3 to 8, 1974, with an expense allowance of $712.27, was presented. It was moved by McCormick, seconded by Ybarra, that the re- quest of the Fire Chief, dated May 6, 1974, be approved and authority granted to issue warrant in the amount of $712.27 to M. T. Mello. Motion carried. Communication from R. M. Eatherly, Fire Chief, dated May 8, 1974, recommending that Larry R. Burdett, Engineer Grade 3 (Temporary), be appointed to the position of Engineer Grade 3, effective June 1, 1974, was presented. It was moved by McCormick, seconded by Gonzales, that the recommendation of the Fire Chief, dated May 8, 1974, be approved. Motion carried. Communication from the Finance Committee, dated May 13, 1974, making certain enumerated recommendations, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by McCormick, that the recommendations of the Finance Committee, as enumerated in communication dated May 13, 1974, be approved. No. 11713-4 Rider, dated April 29, 1974, extending term of Agreement A-75179 between Los Angeles & Salt Lake Railroad Company - Union Pacific Railroad Company and the City of Vernon covering license for 30-foot private roadway across railroad right of way and Vernon Industrial Lead Track #3, was presented. It was moved by Gonzales, seconded by Ybarra, that the Mayor and the City Clerk be authorized to execute, on behalf of the City of Vernon, Extension Rider, identified as Union Pacific Railroad Company's document C.L.D. No.. 11713-4, to Agreement of September 1, 1954, Rail- road's Contract Audit No. A-75179. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated May 15, 1974, requesting that Lieutenant D. E. Fisher be reimbursed the sum of $16.10 from the Education and Training Budget appropriation for Police Science Courses at Cerritos College, was presented. It was moved by McCormick, seconded by Ybarra, that the request of the Police Chief, dated May 15, 1974 be approved and authority granted to issue warrant in the amount of $16.10 to D. E. Fisher. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated M~y 16, 1974, requesting that Officers J. E. Mason, H. N. Sto1an and D. J. Tavernel1i be permitted to attend the Law Enforcement Academy of Driving at Irvine, California from June 5 to 7, 1974, inclusive, at a total cost of $792.00, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Gonzales, that the request of the Police Chief, dated May 16, 1974, be approved; that authority be granted to issue warrant in the amount of $675.00 to the Law Enforcement Academy of Driving; and that authority be granted to issue warrants in the amount of $39.00 each to J. E. Mason, H. N. Sto1an and D. J. Taverne11i. Motion carried. Report of Health Department Activities for the month of April, 1974, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by McCormick, that the Report of Health Department Activities be received and filed. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated May 16, 1974, transmitting Addendum No. 1 to Contract No. 376, City Hall and Police Facility and Parking Structure and Fire Department Service Garage prepared by Marion J. Varner and Associates, Architect; and recommending that Addendum No. 1 to Contract No. 376 be approved and that all prospective bidders be notified, was presented. Communication from Strauss Construction Company, Inc., dated May 15, 1974, requesting two week's extension of time for bidding on Contract No. 376, City Hall and Police Facility and Parking Structure and Fire Department Service Garage, due to conflict with other projects which they are bidding, was presented. It was moved by Ybarra, seconded by McCormick, that the request of Strauss Construction Company, Inc., dated May 15, 1974, be denied. Motion carried. "Warrant Register No. 405" covering claims and demands presented during the period May 1 to 15, which includes Demands Nos. 4-1054 to 4-1248 (both inclusive) drawn on the United Cali- fornia Bank, totaling $1,650,055.20 (Light and Power Warrants $1,534,315.94) (Accounting Period May 1974), was examined and audited. It was moved by Ybarra, seconded by McCormick, that "Warrant Register No. 405" be approved and payment authorized for Demands Nos. 4-1054 to 4-1248 (both inclusive), with no exceptions. Motion carried. It was moved by Ybarra, seconded by McCormick, that "Payroll Warrant and Register No. 202" be approved and payment authorized for Demands Nos. 2121 to 2130 (both inclusive), with no exceptions. Communication from Aluminum Company of America, dated May 15, 1974, requesting renewal of the permit on the office trailer designated as Unit 1 on the attached layout Drawing A- 030500-VC, was presented. (Copy to each member of the City Council) It was moved by Gonzales, seconded by McCormick, that the Building Department be authorized to issue a commercial coach renewal permit for a one year extension to Aluminum Company of America for the office trailer designated as Unit 1 on layout Drawing A-030500-VC. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated May 16, 1974, advising that Vernon Paving Company has completed the work in connection with Contract No. 332, Santa Fe Avenue and 25th-26th Street Intersection Reconstruction; and recommending that the work be accepted and that authority be granted to pay the contractor in accordance with the agreement, was presented. Resolution No. 4246 - A Resolution of the City Council of the City of Vernon accepting the work of Vernon Paving Company for the work for Santa Fe Avenue and 25th-26th Street Intersection Reconstruction in accordance with Contract No. 332 of the City of Vernon and in accordance with Specifications TOPICS Project No. T-304l (196), was presented. F. Dickson Company, Inc. for $1,879.48 per month during the period that the City's street sweeper is being repaired, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Gonzales, that the request of the Director of Public Works, dated May 16, 1974, be approved. Motion carried. Communication from F. A. Ziemer, City Clerk-Director of Finance, dated May 16, 1974, recommending that in accordance with the requirements of the Fair Labor Standards Act Amendments of 1974 the workweek for all employees under the jurisdiction of the City Clerk-Director of Finance be established as 12:01 a.m. Sunday to 12:00 midnight Saturday (calendar week), was presented. It was moved by Gonzales, seconded by Ybarra, that the recommendation of the City Clerk-Director of Finance, dated May 16, 1974, be approved. Motion carried. 5~ I I -6- 5 21 74 Communication from A. Nelson, Jr., Director of Public Works, dated May 16, 1974, recommending that in accordance with the requirements of the Fair Labor Standards Act Amendments of 1974 the workweek for all employees under the jurisdiction of the Director of Public Works be established as 12:01 a.m. Sunday to 12:00 midnight Saturday (calendar week), was presented. It was moved by Gonzales, seconded by Ybarra, that the recommendation of the Director of Public Works, dated May 16, 1974, be approved. Motion carried. Communication from C. H. McGovern, City Attorney, dated May 21, 1974, in response to a letter from Fireman Jack E. Anderson, dated April 29, 1974, addressed to the Fire Chief, relative to compensation for unused vacation time, was presented. (Copy to each member of the City Council) It was moved by Gonzales, seconded by Ybarra, that the request of Fireman Jack E. Anderson for compensation for unused vacation time be denied pursuant to an opinion of the City Attorney. Motion carried. Resolution No. 4248 - A Resolution of the City Council of the City of Vernon commending Jack E. Anderson upon his retire- ment, was presented. It was moved by Ybarra, seconded by McCormick that Resolution No. 4248 be approved and adopted. Motion carried. Burch upon his retirement as City Treasurer of the City of Vernon, was presented. It was moved by Gonzales, seconded by Ybarra, that Resolution No. 4245 be approved and adopted. Motion carried.
