19740618 Regular City Council Meeting - Minutes MINUTES OF A REGUlAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD JUNE 18, 1974 AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE. VERNON. CALIFORNIA. COUNCIL PRESENT: Gonzales, Keebler, Malburg, McCormick, Ybarra COUNC IL ABSENT: None I The meeting was called to order by Mayor Leonis C. Malburg. It was moved by Ybarra, seconded by McCormick, that minutes of the meeting of June 4, 1974 be approved as written and submitted. Motion carried. Communication from F. A. Ziemer, City Clerk-Director of Finance, dated June 7, 1974, recommending that Dorothy D. Lewis be advanced to Senior Clerk, Purchasing, Grade 1, and Rita M. Luich be advanced to Senior Stenographer-Switchboard Operator, Grade 1, effective July 1, 1974, was presented. It was moved by Gonzales, seconded by McCormick, that the recommendation of the City Clerk-Director of Finance, dated June 7, 1974, be approved. Motion carried. Communication from R. M. Eatherly, Fire Chief, dated June 5, 1974, recommending that A. J. deBoer be advanced from Engineer, Grade 2, to Engineer, Grade 1, effective July 1, 1974, was presented. It was moved by McCormick, seconded by Ybarra, that the recommendation of the Fire Chief, ,dated June 5, 1974, be approved. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated June 5, 1974, recommending that in accordance with the requirements of the Fair Labor Standards Act Amendments of 1974 the workweek for all miscellaneous employees under the jurisdiction of the Police Department be established as 12:01 a.m. Sunday to 12:00 midnight Saturday (Calendar Week), was presented. I It was moved by Gonzales, seconded by Keebler, that the recommendation of the Police Chief, dated June 5, 1974, be approved. Motion carried. Communication from Jay R. Brown, dated May 27, 1974, requesting an extension for vacating the premises at 3349 Fruitland Avenue, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Gonzales, that Jay R. Brawn be given until July 31, 1974 to vacate the premises at 3349 Fruitland Avenue. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated June 5, 1974, transmitting an Easement and Quitclaim Deed from The Atchison, Topeka and Santa Fe Railway Company covering a portion of 26th Street east of Downey Road; and recom- mending that the Easement and the Quitclaim Deed be accepted and the grantor be advised of the official recordation, was presented. 522 I I -2- 6 18 74 It was moved by Gonzales, seconded by Ybarra, that the Easement and the Quitclaim Deed be accepted from The Atchison, Topeka and Santa Fe Railway Company; and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance for each document. Motion carried. Communication from R. M. Eatherly, Fire Chief, dated June 6, 1974, advising that Fireman C. Claunch has been off duty since March 13, 1974 for heart irregularities; and requesting that the City Council take necessary action to submit this case to the Workmen's Compensation Appeals Board for a ruling, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Keebler, that the request of the Fire Chief, dated June 6, 1974, be approved and that this matter be referred to the City Attorney for drafting the necessary documents. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated June 6, 1974, requesting that Officer B. G. Baker be authorized to attend a class on "Crime Scene Investigation and Physical Evidence Presentation" at the Bahn-Fair Institute of Scientific Law Enforce- ment at South Lake Tahoe, California, from July 9 to 19, 1974, inclusive, at a total cost of $777.00, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Ybarra, that the request of the Police Chief, dated June 6, 1974, be approved; that authority be granted to issue warrant in the amount of $455.00 to Bahn-Fair Institute of Scientific Law Enforcement; and that authority be granted to issue warrant in the amount of $322.00 to B. G. Baker. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated June 10, 1974, requesting that certain personnel as listed be advanced to the grades as indicated effective July 1, 1974, was presented. It was moved by Ybarra, seconded by McCormick, that the request of the Police Chief, dated June 10, 1974, be approved. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated June 10, 1974, transmitting plans and specifications for constructing 1970 Storm Drain Bond Issue Project No. 8250 in 37th Street and Ross Street; and recommending that the plans and specifications be approved, the District be authorized to proceed with the construction and the District be further authorized to occupy and use the public streets in the City of Vernon to construct, operate and maintain said installations, was presented. It was moved by Gonzales, seconded by Keebler, that the recommendation of the Director of Public Works, dated June 10, 1974, be approved. Motion carried. Activity Log of the Police Department for the period June 1 - 15, 1974 inclusive, was presented. It was moved by Ybarra, seconded by Gonzales, that Activity Log of the Police Department be received and filed. Motion carried. 523 -3- 6 18 74 Communication from A. E. Nelson, Jr., Director of Public Works, dated June 10, 1974, requesting authority to advance certain personnel as listed to the grades as indicated, effective July 1, 1974; and requesting authority to reclassify certain personnel as listed to the classification as indicated, effective July 1, 1974, was presented. (Copy to each member of the City Council) It was moved by Gonzales, seconded by McCormick, that the requests of the Director of Public Works, dated June 10, 1974, be approved. Motion carried. I Communication from A. E. Nelson, Jr., Director of Public Works, dated June 12, 1974, advising that Lindt-Wilson Motors has delivered the Utility Trucks in accordance with Contract No. 381; and recommending that the Utility Trucks be accepted and that authority be granted to pay the contractor in accordance with the agreement, was presented. Resolution No. 4262 - A Resolution of the City Council of the City of Vernon accepting delivery of Utility Trucks provided pursuant to Contract No. 381 of the City of Vernon, was presented. It was moved by Ybarra, seconded by McCormick, that Resolution No. 4262 be approved and adopted. Motion carried. Ayes: Gonzales, Keebler, Malburg, McCormick, Ybarra Noes: None Absent: None ''Warrant Register No. 407" covering claims and demands presented during the period June 1 to 15, which includes Demands Nos. 4-1316 to 4-1471 (both inclusive), drawn on the United California Bank, totaling $1,683,120.24 (Light and Power Warrants $1,615,096.29) (Accounting Period June 1974), was examined and audited. It was moved by Ybarra, seconded by Gonzales, that ''Warrant Register No. 407" be approved and payment authorized for Demands Nos. 4-1316 to 4-1471 (both inclusive), with no exceptions. Motion carried. It was moved by Ybarra, seconded by Gonzales, that "Payroll Warrant Register No. 203" be approved and payment authorized for Demands Nos. 2131 to 2140 (both inclusive), with no exceptions. (Copy to each member of the City Council) It was moved by Keebler, seconded by McCormick, that communication from the State of California, Department of Trans- portation, dated June 10, 1974, be received and filed. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated June 12, 1974, requesting that lease agreement between the City of Vernon and Officer Byrt M. Waller for one 1972 MotoGuzzi Motor- cycle, Engine Number VP51419, be terminated; and requesting that new lease agreement, as submitted, between the City of Vernon and Officer Byrt M. Waller for one 1972 Mo~o Guzzi Motorcycle, Engine Number VP51419, be approved effective as of July 1, 1974, was presented. It was moved by Gonzales, seconded by Ybarra, that the requests of the Police Chief, dated June 12, 1974, be approved and that the Mayor and the City Clerk be authorized to execute new lease agreement on behalf of the City of Vernon. Motion carried. Communication from R. H. Bockhacker, Police Chief, dated June 12, 1974, requesting that lease agreement between the City of Vernon and Officer Raymond D. Tisdale for one 1973 Harley Davidson Motorcycle, Engine Number 2A-22158-H3, be terminated; and requesting that new lease agreement, as submitted, between the City of Vernon and Officer Raymond D. Tisdale for one 1973 Harley Davidson Motor- cycle, Engine Number 2A-22158-H3, be approved effective as of July 1, 1974, was presented. It was moved by Gonzales, seconded by Ybarra, that the requests of the Police Chief, dated June 12, 1974, be approved and that the Mayor and the City Clerk be authorized to execute new lease agreement on behalf of the City of Vernon. Motion carried. Communication from Paul P. Hendricks, Consulting Electrical Engineer, dated June 12, 1974, recommending that in order to offset increased cost of purchased power to Vernon that a fuel clause adjustment of .318 cents per Kwh sold be adopted by the City of Vernon to be effective June 20, 1974, was presented. (Copy to each member of the City Council) Communication from Southern California Edison Company, dated June 18, 1974, relative to change in Vernon Retail Fuel Clause. Adjustment Billing Factor, was presented. The Consulting Electrical Engineer orally approved certain changes in his recommendation as outlined in his communication dated June 12, 1974. Resolution No. 4259 - A Resolution of the City Council of the City of Vernon changing the fuel cost adjustment billing factor charged for electrical energy distributed and supplied to its electrical consumers, was presented. 525 -5- 6 18 74 It was moved by Gonzales, seconded by Keebler that Resolution No. 4259 be approved and adopted. Harris, Fire Department Secretary, requesting a two-month leave of absence commencing July 1, 1974; and recom- mending that this request be granted, was presented. (Copy to each member of the City Council) It was moved by Keebler, seconded by Ybarra, that Sheri L. Harris, Fire Department Secretary, be granted a two-month leave of absence, without pay, commencing July 1, 1974. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated June 13>> 1974>> with reference to bids received for providing for Jail Equipment for the City Hall and Police Facility in accordance with Contract No. 376; recommending that the contract be awarded to Central Industrial Engineering Company, Inc. on the basis of their bid of $60>>140.00, was presented. Resolution No. 4260 - A Resolution of the City Council of the City of Vernon accepting the bid of Central Industrial Engineering Company, Inc.>> for Jail Equipment for the City Hall and Police Facility, in accordance with Contract No. 376 of the City of Vernon, was presented. It was moved by Gonzales, seconded by Ybarra, that Resolution No. 4260 be approved and adopted. Motion carried. Nelson, Jr., Director of Public Works>> dated June 13, 1974, with reference to bids received providing for the construction of City Hall and Police Facility and Parking Structure and Fire Department Service Garage in accordance with Contract No. 376; recommending that all bids received for the construction of City Hall and Police Facility and Parking Structure and Fire Department Service Garage be rejected and that the City Hall and Police Facility and Parking Structure portion be readvertised for bids as soon as possible, was presented. (Copy to each member of the City Council) It was moved by Keebler, seconded by McCormick, that the recommendation of the Director of Public Works, dated June 13, 1974, be approved. Motion carried. Resolution No. 4261 - A Resolution of the City Council of the City of Vernon rejecting all bids for the construction of City Hall and Police Facility and Parking Structure and Fire Department Service Garage, in accordance with Contract No. 376 of the City of Vernon, was presented. It was moved by Keebler, seconded by McCormick, that Resolution No. 4261 be approved and adopted. Motion carried. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Gonzales, that Report of Health Department Activities be received and filed. Motion carried. Communication from Rita M. Luich, Secretary to the City of Vernon Library Board of Trustees, dated June 14, 1974, advising that the term of office of Trustee McCormick will expire on June 30, 1974; and requesting that the City Council make a new appoint- ment effective July 1, 1974, was presented. Mayor Malburg appointed William M. McCormick as a Member of the Board of Library Trustees effective July 1, 1974 for a three year term. It was moved by Gonzales, seconded by Ybarra, that the appointment of William M. McCormick as a Member of the Board of Library Trustees effegtive July 1, 1974 for a three year term be approved. Motion carried. Ordinance No. 850 - An Ordinance of the City of Vernon, amending Ordinance No. 849 of the City of Vernon, was read by title for a first reading. It was moved by Gonzales, seconded by Ybarra, that Ordinance No. 850 receive and pass a first reading. Motion carried. Ayes: Gonzales, Keebler, Malburg, McCormick, Ybarra Noes: None Absent: None Resolution No. 4258 - A Resolution of the City Council of the City of Vernon continuing the retention of Paul P. Hendricks, as Consulting Electrical Engineer of the City of Vernon, was presented. It was moved by Ybarra, seconded by Keebler, that Resolution No. 4258 be approved and adopted. Motion carried. McGovern, Attorney at Law, to be effective July 1, 1974.
