MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD SEPTEMBER 3, 1974 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA.
COUNCIL PRESENT: Gonzales, Malburg, McCormick, Ybarra
COUNCIL ABSENT: Kaeser
The meeting was called to order by Mayor Leonis C. Malburg.
It was moved by Ybarra, seconded by Gonzales, that minutes
of the meeting of August 20, 1974 be approved as written and submitted.
Motion carried.
It was moved by Ybarra, seconded by McCormick, that
Ordinance No. 851 receive a second reading by title. Motion carried.
Ordinance No. 851 - An Ordinance of the City of Vernon,
amending The Code of the City of Vernon, California, 1959, by
amending Sec. 7.15-2 of said Code, was read for a second reading by
title. (Copy to each member of the City Council)
It was moved by Gonzales, seconded by McCormick, that
Ordinance No. 851 receive and pass a second reading. Motion carried.

Noes: None
Absent: Kaeser
It was moved by McCormick, seconded by Ybarra, that in
accordance with Government Code Section 36934, the reading of
Ordinance No. 851 in full be waived; and that Ordinance No. 851
receive a third and final reading by title. Motion unanimously
carried.

Ordinance No. 851 - An Ordinance of the City of Vernon,
amending The Code of the City of Vernon, California, 1959, by

Ordinance No. 852 receive and pass a second reading. Motion carried.

Communication from B. G. Baker, Vernon Police Department,
dated August 15, 1974, requesting permission to temporarily park
his personal camper at the rear of Vernon Fire Station No.3, was
presented. (Copy to each member of the City Council)
It was moved by McCormick, seconded by Ybarra, that the
request of Officer B. G. Baker, dated August 15, 1974, be approved
subject to the conditions as outlined in his communication. Motion
carried.
Communication from the Southern California Edison Company,
dated August 15, 1974, transmitting a License Agreement executed by
Swift & Company covering proposed facilities for service to Swift
Food Service, 3750 Jewel Avenue, was presented.
It was moved by Ybarra, seconded by Gonzales, that the
Mayor and the City Clerk be authorized to execute License Agreement
covering proposed facilities for service to Swift Food Service,
3750 Jewel Avenue. Motion carried.

Copy of Resolution No. 74-709 of the Modesto City Council
urging a no vote on Proposition 17 by all citizens of the State,
was presented. (Copy to each member of the City Council)
It was moved by Gonzales, seconded by Ybarra, that copy of
Resolution No. 74-709 of the Modesto City Council be received and
filed. Motion carried.
Communication from A.. E. Chrisman, Police Captain, dated
August 26, 1974, requesting that Officers A. W. Tortoriello, R. V.
Sapp, W. H. Horton and D. W. Green be allowed to attend a Criminal
Investigation course being given September 16, 17 and 18, 1974 at
the California State University at a cost of $17.00 for each officer,
was presented.

It was moved by McCormick, seconded by Gonzales, that the
request of Police Captain A. E. Chrisman, dated August 26, 1974, be
approved and authority granted to issue warrant in the amount of
$17.00 each to A. W. Tortoriello, R. V. Sapp, W. H. Horton and D. W.
Green. Motion carried.
Copy of Resolution No. 74-37 of the City Council of the
City of Bellflower requesting members of the California Legislature
to repeal and amend those sections of the California Government
Code pertaining to the State Employee Retirement System for State
Legislators who are no longer serving due to loss of election or
apportionment, was presented. (Copy to each member of the City
Council)
It was moved by Ybarra, seconded by McCormick, that copy
of Resolution No. 74-37 of the City Council of the City of Bellflower
be received and filed. Motion carried.
Communication from R. H. Bockhacker, Police Chief, dated
August 28, 1974, recommending that Section 4 of the Agreement between
Michael Snyder and the City of Vernon, dated October 1, 1973,
providing for School Crossing Guard service, be amended to increase
the compensation from $3.00 per hour to $3.25 per hour, effective
September 3, 1974, was presented.
It was moved by Ybarra, seconded by McCormick, that the
recommendation of the Police Chief, dated August 28, 1974, be
approved; and that the Mayor and the City Clerk be authorized to
execute a new Agreement between Michael Snyder and the City of Vernon
effective September 3, 1974. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated August 28, 1974, advising that J. B. Crosby Company,
Inc. has completed the work for Pacific Boulevard Median in accordance
with Contract No. 373; and recommending that the work be accepted and
that authority be granted to pay the contractor in accordance with
the agreement, was presented.
Resolution No. 4286 - A Resolution of the City Council of
the City of Vernon accepting the work of J. B. Crosby Company, Inc.,
for Pacific Boulevard Median Construction, in accordance with Contract
No. 373 of the City of Vernon, was presented.
It was moved by Ybarra, seconded by Gonzales, that
Resolution No. 4286 be approved and adopted. Motion carried.

Activity Log of the Police Department for the period August
16 - 31, 1974 inclusive, was presented.
It was moved by Ybarra, seconded by Gonzales, that Activity
Log of the Police Department be received and filed. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated August 27, 1974, transmitting Contract No. 379 for
Washington Boulevard Reconstruction, Downey Road to East City Boundary;
and recommending that this contract be approved and that authority be
granted to advertise for bids, was presented.

Resolution No. 4268 - A Resolution of the City Council of
the City of Vernon approving Contract No. 379, for Washington
Boulevard Reconstruction, Downey Road to East City Boundary, in
accordance with Contract No. 379 of the City of Vernon, was presented.
It was moved by Ybarra, seconded by Gonzales, that
Resolution No. 4268 be approved and adopted. Motion carried.

Communication from A. E. Nelson, Jr., Director of Public
~"orks, dated August 28, 1974, recommending that street sweeping
services be obtained from R. F. Dickson Company, Inc. for $1,879.48
per month, one sweeping all curbed streets each week, was presented.

It was moved by Ybarra, seconded by McCormick, that the
recommendation of the Director of Public Works, dated August 28,
1974, be approved. Motion carried.
''Warrant Register No. 412" covering claims and demands
presented during the period August 16 to 31, which includes Demands
Nos. 4-2085 to 4-2188 (both inclusive), drawn on the United
California Bank, totaling $65,765.71 (Light and Power Warrants
$4,857.48 (Accounting Period September 1974), was examined and
audited.
It was moved by Ybarra, seconded by Gonzales, that ''Warrant
Register No. 412" be approved and payment authorized for Demands Nos.
4-2085 to 4-2188 (both inclusive), with no exceptions. Motion
carried.

Summons in connection with Case Number C98302 filed in the
Superior Court of California, County of Los Angeles, by Pedro Bravo
Garcia vs. Robert Monzingo, David J. Castellanos, City of Vernon, a
Municipal Corporation, and DOES I through X, inclusive, for assault
and battery; false arrest and imprisonment; and intentional infliction
of mental suffering, was presented. (Copy to each member of the City
Counc il)
It was moved by McCormick, seconded by Ybarra, that Summons
in connection with Case Number C98302 filed in the Superior Court
of California, County of Los Angeles, by Pedro Bravo Garcia vs.
Robert Monzingo, David J. Castellanos, City of Vernon, a Municipal
Corporation, and DOES I through X, inclusive, for assault and battery;
false arrest and imprisonment; and intentional infliction of mental
suffering, be referred to the City Attorney and the City's insurance
carriers for necessary action. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated August 30, 1974, transmitting a letter from Filtrol
Corporation, dated August 28, 1974, requesting a variance to the
Building Code relative to the property at 3200 E. Washington
Boulevard; and recommending approval for a variance to the Code,

provided the opening be protected with an approved 3-hour fire door
and the necessary permits be obtained and provided that upon sale
or change of occupancy, termination of lease or any other use of
the building not necessitating said opening, then the opening shall
be closed and returned to its original state or as required by the
Code, was presented. (Copy to each member of the City Council)
It was moved by McCormick, seconded by Ybarra, that F iltro 1
Corporation be granted a variance from the provisions of the Building
Code covering the property at 3200 E. Washington Boulevard, subject
to the conditions as outlined in letter from the Director of Public
Works, dated August 30, 1974. Motion carried.
Communication from F. H. Colvin, Assistant Fire Chief,
dated August 30, 1974, requesting authority and funds to purchase
tools and supplies, at an estimated cost of $1,000.00, necessary
for Autofireman-Electrica1 Specialist Robert J. Glassner to
adequately perform related repair and maintenance duties for the
City, was presented.
It was moved by Ybarra, seconded by Gonzales, that the
request of the Assistant Fire Chief, dated August 30, 1974, be
referred to the Finance Committee for study and recommendation.
Motion carried.
Communication from F. H. Colvin, Assistant Fire Chief, dated
August 30, 1974, requesting that Captain M. T. Mello be appointed
Assistant Fire Chief, Grade 3, effective September 1, 1974, was
presented.
It was moved by McCormick, seconded by Ybarra, that the
request of the Assistant Fire Chief, dated August 30, 1974, be
approved. Motion carried.
Summons and Complaint in connection with Case Number
SE C 13509 filed in the Superior Court of the State of California
for the County of Los Angeles, by Murphy Doyle vs. City of Vernon,
a Municipal Corporation; Jack Henry Looper; DOE I through XX,
inclusive, for personal injuries and damages, was presented.
It was moved by McCormick, seconded by Ybarra, that Summons
and Complaint in connection with Case Number SE C 13509 filed in the
Superior Court of the State of California for the County of Los
Angeles, by Murphy Doyle vs. City of Vernon, a Municipal Corporation;
Jack Henry Looper; DOE I through DOE XX, inclusive, for personal
injuries and damages, be referred to the City Attorney and the City's
insurance carrier for necessary action. Motion carried.
The City Clerk reported orally that Mr. William M.
McCormick is interested in leasing the vacant city-owned house
located at 3349 Fruitland Avenue.
It was moved by Gonzales, seconded by Ybarra, that the
city-owned house located at 3349 Fruitland Avenue be leased to
William M. McCormick as soon as it is available for occupancy.
Motion carried.

Resolution No. 4285 -A Resolution of the City Council of
the City of Vernon congratulating the City of Maywood on its 50th
Anniversary, was presented.
It was moved by Gonzales, seconded by Ybarra, that
Resolution No. 4285 be approved and adopted. Motion carried.

Pursuant to a recommendation of the Planning Commission,
Resolution No. 4282 - A Resolution of the City Council of the City
of Vernon approving the Environmental Impact Statement' regarding the
Land Use Element, Circulation Element, Housing Element, Conservation
Element, Seismic Safety Element, Noise Element, Scenic Highway
Element and Safety Element of the General Plan, was presented.
It was moved by Gonzales, seconded by McCormick, that
Resolution No. 4282 be approved and adopted. Motion carried.

Pursuant to a recommendation of the Planning Commission,
Resolution No. 4283 - A Resolution of the City Council of the City

the General Plan, was presented.
It was moved by Ybarra, seconded by Gonzales, that
Resolution No. 4283 be approved and adopted. Motion carried.

SITTING AS A PLANNING COMMISSION HELD AT
1:00 P.M. ON TUESDAY, SEPTEMBER 3, 1974,
IN THE COUNCIL CHAMBER OF THE CITY HALL
LOCATED AT 4305 SANTA FE AVENUE, VERNON,
CALIFORNIA FOR THE PURPOSE OF ALLCMING THE
GENERAL PUBLIC TO COMMENT OR OBJECT TO
CERTAIN ELEMENTS OF THE GENERAL PlAN.

The hearing was called to order by Chairman Malburg.
The City Clerk stated that this was the tfme and place
for the hearing of the City Council sitting as a Planning
Commission of the City of Vernon for the purpose of allowing the
general public to comment or object to the following Elements of
the General Plan:
Land Use Element
Circulation Element
Housing Element
Conservation Element
Seismic Safety Element
Noise Element
Scenic Highway Element
Safety Element
The City Clerk reported that Notice of Hearing was posted
in accordance with Section 65854 of the Government Code of the
State of California; and presented Affidavit that Notice of Hearing
was posted on August 22, 1974.
Mr. James M. Hinzde1, Chief Planner, and Miriam W.
Schmitt, Senior Planner, of Koebig & Koebig, Inc., Planning
Services Contractor for the City of Vernon, appeared before the
Planning Commission and discussed the draft of the following elements
of the General Plan as prepared for the City of Vernon:

Circulation Element
Housing Element
Conservation Element
Seismic Safety Element
Noise Element
Scenic Highway Element
Safety Element
Chairman Malburg asked if any written communications had
been received relative to this matter.
The City Clerk reported that no written communications had
been received.
Chairman Malburg asked if anyone wished to make an oral
comment with reference to the proposed Elements of the General Plan.
No one responded.

After discussion, it was moved by McCormick, seconded by
Ybarra, that the following be eliminated from the draft of the
General Plan Program:
I
(1) First paragraph of Page 6 of the Land Use Element;
(2) Fourth paragraph of Page 6 of the Land Use Element;
(3) That portion of the Land Use & Circulation Map
referring to selected residential and commercial
sites;
(4) Last three words of page 7 of the Land Use Element;
and
(5) "Subdivision Ordinance" on page 11 of the Safety
Element.
Motion carried.

Absent: Kaeser
It was moved by Gonzales, seconded by McCormick, that the
Planning Commission approve the Elements of the General Plan as
amended and make a determination that the Elements of the General
Plan as amended will not have a significant effect on the environ-
ment;and that the Planning Commission recommend that the City
Council approve the Elements of the General Plan as amended and
make a determination that the Elements of the General Plan as
amended will not have a significant effect on the environment.
Motion carried.
