19741105 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD NOVEMBER 5, 1974 AT TWO 0' CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE. VERNON. CALIFORNIA. COUNCIL PRESENT: Gonzales, Kaeser, Malburg, McCormick, Ybarra COUNCIL ABSENT: None The meeting was called to order by Mayor Leonis C. Malburg. It was moved by McCormick, seconded by Ybarra. that minutes of the meeting of October 15, 1974 be approved as written and submitted. Motion carried. Communication from the Chief Administrative Officer, County of Los Angeles, dated November 1, 1974, transmitting a "Notice of Intent of the City Council of the City of Vernon" authorizing the City's participation with the County of Los Angeles in the joint development and submittal of 911 Tentative Plans to the State of California by January 31, 1975 or any other date that may be prescribed by law, was presented. (Copy to each member of the City Council with copy of "Notice of Intent") Fire Captain X. J. Padilla, Assistant Director of Civil Defense, appeared before the City Council and reported on the meetings that he and other representatives of the City of Vernon had attended relative to the "911" Emergency Telephone System. It was moved by Ybarra, seconded by Kaeser, that the "Notice of Intent" as transmitted be approved and that the Mayor and the City Clerk be authorized to execute the "Notice of Intent" to participate with the County of Los Angeles relative to "911" planning. Motion carried. It was moved by Gonzales, seconded by Kaeser, that Ordinance No. 853 receive a second reading by title. Motion carried. Ordinance No. 853 - An Ordinance of the City of Vernon amending The Code of the City of Vernon, California, 1959, was read for a second reading by title. (Copy to each member of the City Council) It was moved by Ybarra, seconded by McCormick, that Ordinance No. 853 receive and pass a second reading. Motion carried. Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: None Absent: None It was moved by McCormick, seconded by Gonzales, that in accordance with Government Code Section 36934, the reading of Ordinance No. 853 in full be waived; and that Ordinance No. 853 receive a third and final reading by title. (Copy to each member of the City Council) It was moved by McCormick, seconded by Kaeser, that communication from the City of Maywood, dated October 11, 1974, together with transmittal, be received and filed. Motion carried. Communication from the Residents of Furlong Place, dated October 14, 1974, requesting that considerati.on be given regarding provisions for holding or storage space in the new parking structure, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by McCormick, that communication from the Residents of Furlong Place, dated October 14, 1974, be referred to the Finance Committee for study. Motion carried. Communication from S. E. Hogan, Acting Chief of Police, dated September 25, 1974, requesting that certain personnel be re~bursed the amounts as indicated from the Education and Training Budget appropriation for Police Science Courses, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Gonzales, that the request of the Acting Police Chief, dated September 25, 1974, be approved and authority granted to issue warrants in the amounts as indicated. Motion carried. Communication from F. H. Colvin, Fire Chief, dated October 21, 1974, requesting that certain personnel be reimbursed the amounts as indicated from the Education and Training Budget appro- priation for Fire Science Courses, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Kaeser, that the request of the Fire Chief, dated October 21, 1974, be approved and authority granted to issue warrants in the amounts as indicated. Motion carried. Communication from F. H. Colvin, Fire Chief, dated October 21, 1974, advising that the Federal Bureau of Investigation requests permission to use the hose tower at Fire Station #1 for the purpose of training their personnel in entry and exiting upper levels utilizing repelling equipment; and transmitting a letter releasing the City from any liability, was presented. (Copy to each member of the City Council) It was moved by Gonzales, seconded by Kaeser, that the Federal Bureau of Investigation be granted permission to use the hose I I -3- 11 5 74 tower at Fire Station #1 for the purpose of training their personnel in entry and exiting upper levels utilizing repelling equipment, provided that the Federal Bureau of Investigation itself furnishes the City with a letter releasing the City from any liability. Motion carried. Communication from F. H. Colvin, Fire Chief, dated October 22, 1974, recommending that Fireman W. W. Gibson be suspended five working shifts, without pay, on October 22, 25, 28, 31 and November 3, 1974 for infraction of Vernon Fire Department Rules and Regulations, was presented. It was moved by Kaeser, seconded by Ybarra, that the recom- mendation of the Fire Chief, dated October 22, 1974, be approved. Motion carried. Communication from S. E. Hogan, Police Chief, dated October 25, 1974, requesting that Officers A. Hoover and R. Bertz be permitted to attend the Law Enforcement Academy of Driving at Irvine, California from November 18 to 20, 1974, inclusive, and that Sgt. R. Amos be permitted to attend from November 25 to 27, 1974, inclusive, at a total cost of $778.50, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Kaeser, that the request of the Police Chief, dated October 25, 1974, be approved; that authority be granted to issue warrant in the amount of $675.00 to the Law Enforcement Academy of Driving; and that authority be granted to issue warrants in the amount of $34.50 each to A. Hoover, R. Bertz and R. Amos. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated October 28, 1974, with reference to the General Require- ments of Contract No. 383 in connection with partial payments for materials, fixtures and equipment delivered to the job site, recom- mending that Contract No. 383 be amended by adding "or an alternate site" following "to the job site", was presented. (Copy to each member of the City Council) Resolution No. 4294 - A Resolution of the City Council of the City of Vernon authorizing the execution of an amendment to the contract between Ruane Corporation and the City of Vernon, was presented. It was moved by Ybarra, seconded by Kaeser, that Resolution No. 4294 be approved and adopted. Motion carried. Nelson, Jr., Director of Public Works, dated October 28, 1974, recommending that authority be granted to replace Water Department paint spray gun cup at an approximate cost of $125.00, was presented. (Copy to each member of the City Council) It was moved by Kaeser, seconded by McCormick, that the recommendation of the Director of Public Works, dated October 28, 1974, be approved. It was moved by Ybarra, seconded by McCormick, that Activity Log of the Police Department be received and filed. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated October 28, 1974, recommending that Ronald Patnaude, Francis Sumner, Fred Tachovsky and Leonard Wranosky be authorized to attend a California Noise Insulation Standards Seminar with the registration fee of $25.00 each paid by the City, was presented. (Copy to each member of the City Council) It was moved by Gonzales, seconded by Ybarra, that the recommendation of the Director of Public Works, dated October 28, 1974, be approved and authority granted to issue warrants in the amount of $25.00 each to Ronald Patnaude, Francis Sumner, Fred Tachovsky and Leonard Wranosky. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated October 28, 1974, transmitting an Easement from Santa Fe Land Improvement Company for a parcel of land on the north side of Washington Boulevard required for street construction; and recom- mending that the Easement be accepted and the grantors be advised of the official recordation, was presented. It was moved by McCormick, seconded by Kaeser, that Easement be accepted from Santa Fe Land Improvement Company; and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Communication from Haskins & Sells, Certified Public Accountants, dated October 28, 1974, transmitting financial state- ments and supplemental schedules of the City of Vernon and the financial statements and supplemental schedule of the City of Vernon Revenue Sharing Fund for the year ended June 30, 1974 and their opinions dated August 9, 1974, was presented. (Copy of reports to each member of the City Council) It was moved by McCormick, seconded by Ybarra, that communication from Haskins & Sells, Certified Public Accountants, dated October 28, 1974, together with transmittals, be received for study. Motion carried. Communication from F. A. Ziemer, City Clerk-Director of Finance, dated October 29, 1974, recommending that Bernard J. Fratto, Deputy City Clerk-Deputy Director of Finance, be authorized to attend a one-day program on the "Application of the FLSA to Fire Protection and Law Enforcement Activities" on December 18, 1974, at the Airport Marina Hotel near the Los Angeles International Airport at a cost of $40.00 including all materials, luncheon and parking fees, was presented. Communication from S. E. Hogan, Police Chief, dated October 28, 1974, requesting that Captain A. E. Chrisman be authorized to attend a major conference on the Application of the Fair Labor Standards Act to Fire Protection and Law Enforcement Activities on December 18, 1974 at the Airport Marina Hotel in Inglewood, California at a cost of $40.00 including all materials, luncheon and parking fees, was presented. It was moved by Ybarra, seconded by Kaeser, that the request of the Police Chief, dated October 31, 1974, be approved and authority granted to issue warrant in the amount of $26.94 to E. W. Roady. I I -6- 11 5 74 Communication from the State of California, Department of Health, dated October 29, 1974, with reference to the Child Health and Disability Prevention Program established for the purpose of providing early and periodic assessments of the health status of children, was presented. (Copy to each member of the City Council) It was moved by Gonzales, seconded by McCormick, that the State Department of Health be notified that the City of Vernon does not elect to provide the services of a community Child Health and Disability Prevention Program as defined in AB 2068 and Program Standards. Motion carried. ''Warrant Register No. 416" covering claims and demands presented during the period October 15 to 31, which includes Demands Nos. 4-2639 to 4-2760 (both inclusive) drawn on the United California Bank, totaling $152,051.39 (Light and Power Warrants $3,188.01 (Accounting Period November 1974), was examined and audited. It was moved by Ybarra, seconded by McCormick, that ''Warrant Register No. 416" be approved and payment authorized for Demands Nos. 4-2639 to 4-2760 (both inclusive), with no exceptions. It was moved by Ybarra, seconded by Gonzales, that Resolution No. 4293 be approved and adopted. Motion carried.
