CITY COUNCIL OF THE CITY OF VERNON
HELD NOVEMBER 19, 1974 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANl'A FE
AVENUE. VERNON. CALIFORNIA.
COUNCIL PRESENT: Gonzales, Kaeser, Malburg, McCormick, Ybarra
COUNCIL ABSENT: None
The meeting was called to order by Mayor Leonis C. Malburg.
It was moved by McCormick, seconded by Gonzales, that
minutes of the meeting of November 5, 1974 be approved as written
and submitted. Motion carried.
Communication from Mr. Nicholas Weber, Chairman of the
C.M.D. Lighting Committee of the Vernon Chamber of Commerce, dated
November 7, 1974, requesting that the City Council take affirmative
action at this time to include the Central Manufacturing District,
or any portion thereof, in the general street lighting program of
the City of Vernon, was presented. (Copy to each member of the
City Council)
It was moved by Ybarra, seconded by McCormick, that the
request of Mr. Nicholas Weber, Chairman of the C.M.D. Lighting
Committee of the Vernon Chamber of Commerce, dated November 7, 1974,
be approved; and that the street lights be installed as soon as the
engineering work can be completed and as soon as the Southern
California Edison Company, Operator for the City of Vernon, can
schedule the work. Motion carried.

Communication from Filtro1 Corporation, dated October 31,
1974, requesting a variance to the ordinance governing fuel oil
storage to permit above ground installation and use of two fuel oil
storage tanks, subject to certain conditions, was presented. (Copy
to each member of the City Council)
Communication from A. E. Nelson, Jr., Director of Public
Works, dated November 13, 1974, with reference to the request for a
variance to the Uniform Mechanical Code submitted by Filtrol
Corporation, advising that the Building Department has no objections
to this request provided that the Filtrol Corporation meets all the
requirements of the Vernon Fire Department, and provided that the
Fi1trol Corporation complies with all the other conditions as
outlined, was presented. (Copy to each member of the City Council)
It was moved by Gonzales, seconded by Kaeser, that Filtrol
Corporation be granted a variance to the Uniform Mechanical Code
to permit above ground fuel oil storage tanks, subject to the
following conditions:
(1) That Fi1trol meets all the requirements of the
Vernon Fire Department;
(2) That Filtrol submits all the necessary plans for a
structural check of the tanks, foundation and diked areas for the
issurance of a permit and pays the prescribed fees;

(3) That Filtrol takes out the mechanical permits to
install the necessary piping in connection with these tanks;
(4) That Filtrol takes out the necessary permits for
the fire protection system; and
(5) That the approval of this variance not be construed
to be a precedent for any other requests of the same nature.
Motion carried.
Communication from F. A. Ziemer, City Clerk-Director of
Finance, dated November 7, 1974, recommending that Lois Hilton be
advanced to Deputy City Clerk-Accountant, Grade 1, and that Sheila
H. McKenna be advanced to Deputy City Clerk-Payroll, Grade 1,
effective December 1, 1974, was presented.
It was moved by McCormick, seconded by Kaeser, that the
recommendation of the City Clerk-Director of Finance, dated November
7, 1974, be approved. Motion carried.
Communication from C. H. McGovern, City Attorney, dated
November 6, 1974, recommending that the Cla~ of Charles Barrios
Gonzales, et al, be denied and that the cla~ants be so advised,
was presented. (Copy to each member of the City Council)
It was moved by Kaeser, seconded by Ybarra, that the Claim
of Charles Barrios Gonzales, Sam Wesley Berry and Henry Lee Battle,
individuals, on behalf of themselves and all other persons s~ilarly
situated, vs. City of Vernon, be denied; and that the City Attorney
be instructed to give the claimants written notice of insufficiency
pursuant to Government Code Sections 910.8 and 915.4. Motion
carried.
Communication from the Metropolitan Transportation
Engineering Board, dated October 30, 1974, transmitting a copy of
its resolution requesting the Federal Highway Administration to
revise their standards and procedures on noise level requirements
on Federal-Aid System Projects, and requesting the City of Vernon
to adopt a s~ilar resolution, was presented. (Copy to each member
of the City Council)
Communication from A. E. Nelson, Jr., Director of Public
Works, dated November 12, 1974, recommending that the City of Vernon
adopt a resolution s~ilar to the one adopted by the Metropolitan
Transportation Engineering Board, was presented. (Copy to each
member of the City Council)
Resolution No. 4296 - A Resolution of the City Council
of the City of Vernon requesting that the Federal Highway Admini-
stration revise their standards and procedures on noise level
requirements on Federal-Aid System Projects, was presented.
It was moved by Ybarra, seconded by Kaeser, that Resolution
No. 4296 be approved and adopted. Motion carried.

Communication from F. H. Colvin, Fire Chief, dated November
6, 1974, advising that Fireman J. R. Brown has been off duty with an
ankle injury since December 9, 1973; and recommending that his name
be deleted from the City payroll effective December 10, 1974, was
presented.

It was moved by Kaeser, seconded by Gonzales, that the
recommendation of the Fire Chief, dated November 6, 1974, be
approved. Motion carried.
Copy of Resolution No. 74-71 of the City Council of the
City of Cerritos approving the Federal Aid Urban Committee as
promulgated by the joint committee and supported by the League of
California Cities and authorizing the City's League representative
to support the urban committee, was presented. (Copy to each member
of the City Council)
It was moved by Gonzales, seconded by Kaeser, that copy
of Resolution No. 74-71 of the City Council of the City of Cerritos
be received and filed. Motion carried.
Communication from S. E. Hogan, Police Chief, dated
November 8, 1974, requesting that Officer D. J. Tavernelli be
promoted to Policeman, Grade 1, effective as of December 1, 1974,
was presented.
It was moved by Ybarra, seconded by Kaeser, that the
request of the Police Chief, dated November 8, 1974, be approved.
Motion carried.
Communication from the Finance Committee, dated November
12, 1974, making certain enumerated recommendations to the City
Council, was presented. (Copy to each member of the City Council)
It was moved by Kaeser, seconded by McCormick, that the
recommendations of the Finance Committee be approved as enumerated
in its communication dated November 12, 1974. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated November 13, 1974, with reference to redevelopment work
on Well No. 11, recommending that the attached proposal of Roscoe
Moss Company be accepted and that authority be granted to the
Director of Public Works to authorize increase or decrease in time
as necessary; and recommending that Aurora Pump Company be authorized
to alter Well No. 10 pump as outlined, was presented. (Copy to each
member of the City Council)
It was moved by Gonzales, seconded by Kaeser, that the
recommendations of the Director of Public Works, dated November 13,
1974, be approved. Motion carried.
Report of Health Department Activities for the month of
October, 1974 was presented. (Copy to each member of the City
Council)
It was moved by Ybarra, seconded by McCormick, that Report
of Health Department Activities be received and filed. Motion
carried.
Activity Log of the Police Department for the period
November 1 to 15, 1974 inclusive, was presented.
It was moved by McCormick, seconded by Kaeser, that
Activity Log of the Police Department be received and filed. Motion
carried.

''Warrant Register No. 417" covering claims and demands
presented during the period November 1 to 15, which includes Demands
Nos. 4-2761 to 4-2917 (both inclusive), drawn on the United
California Bank, totaling $2,929,438.29 (Light and Power Warrants
$2,406,202.38) (Accounting Period November 1974), was examined and
audited.
It was moved by Gonzales, seconded by Ybarra, that
''Warrant Register No. 417" be approved and payment authorized for
Demands Nos. 4-2761 to 4-2917 (both inclusive), with no exceptions.
Motion carried.

"Payroll Warrant Register No. 208" covering claims and
demands presented during the period October 1 to 31, which includes
Demands Nos. 2181 to 2190 (both inclusive), drawn on the Crocker
National Bank, totaling $406,553.67 (Accounting Period October 1974),
was examined and audited.
It was moved by Gonzales, seconded by Ybarra, that
"Payroll Warrant Register No. 208" be approved and payment authorized
for Demands Nos. 2181 to 2190 (both inclusive), with no exceptions.
Motion carried.

Copy of communication from Becker Bros. Steel Supply Co.,
dated November 6, 1974, addressed to the Vernon Fire Department,
requesting a temporary variance on the removal of the skylights at
the Howard Supply Building, was presented. (Copy to each member
of the City Council)
Communication from F. H. Colvin, Fire Chief, and A. E.
Nelson, Jr., Director of Public Works, dated November 14, 1974,
with reference to the request of Becker Bros. Steel Supply Co.,
dated November 6, 1974, for a temporary variance on the removal of
the skylights on the roof of the building at 5125 Santa Fe Avenue,
suggesting that this Company accept all responsibility and any and
all liabilities that might result from any damages or injuries to
life or property during the temporary occupancy of these premises,
not exceeding five months, was presented.
Mr. Leo L. Becker, Vice President of Becker Bros. Steel
Supply Co., made an oral request that the extension of time of
occupancy of these premises be increased from five months to six
months.
It was moved by Kaeser, seconded by McCormick, that Becker
Bros. Steel Supply Co. be granted a variance from the Uniform
Building Code Section 5205B, provided that Becker Bros. Steel Supply
Co. accept all responsibility and any and all liabilities that might
result from any damages or injuries to life or property during the
temporary occupancy of the premises at 5125 Santa Fe Avenue; provided
that the occupancy of these premises does not exceed May 31, 1975;
and provided that Becker Bros. Steel Supply Co. agrees to hold the
City of Vernon harmless from any and all claims resulting from said
occupancy. Motion carried.

Communication from Teresa L. Hatt, Public Works Department
employee, dated November 14, 1974, requesting a Maternity Leave
from January 13, 1975 to July 1, 1975, was presented, (Copy to each
member of the City Council)
It was moved by Ybarra, seconded by Gonzales, that Teresa
L. Hatt be granted a leave of absence, without pay, from January 13,
1975 to July 1, 1975. Motion carried.
Communication from the Vernon Police Officers' Benefit
Association, dated November 15, 1974, requesting permission to hold
their annual Children's Christmas Party in the Public Worksf8cility
lunchroom on Saturday, December 21, 1974, at 1:00 P.M., was
presented.
It was moved by Ybarra, seconded by Kaeser, that the Vernon
Police Officers' Benefit Association be granted permission to use
the Public Works facility lunchroom on Saturday, December 21, 1974,
for the purpose of holding their annual Children's Christmas Party,
provided that certain measures are taken to insure the safety of the
children as the Director of Public Works deems necessary. Motion
carried.
Communication from S. E. Hogan, Police Chief, dated
November 14, 1974, requesting that Officer L. C. Eldridge be
reimbursed the sum of $86.00 from the Education and Training Budget
appropriation for Police Science Courses, was presented.
It was moved by Gonzales, seconded by Kaeser, that the
request of the Police Chief, dated November 14, 1974, be approved
and authority granted to issue warrant in the amount of $86.00 to
L. C. Eldridge. Motion carried.
Communication from F. H. Colvin, Fire Chief, dated
November 15, 1974, requesting authority and funds to purchase fifteen
box spring and mattress sets for Fire Station No. 2 at an approximate
cost of $1,000.00, was presented.
It was moved by Kaeser, seconded by Ybarra, that the
request of the Fire Chief, dated November 15, 1974, be approved.
Motion carried.
Communication from Paul P. Hendricks, Consulting Electrical
Engineer, dated November 15, 1974, with reference to the Vernon fuel
clause adjustment, was presented. (Copy to each member of the City
Council)
It was moved by Gonzales, seconded by Ybarra, that communi-
cation from the Consulting Electrical Engineer, dated November 15,
1974, be received and filed. Motion carried.
Communication from S. E. Hogan, Police Chief, dated
November 15, 1974, advising that he has suspended Officer R. V. Sapp,
without pay, effective November 21 and 22, 1974, for violation of
Section 400.20 of the Department's Manual of Policy, Ethics and
Procedure, was presented.
It was moved by McCormick, seconded by Kaeser, that the
action taken by the Police Chief be approved. Motion carried.
