MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF VERNON
HELD DECEMBER 17, 1974 AT TWO O'CLOCK
P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA FE
AVENUE,. VERNON,. CALIFORNIA.
COUNCIL PRESENT: Gonzales, Kaeser, Malburg, McCormick, Ybarra
COUNCIL ABSENT: None
The meeting was called to order by Mayor Leonis C. Malburg.
It was moved by Ybarra, seconded by Gonzales, that minutes
of the meeting of December 3, 1974 be approved as written and
submitted. Motion carried.
It was moved by McCormick, seconded by Kaeser, that
Ordinance No. 854 receive a second reading by title. Motion carried.
Ordinance No. 854 - An Ordinance of the City Council of
the City of Vernon amending Chapter 3 of The Code of the City of
Vernon, California, 1959, which provides for the licensing,
impounding and regulating the keeping, sale and exhibition of
animals by amending certain sections thereto, was read for a second
reading by title. (Copy to each member of the City Council)
It was moved by Gonzales, seconded by Ybarra, that
Ordinance No. 854 receive and pass a second reading. Motion carried.

Absent: None
It was moved by McCormick, seconded by Kaeser, that in
accordance with Government Code Section 36934, the reading of
Ordinance No. 854 in full be waived; and that Ordinance No. 854
receive a third and final reading by title. Motion unan~ous1y
carried.

Ordinance No. 854 - An Ordinance of the City Council of
the City of Vernon amending Chapter 3 of The Code of the City of
Vernon, California, 1959, which provides for the licensing,
impounding and regulating the keeping, sale and exhibition of
an~a1s by amending certain sections thereto, was read by title
for a third and final reading.
It was moved by Ybarra, seconded by Kaeser, that
Ordinance No. 854 receive and pass a third reading and be adopted.
Motion carried.

Communication from F. H. Colvin, Fire Chief, dated
November 27, 1974, requesting that certain personnel, as listed, be
issued checks in the amount of $30.00 each to cover parking fees for
the month of January, 1975, while attending Paramedic training
sessions at L.A. County University of Southern California Medical

It was moved by Ybarra, seconded by McCormick, that the
request of the Fire Chief, dated November 27, 1974, be approved
and authority granted to issue warrants in the amount of $30.00
each to the personnel as listed. Motion carried.
Communication from Leslie C. Nichols, Attorney at Law,
dated November 25, 1974, with reference to Claim of Gonzales, Berry
and Battle, was presented. (Copy to each member of the City Council)
It was moved by Gonzales, seconded by Ybarra, that communi-
cation from Leslie C. Nichols, Attorney at Law, dated November 25,
1974, be referred to the City Attorney. Motion carried.
Communication from F. H. Colvin, Fire Chief, dated
November 27, 1974, submitting Specifications No. 382, "Fire Department
Radio Communications System"; and recommending that these specifi-
cations be approved and that authority be granted to advertise for
bids, was presented.
Resolution No. 4302 - A Resolution of the City Council of
the City of Vernon approving Specification No. 382 and authorizing
notice inviting sealed proposals or bids for the furnishing,
delivering, and installing to the City of Vernon, Fire Department
Radio Communications System in accordance with Specification No.
382, was presented.
It was moved by Gonzales, seconded by Kaeser, that
Resolution No. 4302 be approved and adopted. Motion carried.

Communication from Edward L. Saenz, dated December 2, 1974,
requesting permission to construct a screened-in and roofed patio at
the city-owned house located at 3560 E. Vernon Avenue, was presented.

It was moved by Kaeser, seconded by Ybarra, that Edward L.
Saenz be granted permission to construct a screened-in and roofed
patio at the city-owned house located at 3560 E. Vernon Avenue,
subject to the conditions as outlined in his communication dated
December 2, 1974. Motion carried.
Communication from F. H. Colvin, Fire Chief, dated
December 4, 1974, recommending that Naomi Jean Hoffman be advanced
from Clerk-Typist, Grade 2 to Grade 1, effective January 1, 1975,
was presented.
It was moved by Gonzales, seconded by Kaeser, that the
recommendation of the Fire Chief, dated December 4, 1974, be
approved. Motion carried.
Communication from Captain Patrick N. Moorehead, Vernon
Fire Department, dated December 4, 1974, with reference to his off-
duty sporting accident, was presented. (Copy to each member of the
City Council)
It was moved by Ybarra, seconded by Gonzales, that communi-
cation from Captain Patrick N. Moorehead, Vernon Fire Department,
dated December 4, 1974, be received and filed. Motion carried.

It was moved by McCormick, seconded by Kaeser, that the
five year estimate for anticipated street improvement projects, as
submitted by the Director of Public Works under date of April 19,
1974, be approved in principle only; and that the priority suggested
by the Director of Public Works and the amounts estimated to cover
the costs of the projects suggested by the Director of Public Works
not be construed as final approval but only as a guide for long
range planning and that this summary be reviewed and re-eva1uated
each fiscal year. Motion carried.
Communication from Rosen Meat Packing Company, dated
December 5, 1974, requesting permission to maintain their Office
Trailer at its present location due to the circumstances as outlined,
was presented. (Copy to each member of the City Council)
It was moved by Ybarra, seconded by Gonzales, that the
Building Department be authorized to issue a commercial coach renewal
permit for a one-year extension to Rosen Meat Packing Company for
the Office Trailer located on the premises at 4224 District Boulevard.
Motion carried.
Communication from S. E. Hogan, Police Chief, dated December
10, 1974, requesting that L. J. Ebe1t be advanced from Policeman,
Grade 2 to Grade 1, effective January 1, 1975, was presented.
It was moved by Kaeser, seconded by McCormick, that the
request of the Police Chief, dated December 10, 1974, be approved.
Motion carried.
Communication from S. E. Hogan, Police Chief, dated December
10, 1974, requesting authority to employ Paul Robert Denney and
Kendall Duane Stahly as Police Cadets, Grade 4, effective January 1,
1975, was presented.
It was moved by Ybarra, seconded by Kaeser, that the
request of the Police Chief, dated December 10, 1974, be approved.
Motion carried.
Report of Health Department Activities for the month of
November 1974, was presented. (Copy to each member of the City
Council)
It was moved by Ybarra, seconded by McCormick, ~hat Report
of Health Department Activities be received and filed. Motion carried.
Activity Log of the Police Department for the period
December 1 to 15, 1974 inclusive, was presented.
It was moved by Gonzales, seconded by Kaeser, that Activity
Log of the Police Department be received and filed. Motion carried.

Communication from Pacific Cold Storage Company, dated
November 22, 1974, requesting a variance to permit the construction
of a canopy over a portion of one of their loading docks located
on the east side of the building at 2851 E. 44th Street and adjacent
to the newly remodeled meat packing plant at Salem Packing Company,
was presented. (Salem Packing Company co-signed the request.)

Communication from A. E. Nelson, Jr., Director of Public
Works, dated December 11, 1974, with reference to request for variance
for Pacific Cold Storage Company, 2851 E. 44th Street, advising that
the Building and Fire Departments have investigated this request for
a variance to the Uniform Building Code and will approve the request
under the conditions as outlined in the letter from Pacific Cold
Storage Company dated November 22, 1974, was presented. (Copy to
each member of the City Council)
It was moved by McCormick, seconded by Kaeser, that Pacific
Cold Storage Company be granted a variance from the provisions of the
Uniform Building Code covering the property at 2851 E. 44th Street,
subject to the conditions as outlined in their letter dated November
22, 1974. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated December 11, 1974, requesting authority to advance
certain employees on the basis of merit effective January 1, 1975;
and requesting authority to reclassify L. Gonzales to Utility Man III,
Step 2, on the basis of increased responsibility effective January
1, 1975, was presented. (Copy to each member of the City Council)
It was moved by Kaeser, seconded by McCormick, that the
requests of the Director of Public Works, dated December 11, 1974,
be approved. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated December 12, 1974, requesting authority for Victor H.
Vaits to attend a Street and Traffic Control Systems II meeting at
Los Angeles on January 9 & 10, 1975 with an expense allowance of
$75.00, was presented.
It was moved by Ybarra, seconded by Gonzales, that the
request of the Director of Public Works, dated December 12, 1974,
be approved and authority granted to issue warrant in the amount of
$75.00 to Victor H. Vaits. Motion carried.
Communication from S. E. Hogan, Police Chief, dated
December 12, 1974, requesting that Officer G. M. Alverez be reimbursed
the sum of $61.17 from the Education and Training Budget appropriation
for Police Science courses at Cerritos College, was presented.
It was moved by Gonzales, seconded by Kaeser, that the
request of the Police Chief, dated December 12, 1974, be approved
and authority granted to issue warrant in the amount of $61.17 to
G. M. Alverez. Motion carried.
Memorandum from the Purchasing Agent to the Finance Director,
dated December 17, 1974, with reference to the written proposal from
Mr. Jay Baess1er to purchase surplus Fire Engine 33 for the sum of
$2,010.00, was presented.

Communication from Orner C. Sherwood (Policeman), dated
December 12, 1974, requesting the City Council to take the necessary
action to enable him to receive benefits from the Public Employees'
Retirement System due to an industrial disability, effective October
17, 1974, was presented. (Copy to each member of the City Council)
On June 21, 1974, Orner C. Sherwood/Policeman made appli-
cation to the Public Employees' Retirement System for a disability
retirement to be effective October 17, 1974.
On July 16, 1974, the City Council adopted Resolution No.
4269 - A Resolution of the City Council of the City of Vernon,
California, requesting the Workmen's Compensation Appeals Board of
the State of California to determine the eligibility for retirement
of a local safety member (Orner C. Sherwood). No determination has
been made.
Discussion was held with reference to disability retirement
application filed by Orner C. Sherwood. The City Council reviewed
the medical records of Policeman Orner C. Sherwood.
Resolution No. 4303 - A Resolution of the City Council of
the City of Vernon, California, pursuant to Section 21023.6, Govern-
ment Code of the State of California (Orner C. Sherwood), was presented.
It was moved by Ybarra, seconded by Kaeser, that Resolution
No. 4303 be approved and adopted. Motion carried.

''Warrant Register No. 419" covering claims and demands
presented during the period December 1 to 15, which includes Demands
Nos. 4-3011 to 4-3179 (both inclusive), drawn on the United California
Bank, totaling $2,807,838.24 (Light and Power Warrants $2,566,479.15)
(Accounting Period December 1974), was examined and audited.
It was moved by Gonzales, seconded by Ybarra, that ''Warrant
Register No. 419" be approved and payment authorized for Demands Nos.
4-3011 to 4-3179 (both inclusive), with no exceptions. Motion
carried.

"Payroll Warrant Register No. 209" covering claims and
demands presented during the period November 1 to 30, which includes
Demands Nos. 2191 to 2199 (both inclusive), drawn on the Crocker
National Bank, totaling $406,390.73 (Accounting Period November
1974), was examined and audited.
It was moved by Gonzales, seconded by Ybarra, that "Payroll
Warrant Register No. 209" be approved and payment authorized for
Demands Nos. 2191 to 2199 (both inclusive), with no exceptions.
Motion carried.

Communication from F. H. Colvin, Fire Chief, dated December
12, 1974, advising that in conformance with the Fair Labor Standards
Amendments of 1974, the Vernon Fire Department will adopt, for sworn
personnel, a twenty-eight (28) day work cycle, commencing 0730 hours
on January 1, 1975; and suggesting that sworn personnel holding the
rank of Fire Captain and above be excluded from coverage of the Fair
Labor Standards Act, except the time and one-half provision for wages,
was presented. (Copy to each member of the City Council)
It was moved by McCormick, seconded by Kaeser, that the
work cycle proposed in communication from the Fire Chief, dated
December 12, 1974, be approved. Motion carried.
Discussion was held with reference to the suggestion of the
Fire Chief that sworn personnel holding the rank of Fire Captain and
above be excluded from coverage of the Fair Labor Standards Act,
except the time and one-half provision for wages.
It was moved by Kaeser, seconded by McCormick, that the
suggestion of the Fire Chief that sworn personnel holding the rank
of Fire Captain and above be excluded from coverage of the Fair

wages, be referred to the Finance Committee for study and recom-
mendation. Motion carried.
Communication from S. E. Hogan, Police Chief, dated December
17, 1974, advising that in accordance with the requirements of the
Fair Labor Standards Act's Amendments of 1974, he recommends that the
work week of all sworn employees under the jurisdiction of the Police
Department be established as 12:01 A.M. Sunday to 12:00 Midnight
Saturday; and that a seven day work cycle be adopted, was presented.
It was moved by McCormick, seconded by Ybarra, that the
recommendation of the Police Chief, dated December 17, 1974, be
approved. Motion carried.
Resolution No. 4301 - A Resolution of the City Council of
the City of Vernon detaching certain territory from the Southeast
Mosquito Abatement District, was presented.
It was moved by Gonzales, seconded by Kaeser, that
Resolution No. 4301 be approved and adopted. Motion carried.

Resolution No. 4299 - A Resolution of the City Council of
the City of Vernon granting a zoning variance for Grant Oil Tool
Company, was presented.
It was moved by McCormick, seconded by Kaeser, that
Resolution No. 4299 be approved and adopted. Motion carried.

Resolution No. 4300 - A Resolution of the City Council of
the City of Vernon expressing its condolences upon the death of
Robert H. Bockhacker, Police Chief of the City of Vernon, and
expressing its appreciation for his devoted work as a member of the
Vernon Police Department, was presented.
