19750617 Regular City Council Meeting - Minutes 661. MINUTES OF THE HEARING OF THE CITY COUNCIL SITTING AS A PLANNING COMMISSION HELD AT 1:15 P.M. ON TUESDAY, JUNE 17, 1975, IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA FOR THE PURPOSE OF DETERMINING WHETHER OR NOT ORDINANCE NO. 856 OF THE CITY OF VERNON SHALL BE ADOPTED TO REZONE SAID CITY. PLANNING COMMISSION PRESENT: Gonzales, Malburg, McCormick, Ybarra PLANNING COMMISSION ABSENT: Kaeser The hearing was called to order by Chairman Malburg. I The City stated that this was the time and place for the hearing of the City Council sitting as a Planning Commission of the City of Vernon, pursuant to Resolution No. 4336, to de- termine whether to adopt, reject or modify proposed Ordinance No. 856. , The City Clerk reported that Notice of Hearing was posted in accordance with Section 65854 (b) of the Government Code of the State of California; and presented Affidavit that Notice of Hearing was posted on May 21, 1975. Chairman Malburg asked if any written communications had been received relative to this matter. The City Clerk reported that no written communications had been received relative to this matter. Chairman Malburg asked if anyone wished to make an oral comment with reference to proposed Ordinance No. 856. No one responded. I After discussion it was moved by Gonzales, seconded by McCormick, that the Planning Commission approve the adoption of Ordinance No. 856 as presented and make a determination that Ordinance No. 856 will not have a significant effect on the environ- ment; and that the Planning Commission recommend that the City Council approve the adoption of Ordinance No. 856 and make a de- termination that Ordinance No. 856 will not have a significant effect on the environment. Motion carried. Ayes: Gonzales, Malburg, McCormick, Ybarr~ Noes: None Absent: Kaeser Resolution No. 4342 - A Resolution of the City Council of the City of Vernon sitting as a Planning Commission recommending that proposed Ordinance No. 856 be adopted to be consistent with the General Plan and making a determination that said ordinance will not have a significant effect on the environment, was pre- sented. It was moved by Ybarra, seconded by McCormick, that Resolution No. 4342 be approved and adopted. Motion carried. COUNCIL PRESENT: Gonzales, Kaeser, Malburg, McCormick, Ybarra COUNCIL ABSENT: None I The meeting was called to order by Mayor Leonis C, Malburg, It was moved by McCormick, seconded by Kaeser, that minutes of the meeting of June 3, 1975 be approved as written and submitted, Motion carried, The Clerk announced that this was the time and place for opening of bids received for one dump truck in accordance with Contract No, 390, It was moved by Gonzales, seconded by Ybarra, that the Clerk be instructed to open and read the bids submitted. Motion carried, The Clerk opened and read the following bids: Park Ford Automotive, Inc, Alameda Ford Truck Sales, Inc. Maurice J. Sopp & Son (1975 Model) Maurice J. Sopp & Son (1976 Model) Muller Chevrolet $ 11,750,38 14,564,56 14,318.95 15, 411. 60 13,257,91 It was moved by McCormick, seconded by Ybarra, that bids received for one dump truck, in accordance with Contract No. 390, be referred to the Director of Public Works and the City Attorney for checking and report. Motion carried. . Communication from Aluminum Company of America, dated June 4, 1975, requesting that the City Council reconsider the action it took at the meeting of April 1, 1975, in rejecting the renewal of the permit for their Office Trailer Unit No, 1, for the reasons as outlined; and requesting that the deliberations include Units Nos. 7 and 8 expiring on August 31, 1975, as the decision on Unit No. 1 will affect the use of these units, was presented, (Copy to each member of the City Council) . I Mr, J, R, Jones, Engineering Manager, Aluminum Company of America, appeared before the City Council to elaborate on the communication from the Aluminum Company of America, dated June 4, 1975; and to answer any questions relative to this matter, After discussion, it was moved by McCormick, s~conded by Ybarra, that the Building Department be authorized to issue commercial coach renewal permits for a one year extension from September 1, 1975 to Aluminum Company of America for use of the office trailers designated as Units Nos, 1, 7 and 8. Motion carried. Claim for Damages of Dow Chemical Company (Charles A, Ashburn), dated June 2, 1975, against the City of Vernon, was pre~ented, (Copy to each member of the City Council) 663 I I -2- 6 17 75 The City Clerk advised that he had received written notification from Harbor Insurance Company, the City's insurance carrier, that the claim has been settled and no further action is required on the part of the City. It was moved by Gonzales, seconded by Ybarra, that the Claim for Damages of Dow Chemical Company (Charles A, Ashburn), dated June 2, 1975, against the City of Vernon, be referred to Harbor Insurance Company, Motion carried. Communication was presented from S. E, Hogan, Police Chief, dated June 4, 1975, requesting that the following be advanced as indicated effective July 1, 1975: L, W. Stone to Policeman, Grade 1 D. W, Green to Policeman, Grade 2 It was moved by Kaeser, seconded by McCormick, that the request of Police Chief, dated June 4, 1975, be approved, Motion carried, Communication from A. E, Nelson, Jr" Director of Public Works dated June 4, 1975, requesting authority to advance ~onald Lee Anderson to Utility Man IV, Step 4, effective July 1, 1975, waspresented, It was moved by Kaeser, seconded by McCormick that the request of the Director of Public Works, dated June 4, 1975, be approved, Motion carried. Communication from A, E, Nelson, Jr" Director of Public Works, dated June 4, 1975, requesting authority to employ Richard J, Venezia, as Utility Man IV, Step 5, for a temporary period from approximately June 25, 1975 through September 30, 1975, was presented, " It was moved by Ybarra, seconded by Kaeser, that the request of the Director of Public Works, dated June 4, 1975, be approved, Motion carried. Communication from the County of Los Angeles, Road Department, dated June 3, 1975, with reference to proposed installation of illuminated street name signs at Downey Road and Fruitland Avenue, requeSting the City Council to take certain action, was presented, (Copy to each member of the City Counc ill Resolution No, 4341 - A Resolution of the City Council of the City of Vernon, California, consenting to establishment of portions of Downey Road and Fruitland Avenue within said City as apart of the System of County High- ways of the County of Los Angeles, was presented, It was moved by McCormick, seconded by Gonzales, that Resolution No, 4341 be approved and adopted, Motion carried, Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: None Absent: ~.<me Communication from A, E. E, Nelson, Jr., Director of Public Works, dated June 6, 1975, transmitting a proposed agreement prepared by The Atchison, Topeka and Santa Fe Railway Company cpvering the installation of two No, 8A flashing light signals on 22 -foot cantilevers at Pacific Boulevard Crossing No, 2H-1. 35-C at 46th Street intersection; and recommending that the agreement be approved and the Mayor and the City Clerk be authorized to execute the document, was presented, It was moved by Kaeser, seconded by McCormick, that the recom- mendation of the Director of Public Works, dated June 6, 1975, be approved; and that the Mayor and the City Clerk be authorized to execute Agreement between The Atchison, Topeka and Santa Fe Railway Company and the City of Vernon covering the installation of two No, 8A flashing light Signals at Pacific Boulevard Crossing No, 2H-1. 35..;C at 46th Street intersection, Motion carried, Communication from Lillian S. Lewicki, dated June 9, 1975, tendering her resignation effective at the close of the business day, July 8, 1975, was presented, It was moved by Gonzales, seconded by Ybarra, that the resignation of Lillian S. Nelson, Jr., Director of Public Works, dated June 12, 1975, requesting authority to advance certain personnel as indicated effective July 1, 1975, was presented, (Copy to each member of the City Council) It was mo.-ed by Ybarra, seconded by Kaeser, that the request of the Director of Public Works, dated June 12, 1975, be approved. Motion carried. Report of Health Department Activities for the month of May, 1975, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Ybarra, that Report of Health Department Activities be received and filed. Motion carried. ''Warrant Register No. 431" covering claims and demands presented during the period June 1 to 15, which includes Demands Nos. 5-1356 to 5-1537 (both inclusive) drawn on the United California Bank, totaling $2,948,018.96 (Light and Power Warrants $2,774,455. 75) (Accounting Period June 1975) was examined and audited, It was moved by ~onzales, seconded by Ybarra, that "Warrant Register No. 431" be approved and payment authorized for Demands Nos. 5-1356 to 5-1537 (both inclusive), with no exceptions. Motion carried. Bank, totaling $409, 306. 58 (Accounting Period May, 1975), was examined and audited. It was moved by Gonzales, seconded by Ybarra, thatl'tPayroll Warrant Register No. 215" be approved and payment authorized for Demands Nos. 2250 to 2258 (both inclusive), with no exceptions. Baker be authorized to atte:nd a California Department of Justice "Specialized Surveillance Equipment" course in Broderick, California on July 1, 2 and 3, 1975, with an expense allowance of $154.00, was presented. It was moved by Kaeser, seconded by McCormick that the request of the Police Chief, dated June 13, 1975, Qe approved and authority granted to issue warrant tIt the amount of $154. 00 toB. G. Baker. Motion carried. Resolution No. 4342 - A Resolution of the City Council of the City of Vernon sitting as a Planning Commission recommending that proposed Ordinance No. 856 be adopted to be consistent with the General Plan and making a determination that said ordinance will not have a significant effect on the environment, was presented. 666 I -5- 6 17 75 Ordtnanee No. 856 - An Ordinance of the City of Vernon establishing zoning districts in the City. of Vernon, California, and regulating and restricting use of land and buildings, height of buildings, open spaces and the location of buildings and improvements on land, adopting a map showing said zoning districts, defining the terms used in the ordinance, providing for its adjustment, amendment, and enforcement, prescribing penalties for violations and repealing Ordinances 541, 578, 594, 640 and 752 and all ordinances in conflict herewith, was read by title for a first reading, It was moved by McCormick, seconded by Gonzales, that Ordinance No. 856 receive and pass a first reading. Motion carried. Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: None Absent: None The City Clerk-Director of Finance made an oral request to employ a Secretary on a temporary basis until a permanent replacement can be recruited to replace Lillian S. Lewicki. It was moved by Kaeser, seconded by Ybarra, that the oral request of the City Clerk-Director of Finance be approved. Motion carried. Discussion was held with reference to Agreement between the City of Vernon and Los Angeles County Fire Protection District for Automatic First- Alarm assignments in all cities of the Area ''Eu mutual aid area, except for the City of Commerce, which was approved by the City Council at its meeting held June 3, 1975. It was moved by Ybarra, seconded by Kaeser , that the City Clerk and the Fire Chief be instructed not to forward said Agreement until so instructed by the City COUIlcil. Motion carried.. The Mayor called the City Council into Executive Session at 3:10 o'clock p. m. pursuant to Government Code Section 54957. 6 for the purpose of reviewing with the City Attorney the requests of the recognized units of the Fire and Police Departments relative to salaries, salary schedules and compensation paid in the form of benefits; and for the purpose of instructing the Ciwrelative to these requests. Attorne~ All the persons with the exception of the City Clerk, City Attorney and the Police Chief, were excluded from the Executive Session. Mayor Malburg ordered that communications to and from the Executive Session were. deemed private. The Executive Session ended at 3 :28 o'clock p. m. It was moved by McCormick, seconded by Ybarra, that the meeting adjourn until Thursday, June 26, 1975, at 2:00 o'clock p. m., in the Council Chamber of the City Hall located at 4305 Santa Fe Avenue, Vernon, California.
