MINUTES OF A REGULAR MEETING
OF THE CITY COUNCIL OF THE
CITY OF VERNON HELD NOVEMBER
18, 1975, AT TWO O'CLOCK P.M.
IN THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305 SANTA
FE AVENUE. VERNON. CALIFORNIA

The meeting was called to order by Mayor Pro Tempore
It was moved by McCormick, seconded by Kaeser, that
minutes of the meeting of November 4, 1975, be approved as writ-
ten and submitted. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated November 13, 1975, transmitting Addendum No. 1 to
Contract No. 397; and recommending that this Addendum be approved
prior to the opening of bids, was presented. (Copy to each member
of the City Council)
Resolution No. 4368 - A Resolution of the City Council
of the City of Vernon, Approving Addendum No. 1 to Contract No.
397 for Washington Boulevard and Alameda Street Resurfacing and
Amending Resolution No. 4365 of the City of Vernon, was presented.
It was moved by Gonzales, seconded by McCormick, that
Resolution No. 4368 be approved and adopted. Motion carried.

The Clerk announced that this was the time and place for
opening of bids received for Traffic Signal Modernization in accord-
ance with Contract No. 395.
It was moved by McCormick, seconded by Gonzales, that
the Clerk be instructed to open and read the bids submitted.
Motion carried.
The Clerk opened and read the following bids:

Traffic Signal Modernization in accordance with Contract
be referred to the Director of Public Works and the City
for checking and report. Motion carried.

At this time, 2:07 o'clock p.m., Mayor Malburg arrived
and took his seat at the Council table.
The Clerk announced that this was the time and place
for opening of bids received for Washington Boulevard and Alameda
Street Resurfacing in accordance with Contract No. 397.
It was moved by Ybarra, seconded by Gonzales, that the
Clerk be instructed to open and read the bids submitted. Motion
carried.
The Clerk opened and read the following bids:

It was moved by McCormick, seconded by Gonzales, that
the bids received for Washington Boulevard and Alameda Street
Resurfacing in accordance with Contract No. 397, be referred to
the Director of Public Works and the City Attorney for checking
and report. Motion carried.
It was moved by Kaeser, seconded by McCormick, that
Ordinance No. 861 receive a second reading by title. Motion
carried.
Ordinance No. 861 - An Ordinance of the City of Vernon,
Amending The Code of the City of Vernon, California, 1959, by
Amending Sections 25.l, 25.2, 25.3, 25.5, 25.6 and 25.8 of Said
Code, Establishing Rates for the Sale of Water in Said City and
Repealing all Ordinances in Conflict Therein, was read for a
second reading by title. (Copy to each member of the City Council)
It was moved by Gonzales, seconded by Ybarra, that
Ordinance No. 861 receive and pass a second reading. Motion
carried.

It was moved by McCormick, seconded by Kaeser, that in
accordance with Government Code Section 36934, the reading of
Ordinance No. 861 in full be waived; and that Ordinance No. 861

Communication from the County of Los Angeles, Department
of Urban Affairs, dated October 29, 1975, with reference to Board
of Supervisors action of October 7 and October 21 Re city partici-
pation in the "Urban County" Housing and Community Development
Program for 1976-77, was presented. (Copy to each member of the
City Council)
It was moved by Gonzales, seconded by Kaeser, that the
County of Los Angeles, Department of Urban Affairs be notified
that the City of Vernon does not wish to participate in the "Urban
County" Housing and Community Development Program for 1976-77.

Communication from F. H. Colvin, Fire Chief, dated
November 5, 1975, requesting that Captains G. S. Eystad, L. M.
Jackson and L. D. Schultz, be authorized to attend a Defensive
Driving Course at Los Angeles on November 25 and 26, 1975, with
an expense allowance of $50.00 each, was presented.
It was moved by McCormick, seconded by Kaeser, that the
request of the Fire Chief, dated November 5, 1975, be approved and
authority granted to issue warrants in the amount of $50.00 each
to G. S. Eystad, L. M. Jackson and L. D. Schultz. Motion carried.
Communication from F. A. Ziemer, City Clerk-Director of
Finance, dated November 6, 1975, recommending that certain person-
nel as indicated be reclassified effective December 1, 1975, was
presented. (Copy to each member of the City Council)
It was moved by Kaeser, seconded by Gonzales, that the
recommendation of the City Clerk-Director of Finance, dated Nov-
ember 6, 1975, be approved. Motion carried.
Summons on First Amended Cross-Complaint in connection
with Case No. C 47303 filed in the Superior Court of the State of
California, for the County of Los Angeles, for indemnity and equi-
table contribution and declaratory relief; (Cross-Complainant: G.
J. Payne Company, Inc., a Corporation; Cross-Defendants: Jack T.
Craig, Market Basket, Inc., City of Vernon, a Municipal Corporation,
Frank C. Camino, Roes I to XX), was presented.
It was moved by Gonzales, seconded by Kaeser, that Summons
on First Amended Cross-Complaint in connection with Case No. C47303
filed in the Superior Court of the State of California, for the
County of Los Angeles, for indemnity and equitable contribution and
declaratory relief, be referred to the City Attorney and the City's
insurance carrier for necessary action. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated November 7, 1975, transmitting an Easement Assignment
from Saxony Products, Inc. to Edward and Rita Shamie; and recommend-
ing that the Assignment be approved, was presented.
It was moved by Kaeser, seconded by Ybarra, that the
Mayor and the City Clerk be authorized to execute Easement Assign-
ment from Saxony Products, Inc., to Edward and Rita Shamie. Motion
carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated November 6, 1975, advising that Koebig and Koebig, Inc.
has completed its contract for planning services with the City by
delivery of a loose leaf binder entitled "VERNON, GENERAL PLAN, AN
INDUSTRIAL CITY"; and recommending that copies be distributed as
shown on the enclosure, that copies of individual elements be dis-
tributed as requested by other governmental agencies and that the
remainder of the copies be available for sale at a cost of fifty
dollars ($50.00) each, was presented. (Copy to each member of the

It was moved by Ybarra, seconded by McCormick, that the
recommendation of the Director of Public Works, dated November 6,
1975, be approved. Motion carried.
Communicaticn from F. H. Colvin, Fire Chief, dated Nov-
ember 12, 1975, recommending that Donald E. Pod1as be advanced from
Captain, Grade 2 to Grade 1, effective December 1, 1975, was
presented.
It was moved by Kaeser, seconded by McCormick, that the
request of the Fire Chief, dated November l2, 1975, be approved.
Motion carried.
Activity Log of the Police Department for the period
November 1 - 15, 1975, inclusive, was presented.
It was moved by Ybarra, seconded by Gonzales, that the
Activity Log of the Police Department for the period November 1 -
15, 1975, inclusive, be received and filed. Motion carried.
"Warrant Register No. 441" covering claims and demands
presented during the period November 1 to 15, which includes Demands
Nos. 5-2687 to 5-2865 (both inclusive) drawn on the United California
Bank, totaling $2,936,367.94 (Light and Power Warrants $2,687,436.36)
(Accounting Period November 1975), was examined and audited.
It was moved by Ybarra, seconded by Gonzales, that '~arrant
Register No. 441" be approved and payment authorized for Demands
Nos. 5-2687 to 5-2865 (both inclusive) with no exceptions. Motion
carried.

"Payroll Warrant Register No. 220" covering claims and
demands presented during the period October 1 to 3l, which includes
Demands Nos. 2304 to 2313 (both inclusive), drawn on the Crocker
National Bank, totaling $473,746.40 (Accounting Period October 1975),
was examined and audited.
It was moved by Ybarra, seqonded by Gonzales, that the
"Payroll Warrant Register No. 220" be approved and payments author-
ized for Demands Nos. 2304 to 2313 (both inclusive), with no excep-
tions. Motion carried.

Report of Health Department Activities for the month of
October, 1975, was presented. (Copy to each member of the City

It was moved by McCormick, seconded by Kaeser, that
report of Health Department Activities be received and filed.

At this time, 2:45 o'clock p.m., Councilman Ybarra was
excused from the meeting.
There being no further business to come before the meet-
ing, it was moved by McCormick, seconded by Kaeser, that the meeting
be adjourned. Motion carried.
