19760309 Regular City Council Meeting - Minutes MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD MARCH 9, 1976, AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA I COUNCIL PRESENT: Gonzales, Kaeser, Malburg, Ybarra COUNCIL ABSENT: McCormick The meeting was called to order by Mayor Leonis C. Malburg. It was moved by Ybarra, seconded by Gonzales, that minutes of the meeting of March 2, 1976, be approved as writ- ten and submitted. Motion carried. Pursuant to Resolution No. 4383, the City Clerk pre- sented his "Certificate of Canvass" of the results of the regular General Municipal Election held March 2, 1976. (Copy to each member of the City Council) Resolution No. 4394 - A Resolution of the City Council of the City of Vernon, California, reciting the fact of the General Municipal Election held in said City of Vernon on the 2nd day of March, 1976, declaring the result thereof and such other matters as are provided by law, was presented. It was moved by Ybarra, seconded by Kaeser, that Resolution No. 4394 be approved and adopted. Motion carried. Ayes: Gonzales, Kaeser, Malburg, Ybarra Noe s : None Absent: McCormick The City Clerk issued Certificates of Election to Keith K. Kaeser and Hilario Gonzales and administered the Oath of Office prescribed in the State Constitution to the duly elected members of the City Council. I The election was held for the purpose of electing the following officers of said City as required by the law relating to cities in the State of California, to wit: Two (2) Members of the City Council of said City for the full term of four years. The total number of votes cast in the City was forty- nine (49), and the number of precincts used in said election was one (1). The names of the persons voted for at said election for Members of the City Council of said City were as follows: 090 -2- 3-9-76 Keith K. Kaeser Hilario Gonzales The votes cast for the two (2) offices of City Council for the full term of four (4) years in the entire City (Precinct #1), were as follows: I Keith K. Kaeser Hilario Gonzales 49 48 The Clerk announced that this was the time for the selection of the Mayor. Upon motion of Ybarra, seconded by Kaeser, Leonis C. Malburg was elected as Mayor. Motion carried. Ayes: Gonzales, Kaeser, Malburg, Ybarra Noe s : None Absent: McCormick The Mayor announced that this was the time for the selection of a Mayor Pro Tempore. Upon motion of Gonzales, seconded by Kaeser, Thomas A. Ybarra was elected as Mayor Pro Tempore. Motion carried. Ayes: Gonzales, Kaeser, Malburg, Ybarra Noe s : None Absent: McCormick Mayor Malburg then appointed the following Committees until further order of the Chair: Finance Committee Malburg, Gonzales and Ybarra Fire and Police Committee Malburg, McCormick and Ybarra It was moved by Ybarra, seconded by Kaeser, that the Committees appointed by the Mayor be approved. Motion carried. Ayes: Gonzales, Kaeser, Malburg, Ybarra Noe s : None Absent: McCormick Communication from Vincent Salerno, Utility Man, dated March 1, 1976, requesting permission to lease a City-owned two- bedroom house or apartment as soon as one becomes available, was presented. Communication from A. E. Nelson, Jr., Director of Public Works, dated March 3, 1976, recommending that the request of Mr. Vincent Salerno, Utility Man, for City housing be granted, was presented. (Copy to each member of the City Council) 091 -3- 3-9-76 It was moved by Kaeser, seconded by Gonzales, that communication from Mr. Vincent Salerno, dated March 1, 1976, and communication from the Director of Public Works, dated March 3, 1976, be received and filed for future consideration. Motion carried. I Communication from S. E. Hogan, Police Chief, dated March 3, 1976, requesting authority for Lt. G. W. Wilcox and Sgt. F. E. Sweeney to attend the 4th Annual "California Narcotic Intelligence Network" Training Conference at Monterey, California, from April 20 to 23, 1976, with an expense allowance of $283.70 each, was presented. It was moved by Kaeser, seconded by Ybarra, that the request of the Police Chief, dated March 3, 1976, be approved and authority granted to issue warrants in the amount of $293.70 each to G. W. Wilcox and F. E. Sweeney. Motion carried. Communication from S. E. Hogan, Police Chief, dated March 3, 1976, advising that officer A. W. Tortoriello has been terminated as of the close of business on March 19, 1976, for violations of Manual of Policy and Ethics Codes 400.01; 400.37; 400.38; 400.52; and 400.03A, was presented. It was moved by Kaeser, seconded by Ybarra, that the action taken by the Police Chief be approved. Motion carried. Communication from S. E. Hogan, Police Chief, dated March 3, 1976, requesting that Officer Robert F. D'Alessandro be granted permission to attend School Resources Officers' Course at the Center for Criminal Justice, California State Uni- vers ity, Long Beach, Cal ifornia, from April 27 to 29, 1976, at a total cost of $132.50, was presented. I It was moved by Ybarra, seconded by Kaeser, that the request of the Police Chief, dated March 3, 1976, be approved; that authority be granted to issue warrant in the amount of $104.00 to California State University, Long Beach Foundation, Inc.; and that authority be granted to issue warrant in the amount of $28.50 to R. F. D'Alessandro. Motion carried. Communication from the County of Los Angeles, Office of the District Attorney, dated February 26, 1976, requesting the City Council to adopt a resolution supporting AB 3121 (Juve- nile Justice Legislation), was presented. (Copy to each member of the City Council) It was moved by Gonzales, seconded by Ybarra, that the City Attorney be instructed to draft a Resolution supparting AB 3121 (Juvenile Justice Legislation). Pluhar, Utility Man, dated March 2, 1976, requesting that he be reimbursed the sum of $6.36 from the Education and Training Budget appropriation for a text book for Water Hydraulics presented by Pasadena City College, was presented. Pluhar. by Kaeser, seconded Pluhar, dated March to issue warrant in Motion carried. by Ybarra, that the 2, 1976, be approved the amount of $6.36 Communication from A. E. Nelson, Jr., Director of Public Works, dated March 4, 1976, transmitting a fully executed Easement from Bank of America, et al., for a portion of 26th Street and Bandini Boulevard; and recommending that the Easement be accepted and the grantors be advised of the official recorda- tion, was presented. It was moved by Kaeser, seconded by Gonzales, that Easement be accepted from Bank of America, et al; and that the Mayor and the City Clerk be authorized to execute Certificate of Acceptance. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated March 4, 1976, requesting authority for Henry Vasquez to attend a Seminar on Maintenance of Commercial Vehicles in Los Angeles from AprilS to 9, 1976, with an expense allowance of $170.00, was presented. It was moved by Kaeser, seconded by Ybarra, that the request of the Director of Public Works, dated March 4, 1976, be approved and authority granted to issue warrant in the amount of $170.00 to Henry Vasquez. Motion carried. I Summons in connection with Case No. 44106 N filed in the Municipal Court of California, County of Los Angeles, South- east Judicial District, filed by Continental Truck & Towing Co., Inc., a California Corporation, vs. City of Vernon, a Government- al entity; City of Vernon, a Municipal Corporation; Richard Adams; Does 1 through 50, inclusive, Complaint for Negligence (Property Damage), was presented. It was moved by Ybarra, seconded by Gonzales, that Summons in connection with Case No. 44106 N filed in the Munici- pal Court of California, County of Los Angeles, Southeast Judicial District, filed by Continental Truck & Towing Co., Inc., a California Corporation, vs. City of Vernon, a Governmental entity; City of Vernon, a Municipal Corporation; Richard Adams; Does 1 through 50, inclusive, Complaint for Negligence (Property Damage), be referred to the City's insurance carrier and the City Attorney for necessary action. I It was moved by Kaeser, seconded by Ybarra, that Ordinance No. 865 receive and pass a first reading. Motion carried.
