19760316 Regular City Council Meeting - Minutes I COUNCIL PRESENT: COUNCIL ABSENT: MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD MARCH 16, 1976, AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA Gonzales, Kaeser, Malburg, McCormick, Ybarra None Malburg. The meeting was called to order by Mayor Leonis C. It was moved by Ybarra, seconded by Gonzales, that the minutes of the meeting of March 9, 1976, be approved as written and submitted. Motion carried. It was moved by Kaeser, seconded by McCormick, that Ordinance No. 865 receive a second reading by title. Motion carried. Ordinance No. 865 - An Ordinance of the City of Vernon Amending The Code of the City of Vernon, 1959, was read for a second reading by title. (Copy to each member of the City Council) It was moved by Gonzales, seconded by Ybarra, that Ordinance No. 865 receive and pass a second reading. Motion carried. Ayes: Noe s : Absent: Gonzales, Kaeser, Malburg, McCormick, Ybarra None None It was moved by McCormick, seconded by Kaeser, that in accordance with Government Code Section 36934, the reading of Ordinance No. 865 in full be waived; and that Ordinance No. 865 receive a third and final reading by title. It was moved by Ybarra, seconded by Gonzales, that Ordinance No. 865 receive and pass a third reading and be adopted. Motion carried. Ayes: Noes: Absent: Gonzales, Kaeser, Malburg, McCormick, Ybarra None None 095 -2- 3-16-76 Communication from the Finance Committee, dated March 8, 1976, making a certain recommendation to the City Council, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Ybarra, that the recommendation of the Finance Committee be approved as outlined in communication dated March 8, 1976. Motion carried. I Communication from F. H. Colvin, Fire Chief, dated March 8, 1976, transmitting Specifications No. 402, Remodeling Kitchen at Fire Station No.1; and recommending that these specifications be approved and that authority be granted to advertise for bids, was presented. It was moved by Kaeser, seconded by Gonzales, that the City Attorney be instructed to draft a resolution approving Specifications No. 402, as may be amended, and authorizing notice inviting sealed proposals or bids for Remodeling Kitchen at Fire Station No.1 in accordance with Specifications No. 402. Motion carried. Communication from the Teamsters Local 911, not dated, advising that this letter is intended to serve as formal appeal on behalf of Police Officer Albert W. Tortoriello, Badge 4124, Serial Number 261, of the Vernon Police Department regarding his termination from the Vernon Police Department effective Wednesday, March 3, 1976, was presented. (Copy to each member of the City Council) It was moved by Gonzales, seconded by Ybarra, that com- munication from the Teamsters Local 911, with reference to Albert W. Tortoriello, be referred to Harry J. Keaton, Municipal Employ- ee Relations Representative, and the City Attorney to represent the City; and also to deny any recognition of the Teamsters Local 911, since the City presently recognizes the Vernon Police Officers' Benefit Association. Motion carried. I Communication from A. E. Nelson, Jr., Director of Public Works, dated March 9, 1976, with reference to the County of Los Angeles installing mast-arm mounted illuminated street name signs on Downey Road, recommending that the City Council, by Resolution, consent to the request for jurisdiction; and make a finding that this project has no significant effect on the environment and is categorically exempt from the requirement for an Environmental Impact Report, was presented. (Copy to each member of the City Council) Resolution No. 4396 - A Resolution of the City Counc},.l of the City of Vernon, California, Consenting to Establishment of Portions of Downey Road and Fruitland Avenue within said City as a Part of the System of County Highways of the County of Los Angeles, was presented. It was moved by Kaeser, seconded by Gonzales, that Resolution No. 4396 be approved and adopted. Motion carried. Ziemer, City Clerk-Director of Finance, dated March 10, 1976, requesting authority for Bruce V. Ma1kenhorst to attend the Ninth Biennial City Clerks' Institute at Monterey, California, from April 28 to 30, 1976, with an ex- pense allowance of $208.00, was presented. It was moved by Kaeser, seconded by Ybarra, that the request of the City Clerk-Director of Finance, dated March 10, 1976, be approved and authority granted to issue warrant in the amount of $208.00 to Bruce V. Ma1kenhorst. Motion carried. Report of Health Department Activities for the month of February, 1976, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Gonzales, that the Report of Health Department Activities be received and filed. Motion carried. Communication from S. E. Hogan, Police Chief, dated March 10, 1976, requesting that eertain personnel be reimbursed the sums as indicated from the Education and Training Budget appropriation, was presented. (Copy to each member of the City Council) It was moved by Kaeser, seconded by Gonzales, that the request of the Police Chief, dated March 10, 1976, be approved and authority granted to issue warrants in the amounts as indicated. Motion carried. Communication from S. E. Hogan, Police Chief, dated March 11, 1976, requesting that authority be granted to employ Mr. Scott Alan Miedecke as Cadet, Grade 4, effective April 1, 1976, pending outcome of his background investigation, was pre- sented. I It was moved by Ybarra, seconded by Kaeser, that the request of the Police Chief, dated March 1t, 1976, be approved. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated March 11, 1976, requesting authority for Raymond R. Rich to attend the California Water Pollution Controls Association 48th Annual Conference at South Lake Tahoe from April 14 to 17, 1976, with an expense allowance of $289.80, was presented. It was moved by Gonzales, seconded by Ybarra, that the request of the Director of Public Works, dated March 11, 1976, be approved and authority granted to issue warrant in the amount of $289.80 to Raymond R. Nelson, Jr., Director of Public Works, dated March 10, 1976, transmitting Contract No. 398, Traf- fic Signal Installation, Atlantic Boulevard and District Boulevard; and recommending that this contract be approved and that authority be granted to advertise for bids, was presented. I Resolution No. 4393 - A Resolution of the City Council of the City of Vernon Approving Contract No. 398 and Authorizing Notice Inviting Sealed Proposals or Bids for Traffic Signal In- stallation, Atlantic Boulevard and District Boulevard in Accord- ance with Contract No. 398 of the City of Vernon, was presented. It was moved by Ybarra, seconded by Gonzales, that Resolution No. 4393 be approved and adopted. Motion carried. It was moved by Gonzales, seconded by McCormick, that the Activity Log of the Police Department be received and filed. Motion carried. Communication from Edward L. Saenz, Utility Man, dated March 11, 1976, requesting that he be reimbursed the sum of $9.55 from the Education and Training Budget appropriation for a course in Modern Water Works, was presented. It was moved by Kaeser, seconded by Ybarra, that the re- quest of Edward L. Saenz, dated March 11, 1976, be approved and authority granted to issue warrant in the amount of $9.55 to Edward L. Saenz. Motion carried. Communication from H. K. Santoorgian, representing Harbor Insurance Company, dated March 11, 1976, advising that Claim from the Interinsurance Exchange of the Automobile Club of Southern California, dated February 26, 1976, Subrogee of H. P. Cobbs, should be rejected, was presented. I It was moved by Kaeser, seconded by Ybarra, that Claim from the Interinsurance Exchange of the Automobile Club of Southern California, dated February 26, 1976, Subrogee of H. P. Cobbs, be rejected. ''Warrant Register No. 449" covering claims and demands presented during the period March 1 to 15, which includes Demands Nos. 6-598 to 6-792 (both inclusive) drawn on the United Cali- fornia Bank, totaling $3,317,079.18 (Light and Power Warrants $3,074,244.40) (Accounting Period March 1976), was examined and audited. It was moved by Ybarra, seconded by Gonzales, that ''Warrant Register No. 449" be approved and payment authorized for Demands Nos. 6-598 to 6-792 (both inclusive), with no excep- tions. It was moved by Ybarra, seconded by Gonzales, that "Payroll Warrant Register No. 224" be approved and payments authorized for Demands Nos. 2343 to 2351 (both inclusive), with no exceptions.
