19760406 Regular City Council Meeting - Minutes MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD APRIL 6, 1976, AT TWO O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA COUNCIL PRESENT: Gonzales, Kaeser, Malburg, McCormick, Ybarra COUNCIL ABSENT: None Malburg. The meeting was called to order by Mayor Leonis C. It was moved by Gonzales, seconded by Ybarra, that the minutes of the meeting of March 16, 1976, be approved as written and submitted. Motion carried. The Clerk announced that this was the tfme and place for opening of bids received for Traffic Signal Installation, Atlantic Boulevard and District Boulevard, in accordance with Contract No. 398. It was moved by McCormick, seconded by Kaeser, that the Clerk be instructed to open and read the bids submitted. Motion carr ied . The Clerk opened and read the following bids: 1. Signal Maintenance, Inc. 2. Steiny and Company, Inc. 3. Trend Equipment Corp. 4. Sherwin Electric Service 5. Phoenix Electrical Service Co., Inc. 6. C. T. & F., Inc. $ 25,106.56 17,401.00 21,137.00 18,694.00 18,850.00 18,379.00 It was moved by McCormick, seconded by Ybarra, that bids received for Traffic Signal Installation, Atlantic Boulevard and District Boulevard in accordance with Contract No. 398, be refer- red to the Department of Public Works and the City Attorney for checking and report. Motion carried. Communication from Mr. Vaughn Beck, Plant Manager of Vernon Meatland, Inc., dated March 31, 1976, advising that he would like to appear before the City Council on April 6, 1976, to request permission to use the west five feet of the twelve foot sidewalk. on Soto Street for approximately sixty feet, subject to usual compliance with Vernon Encroachment Ordinances, was present- ed. (Copy to each member of the City Council) Mr. Vaughn Beck, Plant Manager of Vernon Meatland, Inc., appeared before the City Council and elaborated on his letter dated March 31, 1976. :100 -2- 4-6-76 After discussion, it was moved by Gonzales, seconded by Kaeser, that communication from Vernon Meat1and, Inc., dated March 31, 1976, be referred to the Director of Public Works for study and report. Motion carried. I Communication from A. E. Nelson, Jr., Director of Public Works, dated March 16, 1976, advising that C. T. & F., Inc., has completed the work on Traffic Signal Modernization in accordance with Contract No. 395; and recommending that the work be accepted and that authority be granted to pay the contractor in accordance with the agreement, was presented. Resolution No. 4397 - A Resolution of the City Council of the City of Vernon Accepting the Work of C. T. & F., Inc., for Traffic Signal Modernization, in Accordance with Contract No. 395 of the City of Vernon, was presented. It was moved by Kaeser, seconded by Gonzales, that Resolution No. 4397 be approved and adopted. Motion carried. Tortoriello, Badge 124, Serial Number 261, of the Vernon Police Department regarding his termination from the Vernon Police Department effective Wednesday, March 3, 1976, was presented. (Copy to each member of the City Council) Communication from the Law Offices of Stephen Warren Solomon, Inc., dated March 31, 1976, requesting that the hearing relative to Albert W. Tortoriello be continued to April 20, 1976, to allow them to have a full opportunity to prepare a defense, was presented. I It was moved by Gonzales, seconded by Ybarra, that the City Attorney be instructed to advise the Vernon Police Officers' Benefit Association, Mr. Albert W. Tortoriello and the Law Offices of Stephen Warren Solomon, Inc., that the continued date for the hearing of Albert W. Tortoriello will be April 20, 1976, at 2:00 o'clock p.m., or as soon thereafter as the matter may be heard, in the City Council Chamber of the City of Vernon, 4305 Santa Fe Avenue, Vernon, California. Motion carried. Communication from the Los Angeles Bureau of Municipal Research, dated March 18, 1976, relative to the 1975-76 Vernon Real Property Inventory, requesting the City to share one-half of the outside costs, was presented. (Copy to each member of the City Council) It was moved by Kaeser, seconded by Ybarra, that the request of the Los Angeles Bureau of Municipal Research, dated March 18, 1976, be denied. Motion carried. 1-0:1 -3- 4-6-76 Summons in connection with Case Number SEC 18214, filed in the Superior Court of the County of Los Angeles, Southeast District, by Donald E. Fisher vs. City of Vernon, Frank A. Ziemer, Leonis C. Malburg, Hilario Gonzales, Keith K. Kaeser, William M. McCormick, Thomas A. Ybarra and Does 1 through 10, inclusive, was presented. (Copy to each member of the City Council) I It was moved by McCormick, seconded by Kaeser, that Summons in connection with Case Number SEC 18214 filed in the Superior Court of the County of Los Angeles, Southeast District, by Donald E. Fisher vs. City of Vernon, et a1, be referred to the City Atto~ney and Attorney Harry J. Keaton, Municipal Employee Relations Representative for the City of Vernon, for necessary action. Motion carried. Communication from the Board of Supervisors, County of Los Angeles, dated March 19, 1976, advising that the existing agreements for either Maintenance of City Prisoners in County Jails and/or Hospitalization of City Prisoners with the City of Vernon is terminated effective June 30, 1976, was presented. (Copy to each member of the City Council) Ordinance No. 866 - An Ordinance of the City of Vernon Providing for the Confinement of its Prisoners in the County Jails and the Hospitalization of its Prisoners, where Necessary, was read by title for a first reading. It was moved by Kaeser, seconded by McCormick, that Ordinance No. 866 receive and pass a first reading. Motion carried. Council) I It was moved by McCormick, seconded by Kaeser, that communication from Silber, Benezra & Tas1itz, Attorneys at Law, dated March 18, 1976, be referred to the City Attorney and to Mr. Harry J. Keaton, Municipal Employee Relations Rep~esentative, for a legal opinion as to the merits and advisability and necessity, if any, to amend Resolution No. 4027; that Mr. Harry J. Keaton, Municipal Employee Relations Representative, be instructed to give notice to the Vernon Fire Fighters, Local 2312, that the City in- tends to implement new wage rates effective July 1, 1976; and that Mr. Harry J. Keaton,Municipa1 Employee Relations Representative, be instructed to give notice to the Vernon Fire Fighters, Local 2312, pursuant to Resolution No. 4027, that the City's representa- tives are ready to meet and confer on such changes. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated March 23, 1976, transmitting a summary of the major street projects anticipated for the next five years, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Gonzales, that a summary of the major street projects anticipated for the next five years be referred to the Finance Committee for study and report. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated March 24, 1976, transmitting a proposed License Agreement with Mobil Oil Corporation to maintain a private eight inch water line in the north side of 37th Street between Jewel Avenue and Soto Street; and recommending that the License Agree- ment be executed, was presented. It was moved by McCormick, seconded by Gonzales, that the recommendation of the Director of Public Works, dated March 24, 1976, be approved; and that the Mayor and the City Clerk be authorized to execute License Agreement between the City of Vernon and Mobil Oil Corporation. Motion carried. Communication from Policeman Gary M. Alverez, dated March 25, 1976, requesting that he be considered for the rental of a City-owned two bedroom apartment, was presented. It was moved by Kaeser, seconded by Gonzales, that the request of Policeman Gary M. Alverez, dated March 25, 1976, be received and filed for future consideration. Motion carried. Communication from S. E. Hogan, Police Chief, dated March 25, 1976, requesting authority for Sergeant Richard L. McBean to attend the 1976 National Cargo Security Conference at Washington D. C. from March 29 to April 1, 1976, with an expense allowance of $54.50, was presented. It was moved by Kaeser, seconded by Ybarra, that the request of the Police Chief, dated March 25, 1976, be approved and authority be granted to issue warrant in the amount of $54.50 to Richard L. McBean. Motion carried. Communication from F. H. Colvin, Fire Chief, dated March 19, 1976, transmitting Specifications No. 402 "Remodeling Kitchen at Fire Station 11"; and recommending that these specifications be approved and that authority be granted to advertise for bids, was presented. 1_03 -5- 4-6-76 Resolution No. 4399 - A Resolution of the City Council of the City of Vernon Approving Specifications No. 402 and Authorizing Notice Inviting Sealed Proposals or Bids for Remodel- ing the Kitchen at Fire Station 11, in Accordance with Specifica- tions No. 402 of the City of Vernon, was presented. It was moved by Ybarra, seconded by McCormick, that the recommendation of the Director of Public Works, dated March 29, 1976, be approved; and that the Mayor and the City Clerk be author- ized to execute License Agreement between the City of Vernon and Byron Jackson Pump, Division of Borg-Warner Corporation. Motion carried. Communication from C. E. Nemethi, M.D., Health Officer, dated March 29, 1976, requesting authority for Louis S. Hauger to attend the California Conference of Directors of Environmental Health at San Diego, California, from May 10 to 14, 1976, inclusive, with an expense allowance of $325.00, was presented. It was moved by Kaeser, seconded by Gonzales, that the request of the Health Officer, dated March 29, 1976, be approved and authority granted to issue warrant in the amount of $325.00 to Louis S. Hauger. Motion carried. Communication from S. E. Hogan, Police Chief, dated March 31, 1976, requesting that Officer R. D. Gott be reimbursed the sum of $36.03 from the Education and Training Budget appropriation for Police Science courses, was presented. I It was moved by Kaeser, seconded by Gonzales, that the request of the Police Chief, dated March 31, 1976, be approved and authority granted to issue warrant in the amount of $36.03 to R. D. Gott. It was moved by McCormick, seconded by Ybarra, that Activity Log of the Police Department be received and filed. Motion carried. :t04 I .1 -6- 4-6-76 ''Warrant Register No. 450" covering claims and demands presented during the period March 16 to 31, which includes Demands Nos. 6-793 to 6-892 (both inclusive) drawn on the United California Bank, totaling $95,082.20 (Light and Power Warrants $5,986.61) (Accounting Period April 1976), was examined and audited. It was moved by Ybarra, seconded by McCormick, that "Warrant Register No. 450" be approved and payment authorized for Demands Nos. 6-793 to 6-892 (both inclusive), with no excep- tions. It was moved by Kaeser, seconded by McCormick, that the request of the Director of Public Works, dated April 1, 1976, be approved and authority granted to issue warrant in the amount of $80.00 to Lewis R. It was moved by McCormick, seconded by Kaeser, that the request of the Police Chief, dated April 1, 1976, be approved; that authority be granted to issue warrant in the amount of $33.75 to Rio Hondo College; and that authority be granted to issue war- rants in the amount of $15.00 each to H.
