MINUTES OF A REGULAR MEETING
OF THE CITY COUNCIL OF THE
CITY OF VERNON HELD APRIL 20,
1976, AT TWO O'CLOCK P.M. IN
THE COUNCIL CHAMBER OF THE
CITY HALL LOCATED AT 4305
SANTA FE AVENUE, VERNON,
CALIFORNIA

The meeting was called to order by Mayor Leonis C.
Malburg.
It was moved by Ybarra, seconded by Kaeser, that the
minutes of the meeting of April 6, 1976, be approved as written
and submitted. Motion carried.
The Clerk announced that this was the time and place
for opening of bids received for furnishing Furniture and Acces-
sories for Vernon City Hall and Police Facility in accordance
with Contract No. 403.
It was moved by Gonzales, seconded by Kaeser, that the
Clerk be instructed to open and read the bids submitted. Motion
carried.
The Clerk opened and read the following bids:
1. Sam Yocum, Inc.
2. James Hill & Co., Inc.
3. United Desk Company

It was moved by Gonzales, seconded by Ybarra, that bids
received for furnishing Furniture and Accessories for Vernon
City Hall ,and Police Facility in accordance with Contract No.
403 be referred to the Director of Public Works and the City
Attorney for checking and report. Motion carried.

The Clerk announced that this was the time and place
for opening of bids received for Remodeling Kitchen at Fire
Station #1 in accordance with Specifications No. 402.
It was moved byGGonza1es, seconded by Kaeser, that the
Clerk be instructed to open and read the bids submitted. Motion
carried.
The Clerk opened and read the following bid:

It was moved by Ybarra, seconded by Kaeser, that bids
received for Remodeling Kitchen at Fire Station #1 in accordance
with Specifications No. 402, be referred to the Finance Committee
for study and report back. Motion carried.

Communication from the Law Offices of Stephen Warren
Solomon, Inc., dated April 15, 1976, requesting that the hear-
ing relative to Albert W. Tortoriello be continued to May 4,
1976, to allow them to complete the preparation for their client's
defense, was presented.

It was moved by Ybarra, seconded by Kaeser, that pursuant
to the request of the Law Offices of Stephen Warren Solomon, Inc.,
dated April 15, 1976, the hearing in the matter of Albert W.
Tortoriello regarding his discharge from the Vernon City Police
Department, be continued until May 4, 1976, at 2:00 o'clock p.m.,
or as soon thereafter as the matter may be heard, in the Council
Chamber of the City of Vernon, 4305 Santa Fe Avenue, Vernon,
California. Motion carried.
It was moved by Kaeser, seconded by Ybarra, that Ordi-
nance No. 866 receive a second reading by title. Motion carried.
Ordinance No. 866 - An Ordinance of the City of Vernon
Providing for the Confinement of its Prisoners in the County Jails
and the Hospitalization of its Prisoners, Where Necessary, was
read for a second reading by title. (Copy to each member of the
City Council)
It was moved by Gonzales, seconded by Ybarra, that Ordi-
nance No. 866 receive and pass a second reading. Motion carried.

It was moved by Kaeser, seconded by Ybarra, that in
accordance with Government Code Section 36934, the reading of
Ordinance No. 866 in full be waived; and that Ordinance No. 866
receive a third and final reading by title. Motion unanimously
carried.

It was moved by Kaeser, seconded by Ybarra, that the
recommendation of the Fire Chief, dated April 7, 1976, be approv-
ed. Motion carried.

Communication from S. E. Hogan, Police Chief, dated
April 13, 1976, requesting that certain personnel be re~bursed
the amounts as indicated from the Education and Training Budget
appropriation for Fo1ice Science courses, was presented.
It was moved by Gonzales, seconded by Kaeser, that the
request of the Police Chief, dated April 13, 1976, be approved
and authority granted to issue warrants in the amounts as indi-
cated. Motion carried.
Report of Health Department Activities for the month of
March, 1976, was presented. (Copy to each member of the City
Council)
It was moved by Ybarra, seconded by Gonzales, that
Report of Health Department Activities be received and filed.
Motion carried.
Communication was presented from S. E. Hogan, Police
Chief, dated April 13, 1976, requesting that the following per-
sonnel be promoted, effective May 1, 1976:
R. W. Mitchell to Policeman, Grade 1
R. L. Michalski to Policeman, Grade 2
F. C. Grant to Policeman, Grade 3
It was moved by Kaeser, seconded by Ybarra, that the
request of the Police Chief, dated April 13, 1976, be approved.
Motion carried.
Communications from M. T. Mello, Assistant Fire Chief,
dated April 12, 1976, requesting authority for R. Salisbury and
D. Kruse to attend the Mack Service Training School - Waterous
Pumps at Hayward, California, from April 2 to 9, 1976, with an
expense allowance of $258.40 each, was presented.

It was moved by Kaeser, seconded by Ybarra, that the
requests of the Assistant Fire Chief, dated April 12, 1976, be
approved and authority granted to issue warrants in the amount
of $258.40 each to R. Salisbury and D. Kruse. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated April 13, 1976, with reference to the request of
Vernon Meat1and, Inc. to use the west five feet of the twelve
foot sidewalk on Soto Street for approximately sixty feet, making
certain recommendations relative to this matter, was presented.

It was moved by Kaeser, seconded by Gonzales, that the
request of Vernon Meat1and, Inc. to use the west five feet of
the twelve foot sidewalk on Soto Street for approximately sixty
feet be denied; that Vernon Meat1and, Inc. be advised to proceed
with the relocation work without utilizing the street right-of-
way; that all work to change the cattle unloading facility be

done in accordance with City Code and Ordinance; and that the
cooperation of Vernon Meat1and, Inc. be solicited so that trucks
waiting to unload do not wait on Soto Street. Motion carried.

Communication from A. E. Nelson, Jr., Director of Public
Works, dated April 14, 1976, with reference to bids received for
.Traffic Signal Installation, Atlantic Boulevard and District
Boulevard, in accordance with Contract No. 398, recommending that
the contract be awarded to Steiny and Company on the basis of
their bid of $17,401.00, was presented.
Resolution No. 4403 - A Resolution of the City Council
of the City of Vernon Accepting the Bid of Steiny and Company,
for Traffic Signal Installation, Atlantic Boulevard and District
Boulevard, in Accordance with Contract No. 398 of the City of
Vernon, was presented.

Communication from A. E. Nelson, Jr., Director of Public
Works, and F. H. Colvin, Fire Chief, dated April 14, 1976, with
reference to request for variance to Uniform Building Code for a
proposed structure at 2626 East 26th Street, recommending approv-
al of the variance to Table 5-A and Section 2103 of the Uniform
Building Code to allow construction of a Type IV building, F-1
occupancy, at the proposed location without the use of fire-
resistive walls; and subject to certain other conditions as indi-
cated, was presented. (Copy to each member of the City Council)

It was moved by Kaeser, seconded by Gonzales, that B & M
Terminal Facilities be granted a variance to Table No. 5-A and
Section 2103 of the Uniform Building Code to allow construction
of a Type IV building, F-1 occupancy, at 2626 East 26th Street
without the use of fire-resistive walls, subject to the conditions
as stated in their letter to the Building Department, dated April
8, 1976; and subject to the necessary conditions in the issuance
of permits required to perform the work needed to make the struc-
ture suitable for its intended use. Motion carried.
Activity Log of the Po1fue Department for the period
April 1 - 15, 1976, inclusive, was presented.
It was moved by Ybarra, seconded by Kaeser, that Activity
Log of the Police Department be received and filed. Motion carried.
''Warrant Register No. 451" covering claims and demands
presented during the period April 1 to 15, which includes Demands
Nos. 6-893 to 6-1083 (both inclusive) drawn on the United California
Bank, totaling $3,297,117.84 (Light and Power Warrants $3,071,071.09)
(Accounting Period April 1976), was examined and audited.

It was moved by Ybarra, seconded by Gonzales, that
"Warrant Register No. 451" be approved and payment authorized
for Demands Nos. 6-893 to 6-1083 (both inclusive), with no ex-
ceptions. Motion carried.

"Payroll Warrant Register No. 225" covering claims and
demands presented during the period March 1 to 31, which includes
Demands Nos. 2352 to 2361 (both inclusive), drawn on the Crocker
National Bank, totaling $475,856.96 (Accounting Period March 1976)
was examined and audited.
It was moved by Ybarra, seconded by Gonzales, that
"Payroll Warrant Register No. 225" be approved and payment
authorized for Demands Nos. 2352 to 2361 (both inclusive), with
no exceptions. Motion carried.

destroyed in an automobile accident, recommending that a replace-
ment solid state controller cabinet be purchased and installed,

It was moved by Kaeser, seconded by Ybarra, that the
recommendation of the Director of Public Works, dated April 15,
1976, be approved. Motion carried.
Communicationsfrom F. H. Colvin, Fire Chief, dated April
15, 1976, requesting authority for himself and M. T. Mello to
attend the California Fire Chiefs Annual Conference at Burbank,
California, from May 24 to 29, 1976, with an expense allowance of
$125.00 each, was presented.

It was moved by Ybarra, seconded by Gonzales, that the
requests of the Fire Chief, dated April 15, 1976, be approved and
authority granted to issue warrants in the amount of $125.00 each
to F. H. Colvin and M. T. Mello. Motion carried.
Summons in connection with Case Number NEC 19259, filed
in the Superior Court of California, County of Los Angeles, by
Sergio Luna vs. City of Vernon, a Municipal Corporation; Does I
through XX, inclusive, for negligence - personal injuries _
damages, was presented.
It was moved byIKaeser, seconded by Ybarra, that Summons
in connection with Case Number NEC 19259, filed in the Superior
Court of California, County of Los Angeles, by Sergio Luna vs.
City of Vernon, a Municipal Corporation; Does I through XX, in-
clusive, for negligence - personal injuries - damages, be refer-
red to the City's insurance carrier and the City Attorney for nec-
essary action. Motion carried.
