The meeting was called to order by Mayor Leonis C.
Malburg.
It was moved by McCormick, seconded by Ybarra, that the
minutes of the meeting of April 20, 1976, be approved as written
and submitted. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated April 28, 1976, transmitting Addendum No. 1 to Con-
tract No. 401, Communications Equipment for Vernon City Hall and
Police Facility, prepared by Marion J. Varner and Associates; and
recommending that Addendum No. 1 to Contract No. 401 be approved
prior to the opening of bids, was presented.
Resolution No. 4406 - A Resolution of the City Council
of the City of Vernon Approving Addendum No. 1 to Contract No.
401 for Communications Equipment for the Vernon City Hall and
Police Facility and Amending Resolution No. 4401 of the City of
Vernon, was presented.
It was moved by McCormick, seconded by Gonzales, that
Resolution No. 4406 be approved and adopted. Motion carried.

opening of bids received for the furnishing of Communications
Equipment for the Vernon City Hall and Police Facility in accord-
ance with Contract No. 401.
It was moved by Ybarra, seconded by McCormick, that the
Clerk be instructed to open and read the bids submitted. Motion
carried.

It was moved by McCormick, seconded by Ybarra, that
the bids received for the furnishing of Communications Equipment
for the Vernon City Hall and Police Facility in accordance with
Contract No. 401 be referred to the Director of Public Works and
the City Attorney for checking and report. Motion carried.

Communication from Louis S. Hauger, Director of
Environmental Health, dated April 20, 1976, recommending that
the City Council approve the animal control program as outlined
in said communication and authorize the Department of Health and
Environmental Control to fully implement it on July 1, 1976, was
presented. (Copy to each member of the City Council)
It was moved by Gonzales, seconded by McCormick, that
the recommendation of the Director of Environmental Health, dated
April 20, 1976, be approved. Motion carried.
Resolution No. 4404 - A Resolution of the City Council
of the City of Vernon Authorizing the Execution of an Agreement
Between the City of Vernon and the County of Los Angeles for
Animal Control Services, was presented.
It was moved by McCormick, seconded by Ybarra, that
Resolution No. 4404 be approved and adopted. Motion carried.

Copy of Resolution No. 11,358 of the City Council of the
City of Compton authorizing the City Manager to enter into Joint
Power Agreement for purposes of providing better fire prevention
to the citizens of Compton, was presented. (Copy to each member
of the City Council)
It was moved by McCormick, seconded by Gonzales, that
copy of Resolution No. 11,358 of the City Council of the City of
Compton be received and filed. Motion carried.

Communication from Fireman Larry J. Weaver, dated April
21, 1976, requesting permission to temporarily park his boat
trailer at the rear of Vernon Fire Station No.3, subject to
certain conditions, was presented.
It was moved by McCormick, seconded by Ybarra, that the
request of Fireman Larry J. Weaver, dated April 21, 1976, be
approved subject to the conditions as outlined in his communica-
tion. Motion carried.
Communication from Fireman Robert L. Hawkey, dated
April 22, 1976, requesting permission to temporarily park his
personal camper at the rear of Vernon Fire Station No.3, subject
to certain conditions, was presented.

It was moved by McCokmick, seconded by Ybarra, that the
request of Fireman Robert L. Hawkey, dated April 22, 1976, be
approved subject to the conditions as outlined in his communica-
tion. Motion carried.

Claim for Damages, dated April 23, 1976, filed by Reed
Albert Parry against the City of Vernon, was presented. (Copy
to each member of the City Council)
It was moved by Gonzales, seconded by Ybarra, that Claim
for Damages, dated April 23, 1976, filed by Reed Albert Parry
against the City of Vernon, be rejected. Motion carried.
Claim for Damages, dated AprilS, 1976, filed by Armond
Burroughs against the City of Vernon, was presented. (Copy to
each member of the City Council)
It was moved by Ybarra, seconded by McCormick, that
Claim for Damages, dated AprilS, 1976, filed by Armond Burroughs
against the City of Vernon, be rejected. Motion carried.
Communication from S. E. Hogan, Police Chief, dated April
26, 1976, requesting authority for Lt. B. G. Emrick to attend the
California Law Enforcement Association of Records Supervisors
Annual Training Conference at Carmel, California, from May 20 to
22, 1976, with an expense allowance of $207.80, was presented.
It was moved by Gonzales, seconded by McCormick, that
the request of the Police Chief, dated April 26, 1976, be approved
and authority granted to issue warrant in the amount of $207.80 to
B. G. Emrick. Motion carried.
Communication from F. H. Colvin, Fire Chief, dated April
27, 1976, requesting that certain personnel be reimbursed the
amounts as indicated from the Education and Training Budget appro-
priation for Fire Science courses, was presented.

It was moved by McCormick, seconded by Ybarra, that the
request of the Fire Chief, dated April 27, 1976, be approved and
authority granted to issue warrants in the amounts as indicated.
Motion carried.
Communication from Lindt-Wilson Motors, Inc., dated
April 26, 1976, requesting that the City Council approve payment
of the sales tax on 1976 Ford Dump Truck delivered to the City on
January 7, 1976, in accordance with Contract No. 390, was presented.

Communication from C. H. McGovern, City Attorney, dated
May 3, 1976, addressed to F. A. Ziemer, with reference to payment
of sales taxes on 1976 Ford Dump Truck per request of Lindt-
Wilson Motors, Inc., was read.

It was moved by Gonzales, seconded by Ybarra, that the
request of Lindt-Wilson Motors, Inc., dated April 27, 1976, be
denied. Motion carried.

Communication from A. E. Nelson, Jr., Director of Public
Works, dated April 27, 1976, transmitting a proposed License
Agreement with Kaiser Steel Tubing, Inc. covering a building,
asphalt paving, an electrical transformer pad and equipment and
appurtenances in joint right-of-way for one or more railroad
tracks between the City Hall property on Santa Fe Avenue and the
property to the north; and recommending that the Encroachment
License Agreement be executed, was presented.
It was moved by McCormick, seconded by Gonzales, that
the recommendation of the Director of Public Works, dated April
27, 1976, be approved; and that the Mayor and the City Clerk be
authorized to execute Encroachment License Agreement between the
City of Vernon and Kaiser Steel Tubing, Inc. Motion carried.
Activity Log of the Police Department for the period
April 16 - 30, 1976, inclusive, was presented.
It was moved by Ybarra, seconded by Gonzales, that
Activity Log of the Police Department be received and filed.
Motion carried.
Communication from F. A. Ziemer, City Clerk-Director of
Finance, dated April 30, 1976, requesting authority and funds to
purchase a new F & E Check Protector and a F & E Check Signer
and Dater from F & E Checkwriter Company at an approximate cost
of $1,013.00, was presented. (Copy to each member of the City
Council)
It was moved by Ybarra, seconded by Gonzales, that the
request of the City Clerk-Director of Finance, dated April 30,
1976, be approved. Motion carried.

Communication from United Business Interiors, dated May
3, 1976, with reference to partial bid submitted by them on fur-
nishings for the new City Hall and Police Facility in accordance
with Contract No. 403, was read.
Marion J. Varner, Architect, appeared before the City
Council and spoke in rebuttal to the communication from United
Business Interiors, dated May 3, 1976.
Communication from A. E. Nelson, Jr., Director of Public
Works, dated April 30, 1976, with reference to bids received for
furnishing Furniture and Accessories for Vernon City Hall and
Police Facility in accordance with Contract No. 403, recommending
that the contract be awarded to James Hill & Co., Inc., on the
basis of their bid of $137,113.14; subject to certain conditions
as outlined, was presented. (Copy to each member of the City
Council)

Resolution No. 4405 - A Resolution of the City Council
of the City of Vernon Accepting the Bid of James Hill & Co., Inc.,
for Furniture and Accessories for Vernon City Hall and Police
Facility in Accordance with Contract No. 403 of the City of
Vernon, was presented.

It was moved by McCormick, seconded by Gonzales, that
Resolution No. 4405 be approved and adopted. Motion carried.

''Warrant Register No. 452" covering claims and demands
presented during the period April 16 to 30, which includes
Demands Nos. 6-1084 to 6-1145 (both inclusive) drawn on the
United California Bank, totaling $91,957.25 (Light and Power
Warrants $29,651.30) (Accounting Period May 1976) was examined
and audited.
It was moved by Ybarra, seconded by McCormick, that
''Warrant Register No. 452" be approved and payment authorized
for Demands Nos. 6-1084 to 6-1145 (both inclusive), with no ex-
ceptions. Motion carried.

Hearing in the matter of Albert W. Tortoriello regarding
his discharge from the Vernon City Police Department.
At approximately 2:31 o'clock p.m. the City Clerk
announced that this was the time and place for the hearing in
the matter of ALBERT W. TORTORIELLO, regarding his discharge
from the Vernon City Police Department.

The City Clerk advised the City Council that the City
of Vernon was represented by Mr. Nick Counter of the law firm
of Mitchell, Silberberg & Knupp. Mr. Tortoriello was present
and represented by Mr. Richard Goldman. The parties were advised
that they were able to present whatever evidence was appropriate
and that testimony would be taken from interested witnesses.
The City Clerk then announced that Darlene Villani, from
the office of Edwin L. Sarnoff & Associates, was present as a
Certified Shorthand Reporter and that all proceedings would be
taken down verbatim and reduced to a transcript.
The Mayor then asked Mr. Counter to proceed on behalf
of the City of Vernon.
The proceedings then began with Mr. Richard Goldman
representing Mr. Albert W. Tortoriello.

The following witnesses were called during the proceedings:

Mayor Malburg asked both parties to present any additional
information that they might have by way of rebuttal or otherwise.
Both parties stated that they had nothing further to present.
Upon motion of McCormick, seconded by Ybarra, the matter
was referred to the City Council of the City of Vernon for deter-
mination. Motion carried.
The hearing ended at 8:15 o'clock p.m.

There being no further business to come before the
meeting, it was moved by McCormick, seconded by Gonzales, that
the meeting be adjourned. Motion carried.
