COUNCIL ABSENT:

The meeting was called to order by Mayor Leonis C.
It was moved by Ybarra, seconded by Kaeser, that the
minutes of the meeting of May 4, 1976, be approved as written
and submitted. Motion carried.
Communication from Louis S. Hauger, Director of
Environmental Health, dated May 10, 1976, recommending that the
City Council not renew the State Radiation Contract on July 1,
1976, was presented. (Copy to each member of the City Council)
It was moved by Kaeser, seconded by Gonzales, that
the recommendation of the Director of Environmental Health, dated
May 10, 1976, be approved. Motion carried.
Communication from F. H. Colvin, Fire Chief, dated May
5, 1976, recommending that Larry R. Burdett be advanced from
Engineer, Grade 2 to Grade 1, effective June 1, 1976, was pre-
sented.
It was moved by McCormick, seconded by Kaeser, that the
recommendation of the Fire Chief, dated May 5, 1976, be approved.
Motion carried.

Communication from S. E. Hogan, Police Chief, dated
May 7, 1976, requesting authority to attend the California Peace
Officers' Association - Annual Conference at Anahe~, California,
from May 23 to 27, 1976, with an expense allowance of $154.50,
was presented.
It was moved by Ybarra, seconded by Gonzales, that the
request of the Police Chief, dated May 7, 1976, be approved and
authority granted to issue warrant in the amount of $154.50 to
S. E. Hogan. Motion carried.
Communication from A. E. Nelson, Jr., Director of
Public Works, dated May 10, 1976, requesting that a new resolu-
tion be adopted establishing fees for Building, Electrical,
Plumbing, Heating, Ventilation, Cooling, Refrigeration and Fire
Protection permits issued by the City of Vernon; for special in-
spections or for Certificates of Occupancy; for temporary use of
commercial coaches; and for review and approval of tentative
parcel maps for division of property, was presented. (Copy to

Resolution No. 4408 - A Resolution of the City of
Vernon Establishing Fees for Building, Electrical, Plumbing,
Heating, Ventilating, Cooling, Refrigeration and Fire Protec-
tion Permits issued by the City of Vernon and for Special In-
spections or for Certificates of Occupancy and for Temporary
Use of Commercial Coaches and for Review and Approval of
Tentative Parcel Maps for Division of Property, was presented.

It was moved by Ybarra, seconded by Kaeser, that
Resolution No. 4408 be approved and adopted. Motion carried.

Communications from F. H. Colvin, Fire Chief, dated
May 10, 1976, requesting authority for J. E. Muldown and R.
Wiles to attend the California Conference of Arson Investigators
and the International Association of Arson Investigators Work-
shop at Fresno, California, from June 1 to 4, 1976, with an ex-
pense allowance of $212.00 each, was presented.
It was moved by McCormick, seconded by Kaeser, that
the requests of the Fire Chief, dated May 10, 1976, be approved
and authority granted to issue warrants in the amount of $212.00
each to J. E. Muldown and R. Wiles. Motion carried.
Report of Health Department Activities for the month
of April, 1976, was presented. (Copy to each member of the City
Council)
It was moved by Ybarra, seconded by Gonzales, that
Report of Health Department Activities be received and filed.
Motion carried.
Communication from the Finance Committee, dated May
11, 1976, transmitting copies of certain documents; requesting
that the City Council approve the recommendations of the Finance
Committee as outlined in the minutes of the regular meeting of
the Finance Committee held May 10, 1976, was presented. (Copy
to each member of the City Council)

It was moved by Kaeser, seconded by McCormick, that
the recommendations of the Finance Committee as outlined in the
minutes of the regular meeting of the Finance Committee held
May 10, 1976, be approved. Motion carried.
Resolution No. 4410 - A Resolution of the City Council
of the City of Vernon Rejecting all Bids for Remodeling the
Kitchen at Fire Station #1, in Accordance with Specifications
#402 of the City of Vernon, was presented.
It was moved by Gonzales, seconded by Ybarra, that
Resolution No. 4410 be approved and adopted. Motion carried.

Communication from S. E. Hogan, Police Chief, dated
May 11, 1976, requesting that Dean E. Bates be promoted to
Policeman, Grade 1, effective June 1, 1976, was presented.
It was moved by Gonzales, seconded by Ybarra, that
the request of the Police Chief, dated May 11, 1976, be approv-
ed. Motion carried.

Communication from A. E. Nelson, Jr., Director of
Public Works, dated May 11, 1976, advising that C. T. & F., Inc.,
has completed the work of Traffic Signal Installation Santa Fe
Avenue at Pacific Boulevard-Vernon Avenue.in accordance with
Contract No. 389; and recommending that the work be accepted and
that authority be granted to pay the contractor in accordance
with the agreement, was presented.
Resolution No. 4411 - A Resolution of the City Council
of the City of Vernon Accepting the Work of C. T. & F., Inc.,
for Traffic Signal Installation, Santa Fe Avenue at Pacific Boule-
vard-Vernon Avenue, in Accordance with Contract No. 389 of the
City of Vernon, was presented.
It was moved by Gonzales, seconded by Kaeser, that
Resolution No. 4411 be approved and adopted. Motion carried.

Communication from F. A. Ziemer, City Clerk-Director of
Finance, dated May 12, 1976, requesting that Sheila H. McKenna be
reimbursed the sum of $17.91 from the Education and Training
Budget appropriation for an Accounting course at Cerritos College,
was presented.
It was moved by Kaeser, seconded by Ybarra, that the
request of the City Clerk-Director of Finance, dated May 12, 1976,
be approved and authority granted to issue warrant in the amount
of $17.91 to Sheila H. McKenna. Motion carried.

Communication from A. E. Nelson, Jr., Director of Public
Works, dated May 12, 1976, transmitting proposed Resolution No.
4409 pertaining to Federal-aid Urban System; and recommending
that the resolution be adopted, was presented. (Copy to each mem-
ber of the City Council)
Resolution No. 4409 - A Resolution of the City Council
of the City of Vernon Approving the City of Vernon's Portion of
the 1980 Functional Usage Study and the Designation of Federa1-
Aid Urban Routes in said City, was presented.
It was moved by McCormick, seconded by Gonzales, that
Resolution No. 4409 be approved and adopted. Motion carried.

Communication from A. E. Nelson, Jr., Director of Public
Works, dated May 12, 1976, transmitting Contract No. 393; 45th
Street, 54th Street and Packers Avenue Improvement; and recommend-
ing that the contract be approved and that authority be granted to
advertise for bids, was presented.

Resolution No. 4407 - A Resolution of the City Council
of the City of Vernon Approving Contract No. 393 and Authorizing
Notice Inviting Sealed Proposals or Bids for 45th Street, 54th
Street and Packers Avenue Improvement, in Accordance with Contract
No. 393 of the City of Vernon, was presented.
It was moved by Ybarra, seconded by Gonzales, that
Resolution No. 4407 be approved and adopted. Motion carried.

Communication from F. H. Colvin, Fire Chief, dated May
12, 1976, advising that Firemen G. O. Dressen and J. D. Hood have
each been suspended, without pay, May 12 and 15, 1976, for viola-
tion of the Vernon Fire Department Rules and Regulations, General
Rules, Article 48, was presented.

It was moved by McCormick, seconded by Ybarra, that the
action taken by the Fire Chief be approved. Motion carried.
Communication from Lewis R. Adams, Civil Engineer, dated
May 13, 1976, requesting permission to install certain equipment
in the municipal house located at 3345 Fruitland Avenue, subject
to certain conditions, was presented. (Copy to each member of the
City Council)
It was moved by Kaeser, seconded by Ybarra, that the
request of Lewis R. Adams, dated May 13, 1976, be approved subject
to the conditions as outlined in said communication. Motion carried.

''Warrant Register No. 453" covering claims and demands
presented during the period May 1 to 1~ which includes Demands Nos.
6-1146 to 6-1325 (both inclusive) drawn on the United California
Bank, totaling $3,358,532.92 (Light and Power Warrants
$3,089,249.97) (Accounting Period May 1976) was examined and
audited.
It was moved by Gonzales, seconded by Kaeser, that
"Warrant Register No. 453" be approved and payment authorized for
Demands Nos. 6-1146 to 6-1325 (both inclusive), with no exceptions.
Motion carried.

It was moved by Gonzales, seconded by Kaeser, that
"Payroll Warrant Register No. 226" be approved and payment author-
ized for Demands Nos. 2362 to 2373 (both inclusive), with no
exceptions. Motion carried.

Activity Log of the Police Department for the period
May 1 - 15, 1976, inclusive, was presented.
It was moved by Ybarra, seconded by McCormick, that
Activity Log of the Police Department be received and filed.
Motion carried.
The City Attorney requested that he and the Municipal
Employee Relations Representative be granted an extension from
the time for negotiations set forth in Resolution No. 4207 in order
to meet and confer with representatives of the Police and Fire
Departments.
It was moved by McCormick, seconded by Gonzales, that
such extension be granted but not to exceed June 14, 1976. Motion
carried.

The City Clerk advised that on May 17, 1976, he received
the transcript of the hearing held on Tuesday, May 4, 1976, in the
matter of Albert W. Tortoriello regarding his discharge from the
Vernon City Police Department.
A general discussion was held and the City Council found
as follows:
(a) That Officer Tortoriello was responsible as charged
for violation of Vernon Police Department Manual of Policy and
Ethics, Sections 400.52, 400.01 and 400.08 (2).

It was moved by McCormick, seconded by Gonzales, that
the prior action of the Police Chief be approved and that after
hearing the evidence, the action be reaffirmed; and that the City
Attorney be instructed to notify Counsel for Mr. Tortoriello of
the decision of the City Council. Motion carried.

ing, it was moved by Kaeser, seconded by Gonzales, that the meeting
be adjourned. Motion carried.
