19760615 Regular City Council Meeting - Minutes I I I I I MINUTES OF A REGUIAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD JUNE 15, 1976, AT TWO O'CLOCK P.M. IN THE COUNC IL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA COUNCIL PRESENT: Gonzales, Kaeser, Malburg, McCormick, Ybarra COUNCIL ABSENT: None The meeting was called to order by Mayor Leonis C. Malburg. It was moved by Gonzales, seconded by Ybarra, that the minutes of the meeting of June 1, 1976, be approved as written and submitted. Motion carried. Mr. C. H. McGovern, City Attorney, and Mr. Harry J. Keaton, Municipal Employee Relations Representative, presented three fully executed Memorandums of Understanding between the Municipal Employees Relations Representative of the City of Vernon and the following Employee Groups: Vernon Police Officers' Benefit Association (Employee Group 2), dated June 15, 1976; Vernon Fire Fighters Local 2312 (Employee Group 1), dated June 15, 1976; and Vernon Fire Fighters Local 2312 (Employee Group 4), dated June 15, 1976. The City Attorney and Mr. Keaton commented on the Memorandums of Understanding and recommended that the City Council approve said documents. Representatives of the Employee Groups involved also commented on the Memorandums and recommended that the City Council approve said documents. Resolution No. 4419 - A Resolution of the City Council of the City of Vernon Approving a Memorandum of Understanding Between the Municipal Employee Relations Representative of the City of Vernon and the Vernon Police Officers' Benefit Association (Employee Group 2) was presented. It was moved by Kaeser, seconded by Ybarra, that Resolution No. 4419 be approved and adopted. Motion carried. Ordinance No. 867 - An Ordinance of the City of Vernon Amending Sec. 2.1 of The Code of the City of Vernon, California, 1959, was read for a second reading by title. (Copy to each mem- ber of the City Council) It was moved by Ybarra, seconded by McCormick, that Ordinance No. 867 receive and pass a second reading. Motion carried. Ayes: Noes: Absent: Gonzales, Kaeser, Malburg, McCormick, Ybarra None None I It was moved by Kaeser, seconded by Gonzales, that in accordance with Government Code Section 36934, the reading of Ordinance No. 867 in full be waived; and that Ordinance No. 867 receive a third and final reading by title. Colvin, Fire Chief, dated June 1, 1976, recommending that he be advanced to Fire Chief, Step 2, and that M. T. Mello be advanced to Assistant Fire Chief, Grade 1, effective July 1, 1976, was presented. It was moved by McCormick, seconded by Kaeser, that the recommendations of the Fire Chief, dated June 1, 1976, be approved. Motion carried. Communication from S. E. Hogan, Police Chief, dated June 2, 1976, requesting authority for L. S. Rosenkrantz to at- tend the California Association of Polygraph Examiners' Seminar at San Diego, California, on June 26 & 27, 1976, with an expense allowance of $132.20, was presented. I It was moved by Kaeser, seconded by Gonzales, that the request of the Police Chief, dated June 2, 1976, be approved and authority granted to issue warrant in the amount of $132.20 to L. S. Rosenkrantz. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated June 8, 1976, with reference to bids received for 45th Street - 54th Street and Packers Avenue Improvement in accord- ance with Contract No. 393, recommending that the contract be awarded to United Asphalt Company, Inc., on the basis of their bid of $79,375.55, was presented. Resolution No. 4417 - A Resolution of the City Council of the City of Vernon Accepting the Bid of United Asphalt Company, Inc., for 45th Street - 54th Street and Packers Avenue Improvement in Accordance with Contract No. 393 of the City of Vernon, was presented. I It was moved by McCormick, seconded Resolution No. 4417 be approved and adopted. Ayes: Gonzales, Kaeser, Malburg, Noes: None Absent: None by Ybarra, that Motion carried. McCormick, Ybarra I Communication from S.E. Hogan, Police Chief, dated June 8, 1976, requesting that Don W. Green be promoted to Police- man, Grade 1, effective July 1, 1976, was presented. The Police Chief made an oral request that his communi- cation, dated June 8, 1976, relative to Policeman Don W. Green, be withdrawn for the time being. 1~1 -4- 6-15-76 I It was moved by Kaeser, seconded by Gonzales, that communication from the Police Chief, dated June 8, 1976, relative to Policeman Don W. Green, be deleted from the agenda. Motion carried. I Communication from S. E. Hogan, Police Chief, dated June 8, 1976, requesting that he be advanced from Police Chief, Step 3 to 2, effective July 1, 1976, was presented. It was moved by Kaeser, seconded by Ybarra, that the request of the Police Chief, dated June 8, 1976, be approved. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated June 9, 1976, requesting authority to advance certain employees and reclassify certain employees effective July 1, 1976, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Kaeser, that the request of the Director of Public Works, dated June 9, 1976, be approved. Motion carried. I Activity Log of the Police Department for the period June 1 - 14, 1976, inclusive, was presented. It was moved by McCormick, seconded by Gonzales, that Activity Log of the Police Department be received and filed. Motion carried. Report of Health Department Activities for the month of May, 1976, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by McCormick, that Report of Health Department Activities be received and filed. Motion carried. I Communication from A. E. Nelson, Jr., Director of Public Works, dated June 9, 1976, recommending that the City request the County of Los Angeles, by resolution, to renew the current General Services Agreement between the City and the County of Los Angeles which expires June 30, 1976, was presented. (Copy to each member of the City Council) I Resolution No. 4418 - A Resolution of the City Council of the City of Vernon Authorizing the Renewal of a General Services Agreement Between the City of Vernon and the County of Los Angeles, was presented. It was moved by Ybarra, seconded by Resolution No. 4418 be approved and adopted. Ayes: Gonzales, Kaeser, Malburg, Noes: None Absent: None Kaeser, that Motion carried. Hogan, Police Chief, dated June 9, 1976, requesting authority to employ Mr. Konrad Bruce Raschke as Policeman, Grade 4, effective June 16, 1976; and requesting authority to employ Mr. Refugio Santos as Cadet, Grade 4, effective July 1, 1976, was presented. I It was moved by Kaeser, seconded by Ybarra, that the requests of the Police Chief, dated June 9, 1976, be approved. Motion carried. "Warrant Register No. 455" covering claims and demands presented during the period June 1 to 15, which includes Demands Nos. 6-1396 to 6-1545 (both inclusive) drawn on the United California Bank, totaling $3,359,889.39 (Light and Power Warrants $3,226,987.29) (Accounting Period June 1976), was examined and audited. It was moved by Ybarra, seconded by Gonzales, that ''Warrant Register No. 455" be approved and payment authorized for Demands Nos. 6-1396 to 6-1545 (both inclusive), with no exceptions. Motion carried. It was moved by Ybarra, seconded by Gonzales, that "Payroll Warrant Register No. 227" be approved and payment authorized for Demands Nos. 2374 to 2382 (both inclusive), with no exceptions. Stevens be reimburs- ed the sum of $18.30 from the Education and Training Budget ap- propriation for Police Science courses, was presented. I It was moved by Kaeser, seconded by Gonzales, that the request of the Police Chief, dated June 10, 1976, be approved and authority granted to issue warrant in the amount of $18.30 to G. R. Stevens. Motion carried. Communication from Ronald Anderson, Utility Man, dated June 10, 1976, requesting permission to lease one of the two- bedroom houses when one becomes available, was presented. It was moved by Kaeser, seconded by Ybarra, that the request of Ronald Anderson, dated June 10, 1976, be received and filed for future consideration. Luieh, Secretary to the Library Board of Trustees, dated June 10, 1976, advising that the term of Trustees Malburg and Ybarra will expire on June 30, 1976; and requesting that the City Council make a new date of expiration effective July 1, 1976, was presented. I Mayor Malburg appointed Leonis C. Malburg and Thomas A. Ybarra as:,Members of the Board of Library Trustees effective July 1, 1976, for a three year term. It was moved by Kaeser, seconded by Gonzales, that the appointment of Leonis C. Malburg and Thomas A. Ybarra as Members of the Board of Library Trustees effective July 1, 1976, for a three year term, be approved. Motion carried. Communication from the Finance Committee, dated June 10, 1976, making a recommendation to the City Council, was pre- sented. (Copy to each member of the City Council) It was moved by Kaeser, seconded by Gonzales, that the recommendation of the Finance Committee be approved as out- lined in its communication, dated June 10, 1976. Motion carried. I Certified copy of Resolution No. 1976-24 of the Local Agency Formation Commission of the County of Los Angeles making determinations and approving the proposed detachment of territory designated as "Minor Boundary Change No.1" from County Sanitation District No. 23, was presented. (Copy to each member of the City Counc il) It was moved by Ybarra, seconded by Gonzales, that certified copy of Resolution No. 1976-24 of the Local Agency Formation Commission of the County of Los Angeles be received and filed. Motion carried. I Communication from Chapman L. Bone, Chief of Special Services Division, County of Los Angeles, dated June 9, 1976, transmitting an amendment to extend the City of Vernon's present Agreement for Antmal Control Services to June 30, 1977, was pre- sented. (Copy of communication and amendment to each member of the City Council) Resolution No. 4422 - A Resolution of the City Council of the City of Vernon Authorizing the Execution of an Amendment Extending the Agreements for Animal Control Services to June 30, 1977, was presented. (Copy to each member of the City Council) It was moved by Kaeser, seconded by Ybarra, that the request of the Purchasing Agent, dated June 11, 1976, for author- ization to proceed as outlined in said memorandum relative to annual purchase order-agreements for certain supplies and services for the 1976-77 fiscal year, be approved. Motion carried. Communication from the Finance Committee, dated June 14, 1976, transmitting a copy of the minutes of the Finance Committee of the meeting held June 14, 1976; and requesting that the City Council approve the recommendations of the Finance Committee as outlined in the minutes of the meeting held June 14, 1976, was presented. I It was moved by Ybarra, seconded by Kaeser, that the Mayor and the City Clerk be authorized to execute "Amendment to Memorandum of Agreement", dated June 15, 1976, between the City of Vernon and Charles H. McGovern, Attorney at Law, to be effect- ive July 1, 1976. Motion carried. Claim for Damages, dated June 14, 1976, filed by Charles R. Weldon, Attorney at Law, on behalf of Robert Brown, was presented. I Agreement between the City of Vernon and the Insurance Technology Company to provide services related to a self-insurance program for Worker's Compensation coverage, effective July 1, 1976, was presented. (Approved as to form by the City Attorney) It was moved by McCormick, seconded by Gonzales, that the Mayor and the City Clerk be authorized to execute Agreement between the City of Vernon and the Insurance Technology Company to provide services related to a self-insurance program for Worker's Compensation coverage, effective July 1, 1976. Motion carried. Communication from Bruce V. Malkenhorst, Deputy City Clerk-Deputy Director of Finance, dated June 15, 1976, making certain enumerated recommendations in connection with the City's self insured program for Worker's Compensation, was presented. (Copy to each member of the City Council) I It was moved by McCormick, seconded by Ybarra, that the recommendations of the Deputy City Clerk-Deputy Director of Finance, be approved as enumerated in his communication dated June 15, 1976. Motion carried. Mr. A. J. Duffin, District Sales Manager for State and Local Government Market, Motorola Communications and Electronics, Inc., appeared before the City Council and distributed a copy of a letter, dated June 14, 1976, and other papers, to each member of the City Council. Mr. Duffin addressed the City Council and elaborated on the contents of his letter, dated June 14, 1976, relative to the "Bid on Communications Equipment for the City of Vernon's City Hall and Police Facility Project". No action taken. I There being no further business to come before the meeting, it was moved by Ybarra, seconded by Gonzales, that the meeting be adjourned until Tuesday, June 29, 1976, at 2:00 o'clock p.m. Motion carried.
