MINUTES OF A REGUIAR MEET ING
OF THE CITY COUNCIL OF THE
CITY OF VERNON HELD SEPTEMBER
21, 1976, AT TWO O'CLOCK P.M.
IN THE LUNCH ROOM OF THE PUBLIC
WORKS FACILITY LOCATED AT 4305
SANTA FE AVENUE, VERNON,
CALIFORNIA

Gonzales, Kaeser, Malburg, McCormick, Ybarra
COUNCIL ABSENT: None
The meeting was called to order by Mayor Leonis C.
Malburg.
It was moved by McCormick, seconded by Kaeser, that
minutes of the meeting of September 7, 1976, be approved as writ-
ten and submitted. Motion carried.

Communication from S. E. Hogan, Police Chief, dated
September 8, 1976, requesting that L. B. Reimers be reimbursed
from the City's Education and Training Budget appropriation in
the sum of $34.17 for Police Science courses in which he is en-
rolled at Mt. San Antonio College, was presented.
It was moved by Kaeser, seconded by Gonzales, that the
request of the Police Chief, dated September 8, 1976, be approved
and authority granted to issue warrant in the amount of $34.17 to
L. B. Reimers. Motion carried.
Communication from Captain L. F. E1y, dated September
13, 1976, requesting authority for Lt. L. S. Rosenkrantz to
attend the California Crime Prevention Institute, at California
State Polytechnic University, Pomona, California, from October
17 - 29, 1976, with an expense allowance of $215.00 tuition,
$336.00 meals and lodging, and $7.50 travel, for a total of
$558.50, which is fully approved and P.O.S.T. reimbursable, was
presented.

It was moved by Ybarra, seconded by McCormick, that
the request of the Police Captain, dated September 13, 1976, be
approved and warrants issued as outlined in said communication
in the total amount of $558.50. Motion carried.

Communication from F. H. Colvin, Fire Chief, dated
September 13, 1976, requesting authority for N. J. Jurovich to
attend the Division of Industrial Safety/Ca1-0SHA Hearing on
Proposed Standards for Breathing Apparatus and Protective Cloth-
ing in Sacramento, California, from September 15 - 17, 1976, with
an expense allowance of $121.00, was presented.
It was moved by Ybarra, seconded by McCormick, that the
request of the Fire Chief, dated September 13, 1976, be approved
and authority granted to issue warrant in the amount of $121.00
to N. J. Jurovich. Motion carried.

Report of Health Department Activities for the month
of August, 1976, was presented. (Copy to each member of the City
Counc i1)

It was moved by Kaeser, seconded by Gonzales, that
Report of Health Department Activities be received and filed.
Motion carried.

Communication from A. E. Nelson, Jr., Director of
Public Works, dated September 15, 1976, reporting that his office
has continued to study and review 30th Street, considering both
access and parking problems as they relate to Olympic Machinery
Company, Inc., and the requests which were presented to the City
Council at its meeting September 7, 1976; and recommending that
no changes be made at the present time, was presented.
It was moved by Kaeser, seconded by Ybarra, that the
recommendation of the Director of Public Works, dated September
15, 1976, be approved. Motion carried.

Communication from A. E. Nelson, Jr., Director of
Public Works, dated September 14, 1976, advising that the work
on 45th Street-54th Street and Packers Avenue Improvement under
Conttact No. 393 has been completed; and recommending that the
work be accepted and that authority be granted to pay the Contrac-
tor, United Asphalt Co., Inc., in accordance with the Agreement,
was presented.
Resolution No. 4441 - A Resolution of the City Council
of the City of Vernon Accepting the Work of United Asphalt Co.,
Inc., for 45th Street - 54th Street and Packers Avenue Improvement,
Pursuant to Contract No. 393 of the City of Vernon, was presented.
It was moved by McCormick, seconded by Gonzales, that
Resolution No. 4441 be approved and adopted. Motion carried.

Communication was presented from S. E. Hogan, Police
Chief, dated September 15, 1976, requesting that the following
personnel be reimbursed the amounts as indicated from the Educa-
tion and Training Budget appropriation for Police Science courses:

It was moved by Ybarra, seconded by Kaeser, that the
request of the Police Chief, dated September 15, 1976, be approv-
ed and authority granted to issue warrants in the amounts of
$54.00 to Lt. L. S. Rosenkrantz and $75.49 to Lt. B. G. Emrick.
Motion carried.
Communication from R. E. Duba, President, Ruane
Corporation, dated September 16, 1976, requesting approval of
Progress Payment Request No. 25, in the sum of $228,000.00 for
2/3' of the Contract Retention Funds earned to date regarding
City of Vernon Contract No. 383 - City Hall and Police Facility
and Parking Structure, was presented. (Copy to each member of the

Communication from A. E. Nelson, Jr., Director of
Public Works, dated September 17, 1976, recommending that the
request of the Ruane Corporation, dated September 16, 1976, be
considered favorably, but that the sum of $228,000.00 not be
paid until all outstanding items have been resolved, was pre-
sented. (Copy to each member of the City Council)

The Director of Public Works distributed copies of a
letter from Francis W. Sumner, Super~sing Building Inspector,
dated September 21, 1976, with reference to items in need of
attention in the City Hall and Police Facility Building.
The Director of Public Works elaborated and commented
on his letter dated September 17, 1976; the letter from Ruane
Corporation, dated September 16, 1976; and the letter from the
Supervising Building Inspector, dated September 21, 1976.
Mr. R. E. Duba, President, Ruane Corporation, comment-
ed and elaborated on his request dated September 16, 1976.
Mr. Francis W. Sumner, Supervising Building Inspector,
also was in attendance to answer any questions and also to com-
ment on his letter.

Mr. Marion J. Varner, Architect, commented on the
matter before the City Council relative to the City Hall and Police
Facility Building and recommended that the $228,000.00 be paid.
After discussion, it was moved by McCormick, seconded
by Kaeser, that authority be granted to pay Ruane Corporation
$171,000.00 now and the remaining $57,000.00 when the outstanding
items under Contract No. 383 with Ruane Corporation have been
resolved as pertains to the City Hall and Police Facilities
Building, excluding the Council Chamber. Motion carried.
Communication from Allen M. Rosenthal, for Va1ensi and
Rose, Attorneys at Law, representing Vernon Meat land , Inc., re-
garding the development of a workable cattle unloading system for
their operations at Soto Street near Vernon Avenue, was presented.

Mr. Allen M. Rosenthal, counsel for Vernon Meat1and,
Inc., appeared before the City Council and presented a drawing
regarding the development of a workable cattle unloading system
for the operation of Vernon Meat1and, Inc. on Soto Street near
Vernon Avenue. Mr. Rosenthal commented on the drawing and the
problem.

The Director of Public Works commented on the drawing
as submitted by Vernon Meat1and, Inc.
Mr. Vaughn Beck, Plant Manager, and Mr. Seymour Owens,
Vice President of Vernon Meat1and, Inc., also attended the
meeting.
After a general discussion, it was moved by McCormick,
seconded by Kaeser, that the matter be referred to the City
Attorney and the Director of Public Works to determine the appro-
priate vehicle to accomplish the request, considering the maximum
protection for the City and the public. Motion carried.

Communication from F. H. Colvin, Fire Chief, dated
September 16, 1976, advising that there have been more requests
for permission to park personal vehicles at the rear of Vernon
Fire Station #3 than there are available spaces; and recommend-
ing that no further authorizations be granted for said parking
at the present time, was presented.
It was moved by Kaeser, seconded by Gonzales, that
the recommendation of the Fire Chief, dated September 16, 1976,
be approved. Motion carried.
Activity Log of the Police Department for the period
September 1 - 15, 1976, inclusive, was presented.
It was moved by Ybarra, seconded by Gonzales, that
Activity Log of the Police Department be received and filed.
Motion carried.
''Warrant Register No. 461" covering claims and demands
presented during the period September 1 to 15, which includes
Demands Nos. 6-2201 to 6-2357 (both inclusive) drawn on the
United California Bank, totaling $3,013,939.85 (Light and Power
Warrants $2,883,438.83) (Accounting Period September 1976), was
examined and audited.

It was moved by Ybarra, seconded by McCormick, that
''Warrant Register No. 461" be approved and payment authorized
for Demands Nos. 6-2201 to 6-2357 (both inclusive), with no ex-
ceptions. Motion carried.

"Payroll Warrant Register No. 231m covering claims and
demands presented during the period August 1 to 31, which includes
Demands Nos. 2408 to 2419 (both inclusive), drawn on the Crocker
National Bank, totaling $516,262.79 (Accounting Period August
1976), was examined and audited.

It was moved by Ybarra, seconded by McCormick, that
"Payroll Warrant Register No. 231" be approved and payment author-
ized for Demands Nos. 2408 to 2419 (both inclusive), with no
exceptions. Motion carried.

Communication from F. H. Colvin, Fire Chief, dated
September 16, 1976, with reference to bids received for "The
Repowering of Vernon Fire Department Engine No. 22" in accordance
with Specifications #404 and recommending that the Contract be
awarded to Crown Coach Corporation in accordance with their bid
of $20,440.94; and recommending that the Purchasing Agent be
authorized to issue a Purchase Order to Crown Coach Corporation
as outlined in their bid, including Section R of Specifications
#404, in the additional sum of $648.00 for installation of emer-
gency brake system, was presented. (Copy to each member of the

Resolution No. 4442 - A Resolution of the City Council
of the City of Vernon Accepting the Bid of Crown Coach Corpora-
tion for the Repowering of Vernon Fire Department Engine No. 22
in Accordance with Specifications No. 404 of the City of Vernon,
was presented.

It was moved by Gonzales, seconded by Kaeser, that
Resolution No. 4442 be approved and adopted. Motion carried.

Communication from S. E. Hogan, Police Chief, dated
September 20, 1976, requesting authority for Captain L. F. E1y
to attend the California Association of Polygraph Examiners'
Business Meeting and Training Seminar at Sacramento, California
on October 2 & 3, 1976, with an expense allowance of $199.60,
was presented.
It was moved by Kaeser, seconded by Ybarra, that the
request of the Police Chief, dated September 20, 1976, be
approved and authority granted to issue warrant in the amount of
$199.60 to L. F. E1y. Motion carried.

Communication from S. E. Hogan, Police Chief, dated
September 21, 1976, requesting that Robert D. Finerty be pro-
moted to Policeman, Grade 2, effective October 1, 1976, was pre-
sented.
It was moved by McCormick, seconded by Kaeser, that
the request of the Police Chief, dated September 21, 1976, be
approved. Motion carried.
There being no further business to come before the
meeting, it was moved by Kaeser, seconded by Gonzales, that the
meeting be adjourned. Motion carried.
