19761116 Regular City Council Meeting - Minutes I I COUNCIL PRESENT: COUNCIL ABSENT: MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON, HELD NOVEMBER 16, 1976, AT TWO O'CLOCK P.M. IN THE LUNCH ROOM OF THE PUBLIC WORKS FACILITY OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON. CALIFORNIA Gonzales, Malburg, McCormick, Ybarra Kaeser Malburg. The meeting was called to order by Mayor Leonis C. It was moved by McCormick, seconded by Ybarra, that minutes of the meeting of November 2, 1976, be approved as writ- ten and submitted. Motion carried. It was moved by Gonzales, seconded by McCormick, that Ordinance No. 870 receive a second reading by title. Motion carr ied. Ordinance No. 870 - An Ordinance of the City of Vernon, Amending the Code of The City of Vernon, California, 1959, by Amending Sections 25.1, 25.2, 25.3, 25.5 and 25.8 of said Code, Establishing Rates for the Sale of Water in said City and Repeal- ing All Ordinances in Conflict Therein, was read for a second reading by title. (Copy to each member of the City Council) I It was moved by Ybarra, seconded by McCormick, that Ordinance No. 870 receive and pass a second reading. Motion carried. Gonzales, Malburg, McCormick, Ybarra None Kaeser Resolution No. 76-10-2074 from the City Council of the City of Signal Hill Opposing the Redistribution of Sales Tax Revenues on the Basis of Population, which was adopted by the Signal Hill City Council on October 19, 1976, was presented. (Copy to each member of the City Council) I It was moved by McCormick, seconded by Ybarra, that Resolution No. 76-10-2074 from the City Council of the City of Signal Hill be received and filed. Motion carried. Communication from A. E. Nelson, Jr., Director of Public Works, dated November 3, 1976, transmitting a fully exe- cuted Easement for a portion of Ross Street; and recommending that the Easement be accepted and the grantor advised of the official recordation, was presented. It was moved by Gonzales, seconded by McCormick, that Easement be accepted from Leroy H. Stanton, a Widower, aka Leroy H. Stanton, Sr.; and that the Mayor and the City Clerk be author- ized to execute Certificate of Acceptance. Motion carried. I Communication from A. E. Nelson, Jr., Director of Public Works, dated November 2, 1976, requesting authority for himself and Raymond R. Rich to attend the Southern Regional Industrial Waste Conference/Workshop at Los Angeles, California, on December 9, 1976, with an expense allowance of $18.00 each, was presented. I It was moved by Ybarra, seconded by McCormick, that the request of the Director of Public Works, dated November 2, 1976, be approved and authority granted to issue warrants in the sum of $18.00 each to A. E. Nelson, Jr., and Raymond R. Rich. Motion carried. Communication from S. E. Hogan, Police Chief, dated November 3, 1976, transmitting a copy of a "Lease of Personal Property" on a 1977 Harley Davidson motorcycle, which Officer Raymond D. Tisdale agrees to lease to the City of Vernon, under terms of said lease, to be effective as of November 3, 1976; and requesting that the existing lease agreement between Officer Tisdale and the City dated July 1, 1974, be terminated, was presented. " 1-85 -4- 11-16-76 It was moved by McCormick, seconded by Gonzales, that the request of the Police Chief, dated November 3, 1976, be approved; and that the Mayor and the City Clerk be authorized to execute the new Lease Agreement between Officer Raymond D. Tisdale and the City of Vernon. Motion carried. 1 Communication from the Finance Committee, dated November 8, 1976, transmitting copy of the minutes of the meeting of the Finance Committee held November 8, 1976; and requesting that the City Council approve the recommendations of the Finance Committee as outlined in the minutes of the meeting held November 8, 1976, was presented. (Copy to each member of the City Council) I It was moved by McCormick, seconded by Ybarra, that the recommendations of the Finance Committee be approved as outlined in the minutes of the meeting of the Finance Committee held November 8, 1976. Motion carried. Communication from S. E. Hogan, Police Chief, dated November 4, 1976, requesting that Officer L. J. Ebe1t be reimburs- ed from the City's Education and Training Budget appropriation in the sum of $100.00 to cover the cost of tuition and books for Police Science courses in which he is enrolled, was presented. It was moved by McCormick, seconded by Gonzales, that the request of the Police Chief, dated November 4, 1976, be approv- ed and authority granted to issue warrant in the sum of $100.00 to L. J. Ebe1t. Motion carried. I Communication from A. E. Nelson, Jr., Director of Public Works, dated November 8, 1976, with reference to a request for variance to the Uniform Building Code for a building located at 5820 Alameda Street, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Ybarra, that a variance to the Uniform Building Code for the building at 5820 Alameda Street be approved, subject to the conditions as outlined in the communication from the Director of Public Works; subject to the conditions as outlined in communication dated November 1, 1976, from Mr. Harold Roach; and subject to necessary conditions requir- ed to perform the work needed to make the structure suitable for its intended use. Motion carried. .1 Agreement between the County of Los Angeles and the City of Vernon relative to the Swine Flu Program of 1976, was presented. (Copy to each member of the City Council) I It was moved by Gonzales, seconded by McCormick, that the Mayor and the City Clerk be authorized to execute the Agree- ment between the County of Los Angeles and the City of Vernon relative to the Swine Flu Program on behalf of the City of Vernon. Motion carried. Report of Health Department Activities for the month of October, 1976, was presented. (Copy to each member of the City Counc i1) It was moved by McCormick, seconded by Ybarra, that Report of Health Department Activities for the month of October, 1976, be received and filed. It was moved by McCormick, seconded by Ybarra, that Activity Log of the Police Department for the period November 1 - 15, 1976, inclusive, be received and filed. Motion carried. I I ''Warrant Register No. 465" covering claims and demands presented during the period November 1 to 15, which includes Demands Nos. 6-2671 to 6-2828 (both inclusive) drawn on the United California Bank, totaling $3,116,568.01 (Light and Power Warrants $3,028,059.51) (Accounting Period November 1976), was examined and audited. It was moved by Ybarra, seconded by McCormick, that ''Warrant Register No. 465" be approved and payment authorized for Demands Nos. 6-2671 to 6-2828 (both inclusive), with no exceptions. Motion carried. Ayes: Noes: Absent: Gonzales, Malburg, McCormick, Ybarra None Kaeser "Payroll Warrant Register No. 233" covering claims and demands presented during the period October 1 to 31, which includes Demands Nos. 2430 to 2439 (both inclusive) drawn on the Crocker National Bank, totaling $506,640.29 (Accounting Period October 1976), was examined and audited. I It was moved by Ybarra, seconded by McCormick, that "Payroll Warrant Register No. 233" be approved and payment author- ized for Demands Nos. 2430 to 2439 (both inclusive) with no excep- tions. Ziemer, City Clerk-Director of Finance, dated November 12, 1976, requesting that certain person- nel as indicated be advanced in grade, effective December 1, 1976, was presented. City of Vernon Fire Department, State Compensation Insurance Fund, WCAB Nos. 76 BGN 28147/48/49/50; BGN 29361, was presented. It was moved by Gonzales, seconded by Ybarra, that communication from Hays & Petersen, Attorneys at Law, dated Novem- ber 10, 1976, be referred to the City Attorney for answering. Motion carried. Resolution No. 4445 - A Resolution of the City Council of the City of Vernon Amending the Rules and Regulations Respect- ing the Distribution of Electric Energy Supplied by the City of Vernon, was presented.
