19770215 Regular City Council Meeting - Minutes I I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD FEBRUARY 15, 1977, AT TWO 0' CLOCK P. M. IN THE LUNCH ROOM OF THE PUBLIC WORKS FACILITY OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA COUNCIL PRESENT: Gonzales, Kaeser, Malburg, McCormick, Ybarra COUNCIL ABSENT: None The meeting was called to order by Mayor Leonis C. Malburg. It was moved by Kaeser, seconded by Gonzales, that minutes of the meeting of February 1, 1977, be approved as writ- ten and submitted. Motion carried. Communication from S. E. Hogan, Police Chief, dated January 31, 1977, advising that he has received notification from Clerk Patricia L. Ricks that she is resigning from the Police Department effective as of the end of the business day on February 15, 1977, was presented. I It was moved by Ybarra, seconded by Gonzales, that the resignation of Patricia L. Ricks be accepted. Motion carried. Communication from S. E. Hogan, Police Chief, dated February 7, 1977, requesting authority to appoint Daniel J. Tabor to the pesition of Cadet, Grade 4, effective February 16, 1977, was presented. It was moved by Kaeser, seconded by McCormick, that the request of the Police Chief, dated February 7, 1977, be approved. Motion carried. Communication from S. E. Hogan, Police Chief, dated February 7, 1977, requesting that Officer William E. Waxman be advanced to Patrolman, Grade 1, effective as of March 1, 1977, was presented. .,1. ~,; .. It was moved by McCormick, seconded by Gonzales, that the request of the Police Chief, dated February 7, 1977, be approved. Motion carried. Communication from S. E. Hogan, Police Chief, dated February 7, 1977, requesting that consideration be given to Officer B. Waller to rent the one bedroom apartment located at 3380 East 50th Street, was presented. I The City Clerk-Director of Finance reported that the apartment located at 3380 East 50th Street is not available. It was moved by Kaeser, seconded by Ybarra, that the City-owned one bedroom apartment located at 3382 East 50th Street be leased to Byrt Waller, when it becomes available for occupancy. Motion carried. 21.3 -2- 2-15-77 I Communication from the Finance Committee, dated February 7, 1977, transmitting a copy of the minutes of the Finance Commit- tee meeting held February 7, 1977; and requesting that the City Council approve the recommendations of the Finance Committee as outlined in the minutes of the meeting of February 7, 1977, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Kaeser, that the recommendations of the Finance Committee be approved as outlined in the minutes of the Finance Committee meeting held February 7, 1977. Motion carried. I Communication from F. H. Colvin, Fire Chief, dated February 8, 1977, recommending that D. Pod1as be reduced from Captain, Grade 1 to Captain, Grade 3, effective March 1, 1977, as a result of a flagrant violation of an Order of the City Council, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by McCormick, that a hearing to consider the charges against Captain D. Pod1as and the recommendation of the Fire Chief for disciplinary action against him be held by the City Council at 3:00 o'clock p.m. on March 1, 1977, at their regular meeting, in executive session or public hearing, at the option of Captain Pod1as; and that the City Attorney give notice of the hearing to Captain Pod1as. Motion carried. I Communication from A. E. Nelson, Jr., Director of Public Works/Building, dated February 8, 1977, transmitting a Request for Variance to Uniform Building Code from Nichols Conveyor & Engineering Co., Inc., at 2646 Downey Road; and recommending ~hat said variance be approved, subject to the conditions as outlined in his communication, was presented. (Copy to each member of the City Council) It was moved by Kaeser, seconded by McCormick, that Nichols Conveyor & Engineering Co., Inc., be granted a variance to the Uniform Building Code for the building located at 2646 Downey Road, subject to the conditions as outlined in the communi- cation from the Director of Public Works/Building, dated February 8, 1977. Motion carried. I Report of Health Department Activities for the month of January, 1977, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by Kaeser, that the Report of Health Department Activities be received and filed. Motion carried. I It was moved by Gonzales, seconded by Ybarra, that in accordance with Government Code Section 36934, the reading of Ordinance No. 873 in full be waived; and that Ordinance No. 873 receive a second and final reading by title. (Copy to each mem- ber of the City Council) Motion unanimously carried. I Gonzales, Kaeser, Malburg, McCormick, Ybarra None None Ordinance No. 874 - An Ordinance of the City of Vernon regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equip- ment, use, height, area and maintenance of buildings or structures in the City of Vernon, State of California, and providingrfor the issuance of permits and collection of fees therefor; declaring and establishing fire districts; providing penalties for the violation thereof, and adopting the Uniform Building Code, 1976 Edition, including Appendices, Chapters 23, 38, 48 and 57, promulgated by the International Conference of Building Officials and repealing all ordinances and parts of ordinances in conflict therewith, was read by title for a 1st reading. I It was moved by Ybarra, seconded by McCormick, that Ordinance No. 874 receive and pass a first reading. Motion carried. I It was moved by McCormick, seconded by Kaeser, that Ordinance No. 878 receive and pass a first reading. Motion carried. Ayes: Noes: Absent: Gonzales, Kaeser, Malburg, McCormick, Ybarra None None Resolution No. 4462 - A Resolution of the City of Vernon establishing fees for Building, Electrical, Plumping, Heating, Ventilating, Cooling, Refrigeration and Fire Protection Permits issued by the City of Vernon and for Special Inspections or for Certificates of Occupancy and for Temporary Use of Commercial Coaches, and for review and approval of tentative parcel maps for division of property, was presented. I It was moved by Gonzales, seconded by Ybarra, that Resolution No. 4462 be approved and adopted. Motion carried. Nelson, Jr., Director of Public Works/Building, dated February 10, 1977, recommending that Con- tract No. 408, City Hall Janitorial Service, be approved and that authority be granted to advertise for bids, was presented. Resolution No. 4461 - A Resolution of the City Council of the City of Vernon approving Contract No. 408, and authoriz- ing Notice Inviting Sealed Proposals or Bids for Supplying City Hall Janitorial Services in Accordance with Contract No. 408 of the City of Vernon, was presented. -5- 2-15-77 It was moved by Ybarra, seconded by McCormick, that Resolution No. 4461 be approved and adopted. Hogan, Police Chief, dated February 9, 1977, requesting that the following Officers be reimbursed from the City's Education and Training Budget appropriation for Police Science courses in which they are enrol- led: I P. Ebe1t $100.00 100.00 It was moved by Ybarra, seconded by McCormick, that the request of the Police Chief, dated February 9, 1977, be approved and authority granted to issue warrants in the amounts as indicat- ed. Motion carried. ''Warrant Register No. 471" covering claims and demands presented during the period February 1 to 15, which includes Demands Nos. 7-290 to 7-476 (both inclusive) drawn on the United California Ban~ totaling $3,336,479.39 (Light and Power Warrants $3,191,126.47) (Accounting Period February 1977), was examined and audited. I It was moved by Ybarra, seconded by McCormick, that ''Warrant Register No. 471" be approved and payment be authorized for Demands Nos. 7-290 to 7-476 (both inclusive), with no excep- tions. Motion carried. It was moved by McCormick, seconded by Gonzales, that Activity Log of the Police Department be received and filed. Motion carried. Claim for Damages, filed on behalf of Gracie1a Guttierez by Attorney Warren M. Finn in connection with incident of January 12, 1977, was presented. 217 -6- 2-15-77 It was moved by McCormick, seconded by Kaeser, that Claim for Damages, filed on behalf of Gracie1a Guttierez by Attorney Warren M. Finn, be rejected. Motion carried. I Resolution No. 4460 - A Resolution of the City Council of the City of Vernon, approving Contract No. 410 and authoriz- ing Notice Inviting Sealed Proposals or Bids for One 1500 GPM Fire Apparatus, Pumper, in accordance with Contract No. 410 of the City of Vernon, was presented. I It was moved by Ybarra, seconded by McCormick, that Resolution No. 4460 be approved and adopted. Motion carried. Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: None Absent: None Discussion was held with reference to communication, dated February 8, 1977, from Booth and Simpson, giving notice of renewal rates which will become effective March 1, 1977, from Massachusetts Mutual Group Program. I It was moved by McCormick, seconded by Ybarra, that the City Clerk-Director of Finance be authorized to accept the first alternate of the proposal submitted by Booth and Simpson on behalf of Massachusetts Mutual Life Insurance Company if a better pro- posal is not received; and that the City Clerk-Director of Finance be authorized to accept, on behalf of the City, any proposal received that he considers to be better than the proposal of Massachusetts Mutual Life Insurance Company.
