MINUTES OF A REGULAR MEETING
OF THE CITY COUNCIL OF THE
CITY OF VERNON HELD MARCH 15,

The meeting was called to order by Mayor Leonis C.
It was moved by McCormick, seconded by Kaeser, that
minutes of the meeting of March 1, 1977, be approved as written
and submitted. Motion carried.
The Clerk announced that this was the time and place for
opening of bids for furnishing 1500 GPM Fire Apparatus, Cab Forward
Pumper, Diesel Engine, 500 Gallon Tank, in accordance with Specifi-
cations No. 410.
It was moved by Gonzales, seconded by Ybarra, that the
Clerk be instructed to open and read the bids submitted. Motion
carr ied.
The Clerk opened and read the following bids:

It was moved by Ybarra, seconded by McCormick, that the
bids received for furnishing 1500 GPM Fire Apparatus, Cab Forward
Pumper, Diesel Engine, 500 Gallon Tank, in accordance with Specifi-
cations No. 410, be referred to the Finance Committee and the Fire
Chief for checking and report. Motion carried.
At this time, a representative of Clark Fire Apparatus
reported that he had delivered a bid to the Purchasing Department.
The City Attorney advised the representative of Clark
Fire Apparatus that the Notice Inviting Bids clearly stated
"Sealed proposals will be received by the City of Vernon, California
at the City Clerk's Office of said City at 4305 Santa Fe Avenue,
Vernon 90058, California, until 2:00 p.m. on March 15, 1977, for
furnishing one 1500 gallon per minute Triple Combination Pumper".
It was moved by McCormick, seconded by Kaeser, that the
City not accept the bid of Clark Fire Apparatus as it was not
delivered to the City Clerk's Office as recited in the Notice In-
viting Bids. Motion carried.
The Clerk announced that this was the time and place for
opening of bids for Traffic Signal Installation, Soto Street and
Vernon Avenue, Soto Street and Leonis Boulevard, in accordance with
Contract No. 407.
It was moved by Kaeser, seconded by McCormick, that the
Clerk be instructed to open and read the bids submitted. Motion

It was moved by McCormick, seconded by Gonzales, that the
bids received for Traf ic Signal Installation, Soto Street and

The City Cle k announced that this was the time and place
for the hearing to con ider adoption of the Uniform Building Code,
1976 Edition, as amend d, Uniform Fire Code, 1976 Edition, as amend-
ed, Uniform Mechanical Code, 1976 Edition, as amended, Uniform
Plumbing Code, 1976 Edition, as amended, and Uni.form Code For The
Abatement of Dangerous Building~ 1976 Edition, as amended.
Proof of Publication in the Los Angeles Daily Journal on
February 22nd and March 1st, 1977 of "Notice of Public Hearing" was
duly acknowledged as being on file.
The Clerk reported that no written communications relative
to this matter had been received.
Mayor Malburg asked if anyone in the audience wished to
comment on this matter.
No one wished to comment.
Mayor Malburg declared the hearing closed.

accordance with Government Code Section 36934, the reading of
Ordinance No. 874 in full be waived; and that Ordinance No. 874 re-

Regulating the Erection, Construction, Enlargement, Alteration,
Repair, Moving, Removal, Conversion, Demolition, Occupancy, Equip-
ment, Use, Height, Area, and Maintenance of Buildings or Structures
in the City of Vernon, State of California, and Providing for the
Issuance of Permits and Collection of Fees therefor; Declaring and
Establishing Fire Districts; Providing Penalties for the Violation
thereof, and Adopting the Uniform Building Code, 1976 Edition, in-
cluding Appendices, Chapters 23, 38, 48 and 57, Promulgated by the
International Conference of Building Officials, and Repealing all
Ordinances and Parts of Ordinances in Conflict therewith, was read
by title for a second and final reading.

ellaneous Heat-Producing Appliances or Equipment on Premises within
the City of Vernon; and Adopting the Uniform Mechanical Code, 1976
Edition, and Repealing all Ordinances and Parts of Ordinances in
Conflict herewith, was read by title for a second and final reading.

Summons in connection with Case Number C19l495 filed in
the Superior Court of the State of California, for the County of
Los Angeles by Kanematsu-Gosho (U.S.A.), Inc. vs. County of Los
Angeles, et al., was presented.
It was moved by McCormick, seconded by Ybarra, that
Summons in connection with Case Number C19l495 filed in the Superior
Court of the State of California for the County of Los Angeles by
Kanematsu-Gosho (U.S.A.), Inc. vs. County of Los Angeles, et aI, be
referred to the County Counsel for necessary action. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works/Building, dated March 3, 1977, with reference to bids received
for City Hall Janitorial Service in accordance with Contract No.
408, recommending that the contract be awarded to Executive-Suite
Services, Inc. on the basis of their bid of $20,396.18, was presented.
Mr. Paul Laster, World Wide Building Maintenance, Inc.,
appeared before the City Council and requested that consideration
be given to awarding the contract to World Wide Building Maintenance,
Inc., the present contractor.
It was the consensus of op1n1on of the City Council that
the Contract be awarded to the low bidder.

Resolution No. 4466 - A Resolution of the City Council
of the City of Vernon Accepting the Bid of Executive-Suite
Services, Inc. for Supplying City Hall Janitorial Services in accord-
ance with Contract No. 408 of the City of Vernon, was presented.
It was moved by McCormick, seconded

Communication from L. S. Hauger, Director of Environmental
Health, dated March 8, 1977, requesting that Section 1.8-1 (a) of
The Code of the City of Vernon, California, 1959 be amended to re-
move an obsolete Health Department title and insert two new titles,
was presented. (Copy to each member of the City Council)
It was moved by McCormick, seconded by Ybarra, that the
City Clerk be instructed to draft an amendment to Section 1.8-1 (a)
of The Code of the City of Vernon, California, 1959 to remove an
obsolete title and insert two new titles. Motion carried.
Communication from the Finance Committee, dated March 7,
1977, transmitting a copy of the minutes of the Finance Committee
meeting held March 7, 1977; and requesting that the City Council
approve the recommendations of the Finance Committee as outlined in
the minutes of the meeting of March 7, 1977, was presented. (Copy

ommendations of the Finance Committee be approved as outlined in

Communication from S. E. Hogan, Police Chief, dated March
3, 1977, requesting permission for Lt. Louis S. Rosenkrantz to attend
an Internal Affairs Seminar at the Center for Criminal Justice,
California State University, Long Beach, from March 29 to March 31,
1977, inclusive, at a total cost of $121.00, was presented.
It was moved by McCormick, seconded by Gonzales, that
the request of the Police Chief, dated March 3, 1977, be approved;
that authority be granted to issue warrant in the amount of $85.00
to California State University, Long Beach Foundation; and that
authority be granted to issue warrant in the amount of $36.00 to
Louis S. Rosenkrantz. Motion carried.
Communication from S. E. Hogan, Police Chief, dated March
4, 1977, requesting that Scott A. Miedecke be advanced to Cadet,
Grade 3, effective April 1, 1977, was presented.
It was moved by Ybarra, seconded by Kaeser, that the
request of the Police Chief, dated March 4, 1977, be approved.

Communication from A. E. Nelson, Jr., Director of Public
Works/Building, dated March 9, 1977, with reference to request for
variance to "Off Street Parking and Loading Ordinance" from Stavco,
Inc., 3001 E. 44th Street, recommending that the request be approv-
ed, subject to the conditions as outlined in his communication, was
presented. (Copy to each member of the City Council)
It was moved by Kaeser, seconded by McCormick, that
Stavco, Inc. be granted a variance to the "Off Street Parking and
Loading Ordinance" for the property located at 3001 E. 44th Street,
subject to the conditions as outlined in the communication from the
Director of Public Works/Building, dated March 9, 1977. Motion
carried.
Communication from A. E. Nelson, Jr., Director of Public
Works/Building, dated March 8, 1977, with reference to request for
variance to Uniform Building Code from Glass Containers Corpora-
tion, 3601 Santa Fe Avenue, recommending that the variance be grant-
ed for the reasons as outlined in his communication, was presented.

It was moved by Gonzales, seconded by Kaeser, that Glass
Containers Corporation be granted a variance to the Uniform Build-
ing Code for the building located at 3601 Santa Fe Avenue with
reference to the two exit doors at the southeast corner of the
building at 37th Street and Santa Fe Avenue. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works/Building, dated March 8, 1977, with reference to request for
variance to Uniform Building Code from Glass Containers Corporation,
3601 Santa Fe Avenue; recommending that said request be held in
abeyance until such time as Glass Containers furnishes certain in-
formation to the Building Division and the Fire Department, was
presented. (Copy to each member of the City Council)
It was moved by Ybarra, seconded by Kaeser, that the
request for variance to the Uniform Building Code by Glass Contain-
ers Corporation, 3601 Santa Fe Avenue, be held in abeyance until
such time as Glass Containers Corporation furnishes certain infor-
mation to the Building Division and the Fire Department as requested;
and that upon receipt of this information, recommendations concern-
ing this request for variance be submitted to the City Council.

Communication from Union Pacific Railroad Company, dated
March 4, 1977, transmitting the original and one copy of an Appli-
cation for Franchise for the maintenance and operation of an
industry spur track across Downey Road in the City of Vernon, Cali-
fornia, was presented.
It was moved by McCormick, seconded by Kaeser, that the
Application for Franchise for the maintenance and operation of an
industry spur track across Downey Road in the City of Vernon,
California, submitted by the Union Pacific Railroad Company, be
referred to the Director of Public Works/Building for processing.

Communication from S. E. Hogan, Police Chief, dated March
9, 1977, requesting that Sgt. B. Bunker be authorized to attend the
California Association of Police Training Officers' Seminar in
Solvang, California, on April 15 & 16, 1977, with an expense allow-
ance of $63.80, was presented.
It was moved by McCormick, seconded by Ybarra, that the
request of the Police Chief, dated March 9, 1977, be approved and
authority granted to issue warrant in the amount of $63.80 to B.
Bunker. Motion carried.
Communication from S. E. Hogan, Police Chief, dated March
9, 1977, requesting authority for Sgt. R. L. McBean to attend the
Western Regional Training Institute's course in Organized Crime
Informant Development and Maintenance Course presented by the Cali-
fornia Department of Justice in Sacramento, Califurnia, May 22 to
27, 1977, inclusive, with an expense allowance of $228.00, w~s
presented.
It was moved by Kaeser, seconded by McCormick, that the
request of the Police Chief, dated March 9, 1977, be approved and
authority granted to issue warrant in the amount of $228.00 to R.
L. McBean. Motion carried.
Communication was presented from S. E. Hogan, Police
Chief, dated March 9, 1977, requesting that the following officers
be reimbursed the amounts as indicated from the Education and Train-

request of the Police Chief, dated March 9, 1977, be approved and

February, 1977, was presented. (Copy to each member of the City
Council)
It was moved by McCormick, seconded by Ybarra, that
Report of Health Department Activities be received and filed.

Communication from A. E. Nelson, Jr., Director of Public
Works/Building, dated March 10, 1977, transmitting a Quitclaim
Deed to Associated Beverage Company, Inc.; and recommending that
the Mayor and the City Clerk be authorized to execute the document,
was presented. (Copy to each member of the City Council)
It was moved by Kaeser, seconded by McCormick, that the
Mayor and the City Clerk be authorized to execute Quitclaim Deed
to Associated Beverage Company, Inc. Motion carried.
Communication from A. E. Nelson, Jr., Director of Public
Works/Building, dated March 10, 1977, recommending that the request
of Sheffield Chair Company, to park approximately twenty employee
cars on the City of Vernon property at Fruitland Avenue and Downey
Road, be denied, was presented. (Copy to each member of the City

Communication from Paul P. Hendricks, Consulting Electric-
al Engineer, dated March 11, 1977, with reference to the request of
Sheffield Chair Company to park approximately twenty employee cars
on the City of Vernon property at Fruitland Avenue and Downey Road,
was presented. (Copy to each member of the City Council)
It was moved by Gonzales, seconded by Kaeser, that the
request of Sheffield Chair Company to park approximately twenty
employee cars on the City of Vernon property at Fruitland Avenue
and Downey Road, be denied. Motion carried.
Communication from Paul P. Hendricks, Consulting Electric-
al Engineer, dated March 11, 1977, requesting that the City Council
authorize the Mayor and the City Clerk to execute for the City of
Vernon, a temporary operating Agreement, by which Edison can continue
to operate the Vernon Electrical System for the City of Vernon,
effective April 3, 1977, was presented.
Councilman Keith K. Kaeser disclosed that he is an employ-
ee of Southern California Edison Company, and that he will not enter
into the discussion and will abstain from voting.
It was moved by Ybarra, seconded by Gonzales, that the
Mayor and the City Clerk be authorized to execute for the City of
Vernon a temporary Agreement, by which Southern California Edison
Company can continue to operate the Vernon Electrical System for
the City of Vernon, effective April 3, 1977. Motion carried.

Communication from James Persons, Project Engineer, dated
March 11, 1977, requesting that he be reimbursed in the sum of
$91.00 from the City's Education and Training Budget appropriation
for a course entitled "Maximizing the Use of Existing Transportation
Systems" in which he was enrolled, was presented.
It was moved by Kaeser, seconded by McCormick, that
authority be granted to issue warrant in the amount of $91.00 to
James Persons. Motion carried.
Communication from F. A. Ziemer, City Clerk-Director of
Finance, dated March 11, 1977, recommending that the City absorb
the increase in the premium for the group insurance for employees
and dependents of employees for the remaining months of the 1976-
77 fiscal year; and that consideration be given to having the em-
ployees contribute a portion of the premium to be determined for
the fiscal year 1977-78, was presented.
It was moved by Gonzales, seconded by Kaeser, that the
recommendation of the City Clerk-Director of Finance, dated March
11, 1977, b~ approved. Motion carried.
Activity Log of the Police Department for the period
March 1 to 14, 1977, inclusive, was presented.
It was moved by Kaeser, seconded by Ybarra, that the
Activity Log of the Police Department be received and filed. Motion
carried.

''Warrant Register No. 473" covering claims and demands
presented during the period March 1 to 15, which includes Demands
Nos. 7-538 to 7-720 (both inclusive) drawn on the United California
Bank, totaling $139,946.04 (Light and Power Warrants $86,731.27)
(Accounting ,Period March 1977), was examined and audited.
It was moved by Ybarra, seconded by Kaeser, that '~arrant
Register No. 473" be approved and payment be authorized for Demands
Nos. 7-538 to 7-720 (both inclusive), with no exceptions. Motion

Discussion was held with reference to possible disciplin-
ary action to be taken against Fire Captain Donald Podlas for a
violation of an order of the City Council, which was taken under
submission for a future decision at the Council meeting and Public
Hearing held on March 1, 1977.
It was moved by Gonzales, seconded by McCormick, that
Fire Captain Donald Podlas be suspended for three shifts with no
overtime for a six month period, effective April 1, 1977. Motion
carried.

Discussion was held with reference to Vernon Meatland,
Inc. using a portion of So to Street for their cattle unloading
operation.
It was moved by McCormick, seconded by Kaeser, that the
City Attorney be authorized and instructed to bring appropriate
legal proceedings against Vernon Meatland, Inc. to enjoin and abate
the interference with foot traffic over sidewalk and vehicular
traffic in cattle unloading operations and the improper disposal of
manure in connection with such operation. Motion carried.
