THE CITY COUNCIL OF THE CITY OF
VERNON HELD APRIL 5, 1977, AT

The meeting was called to order by Mayor Leonis C.

Malburg.
It was moved by Ybarra, seconded by Kaeser, that
minutes of the meeting of March 15, 1977, be approved as written
and submitted. Motion carried.
Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/Building, dated March 14, 1977, requesting authority
for Francis W. Sumner to attend a course on "Building Codes and
Inspection - Legal Aspects of Administration and Enforcement" at
the University of California, Oakland, California on May 19 and
20, 1977, with an expense allowance of $300.00, was presented.
It was moved by Kaeser, seconded by Ybarra, that the
request of the Director of Public works/Bui1ding, dated March 14,
1977, be approved and authority granted to issue warrant in the
amount of $300.00 to Francis W. Sumner. Motion carried.

Communication from F. H. Colvin, Fire Chief, dated
March 15, 1977, requesting authorization and funds to purchase
one replacement refrigerator/~reezer unit for Fire Station No. 3
at an estimated cost of $400.00, was presented.
It was moved by Kaeser, seconded by Ybarra, that the
request of the Fire Chief, dated March 15, 1977, be approved.
Motion carried.
Communication from Jerseymaid Milk Products Co., dated
March 16, 1977, advising that they oppose the proposal of Environ-
mental Fuels, Inc. to convert the facility at 3750 Jewel Avenue
to a plant for mixing high and low sulphur crude oils and extract-
ing 'naprr~-like materials therefrom, was presented. (Copy to

It was moved by Ybarra, seconded by Kaeser, that com-
munication from Jerseymaid Milk Products Co., dated March 16,
1977, be received and filed. Motion carried.
Communication from the Board of Supervisors, County of
Los Angeles, dated March 16, 1977, advising that the Board has
pledged to adopt a budget for 1977-78 which will 'not require an
increase in the County tax rate and has adopted a program of re-
ducing the number of County employees each year, was presented.

munication from the Board of Supervisors, County of Los Angeles,
dated March 16, 1977, be received and filed. Motion carried.

Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/BUilding, dated March 18, 1977, with reference to bids
received for Traffic Signal Installation, Soto Street at Vernon
Avenue, Soto Street at Leonis Boulevard, in accordance with Con-
tract No. 407, recommending that the contract be awarded to
Signal Maintenance, Inc. on the basis of their bid of $14,408.00,
was presented.

Resolution No. 4467 - A Resolution of the City Council
of the City of Vernon Accepting the Bid of Signal Maintenance,
Inc. for Traffic Signal Installation, Soto Street at Vernon Avenue,
Soto Street at Leonis Boulevard in Accordance with Contract No.
407 of the City of Vernon, was presented.
It was moved by Kaeser, seconded by Ybarra, that Reso-
lution No. 4467 be approved and adopted. Motion carried.

Communication was presented from F. H. Colvin, Fire
Chief, dated March 21, 1977, requesting that the following per-

It was moved by Kaeser, seconded by Ybarra, that the
request of the Fire Chief, dated March 21, 1977, be approved and
authority granted to issue warrants in the amounts as indicated.
Motion carried.
Communication from the State Solid Waste Management
Board, State of California, dated March 21, 1977, reminding all
cities and counties of a July 1, 1977 deadline for designation
of a local solid waste management enforcement agency, was present-
ed. (Copy to each member of the City Council)
It was moved by Ybarra, seconded by Kaeser, that com-
munication from the State Solid Waste Management Board, State of
California, dated March 21, 1977, be referred to the Director of
Environmental Health for study and report. Motion carried.

Communication from C. E. Nemethi, M.D., Health Officer,
dated March 21, 1977, requesting authority for Louis S. Hauger to
attend the California Conference of Directors of Environmental
Health (Standard Seminar Center) at Fallen Leaf Lake, California,
from May 9 to 13, 1977, inclusive, with an expense allowance of
$360.00, was presented.
It was moved by Kaeser, seconded by Ybarra, that the
request of the Health Officer, dated March 21, 1977, be approved
and authority granted to issue warrant in the amount of $360.00
to Louis S. Hauger. Motion carried.
Communication from F. H. Colvin, Fire Chief, dated
March 22, 1977, requesting authority for Dale M. Kruse to attend
the Mack Fire Pump School at Hayward, California, from April 4
to 8, 1977, with an expense allowance of $232.25, was presented.

It was moved by Kaeser, seconded by Ybarra, that the
request of the Fire Chief, dated March 22, 1977, be approved and
authority granted to issue warrant in the amount of $232.25 to
Dale M. Kruse. Motion carried.

Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/Building, dated March 23, 1977, with reference to
request received from Ladish-Pacific Company, 3321 East Slauson
Avenue for a variance to the Uniform Building Code; recommending
that the request for a variance to eliminate fire sprinklers in
the requested areas be denied; and further recommending that the
Ladish-Pacific Company proceed immediately to provide that fire
protection system throughout their plant as required by the Code
of the City of Vernon, was presented. (Copy to each member of

It was moved by Kaeser, seconded by Ybarra, that the
recommendations of the Director of Public workslBui1ding, dated
March 23, 1977, be approved. Motion carried.
Communication from A. E. Nelson, Jr., Director of Pub-
lic WorkslBuilding, dated March 25, 1977, recommending that Ruane
Corporation be reimbursed the sum of $702.26 which represents 50%
of the electrical costs for the period July 8 through August 20,
1976, for the new City Hall building, was presented. (Copy to
each member of the City Council)

It was moved by Kaeser, seconded by Ybarra, that the
recommendation of the Director of Public Works/Building, dated
March 25, 1977, be approved and authority granted to issue war-
rant in the amount of $702.26 to Ruane Corporation. Motion
carried.
Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/BUilding, dated March 25, 1977, advising that by letter
dated March 17, 1977, the County of Los Angeles Road Department
has transmitted Negative Declaration in accordance with "State
EIR Guidelines" for a project to widen Downey Road bridge; and
recommending that the Negative Declaration be approved and that
a finding be made of no significant effect on the environment,
was presented. (Copy to each member of the City Council)

It was moved by Ybarra, seconded by Kaeser, that the
Negative Declaration submitted in accordance with "State EIR
Guidelines" for a project to widen Downey Road bridge beapprov-
ed; and that the City Council finds that the project will have
no significant effect on the environment. Motion carried.

Ordinance No. 879 - An Ordinance of the City of Vernon
Amending Section 1. 8...1 (a) of the Vernon City Code Authorizing
Certain City Officers and Employees to Arrest Without Warrant,

Chief, dated March 29, 1977, requesting that he be considered as
a tenant for one of the City-owned apartments, was presented.

consideration. Motion carried.

March 15 to 31, 1977, inclusive, was presented.
It was moved by Ybarra, seconded by Kaeser, that
Activity Log of the Police Department be received and filed.
Motion carried.
Claim for Damages, dated March 18, 1977, filed by
Francisco Roa against the City of Vernon, was presented.
It was moved by Kaeser, seconded by Ybarra, that Claim
for Damages, dated March 18, 1977, filed by Francisco Roa against
the City of Vernon, be rejected. Motion carried.

Communication from Richard J. Silber, Attorney at Law,
dated March 21, 1977, addressed to the City Attorney with refer-
ence to disciplinary action t;aken by the City Council against
Fire Captain Donald Podlas, was presented. (Copy to each member
of the City Council)
It was moved by Kaeser, seconded by Ybarra, that the
disciplinary action taken by the City Council on March 15, 1977
against Fire Captain Donald Pod1as be sustained; and that the
City Attorney be instructed to so notify Attorney Richard J.
Silber. Motion carried.
The City Attorney made an oral recommendation that he
be authorized to accept process service from Attorney Richard J.
Silber on behalf of the City Council, provided that he furnishes
eight (8) copies of the service regarding Captain Donald Pod1as.
It was moved by Ybarra, seconded by Kaeser, that the
recommendation of the City Attorney be approved. Motion carried.

Communication from F. H. Colvin, Fire Chief, dated
March 24, 1977, making .certain requests in connection with Speci-
fications No. 387 for the furnishing, delivering, and installing
to the City of Vernon, Fire Department Radio Communications Sys-
tem, was presented. (Copy to each member of the City Council)

Mr. Bill Bennett from Mobile Radio appeared before
the City Council and elaborated on a letter from Mr. Raymond R.
Meza, President of Mobile Radio, dated March 30, 1977, addressed
to F. H. COlvin, Fire Chief; and orally requested a thirty-day
extension to rectify the problems in connection with Specifica-
tions No. 387. .
It was moved by Kaeser, seconded by Ybarra, that Mobile
Radio be granted a thirty-day extension from AprilS, 1977 to
rectify the problems in connection with Specifications No. 387.

March 30, 1977, with reference to Fire Department personnel sub-
poenaed to appear as witnesses in criminal proceedings, was
presented.

munication from the Fire Chief, dated March 30, 1977, be referred

Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/Building, dated March 30, 1977, transmitting Contract
No. 406, Vernon Avenue Improvement, Santa Fe Avenue to Downey
Road; and recommending that this contract be approved and author-
ity be granted to advertise for bids, was presented.

Resolution No. 4468 - A Resolution of the City Council
of the City of Vernon Approving Contract No. 406 and Authorizing
Notice rnviting Sealed Proposals or Bids for Vernon Avenue Improve-
ment, Santa Fe Avenue to Downey Road, in Accordance with Contract
No. 406 of the City of Vernon, was presented.
It was moved by Ybarra, seconded by Kaeser, that Reso-
lution No. 4468 be approved and adopted. Motion carried.

Communication from A. E. Nelson, Jr., Director of Pub-
lic WorkslBui1ding, dated March 30, 1977, transmitting a letter
from Sheffield Chair Company, dated March 29, 1977, conveying to
the City the storm drain between Ross Street and Alameda Street;
and recommending that the ownership of this drain be accepted by
the City, was presented.
It was moved by Kaeser, seconded by Ybarra, that the
ownership of the storm drain between Ross Street and Alameda
Street be accepted from Sheffield Chair Company. Motion carried.

and authority granted to issue warrants in the amounts as indi-
cated. Motion carried.
Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/Bui1ding, dated March 31, 1977, requesting authority
for Lewis R. Adams to attend the 97th Annual American Water Works
Association Conference at Anaheim, California, from May 9 to 12,
1977, with an expense allowance of $142.50, was presented.
It was moved by Kaeser, seconded by Ybarra, that the
request of the Director of Public Works/Bui1ding, dated March 31,
1977, be approved and authority granted to issue warrant in the
amount of $142.50 to Lewis R. Adams. Motion carried.

presented during the period March 16 to 31, which includes
Demands Nos. 7-721 to 7-824 (both inclusive) drawn on the United
California Bank, totaling $3,347,819.43 (Light and Power Warrants
$3,224,068.02) (Accounting Period April 1977), was examined and
audited.

Register No. 474" be approved and payment be authorized for Demands
