MINUTES OF A REGULAR MEETING
OF T HE CITY COUNCIL OF THE
CITY OF VERNON HELD APRIL 19,
1977, AT TWO O'CLOCK P.M. IN
THE LUNCH ROOM OF THE PUBLIC
WORKS FACILITY OF THE CITY

The meeting was called to order by Mayor Leonis C.
Malburg.
It was moved by Gonzales, seconded by Ybarra, that
minutes of the meeting of April 5, 1977, be approved as corrected
due to a typographical error relative to the communication from
the Fire Chief, dated March 30, 1977, which was referred to the
Finance Committee for study and report. Motion carried.
The Clerk announced that this was the time and place
for opening of bids for Vernon Avenue Improvement, Santa Fe
Avenue to Downey Road, in accordance with Contract No. 406.

It was moved by Kaeser, seconded by Ybarra, that the
Clerk be instructed to open and read the bids submitted. Motion
carried.
The Clerk opened and read the following bids:

It was moved by McCormick, seconded by Kaeser, that
the bids received for the Vernon Avenue Improvement, Santa Fe
Avenue to Downey Road, in accordance with Contract No. 406, be
referred to the Director of Public Works/Building and the City
Attorney for checking and report. Motion carried.

Communication from Carol Taylor, Community Relations
Representative, Southern California Rapid Transit District,
dated April 7, 1977, advising that Director Jay Price and she
would like to give the Council a five minute Transportation Up-
date at the next Council meeting, was presented.

Director Jay Price and Carol Taylor, Community Rela-
tions Representative, Southern California Rapid Transit District,
appeared before the City Council and presented an oral Trans-
portation Update.
It was moved by Ybarra, seconded by McCormick, that
in accordance with Government Code Section 36934, the reading
of Ordinance No. 879 in full be waived; and that Ordinance No.
879 receive a second and final reading by title. (Copy to each
member of the City Council) Motion unanimously carried.

Ordinance No. 879 An Ordinance of the City of
Vernon Amending Section 1.8-1 (a) of the Vernon City Code Author-
izing Certain City Officers and Employees to Arrest Without
Warrant, was read by title for a second and final reading.
It was moved by Gonzales, seconded by Ybarra, that
Ordinance No. 879 receive and pass a second reading and be
adopted. Motion carried.

Claim for Damages filed by Barbara De Pillo, dated
April 6, 1977, against the City of Vernon, was presented.
It was moved by McCormick, seconded by Gonzales, that
Claim for Damages filed by Barbara De Pillo, dated April 6, 1977,
against the City of Vernon, be rejected by operation of law (more
than one hundred (100) days). Motion carried.

Communication from the County of Los Angeles, Office
of the Sheriff, dated April 1, 1977, transmitting Agreement
between the City of Vernon and the County of Los Angeles for the
Vernon Police Department to participate in the Los Angeles County
Sheriff's Justice Data Interface Controller System, was
presented. (Copy of communication to each member of the City
Council)
It was moved by McCormick, seconded by Ybarra, that
the Agreement between the City of Vernon and the County of Los
Angeles for the Vernon Police Departme'nt to participate in the
Los Angeles County Sheriff's Justice Data Interface Controller
System be approved; and that the Mayor and the City Clerk be
authorized to execute said Agreement on behalf of the City of
Vernon. Motion carried.

Communication from S. E. Hogan, Police Chief, dated
April 7, 1977, requesting authority to attend the California
Peace Officers Association's Annual Conference at Palo Alto,
California, from May 15' to 19, 1977, with an expense allow-
ance of $406.50, was presented.

It was moved by Kaeser, seconded by Gonzales, that the
request of the Police Chief, dated April 7, 1977, be approved
and authority granted to issue warrant in the amount of $406.50
to S. E. Hogan. Motion carried.
Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/Building, dated Apri18, 1977, requesting authority
for Raymond R. Rich to attend the CWPCA 1977 Conference and
Training School at the Anaheim-Sheraton from April 27 to 30,
1977, with an expense allowance of $103.75, was presented.
It was moved by Ybarra, seconded by Gonzales, that the
request of the Director of Public Works/Building, dated April 8,
1977, b.eap.proved and authority granted to issue warrant in the
amount of $103.75 to Raymond R. Rich. Motio'n carried.

Activity Log of the Police Department for the period
April 1 - 15, 1977, inclusive, was presented.
It was moved by Kaeser, seconded by Ybarra, that
Activity Log of the Police Department be received and filed.
Motion carried.

Communication from Michael J. O'Rourke & Associates,
dated April 7, 1977, with reference to the proposal by Environ-
mental Fuels, Inc. to convert the old Swift and Company Edible
Oil Plant at 3750 Jewel Avenue into a plant at which high sul-
phur crude oils of California and low sulphur fuel oils from
Wyoming and other states would be mixed and preferably the light
naptha-like fractions stripped from the mixed crudes, was pre-
sented. (Copy to each member of the City Council)
It was moved by Kaeser, seconded by Ybarra, that com-
munication from Michael J. O'Rourke & Associates, dated April
7, 1977, be referred to the City Attorney and the Director of
Public Works/Building. Motion carried.
Communication from F. H. Colvin, Fire Chief, dated
April 1, 1977, requesting authority for N. J. Jurovich to at-
tend the Fire Instructor Training Course at Asilomar, California
from May 1 to 7, 1977, with an expense allowance of $387.05, was
presented.

It was moved by Gonzales, seconded by Ybarra, that
the request of the Fire Chief, dated April 1, 1977, be approved
and authority granted to issue warrant in the amount of $387.05
to N. J. Jurovich. Motion carried.
Communication from the Finance Committee, dated April
11, 1977, transmitting a copy of the minutes of the meeting of
the Finance Committee held April 11, 1977; and requesting the
City Council to approve the recommendations as outlined in the
minutes of the meeting of the Finance Committee held April 11,
1977, was presented. (Copy to each member of the City Council)
It was moved by Kaeser, seconded by McCormick, that
the recommendations of the Finance Committee be approved as out-
lined in the minutes of the meeting of the Finance Committee
held April 11, 1977. Motion carried.

Communication from A. E. Nelson, Jr., Director of
Public Works/Building, dated April 12, 1977, transmitting cer-
tain material in connection with the Communications Consulting
Contract between Fieler & Associates and the City; and making
certain enumerated requests, was presented. (Copy to each mem-
ber of the City Council)

It was moved by Kaeser, seconded by Gonzales, that
communication from the Director of Public Works/Building, dated
April 12, 1977, together with transmittals, be referred to the
Finance Committee for study and report. Motion carried.
Communication from the Board of Supervisors, City and
County of San Francisco, transmitting a resolution concerning
the Determinate Sentencing Act of 1976, was presented. (Copy
to each member of the City Council)

It was moved by Gonzales, seconded by Ybarra, that
communication from the Board of Supervisors, City and County of
San Francisco, together with transmittals, be received and filed.
Motion carried.

Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/Building, dated April 14, 1977, transmitting Contract
No. 405, Pavement Marker Installation, Bandini Boulevard (Downey
Road to Atlantic Boulevard) and District Boulevard (Corona Avenue
to Gifford Avenue); and recommending that this contract be approv-
ed and that authority be granted to advertise for bids, was
presented.

Resolution No. 4469 - A Resolution of the City Council
of the City of Vernon Approving Contract No. 405 and Authorizing
Notice Inviting Sealed Proposals or Bids for Pavement Marker
Installation, Bandini Boulevard (Downey Road to Atlantic Boulevard)
and District Boulevard (Corona Avenue to Gifford Avenue), in
Accordance with Contract No. 405 of the City of Vernon, was pre-
sented.
It was moved by Ybarra, seconded by Kaeser, that
Resolution No. 4469 be approved and adopted. Motion carried.

Communication from S. E. Hogan, Police Chief, dated
April 13, 1977, requesting that Lt. L. S. Rosenkrantz be reimburs-
ed in the sum of $100.00 from the City.s Education and Training
Budget appropriation for Police Science courses in which he is
enrolled at Cal Poly University, was presented.
It was moved by Kaeser, seconded by Gonzales, that the
request of the Police Chief, dated April 13, 1977, be approved
and authority granted to issue warrant in the amount of $100.00
to L. S. Rosenkrantz. Motion carried.

Communication from David B. Brearley, Deputy City
Attorney, dated April 14, 1977, transmitting a report concerning
the benefits of contracting with the Contract Cities Unit Los
Angeles County for the District to prosecute violations of local
ordinances; and recommending that the City Clerk be authorized to
request the Board of Supervisors to amend the City's current
General Services Agreement to include said prosecution services,
was presented. (Copy to each member of the City Council)
It was moved by Ybarra, seconded by Gonzales, that the
recommendation of David B. Brearley, Deputy City Attorney, dated
April 14, 1977, be approved. Motion carried.
Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/Building, dated April 15, 1977, transmitting the City's
Progress and Needs Report for fiscal years 1972-73 through
1981-82; and recommending that the report be approved as submit-
ted and that a copy of the report be transmitted to the Department
of Transportation, was presented.

Resolution No. 4470 - A Resolution of the City Council
of the City of Vernon Approving the 2156 Report Regarding Progress
and Needs for the Fiscal Years 1972-73 through 1981-82 to the
Department of Transportation, State of California, was presented.

It was moved by Kaeser, seconded by Gonzales, that
Resolution No. 4470 be approved and adopted. Motion carried.

"Warrant Register No. 475" covering claims and demands
presented during the period April 1 to 15, which includes Demands
Nos. 7-825 to 7-1003 (both inclusive) drawn on the United Cali-
fornia Bank, totaling $281,682.40 (Light and Power Warrants
$107,330.02) (Accounting Period April 1977), was examined and
audited.
It was moved by Ybarra, seconded by Kaeser, that
"Warrant Register No. 475" be a pproved and payment be authorized
for Demands Nos. 7-825 to 7-1003 (both inclusive), with no excep-
tions. Motion carried.

"Payroll Warrant Register No. 238" covering claims and
demands presented during the period March 1 to 31, which includes
Dema'nds Nos. 2482 to 2491 (both inclusive) drawn on the Crocker
National Bank, totaling $510,949.95 (Accounting Period March 1977),
was examined and audited.
It was moved by Ybarra, seconded by Kaeser, that "Pay-
roll Warrant Register No. 238" be approved and payment authorized
for demands Nos. 2482 to 2491 (both inclusive), with no excep-
tions. Motio'n carried.

Report of Health Department Activities for the month

It was moved by McCormick, seconded by Kaeser, that
Report of Health Department Activities be received and filed.
Motion carried.

Discussion was held with reference to application for
Peremptory Writ of Mandate (C.C.P. Section 1085) filed by the
Vernon Fire Fighters Local 2312, Affiliate of the International
Associatio'n of Fire Fighters, a nd Fire Captain Donald Pod1as
v. City of Vernon, a Municipal Corporation, et a1.
It was moved by Gonzales, seconded by Kaeser, that
the City Attorney be authorized to represent the City of Vernon
and all individual officers served with reference to Application
for Peremptory Writ of Mandate (C.C.P. Section 1085) filed by
Vernon Fire Fighters, Local 2312, I.A.F.F., et a1. v. City of
Vernon, et a1. Motion carried.

Discussion was held with reference to the Fire Chief's
action in holding in abeyance the suspension of Captain Pod1as.
I
It was moved by Kaeser, seconded by Ybarra, that in
recognition of the job related injury to Fire Captain Pod1as and
the possibility of financial hardship on him by reason of sus-
pension from duty during such time, the Fire Chief's action in
holding in abeyance such suspension until Captain Pod1as returned
to work is affirmed and ratified; and that by reason of the court
challenge of the validity of the Council imposed disciplinary
action on Captain Pod1as, his suspension shall be held in abeyance
until such court action is resolved. Motion carried.

meeting, it was moved by Kaeser, seconded by Ybarra. that the
meeting be adjourned. Motion carried.
