MINUTES OF A REGULAR MEETING
OF THE CITY COUNCIL OF THE
CITY OF VERNON HELD MAY 3,
1977, AT TWO O'CLOCK P.M. IN

The meeting was called to order by Mayor Leonis C.
Malburg.
It was moved by McCormick, seconded by Kaeser, that
minutes of the meeting of April 19, 1977, be approved as written
and submitted. Motion carried.
Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/Building, dated April 27, 1977, transmitting Addendum
No. 1 to Contract No. 405, Pavement Marker Installation; and
recommending that Addendum No. 1 to Co'ntract No. 405 be approved
prior to opening of bids, was presented.

It was moved by Gonzales, seconded by Ybarra, that
Adde'ndum No. 1 to Contract No. 405, Pavement Marker Installation,
be approved. Motion carried.
The Clerk announced that this was the t~e and place
for opening of bids for Pavement Marker Installation, Bandini
Boulevard (Downey Road to Atlantic Boulevard) and District Boule-
vard (Corona Avenue to Gifford Avenue), in accordance with Contract
No. 405.
It was moved by McCormick, seconded by Ybarra, that the
Clerk be instructed to open and read the bids submitted. Motion
carried.
The Clerk opened and read the following bid:

It was moved by McCormick, seconded by Kaeser, that the
bid received for Pavement Marker Installation, Bandini Boulevard
(Downey Road to Atlantic Boulevard) and District Boulevard (Corona
Avenue to Gifford Avenue), in accordance with Contract No. 405 be
referred to the Director of Public Works/Building and the City
Attorney for checking and report. Motion carried.
Communication from Aluminum Company of America, dated
April 18, 1977, with reference to the Vernon Fire Department,
was presented. (Copy to each member of the City Council)
It was moved by Kaeser, seconded by Gonzales, that com-
munication from Aluminum Company of America, dated April 18, 1977,
be received and filed. Motion carried.

Communication from S. E. Hogan, Police Chief, dated
April 20, 1977, requesting that Raymond L. Michalski be advanc-
ed to Patrolman, Grade 1, effective May 1, 1977, was presented.

It was moved by Ybarra, seconded by Kaeser, that the
request of the Police Chief, dated April 20, 1977, be approved.
Motion carried.
Communicatio'n from A. E. Nelson, Jr., Director of Pub-
lic Works/Building, dated April 26, 1977, with reference to re-
quest for variance to the Uniform Building Code by Glass
Containers Corporation, 3601 Santa Fe Avenue, advising that the
Building Division and the Fire Department recommend acceptance
of this variance, namely two wall openings, one 2' x 3' and one
l' x 2', provided the openings are protected by an approved
automatic water curtain for each opening, was presented. (Copy
to each member of the City Council)
It was moved by McCormick, seconded by Gonzales, that
Glass Containers Corporation, 3601 Santa Fe Avenue, IE granted
a variance to the Uniform Building Code, namely two wall open-
ings, one 2' x 3' and o'ne l' x 2', provided the openings are
protected by an approved automatic water curtain for each open-
ing. Motion carried.

Chief, dated April 26, 1977, requesting that the following per-

lic Works/Building, dated April 27, 1977, with reference to bids
received for Vernon Avenue Improvement in accordance with Contract
No. 406, recommending that the Contract be awarded to Vernon
Paving Company on the basis of their bid of $77,200.10, was
presented.
Resolution No. 4474 - A Resolution of the City Council
of the City of Vernon Accepting the Bid of Vernon Paving Company
for Vernon Avenue Improvement in Accordance ~th Contract No.
406 of the City of Vernon, was presented.

Public Works/Building, dated April 27, 1977, requesting author-
ity for the Purchasing Agent to add w Purchase Order No. 11360
to cover chemical treatment and photographing of Well No. 12 and
to cover other necessary steps to complete the redevelopment of
Well No. 12, was presented. (Copy to each member of the City
Council)
It was moved by Kaeser, seconded by Ybarra, that the
request of the Director of Public Works/Building, dated April 27,
1977, be approved. Motion carried.
Communication from F. H. Colvin, Fire Chief, dated
April 27, 1977, requesting authority to attend the California
Fire Chiefs' Conference at San Jose, California, from May 23 to
28, 1977, with an expense allowance of $368.50, was presented.
It was moved by McCormick, seconded by Ybarra, that
the request of the Fire Chief, dated April 27, 1977, be approved
and authority granted to issue warrant in the amount of $368.50
to F. H. Colvin. Motion carried.
Communication from F. A. Ziemer, City Clerk-Director
of Finance, dated April 26, 1977, requesting authority for Bruce
V. Malkenhorst to attend the Municipal Finance Officers' 1977
Legislative Seminar at Sacramento, California, on May 20, 1977,
with an expense allowance of $88.90, was presented.

the request of the City Clerk-Director of Finance, dated April
26, 1977, be approved and authority granted to issue warrant in
the amount of $88.90 to Bruce V. Malkenhorst. Motion carried.
Report from Louis S. Hauger, Director of Environmental
Health, dated April 28, 1977, on local enforcement agency -
Z'berg-Kapiloff Solid Waste Control Act of 1976, making certain
enumerated recommendations, was presented. (Copy to each member
of the City Council)
It was moved by Kaeser, seconded by McCormick, that
the recommendations of the Director of Environmental Health, be
approved as enumerated in his report dated April 28, 1977, rela-
tive to local enforcement agency - Z'berg-Kapiloff Solid Waste
Control Act of 1976. Motion carried.

Resolution No. 4471 A Resolution of the City Council
of the City of Vernon Fi'ndi'ng the City Solid Waste Disposal Site
to be Exempt from the provisions of Title 7.3 of the Government
Code of the State of California, was presented.

Resolution No. 4471 be approved 8ld adopted. Motion carried.

the period April 16 - 30, 1977, inclusive, was presented.
It was moved by Ybarra, seconded by Kaeser, that
Activity Log of the Police Department be received and filed.
Motion carried.
Communication from Brooks Carden, Purchasing Agent,
dated April 29, 1977, advising that he has filed with the Public
Employees' Retirement System an Application for Retirement to
take effect August 16, 1977, was presented. (Copy to each member
of the City Council)
It was moved by Gonzales, seconded by Ybarra, that
communication from the Purchasing Agent, dated April 29, 1977,
be received and filed. Motion carried.

"Warrant Register No. 476" covering claims and demands
presented during the period April 16 to 30, which includes Demands
Nos. 7-1004 to 7-1065 (both inclusive) drawn on the United Cali-
fornia Bank, totaling $3,431,686.78 (Light and Power Warrants
$3,353,579.85) (Accounting Period May 1977), was examined and
audited.
It was moved by Ybarra, seco'nded by Kaeser, that
"Warrant Register No. 476" be approved and payment authorized for
Demands Nos. 7-1004 to 7-1065 (both inclusive) with no excep-
tions. Motion carried.

Marti'n & Harrison, Attorneys at Law, against the City of Verno'n,

Independent Cities of Los Angeles County, dated April 29, 1977,
with reference to Police Affiliation Court Case, was presented.

It was moved by Kaeser, seconded by Gonzales, that
the City of Vernon contribute the sum of $400.00 to the City of
West Covina in support of the Police Affiliation Court Case.
Motion carried.
Communication from National Institute of Municipal Law
Officers, dated April 26, 1977, with reference to the constitu-
tional challenge to the Federal Unemployment Compensation Amend-
ments of 1976, Public Law No. 94-566 (H.R. 10210) and the Acts
they amend, transmitting a participation Agreement and Questionnaire
to be returned to NIMLO by May 15, 1977, if the City of Vernon
wishes to participate, was presented. (Copy to each member of the
City Council)

It was moved by McCormick, seconded by Kaeser, that the
Mayor and the City Clerk be authorized to execute Participation
Agreement relative to a constitutional challenge to the Federal
Unemployment Compe'nsation Amendments of 1976, Public Law No. 94-566
(H.R. 10210) and the Acts they amend; and that authority be granted
to issue warrant in the amount of $2,500.00 payable to the NIMLO
Federal Unemp1oyme'nt Compe'nsatio'n Tax Litigation Trust Fund; and
that Deputy City Clerk-Deputy Director of Finance be directed to
answer the Questionnaire and attach a sworn affidavit as to his
estimate of the cost of this tax to the City of Vernon. Motion
carried.
Report from David B. Brearley, Deputy City Attorney,
dated May 3, 1977, to the City Council concerning the recognition
of the recognized employee organization of the Police Department
of the City of Verno'n; a'nd making certain recommendations in con-
nection therewith, was presented.
It was moved by McCormick, seconded by Kaeser, that the
recommendations of the Deputy City Attorney, dated May 3, 1977, be
approved. Motio'n carried.

Communication from the City of Beverly Hills, dated
April 27, 1977, addressed to Mayor Leonis C. Malburg, with
reference to a meeting that has been called for Monday, May 9,
1977, at 11:30 a.m., at the Hyatt Hotel, Los Angeles International
Airport, Ce'ntury and Sepulveda Boulevard, to discuss the implica-
tions of the proposal by the City of Los Angeles to charge for fire
mutual aid services, requesting the Mayor and the City of Verno'n's
Fire Chief to attend the meeting a'nd be prepared to discuss tha
issue; and to sign a reaffirmation of the principl~s of the
California Disaster and Civil Defense Master Mutual Aid Agreement,
was prese'nted.

It was moved by McCormick, seco'nded by Kaeser, that the
Fire Chief be instructed to attend the meeting scheduled for
Monday, May 9, 1977; and that the Fire Chief be authorized to sign
a reaffirmation of the principles of the California Disaster and
Civil Defense Master Mutual Aid Agreement. Motion carried.
