19770517 Regular City Council Meeting - Minutes I MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD MAY 17, 1977, AT TWO O'CLOCK P.M. IN THE LUNCH ROOM OF THE PUBLIC WORKS FACILITY LOCATED AT 4305 SANTA FE AVENUE, VERNON. CALIFORNIA COUNCIL PRESENT: Gonzales, Kaeser, Malburg, McCormick, Ybarra I COUNCIL ABSENT: None The meeting was called to order by Mayor Leonis C. Malburg. It was moved by Ybarra, seconded by Gonzales, that minutes of the meeting of May 3, 1977, be approved as written and submitted. Motion carried. I The Clerk announced that this was the time and the place for the Public Hearing for the purpose of determining whether the City's recognition of the Vernon Police Officers' Benefit Association, Teamsters Local 911, as the recognized employee organization for the police officers af the City of Vernon should be levoked on the grounds that said organization violates Section 3508 of the Government Code and is in conflict with Section 4F of Resalution No. 4027 of the City of Vernon. Communication fram Brundage, Beeson & Pappy, legal counsel for the Vernon Police Officers' Benefit Assaciation, dated May 6, 1977. confirming a request for continuance of the hearing regarding the revocatian of the Police Officers' Benefit Associatian as a recognized employee organization, was presented. Beche1y, Business Representa- tive, California Teamsters, Public, Professional & Medical Employ- ees Union, Local 911, dated May 16, 1977, addressed to Mr. Harry Keaton, Municipal Employee Relations Representative for the City of Vernon, advising that the three letters directed to the Police Chief dated April 15, April 17 and April 22, used an improper for- mat and are hereby rescinded effective immediately; and further advising that the Vernan Police Officers' Benefit Association is the recagnized employee organization, not the Teamsters Local 911, was presented. (Copy to each member of the City Council) I I Deputy City Attorney Brearley requested that the Mobile Radio Contract be discussed later in the meeting duri'ng an Executive Session. Communication fram the Finance Committee, dated May 9, 1977, transmitting a copy of the minutes of the meeting of the Finance Committee held May 9, 1977; and requesting the City Council to apprave the recommendations as outlined in the minutes of the meeting of the Finance Committee held May 9, 1977, was presented. (Copy to each member of the City Council) It was moved by Kaeser, seconded by McCormick, that the recommendations of the Finance Committee be approved as out- lined in the minutes of the meeting of the Finance Committee held May 9, 1977. Motion carried. Communicatian from A. E. Nelson, Jr., Director of Pub- lic Works/Building, dated May 9, 1977, advising that Charles J. Pluhar, Utility Man II, has submitted his resignation from City employment effective at the close af the working day May 13, 1977, was presented. I It was moved by Ybarra, seco'oded by Gonzales, that the resignation of Charles J. P1uhar be accepted. Motion carried. Communication from Chapman L. Bone, Chief af the Special Services Division, County of Los Angeles, dated May 9, 1977, transmitting Agreement for Animal Control Services for Fiscal Year 1977-78, was presented. (Copy to each member of the City Cauncil) It was moved by Gonzales, seconded by McCormick, that the Mayor and the City Clerk be autlD rized to execute Agreement between the County of Los Angeles and the City of Vernon for Animal Cantro1 Services for Fiscal Year 1977-78. Nelson, J'r.., Director of Public Works/Building, dated May 10, 1977, with reference to .bids received for Pavement Marker Installation o'n Bandini and District Boulevards in accardance with Contract No. 405, recom- mending that the contract be awarded to Traffic Appliance Corp- oration on the basis of their bid of $3,275.00, was presented. I Resa1ution No. 4477 - A Resolution of the City Council of the City of Vernan Accepting the Bid of Traffic Appliance Corparation for Pavement Marker Installation in Accordance with Contract NO'. 405 of the City of Vernon, as Supplemented, was presented. It was moved by Ybarra, seco'nded by McCormick, that Resolution No. 4477 be appraved and adopted. Motion carried. A. Tachovsky, Senior Electrical Inspector, attend their forthcoming Golden Jubilee Meeting, was presented. (Copy to each member of the City Council) I It was moved by McCormick, seconded by Ybarra, that communication fram the International Association of Electrical Inspectors, dated May 9, 1977, be received and filed. Motion carried. I Cammunication from S. E. Hogan. Police Chief, dated May 10, 1977, requesting that he be authorized to appoint Cadet Daniel J. Tabor to the position af Policeman, Grade 4, effective as af June 1, 1977, was presented. It was moved by Ybarra, seconded by Kaeser, that the request of the Police Chief, dated May 10, 1977, be referred to the Finance Committee for a recommendation. Motion carried. Report af Health Department Activities for the month af April, 1977, was presented. (Copy to each member of the City Council) It was moved by Gonzales, seconded by Kaeser, that the Report of Health Department Activities be received and filed. Motio'n carried. I Activity Log of the Police Department for the period May 1 - 15, 1977, inclusive, was presented. It was moved by Ybarra, seconded by Kaeser, that the Activity Log of the Police Department be received and filed. Motian carried. Cammunication from A. E. Nelson, Jr., Director of Pub- lic Works/Building, dated May 11, 1977, advising that the work on Ross Street under Cantract No. 368 has been completed; and recommending that the wark be accepted and that authority be granted to pay the cantractar, Crowell a nd Larson, in accordance with the Agreement, was presented. I I Resolution No. 4479 - A Resolution of the City Council af the City af Vernon Accepting the Wark of Crowell & Larson, Inc. for Ross Street Construction South of 38th Street in Accord- ance with Co'ntract No. 368 of the City of Vernon, was presented. It was moved by Kaeser, secanded by Ybarra, that Resolution No. 4479 be approved and adapted. Motion carried. Motion carried. I Communication from the Vernon Chamber of Commerce, dated May 12, 1977, regardi'ng the City's investigation af the passibi1ity of contracting with L.A. County for fire services; and requesting that the Chamber Board of Directors be permitted to' appear and discuss the matter before the Council on May 17, 1977, was presented. Mr. Robert W. Adams, Manager of the Vernon Chamber of Cammerce, appeared befare the City Council and presented a com- munication, dated May 17, 1977, signed by Nicholas N. Weber, President of the Vernan Chamber af Commerce, requesting that the Vernon City Gaunci1 recognize the Vernon Chamber of Commerce as a working partner, offering its study and recommendations, re- garding all praposa1s concerning the future aperation of the Vernon Fire Service. (Copy to each member af the City Council) Mr. Weber commented o'n the written request. I It was moved by Gonzales, seconded by Ybarra, that the communications from the Vernon Chamber of Commerce, dated May 12, and 17, 1977, be received and filed. Motion carried. Cammunication from A. E. Nelson, Jr., Director of Pub- lic Works/Building, dated May 12, 1977, transmitting a capy of communication from Deputy City Attorney Brearley, dated May 9, 1977, with reference to interpretatian af zoning Ordinance NO'. 856 relating to the proposed use of property located at 3750 Jewel Avenue by Envira'nmenta1 Fuels, Inc.; and presenting a pro- gress repart on the matter, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Ybarra, that communicatian from the Director of Public Works/Building, dated May 12, 1977, together with transmittal, be received and filed. I I Cammunicatian from John Ferrara, Chairman of the County Transportation Commission, dated April 28, 1977, requesting that he be advised if the City of Verno'n would be willing to contribute financial support to continue S.C.R.T.D. Services and the approx- imate magnitude of the suppart, was presented. (Copy to each member of the City Council) It was moved by Gonzales, seconded by Kaeser, that John Ferraro, Chairman af the County Transpartation Commission, be advised that the City of Vernon is not willing to cantribute financial suppart to continue S.C.R.T.D. Services as the City Council feels that the funding of public transportation should be borne by the users of the system. Mation carried. 256 -5- 5-17-77 Communicatio'n from S. E. Hogan, Police Chief, dated May 13, 1977, indicating the desire of the Police Department to continue its membership in the California Narcotic Infarmation Network and requesting dues in the sum of $75.00 be farwarded before August 31, 1977, was presented. I It was moved by McCormick, seconded by Gonzales, that the request of the Police Chief, dated May 13, 1977, be appraved and authority granted to issue warrant in the amount of $75.00 to California Narcotic Information Network. Motion carried. 'I Communication from Sf E. Hogan, Police Chief, dated May 12, 1977, requesting authority for Lt. B. G. Emric~ to' attend the California Law Enforcement "Annual Training Conference" at Anaheim, California, from May 19 - 21, 1977, with an expense allowance of $96.00, was presented. It was moved by McCormick, seconded by Ybarra, that the request of the palice Chief, dated May 12, 1977, be approved and authority granted to issue warrant in the amount of $96.00 to' B. G. Emrick. Motio'n carried. I "Warrant Register No. 477" covering claims and demands presented during the periad May 1 to 15, which includes Demands NO's. 7-1066 to 7-1245 (bath inclusive) drawn on the United Cali- farnia Bank, totaling $219,599.97 (Light and Power Warrants $95,335.32) (Accounting Period May 1977), was examined ald audited. It was moved by Ybarra, seconded by McCormick, that "Warrant Register No. 477" be appraved and payment authorized for Demands Nos. 7-1066 to 7-l245 (bath inclusive), with no ex- ceptions. Motion carried. I It was moved by Ybarra. seconded by McCormick, that "Payroll Warrant Register No. 239" be approved and payment author- ized for Demands Nos. 2492 to' 2503 (both i'nc1usive), with no ex- ceptions. Hubbard, was presented. I It was moved by McCormick, seconded by Gonzales, that Resa1ution No~ 4478 be approved and adopted. Motion carried. Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: None Absent: None I The Mayor requested the City Council m go into Execu- tive Session at 2:57 o'clock p.m. pursuant to Government Code Section 54957.6 for the purpose of reviewing with Deputy City Attorney Brearley and Deputy City Clerk-Deputy Director of Finance Malkenhorst, of the Council's position regarding salaries, salary schedules, or compensation paid in the form of fringe benefits of employees in the recognized units of the Vernon Fire Fighters Local 2312; and for the purpose of instructing the City's repre- sentatives relative to these matters. It was moved by Ybarra, seconded by Kaeser, that the City Council go into Executive Session. Motion carried. Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: Nane Absent: None I All persons, with the exception of the City Clerk- Director of Finance, Deputy City Clerk-Deputy Director of Finance Malkenharst and Deputy City Attorney Brearley were excluded from the Executive Session. Mayor Malburg ordered that communications to and from the Executive Session were deemed private. At this time, 3:37 o'clock p.m., Councilman Kaeser was excused. The Executive Session ended at 4:02 o'clock p.m. Resolution No. 4473 - A Resolution of the City Council of the City of Vernon Commending Mr. Frank Ziemer far His Years of Outstanding Service an Behalf of the City, was presented. I It was moved by Ybarra, seconded by McCormick, that Resolution No. 4473 be approved and adopted. Motion carried. Ayes: Go'nzales, Malburg, McCormick, Ybarra Noes: None Absent: Kaeser I Deputy City Attorney Brearley requested the City Council to go into Executive Session to discuss the Pod1as litigation and the Mobile Radio Cantract matters within the attorney-client privileges. It was moved by McCormick, seconded by Ybarra, that the City Council go into Executive Session. Motion carried. Ayes: Gonzales, Malburg, McCormick, Ybarra Noes: None Absent: Kaeser 258 -7- 5-17-77 The City Council went into Executive Session at 4:03 o'clock p.m. to discuss the Pod1as litigation and the Mobile Radio Contract matters within the attorney-client privileges. I Mayor Malburg ordered that communications to and from the Executive Session were deemed private. The Executive Session ended at 4:18 o'clock p.m. I There being no further business to came before the meeting, it was moved by Ybarra, seconded by McCormick, that the meeting be adjourned.
