19770705 Regular City Council Meeting - Minutes MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD JULY 5, 1977, AT TWO 0' CLOCK P. M. IN THE LUNCH ROOM OF THE PUBLIC WORKS FACILITY LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA I COUNCIL PRESENT: Gonzales, Kaeser, Malburg, McCormick, Ybarra COUNCIL ABSENT: None I Malburg. The meeting was called to order by Mayor Leonis C. It was moved by Gonzales, seconded by Kaeser, that minutes of the meeting of June 28, 1977, be approved as written and submitted. Motion carried. Resolution No. 4488 - A Resolution of the City Council of the City of Vernon Approving a Budget for the Fiscal Year 1977-78, was presented; It was moved by McCormick, seconded by Ybarra, that Resolution No. 4488 be approved and adopted. Motion carried. Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: None Absent: None Communication from A. E. Nelson, Jr., Director of Public Works/Building, dated June 22, 1977, transmitting a pro- posed Agreement between Central and West Basin Water Replenish- ment District and the City of Vernon; and recommending that the Mayor and the City Clerk be authorized to execute said Agreement on behalf of the City of Vernon, was presented. (Copy to each member of the City Council) It was moved by Gonzales, seconded by Ybarra, that the proposed Agreement between Central and West Basin Water Re- plenishment District and the City of Vernon be approved and that the Mayor and the City Clerk be authorized to execute said Agreement on behalf of the City of Vernon. Motion carried. Communication from S. E. Hogan, Police Chief, dated June 22, 1977, transmitting copy of a "Lease of Personal Prop- erty" on a 1977 Moto Guzzi motorcycle which Officer Byrt M. Waller agrees to lease to the City of Vernon, effective June 21, 1977; and recommending that the existing lease agreement between Officer Waller and the City of Vernon, dated August 5, 1975, be terminated, was presented. It was moved by Kaeser, seconded by McCormick, that the "Lease of Personal Property" on a 1977 Moto Guzzi motor- cycle between Officer Byrt M. Waller and the City of Vernon, be approved; that the Mayor and the City Clerk be authorized to execute said Agreement; and that the existing lease agreement between Officer Waller and the City of Vernon, dated August 5, 1975, be terminated. Motion carried. Communication from S. E. Hogan, Police Chief, dated June 22, 1977, recommending that former Vernon Police Officer, George Skalsky be reimbursed in the sum of $64.00 for the loss of an item of police equipment for which he was charged and sub- sequently recovered and returned to the Police Department, was presented. MOtion carried. Communication from Judy R. Ormesher, dated June 22, 1977, requesting to be considered as an applicant to lease one of the City-owned two-bedroom apartments located on 50th Street, was presented. It was moved by McCormick, seconded by Kaeser, that the communication from Judy R. Ormesher, dated June 22, 1977, be received and filed for future consideration. MOtion carried. Communication was presented from F. H. Colvin, Fire Chief, dated June 20, 1977, requesting that the following per- sonnel be reimbursed from the City's Education and Training Budget appropriation: L. C. Matteson R. A. Garcia $ 10.00 25.00 I It was moved by Kaeser, seconded by Ybarra, that the request of the Fire Chief, dated June 20, 1977, be approved and authority be granted to issue warrants in the amount of $10.00 to L. C. Matteson and $25.00 to R. A. Garcia. MOtion carried. Communication from M. T. Mello, Assistant Fire Chief, dated June 21, 1977, advising that he has applied for his ser- vice retirement, effective at the close of the business day September 30, 1977, was presented. It was moved by McCormick, seconded by Kaeser, that communication from M. T. Mello, dated June 21, 1977, be receiv- ed and filed. MOtion carried. Communication from F. H. Colvin, Fire Chief, dated June 23, 1977, recommending that Captain X. J. Padilla and Autofireman, John R. Kriste be granted military 1eaves-of- absence with pay to report to active duty training in Ian Fran- cisco, California, from July 10 to 15, 1977, was presented. It was moved by Kaeser, seconded by Ybarra, that the recommendation of the Fire Chief, dated June 23, 1977, be approv- ed. Motion carried. I Communication from A. E. Nelson, Jr., Director of Public Works/Building, dated June 24, 1977, transmitting a Re- vised Agreement from the County of Los Angeles for the Examina- tion of Tract Maps and Parcel Maps; recommending that the Mayor and the City Clerk be authorized to execute the Agreement and that an Ordinance be adopted setting the checking fees, was presented. It was moved by Gonzales, seconded by Ybarra, that the recommendations of the Director of Public Works/Building, dated June 24, 1977, be approved. MOtion carried. Communication from Vernon Police Officer, Larry Ebelt, dated June 24, 1977, submitting his resignation as Police Officer from the City of Vernon effective the close of business June 25, 1977, was presented. . It was moved by Ybarra, seconded by McCormick, that communication from Vernon Police Officer, Larry ~e1t, dated June 24, 1977, be received and filed. MOtion carried. Nelson, Jr., Director of Public Works/Building, dated June 28, 1977, advising that the work for Pavement Marker Installation under Contract No. 405 has been completed; and recommending that the work be accepted and authority granted to pay the contractor, Traffic Appliance Corporation, in accordance with the agreement, was presented. Resolution No. 4489 - A Resolution of the City Council of the City of Vernon Accepting the Work of Traffic Appliance Corporation for Pavement Marker Installation, in Accordance with Contract No. 405 of the City of Vernon, was presented. It was moved by McCormick, seconded by Gonzales, that Resolution No. 4489 be approved and adopted. Motion carried. Garner, Vernon Fire Department, dated June 24, 1977, advising the City Council that he has filed for his retirement, effective August 17, 1977, was presented. (Copy to each member of the City Council) It was moved by Ybarra, seconded by McCormick, that communication from Thomas H. Garner, dated June 24, 1977, be received and filed. Motion carried. Communication from the City of Walnut, dated June 27, 1977, transmitting copy of Resolution No. 1687 Opposing SB 287 and Urging Defeat in the Committee on Local Government, which was adopted by the Walnut City Council on June 8, 1977, was pre- sented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Ybarra, that Resolution No. 1687 received from the City of Walnut by trans- mittal dated June 27, 1977, be received and filed. Motion carried. I I Communication from Taylor Kupfer & Summers, Attorneys for Dorothy M. Dautrich, et a1., dated June 27, 1977, transmit- ting a Third Amended Petition for Peremptory Writ of Mandate (CCP la085) filed in the Los Angeles Superior Court, Case No. CA 000295, advising that they have been directed by the Court to include the City of Vernon as a Respondent in the action, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Ybarra, that the City Clerk be authorized to accept service of the Third Amended Petition for Peremptory Writ of Mandate (CCP la085) and that the matter be referred to the City Attorney with the in- struction that he contact the Attorney General's Office and act on behalf of the City of Vernon in any further action necessary. Motion carried. Activity Log of the Police Department for the period June 16 - 30, 1977, inclusive, was presented. It was moved by Kaeser, seconded by McCormick, that Activity Log of the Police Department be received and filed. Motion carried. "Warrant Register No. 480" covering claims and deman:1. s presented during the period June 16 to 30, which includes Demands Nos. 7-1475 to 7-1529, (both inclusive) drawn on the United Cali- fornia Bank, totaling $3,572,193.28 (Light and Power Warrants $3,425,563.13) (Accounting Period June 1977), were examined and audited. 275 -4- 7-5-77 I I It was moved by Ybarra, seconded by Gonzales, that '~arrant Register No. 480" be approved and payment authorized for Demands Nos. 7-1475 to 7-1529 (both inclusive), with no exceptions. Motion carried. Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: None Absent: None All persons, with the exception of the City Clerk- Director of Finance, Bruce V. Malkenhorst, and City Attorney, David B. Brearley, were excluded from the Executive Session. Mayor Malburg ordered that communications to and from the Executive Session were deemed private. The Executive Session ended at 3:25 o'clock p.m. There being no further business to come before the meeting, it was moved by Ybarra, seconded by Gonzales, that the meeting be adjourned.
