19770816 Regular City Council Meeting - Minutes I I I I I MINUTES OF A REGULAR MEETING OF tHE CITY COUNCIL OF THE CITY OF VERNON, HELD AUGUST 16, 1977, AT TWO 0' CLOCK P. M. IN THE LUNCH ROOM OF THE PUBLIC WORKS FACILITY LOCATED AT 4305 SANTA FE AVENUE, VERNON. CALIFORNIA COUNCIL PRESENT: COUNCIL ABSENT: Gonzales, Kaeser, McCormick, Ybarra Malburg The meeting was called to order by Mayor Pro Tempore Thomas A. Ybarra. It was moved by Kaeser, seconded by Gonzales, that minutes of the meeting of August 2, 1977, be approved as written and submit- ted. Motion carried. Communication from Bruce V. Ma1kenhorst, City Clerk-Direc- tor of Finance, dated August 16, 1977, recommending that the Council defer further consideration of the Finance Committee recommendations that (1) The City subcontract for paramedic service; and (2) The City finalize negotiations with Medevac over this company's proposals until after the next negotiations, was presented. (Copy to each mem- ber of the City Council) It was moved by Kaeser, seconded by Gonzales, that the rec- ommendation of the City Clerk-Director of Finance, dated August 16, 1977, be approved. Motion carried. Bruce V. Ma1kenhorst, City Clerk-Director of Finance sub- mitted a report entitled "Staff Report of Costs Attributable to Paramedic Services" recommending that it be received and filed for future consideration. It was moved by Kaeser, seconded by Gonzales, that the rec- ommendation of the City Clerk-Director of Finance be approved, and the report entitled "Staff Report of Costs Attributable to Paramedic Services" be received and filed for future consideration. Motion carried. Communication from A~ E. Nelson, Jr., Director of Public Works/Building, dated August 1, 1977, recommending that authority be granted for Raymond R. Rich to attend the Drought Conference; Indust- rial Water Allocation & Conservation in Los Angeles on July 28 & 29, 1977, with an expense allowance of $26.00, was presented. It was moved by Kaeser, seconded by Gonzales, that the rec- ommendation of the Director of Public Works/Building, dated August 1, 1977, be approved and authority granted to issue warrant in the sum of $26.00 to Raymond R. Rich. Motion carried. Communication from S. E. Hogan, Police Chief, dated August 2, 1977, recommending that authority be granted for Captain A. E. Chrisman and Lt. L. S. Rosenkrantz to attend the California Intelli- gence Seminar at San Diego from September 13 - 16, 1977, with an ex- pense allowance of $297.68 each, was presented. It was moved by Gonzales, seconded by Kaeser, that the rec- ommendation of the Police Chief, dated August 2, 1977, be approved and authority granted to issue warrants in the sum of $297.68 each to A. E. Chrisman and L. S. Rosenkrantz. Motion carried. Communication from Leon B. Kenzy, City of Vernon Fire Capt. Retired, dated July 30, 1977, advising that the Workers' Compensation Appeals Board has made a determination in his case and he is resubmit- ting his request for 14 days vacation pay for the year 1976, in accord- ance with the City Council's previous instructions August 17, 1976, was presented. 012 I I I I I -2- 8-16-77 It was moved by Kaeser, seconded by Gonzales, that the communication from Leon B. Kenzy, dated July 30, 1977, resubmitting his request for 14 days vacation pay for the year 1976, be referred to the Finance Committee. MOtion carried. It was moved by Gonzales, seconded by Kaeser, that in accordance with Government Code Section 36934, the reading of Ordi- nance No. 882 in full be waived; and that Ordinance No. 882 receive a second and final reading by title. It was moved by Gonzales, seconded by Kaeser, that Ordi- 882 receive and pass a second and final reading and be Motion carried. Nelson, Jr., Director of Public Works/Building, dated August 8, 1977, advising that the bids for Traffic Signal Maintenance 1977-80 have been reviewed; recommending that Contract No. 411 be awarded to Signal Maintenance, Inc., on the basis of their bid of $8,136.24, was presented. Resolution No. 4493 - A Resolution of the City Council of the City of Vernon Accepting the Bid of Signal Maintenance, Inc. for Traffic Signal Maintenance 1977-80 in accordance with Contract No. 411 of the City of Vernon, was presented. It was moved by Kaeser, seconded by Gonzales, that Reso1u- 4493 be approved and adopted. Motion carried. (Copy to each member of the City Council) It was moved by Kaeser, seconded by McCormick, that Report of Health Department Activities be received and filed. Motion carried. Communication from F. H. Colvin, Fire Chief, dated August 8, 1977, requesting authorization and funds to install an awning structure at Fire Station #2 at an estimated cost of $800, was presented. It was moved by Kaeser, seconded by Gonzales, that the re- quest of the Fire Chief, dated August 8, 1977, be referred to the Finance Committee. Motion carried. Communication from the League of California Cities, dated August 5, 1977, requesting the City Council to designate a voting representative and alternate who will be present at the Business Session of the Annual Conference Wednesday morning, September 28, 1977, at 10:30 a.m., was presented. It was moved by Kaeser, seconded by Gonzales, that Council- man William M. McCormick be designated Voting Delegate and that City Attorney, David B. Brearley be designated as Voting Alternate to the Annual League of California Cities Conference. It was moved by McCormick, seconded by Gonzales that Activity Log of the Police Department be received and filed. MOtion carried. Communication from the City of Bell, dated August 8, 1977, transmitting a proposed joint resolution with the Cities of Bell, Cudahy, Huntington Park, Maywood, South Gate and Vernon, Commending Assemblywoman Teresa Hughes, for consideration by the Vernon City Council, was presented. (Copy to each member of the City Council) After being advised by the City Attorney that the Resolu- tion, if adopted by the City Council, would be assigned City of Vernon Resolution No. 4497, it was moved by McCormick, seconded by Kaeser, that the joint resolution Commending Assemblywoman Teresa Hughes, City of Vernon Resolution No. 4497, be approved and adopted and that the City Clerk be instructed to reply to the City of Bell advising of the approval and adoption of the Joint Resolution. Nelson, Jr., Director of Public Works/Building, dated August 10, 1977, transmitting Contract No. 412, 25th Street and 37th Street Slurry Sealing, Alameda Street to Santa Fe Avenue; recommending that this Contract be approved and authority granted to advertise for bids, was presented. Resolution No. 4494 - A Resolution of the City Council of the City of Vernon Approving Contract No. 412 and Authorizing Notice Inviting Sealed Proposals or Bids for 25th Street and 37th Street Slurry Sealing, Alameda Street to Santa Fe Avenue, in accordance with Contract No. 412 of the City of Vernon, was presented. It was moved by Gonzales, seconded by McCormick, that Resolution No. 4494 be approved and adopted. Motion carried. Denney, dated August 11, 1977, submitting his resignation as police officer from the City of Vernon, effective at the close of business September 7, 1977, was presented. It was moved by Kaeser, seconded by McCormick, that the resignation submitted by Paul R. Denney via his communication dated August 11, 1977, be accepted, effective September 7, 1977. Motion carried. Communication from Kendall D. Stahly, dated August 11, 1977, submitting his resignation as police officer from the City of Vernon, effective at the close of business September 7, 1977, was presented. It was moved by McCormick, seconded by Kaeser, that the resignation submitted by Kendall D. Stahly via his communication dated August 11, 1977, be accepted, effective September 7, 1977, Motion carried. Communication from S. E. Hogan, Police Chief, dated August 10, 1977, advising that effective August 15, 1977, officer J. E. Prahm will have been absent from duty due to an alleged back injury for 365 days; and recommending that the officer be removed from the City payroll effective August 15, 1977, was presented. 014 I I I I I -4- 8-16-77 It was moved by Kaeser, seconded by McCormick, that the recommendation of the Police Chief, dated August 10, 1977, be approved. Motion carried. Communication from Bruce V. Ma1kenhorst, City C1erk- Director of Finance, dated August 12, 1977, recommending that Toma1yn C. Bures be advanced from Secretary - Deputy City Clerk Grade 4 to Grade 3, effective September 1, 1977, as she has satis- factorily completed one year in her present grade, was presented. It was moved by Gonzales, seconded by Kaeser, that the recommendation of the City Clerk-Director of Finance, dated August 12, 1977, be approved. Motion carried. Communication from the City Council of the City of Long Beach, transmitting a Resolution No. C22360 - Recommending that the League of California Cities Adopt a Resolution Supporting a Nation- al No-Fault Vehicle Liability System, which has been forwarded to the League to be considered at the Annual Conference to be held September 26, 1977, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Gonzales, that Resolution No. C 22360 adopted by the City Council of the City of Long Beach be received and filed. MOtion carried. "Warrant Register No. 483" covering claims and demands presented during the period August 1 to 15, which includes Demands Nos. 7-1735 to 7-1881 (both inclusive) drawn on the United Califor- nia Bank, totaling $121,760.23, (Light and Power Warrants $49.01), was examined and audited. It was moved by Gonzales, seconded by McCormick, that "Warrant Register No. 483" be approved and payment authorized for Demands Nos. 7-1735 to 7-1881 (both inclusive), with no exceptions. MOtion carried. Ayes: Noes: Absent: Gonzales, Kaeser, McCormick, Ybarra None Malburg "Payroll Warrant Register No. 242" covering claims and demands presented during the period July 1 to 31, which includes Demands Nos. 2527 to 2536 (both inclusive) drawn on the Crocker National Bank, totaling $530,671.78 (Accounting Period July 1977), was examined and audited. It was moved by Gonzales, seconded by McCormick, that "Payroll Warrant Register No. 242" be approved and payment author- ized for Demands Nos. 2527 to 2536 (both inclusive), with no excep- tions. Motion carried. Ayes: Gonzales, Kaeser, McCormick, Ybarra Noes: None Absent: Malburg Communication from the Finance Committee, dated August 12, 1977, transmitting copies of the minutes of the Finance Commit- tee meetings of August 8 and August 10, 1977; requesting that the City Council approve the recommendations as outlined in said minutes of the Finance Committee meetings of August 8 and August 10, 1977, was presented. (Copies to each member of the City Council) After discussion, it was moved by McCormick, seconded by Kaeser, that with the exception of the items previously deferred and the recommendation that "the position of Dispatcher be subject to the direction of and jurisdiction of the City Clerk for the first 6 months of operation and be called the Dispatch Department", all other recom- mendations outlined in said minutes, be approved. Motion carried. 015 I I I I I -5- 8-16-77 Communication from Arthur Hoover, dated August 16, 1977, submitting his resignation as police officer from the City of Vernon effective the close of business September 9, 1977, was presented. It was moved by Gonzales, seconded by Kaeser, that the resignation of Arthur Hoover, dated August 16, 1977, be accepted, effective September 9, 1977. Motion carried. Communication from F. H. Colvin, Fire Chief, dated August 16, 1977, requesting authorization and funds to purchase a new re- frigerator for Fire Station #1 at an approximate cost of $420.00, was presented. It was moved by Gonzales, seconded by Kaeser, that the re- quest of the Fire Chief, dated August 16, 1977, be approved. Motion carried. Communication from L. S. Hauger, Director of Environmental Health, dated August 15, 1977, recommending that authority be grant- ed for Eve Wise, R. N., to attend the USC School of Medicine National Conference on Pre-Hospital Care at Century City, California, from August 31 to September 2, 1977, with an expense allowance of $216.00, was presented. It was moved by McCormick, seconded by Gonzales, that the recommendation of the Director of Environmental Health, dated August 15, 1977, be approved and authority granted to issue warrant in the amount of $216.00 to Eve Wise. Motion carried. Communication from Javier Lomeli of the E1 Huapango Cafe, dated August 15, 1977, requesting that he be granted a City License for entertainment on Fridays, Saturdays and Sundays at the E1 Huapango Cafe located at 4903 Santa Fe Avenue, Vernon, California, commencing August 19, 1977 and to extend for the length of their lease, approximately 1980, was presented. The City Attorney indicated that Chapter 9 of the Vernon City Code requires the owner of a business to make the application for public dance permit and that a permit may not be issued for any longer than six (6) months. He further indicated that the owner of the Alcoholic Beverage Control Liquor License would be considered the owner of the business under Chapter 9 of the Vernon City Code. Therefore, he recommended that the application be denied and that the City Clerk notify the applicant of the denial and reason therefor. It was moved by McCormick, seconded by Gonzales, that pur- suant to Chapter 9 of The Code of The City of Vernon, the application of Javier Lomeli be denied in accordance with the advice and recom- mendation of the City Attorney and that the City Clerk be instructed to notify Mr. Lomeli of this action. Motion carried. Resolution No. 4495 - A Resolution of the City Council of the City of Vernon Fixing the Amount of Money Necessary to be Raised by Taxation Upon the Taxable Property Within said City as a Revenue to Carryon the Various Departments of such Municipal Corporation for the Fiscal Year Commending July 1, 1977, and to Pay the Bonded or Other Indebtedness of said City of Vernon, or any Portion or District Thereo~, was presented. It was moved by McCormick, seconded by Kaeser, that Reso- lution No. 4495 be approved and adopted. Motion carried. Colvin, Fire Chief, appeared and read the communi- cation from the County of Los Angeles - Department of Health Services, dated August 10, 1977, denying the request of certification extension to the Vernon Fire Department Paramedics. Reso- 1ution It was moved by McCormick, seconded by Gonzales, that the communication from the County of Los Angeles - Department of Health Services, dated August 10, 1977, be received and filed. Motion carried. It was moved by Gonzales, seconded by Kaeser, that the City Council go into Executive Session in accordance with Gov. Code 54957. Motion carried. Ayes: Noes: Absent: Gonzales, Kaeser, McCormick, Ybarra None Malburg All persons, with the exception of the City Clerk-Director of Finance and the City Attorney, were excluded from the Executive Session. Mayor Pro Tempore, Thomas A. Ybarra, ordered that all com- munications to and from the Executive Session were deemed private. The Executive Session ended at 2:57 p.m. There being no further business to come before the meeting, it was moved by Kaeser, seconded by Gonzales, that the meeting be adjourned until Tuesday, August 30, 1977, at 2:00 p.m. in the lunch room of the Public Works Facility located at 4305 Santa Fe Avenue, Vernon, California.
