19771213 Regular City Council Meeting - Minutes MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD DECEMBER 13, 1977, AT 4:30 O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE.. VERNON.. CALIFORNIA I I COUNCIL PRESENT: COUNCIL ABSENT: Gonzales, Kaeser, Malburg, McCormick, Ybarra None Malburg. The meeting was called to order by Mayor Leonis C. At this time, 4:30 o'clock p.m., it was moved by Gonzales, seconded by Ybarra, that the City Council go into Executive Session in accordance with Government Code Section 54957.6. MOtion carried. Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: None Absent: None I All persons, with the exception of the City Clerk and the City Attorney, were excluded from the Executive Session. Mayor Malburg ordered that all communications to and from the Executive Session were deemed private. It was moved by Ybarra, seconded by Gonzales, that the City Council go out of Executive Session. MOtion carried. The Executive Session ended at 5:25 o'clock p.m. Discussion was held regarding the Fire Chief's un- authorized intervention in the City's Labor Negotiations by his request for certain information from the County of Los Angeles Fire Department and transmitting same to the Fire Association. It was moved by Gonzales, seconded by Ybarra, that the Fire Chief, F. H. Colvin, be suspended for one day, without pay and that the City Clerk be instructed to write a letter advising the Fire Chief that the Council's action would be final ualess he wishes to contest said action and submit additional informa- tion at the next regularly scheduled City Council meeting on December 20, 1977. MOtion carried. Discussion was held with reference to the building located at 28th Street and Santa Fe Avenue; the City Clerk was requested to investigate the status of said building and report back to the Council. S. E. Hogan, Police Chief, appeared and addressed the Council concerning the matter of filling the available Police Cadet positions. It was moved by McCormick, seconded by Kaeser, that the Police Chief submit a list of four qualified candidates who have undergone complete physical examinations commensurate with the duties of the position, with a recommendation for the two he feels best qualified to fill the two authorized Cadet posit- ions; and, that when the Cadets selected are assigned to the Sheriff's Academy for training, they be required to complete an additional physical examination commensurate with the duties of the position. MOtion carried. Communication from the Finance Committee, dated December 13, 1977, making the following recommendations, based on the actions taken at the Finance Committee meeting held on December 12, 1977: I I n58 -2- 12-13-77 I I 1. that the Application for Disability Retirement filed by Police Sergeant James Tucker, be approved; 2. that the Application for Disability Retirement filed by Police Officer George R. Stevens, be approved; 3. that the City Attorney be instructed to file an application to determine whether Police Lieutenant Donald E. Fisher's alleged injuries are industrial in nature, with the Workmens' Compensation Appeals Board, pursuant to Section 21026 of the Government Code; 4. that the City Council adopt a Resolution estab- lishing a temporary administrative procedure applicable to all Department Heads, Officers and Employees of the City of Vernon; 5. that the Police Chief be instructed to submit a list of at least six qualified applicants for the position of Police Cadet, with his recommendations: 6. that a Resolution be adopted extending the City Attorney's Contract with the City of Vernon for an additional six months, up to and including June 30, 1978. I Resolution No. 4520 - A Resolution of the City Council of the City of Vernon Determining the Disability of James Roland Tucker, a Local Safety Member Employed by the City of Vernon (Sections 21024 & 21025 Government Code), was presented. It was moved by Gonzales, seconded by Kaeser, that Resolution No. 4520 be approved and adopted. Motion carried. Ayes: Gonzales, Kaeser, Malburg,McCormick, Ybarra Noes: None Absent: None Resolution No. 4519 - A Resolution of the City Council of the City of Vernon Determining the Disability of George R. Stevens, a Local Safety Member Employed by the City of Vernon (Sections 21024 & 21025 Government Code), was presented. It was moved by McCormick, seconded by Ybarra, that Resolution No. 4519 be approved and adopted. Motion carried. Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: None Absent: None I I After discussion, it was moved by Gonzales, seconded by Kaeser, that the City Attorney be authorized and instructed to intervene on behalf of the City of Vernon regarding the Disability Retirement hearing of Police Lieutenant Donald E. Fisher before the Workmens' Compensation Appeals Board. Motion carried. Resolution No. 4518 - A Resolution of the City Council of the City of Vernon Establishing Temporary Administrative Pro- cedures Applicable to All DeparbBent Heads, Officers and Employ- ees of the City of Vernon, was presented. It was moved by Kaeser, seconded by Ybarra, that Resolution No. 4518 be approved and adopted. Motion carried. Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: None Absent: None 059 -3- 12-13-77 I I The matter of the Finance Conmittee's reconmendation regarding the submission of a list of qualified candidates for the position of Police Cadet, was omitted due to the previous Council action on the matter, which was taken by the City Council at this meeting. Resolution No. 4521 - A Resolution of the City Council of the City of Vernon Extending the Contract with the City Attorney Through June 30, 1978, was presented. It was moved by Kaeser, seconded by Ybarra, that Resolution No. 4521 be approved aad adopted. Motion carried. Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra Noes: None Absent:None There being no further business to come before the meeting, it was moved by Ybarra, seconded by Kaeser, that the meeting adjourn.
