19771220 Regular City Council Meeting - Minutes MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD DECEMBER 20, 1977, AT TWO 0' CLOCK P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON. CALIFORNIA I I COUNCIL PRESENT: COUNCIL ABSENT: Malburg, McCormick, Ybarra (Gonzales absent until 3:55 p.m.) Kaeser Malburg. The meeting was called to order by Mayor Leonis C. It was moved by McCormick, seconded by Ybarra, that minutes of the meeting held December 6, 1977, be approved as written and submitted. Motion carried. The Clerk announced that this was the time and place for opening of bids for Traffic Signal Installation at Santa Fe Avenue and 38th Street, Jewel Avenue and 37th Street, Soto Street and Bandini Boulevard-37th Street, Leonis Boulevard and Alcoa Avenue, in accordance with Contract No. 413. It was moved by Ybarra, seconded by MCCormick, that the Clerk be instructed to open and read the bids submitted. Motion carried. The Clerk opened and read the following bids: I Steiny and Co., Inc. C. T. & F., Inc. Electrend, Inc. $ 42,500.00 37,584.00 50,505.00 I It was moved by MCCormick, seconded by Kaeser, that the bids received for Traffic Signal Installation in accordance with Contract No. 413, be referred to the.Director of Public Works/Building and the City Attorney for checking and report. Motion carried. Communication from Don Hall, of the law firm of Darling, Hall, Rae & Gute, special counsel for the Light and Power Department - City of Vernon, transmitting the proposed Operating Agreement by and between the City of Vernon and Energy Services, Inc., a wholly owned subsidiary of Southern California Edison Company, was presented. Mr. Hall, who has been special counsel to the City of Vernon in matters relating to the Vernon Electrical System for the past 16 years, appeared and summarized the provisions of the proposed Operating Agreement which he had previously transmitted to all members of the City Council. He indicated that it was the best possible Agreement that could be negotiat- ed at this time and recommended its approval and execution. Mr. Hall delivered to the City Council the original proposed Agreement containing the signatures of the Officers of Energy Services, Inc., a wholly owned subsidiary of Southern California Edison Company. Paul Hendricks, Consulting Electrical Engineer for the City of Vernon regarding all matters affecting the City of Vernon electrical system, discussed the proposed Operating Agreement and indicated that it was the best possible Agree- ment which could be negotiated at this time and recommended its approval and execution. I Resolution No. 4523 - A Resolution of the City Council of the City of Vernon Approving the Proposed Operating Agreement with Energy Services, Inc., a wholly owned subsidiary of Southern California Edison Company and Authorizing the Execution Thereof, was presented. 061. -2- 12-20-77 I I It was moved by McCormick, seconded by Ybarra, that Resolution No. 4523 be approved and adopted. Nelson, Jr., Director of Public Works/Building, dated December 16, 1977, advising that the work on City Hall and Police Facility and Parking Structure under Contract No. 383 has been completed; recommending that the work be accepted and that authority be granted to pay the Contractor in accordance with the Agreement, was presented. Resolution No. 4524 - A Resolution of the City Council of the City of Vernon Accepting the Work on City Hall and Police Facility and Parking Structure, in Accordance with Contract No. 383 of the City of Vernon, was presented. It was moved by McCormick, seconded by Ybarra, that Resolution No. 4524 be approved and adopted. MOtion carried. Ayes: Gonzales, , Malburg, McCormick, Ybarra Noes: None Absent: Kaeser After discussion, it was moved by Ybarra, seconded by McCormick, that Resolution No. 4517 - Approving Contract No. 415 and Authorizing Notice Inviting Sealed Proposals or Bids for City Hall Landscaping in Accordance with Contract No. 415 of the City of Vernon, be amended extending the date of Decem- ber 20, 1977, for submitting bids, to January 3, 1978. MOtion carried. I I I Communication from Fireman Retired, Van M. Barr, dated December 5, 1977, requesting vacation pay incurred for the period July 1, 1975 through November 15, 1976, was presented. It was moved by McCormick, seconded by Ybarra, that the request of Fireman Retired, Van M. Barr, dated December 5, 1977, be referred to the Finance Committee for study and rec- ommendation. MOtion carried. Communication from S. E. Hogan, Police Chief, dated December 6, 1977, advising that due to Captain A. E. Chrisman's illness aad consequent absence from duty, and the appointment of Lt. Taylor to the position of Acting Captain of Patrol, Sgt. Putman has been acting in the capacity of Lieutenant and MOrning Watch Commander; recommending that Sergeant Putman be advanced to the rank of Acting Lieutenant Grade 3, effective as of Decem- ber 5, 1977, for the duration of Captain Chrisman's illness, was presented. It was moved by McCormick, seconded by Ybarra, that the recommendation of the Police Chief, dated December 6, 1977, be approved. Motion carried. Communication from F. H. Colvin, Fire Chief, dated December 5, 1977, requesting that Fireman Ronald L. Hedlund be reimbursed from the City's Education and Training Budget appro- priation in the sum of ~100.00 for courses satisfactorily com- pleted at Ca1 State Long Beach, was presented. It was moved by Ybarra, seconded by McCormick, that the request of the Fire Chief, dated December 5, 1977, be approved. Motion carried. 062 -3- 12-20-77 I I Communication from S. E. Hogan, Police Chief, dated December 1, 1977, recommending that Shirley Tucker be advanced to the position of Secretary Grade 2, having satisfactorily completed one year in her present grade, effective January 1, 1978, was presented. It was moved by McCormick, seconded by Ybarra, that the recommendation of the Police Chief, dated December 1, 1977, be approved. MOtion carried. Communication from Bruce V. Malkenhorst, City Clerk- Director of Finance, dated December 8, 1977, conveying the rec- ommendation of the Finance Committee made at its meeting held November 7, 1977, that based on the advice of the City Attorney, the claims filed against the City of Vernon by Cornell Frederick and Cheryl Thames, resulting out of injuries sustained on April 5, 1977, be rejected and that appropriate notification be made to the attorneys representing Mr. Frederick and Ms. Thames, Fleishman & Meyerhoff, was presented. It was moved by MCCormick, seconded by Ybarra, that the recommendation of the Finance Committee at its meeting held November 7, 1977, conveyed via communication from the City Clerk- Director of Finance, dated December 8, 1977, be approved. I Communication from JoAnna Chisholm, Administrative Dean, Huntington Park High School, dated November 22, 1977, advising that their school is sponsoring an annual Boys' Week urging cooperation from the City of Vernon in allowing some of their young men to assume positions in the City Government on that day, was presented. (Copy to each member of the City Council) I It was moved by MCCormick, seconded by Ybarra, that the City Clerk-Director of Finance, be authorized to write to Ms. Chisholm, advising her that the City of Vernon would be honored to participate in their annual Boys' Week program on a day scheduled for a City Council meed. ng. Malburg, Chairman of the Finance Committee, dated December 14, 1977, submitting a re- quest from the Committee that, based upon the evidence consider- ed by the Committee at its meeting held December 12, 1977, the Council approve the Disability Retirement for Police Sergeant Ernest T. Brazil, was presented. Communication from Police Sergeant Ernest T. Brazil, dated December 14, 1977, regarding the retirement hearing before the Council on December 20, 1977, advising that he has an appointment with his doctor on that date and time and has not had sufficient time to secure legal counsel to represent him at said meeting; requesting that the hearing be continued to the next regularly scheduled City Council meeting, was presented. Communication from Bruce V. Malkenhorst, City Clerk- Director of Finance, dated December 16, 1977, advising that the Finance Committee, after having considered the extenuating cir- cumstances as outlined in a communication received from Police Sergeant Ernest T. Brazil, it is hereby recommended that the City Council grant the requested continuance of the hearing re- garding Sergeant Brazil's Disability Retirement to the next regular mee~ing of the City Council to be held on January 3, 1978, was presented. Malkenhorst, City Clerk- Director of Finance, dated December 16, 1977, advising that based upon consideration of a request from the City Clerk- Director of Financ~, submitted to the Finance Committee at its meeting held December 15, 1977, the Finance Committee hereby recommends that the.Council approve the request of the City Clerk to employ a Clerk Typist-Office Trainee on a temporary basis, at a compensatory rate of $3.50 per hour effective as soon as a selection has been made, was presented. It was moved by Ybarra, seconded by McCormick, that the recommendation of the Finance Committee as conveyed in the communication from the City Clerk-Director of Finance, dated December 16, 1977, be approved. Communication from Gerald Gess of Gee Gee Liquor Store, dated December 15, 1977, regarding his request for permis- sion to install a pool table in his Beer Bar at 4505 Downey Road, Vernon, California, .which was granted by the City Council; making an additional request for permission to install two more pool tables, making a total of three tables, was presented. MOtion carried. Report of Health Department Activities for the month of November 1977, was presented. (Copy to each member of the City Council). It was moved by Ybarra, seconded by McCormick, that Report of Health Department Activities be received and filed. Motion carried. I Activity Log of the Police Department for the period December 1 - 15, 1977, inclusive, was presented. It was moved by McCormick, seconded by Ybarra, that Activity Log of the Police Department be received and filed. MOtion carried. "Warrant Register No. 491" covering claims and demands presented during the period December 1 to 15, which includes Demands Nos. 7-2727 to 7-2876 (both inclusive) drawn on the United California Bank, totaling $156,904.93 (Light and Power Warrants $102,634.6$) (Accounting Period December 1977), was examined and audited. I It was moved by Ybarra, seconded by McCormick, that "Warrant Register No. 491" be approved and payment authorized for Demands Nos. 7-2727 to 7-2876 (both inclusive), with no ex- ceptions. It was moved by Ybarra, seconded by McCormick, that "Payroll Warrant R.egister No. 246" be approved and payment authorized for Demands Nos. 2575 to 2586 (both inclusive), with no exceptions. Jackson, City of Vernon Fire Fighter, dated December 16, 1977, advising that he will vacate the City-owned apartment at 3376 East 50th Street, by December 31, 1977, was presented. It was moved by Ybarra, seconded by McCormick, that the communication received from Lawrence M. Jackson, dated December 16, 1977, be received and filed. MOtion carried. Communication from Bruce V. Malkenhorst, City Clerk- Director of Finance,! dated December 13, 1977, advising that at the City Council meeting held November 1, 1977, a communication from A. E. Nelson, Jr., Director of Public Works/Building, dated October 25, 1977, transmitting a copy of an Agreement between Fie1er and Associates and the City of Vernon, was presented; rec- ommending that said ,Agreement be amended to authorize Phase 11 activity. The City iCounci1 voted to refer this recoDlDendation to the Finance ColDl11fttee for study and report. At its meeting held December 12, 1977, the Finance Committee, after due con- sideration, has made the recommendation that the City Council deny said amendment to authorize Phase II activity under said Agreement, was presented. It was moved by Ybarra, seconded by McCormick, that the recommendation of the Finance Committee, as conveyed via communication from the City Clerk-Director of Finance, dated December 13, 1977, that an amendment to the Agreement between Fieler and Associates and the City of Vernon authorizing Phase 11 activity, be denied. MOtion carried. At this time, 4:15 o'clock p.m., it was moved by Gonzales, seconded by Ybarra, that the City Council go into Executive Session in accordance with Government Code Section 54957.6. MOtion carried. Mayor Malburg ordered that all communications to and from the Executive Session were deemed private.
