CITY COUNCIL OF THE CITY OF VERNON
HELD JANUARY 3, 1978, AT TWO 0' CLOCK

The meeting was called to order by Mayor Leonis C.
It was moved by Ybarra, seconded by Gonzales, that
minutes of the meetings of December 13 and 20, 1977, be approved
as written and submitted. MOtion carried.
A. E. Nelson, Director of Public Works/Building, pre-
sented an Addendum to ,Contract No. 415 - Landscaping City Hall
Grounds.

It was moved by Ybarra, seconded by McCormick, that
the Addendum to Contr_ct No. 415, as presented, be approved and
the action of the Director of Public Works/Building be ratified.
Motion carried.
The Clerk announced that this was the time and place
for opening bids for Landscaping City Hall Grounds in accordance
with Contract No. 415 of the City of Vernon.
It was moved by Ybarra, seconded by Gonzales, that the
Clerk be instructed to open and read the bids submitted. MOtion
carried.
The Clerk opened and read the following bids:

It was moved by Gonzales, seconded by McCormick, that
the bids received for 'Landscaping City Hall Grounds in accordance
with Contract No. 415, along with the Addendum to said Contract,
be referred to the Director of Public Works/Building and the City
Attorney for checking and report. MOtion carried.
Communication from Shirley A. Tucker, Secretary to the
Police Chief, dated December 27, 1977, submitting her resignation
from the City of Vernon, effective as of the close of business on
February 24, 1978, was presented.
It was moved by Gonzales, seconded by McCormiCk, that
Mrs. Tucker's resignation, as submitted via communication dated
December 27, 1977, be laccepted, effective as of February 24, 1978.
MOtion carried.
Communicati~n from James R. Tucker, dated December 27,
1977, advising that he will be vacating the residence at 4323
Furlong Place, Vernon,i California, as of January 31, 1978, was
presented.
It was moved by Ybarra, seconded by McCormick, that
communication from James R. Tucker, dated December 27, 1977, be
received and filed. MOtion carried.

Claim filed by Anthony R. Lopez against the City of V
Vernon and the Vernon Police Department) received by the City
Clerk's office December 23, 1977) was presented. (Copy to each
member of the City Council) the City Attorney and the Police

It was moved by Gonzales) seconded by Kaeser) that the
Claim filed by Anthony R. Lopez) and received by the City Clerk
December 23) 1977) be referred to the City Attorney for study
and recommendation to the Finance Committee for establishing a
procedure for processing liability claims. MOtion carried.
Communication from Frank Murillo) Purchasing Agent)
dated December 22, 1977, requesting authority to attend the
three day conference for the California Association of Public
Purchasing Officers at the Marriott Hotel in Newport Beach,
California) from February 1 - 3, 1978) with an expense allow-
ance of $214.50) was presented.
It was moved by Kaeser) seconded by Ybarra) that the
request of the Purchasing Agent) dated December 22, 1977) be
approved and auther ity. granted to issue warrant in the amount
of $214.50 to Frank Murillo. MOtion carried.
Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/BUilding) dated December 28) 1977) regarding the Emer-
gency Telephone Users Surcharge Law and the implementation of a
911 Emergency Telephone System for the City of Vernon; recommend-
ing that the preparation of a City 911 Plan and an application
for funding using the communications center be authorized and
that the County of Los Angeles be advised of the decision not to
implement a joint 911 Emergency Telephone System) was presented.
It was moved by Ybarra) seconded by Gonzales, that the
recommendation of t he Director of Public Works/Building) dated
December 28, 1977) be approved. MOtion carried.
Communication - Invoice from Light and Power Special
Counsel) Darling) Hall) Rae & Gute) dated December 21) 1977, for
services rendered and costs advanced on behalf of the City of
Vernon in the sum of $25,323.35) was presented.
It was moved by Gonzales, seconded by Kaeser) that the
communication - invoice) dated December 21, 1977) be approved
for payment and authority granted to issue warrant in the sum of
$25)323.35 to Light & Power Special Counsel) Darling) Hall, Rae
& Gute. MOtion carried.
Communication from F. H. Colvin) Fire Chief) dated
December 15, 1977) transmitting an updated Mutual Aid Agreement
involving the cities of Compton, Downey, Lynwood) MOntebe110,
Santa Fe Springs and Vernon; recommending that this Agreement
be approved) was presented.
It was moved by McCormick, seconded by Ybarra) that
the updated Mutual Aid! Agreement as transmitted via communica-
tion from the Fire Chief) dated December 15) 1977) be approved
and authority granted for the Mayor and the City Clerk to ex-
ecute said Agreement on behalf of the City of Vernon. MOtion
carried.

Communication from Empire Container Corporation) dated
December 28) 1977) advising that they would be interested in the
purchase of a parcel of land owned by the City of Vernon) locat-
ed on East 55th Street) adjacent on the east to the Flintkote
property, Parcel 13-14-15) Page 16, Book 6308 to enable them to
move their corrugated box manufacturing operation) which employs
60 persons, to the City of Vernon; requesting an opportunity to
discuss the matter with the City Council) was presented.

It was moved by Gonzales, seconded by Ybarra, that the
request of Empire Container Corporation, dated December 28, 1977,
be denied, and that th$ City Clerk be instructed and directed to
write a letter to Empire Container Corporation, advising them of
the Council's action, based upon the fact that the subject land
is the site of a solid waste disposal for the City of Vernon and
is not available for sale. Motion carried.
"Warrant Register No. 492" covering claims and demands
presented during the period December 16 to 31, which includes
Demands Nos. 8-1 to 8-S0 (both inclusive) drawn on the United
California Bank, totaling $3,392,811.73, (Light and Power Warrants
$3,334,867.48) (Accounting Period January 1978, was examined and
audited.

It was moved by Ybarra, seconded by Kaeser, that
r'Warrant Register No. 492" be approved and payment authorized
for Demands Nos. 8-1 to 8-50 (both inclusive), with no excep-
tions. Motion carried.

Activity Log of the Police Department for the period
December 16 - 31, 1977, inclusive, was presented.
It was moved by Kaeser, seconded by Ybarra, that the
Activity Log of the Police Department be received and filed.
Motion carried.

Communication from A. E. Nelson, Jr., Director of Pub-
lic Works/BUilding, dated December 19,1977, transmitting.Con-
tract No. 416 - Traffic Pavement Striping - 1978; recommending
that this Contract be approved and authority granted to advertise
for bids, was presented.
Resolution NX. 4525 - A Resolution of the City Council
of the City of Vernonpproving Contract No. 416 and Authorizing
Notice Inviting Sealed Proposals or Bids for Traffic Pavement
Striping, in Accordance with Contract No. 416 of the City of
Vernon, was presented.
It was moved by Ybarra, seconded by Kaeser, that
Resolution No. 4525 be approved and adopted. Motion carried.

Communication from the Finance Committee, dated Decem-
ber 30, 1977, recommending that based on the medical reports
submitted, the Application for Disability Retirement filed by
Police Lieutenant Donald E. Fisher, be granted, was presented.
Resolution No. 4526 - A Resolution of the City Council
of the City of Vernon Determining the Disability of Donald
Erwyn Fisher, a Local Safety Member Employed by the City of
Vernon (Section 21024 & 21025 Government Code), was presented.
It was moved by Kaeser, seconded by Gonzales, that
Resolution No. 4526 bel approved and adopted. Motion carried.

Hearing in the matter of the Disability Retirement of
Police Ser.geant Ernest,T. Brazil, which was continued from the
City Council meeting held December 20, 1977.

At approximately 2:40 o'clock p.m., the City Clerk
announced that this was the time and place for the hearing in
the matter of the Disability Retirement of Police Sergeant
Ernest T. Brazil.
Sergeant Brazil appeared and addressed the Council
on this matter and requested a closed hearing in accordance
with Government Code Section 54957, to consider the recommenda-
tion of the Finance Committee made at its meeting held December
20, 1977, requiring Sergeant Brazil to retire due to an indus-
trial disability.
It was moved by Kaeser, seconded by Gonzales, that
the request of Sergeant Brazil for a closed hearing in accord-
ance with Government Code Section 54957 be granted. Motion
carried.

At this time. 3:10 o'clock p.m., it was moved by
Kaeser, seconded by Gonzales, that the Council go out of closed
session. Motion carried.

Resolution No. 4522 - A Resolution of the City Council
of the City of Vernon Determining the Disability of Ernest T.
Brazil, a Local Safety Member Employed by the City of Vernon
(Section 21024 & 21025 Government Code), was presented.
It was moved by Kaeser, seconded by Gonzales, that
Resolution No. 4522 be approved and adopted. Motion carried.
Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra
Noes: None
Absent: None
At this time, 3:15 o'clock p.m., it was moved by
Gonzales, seconded by Kaeser, that the City Council go into
Executive Session in accordance with the provisions relating
to Attorney/Client Privilege. Motion carried.
Ayes: Gonzales, Kaeser, Malburg, McCormick, Ybarra
Noes: None
Absent: None
All persons, with the exception of the City Clerk and
the City Attorney, were excluded from the Executive Session.
Mayor Malburg ordered that all communications to and
from the Executive Ses~ion were deemed private.
At this time, 3:35 o'clock p.m., it was moved by
McCormick, seconded by Kaeser, that the City Council go out of
Executive Session. Motion carried.
There being no further business to come before the
meeting, it was moved by McCormick, seconded by Kaeser, that
the meeting be adjourned. Motion carried.
