19780126 Regular City Council Meeting - Minutes MINUTES OF AN ADJOURNED REGUlAR MEETING OF THE CITY COUNCIL OF THE CITY OF VERNON HELD JANUARY 26, 1978, AT FOUR O'CLOCK P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON. CALIFORNIA I COUNCIL PRESENT: COUNCIL ABSENT: Gonzales, Kaeser, Malburg, Ybarra McCormick I Malburg. The meeting was called to order by Mayor Leonis C. It was moved by Kaeser, seconded by Ybarra, that in accordance with Government Code Section 36934, the reading of Ordinance No. 884 in full be waived; and that Ordinance No. 884 receive a second and final reading by title. (Copy to each member of the City Council). Motion unanimously carried. Ayes: Gonzales, Kaeser, Malburg, Ybarra Noes: None Absent: McCormick Ordinance No. 884 - An Ordinance of the City of Vernon Repealing Ordinance No. 852 and Providing for Salary and Expense Allowance for Members of the City Council of the City of Vernon, was read by title for a second and final read- ing. I It was moved by Kaeser, seconded by Ybarra, that No. 884 receive and pass a second reading and be Motion carried. Ayes: Gonzales, Kaeser, Malburg, Ybarra Noes: None Absent: McCormick Ordinance No. 885 - An Ordinance of the City Council of the City of Vernon Amending Section 5.2 of Ordinance No. 252 Section 1, was read by title for a 1st reading. Ordinance adopted. It was moved by Ybarra, seconded by Kaeser, that Ordinance No. 885 receive and pass a 1st reading. Motion carried. Ayes: Noes: Absent: Gonzales, Kaeser, Malburg, Ybarra None McCormick I Communication from the Finance Committee, dated January 24, 1978, recommending that the City Clerk and all mem- bers of the Finance Committee be authorized to attend the Cali- fornia Society of Municipal Finance Officers Conference to be held in San Diego, California, from February 8 - 10, 1978, with an expense allowance of $288.50 each, was presented. It was moved by Kaeser, seconded by Ybarra, that the recommendation of the Finance Committee, dated January 24, 1978, be approveq, and authority granted to issue warrants in the sum of $288.50 each to those persons authorized to attend. Motion carried. I Communication from the Finance Committee, dated January 24, 1978, advising that the City of Vernon's Consulting Electrical Engineer, Paul Hendricks appeared before the Committee at its meeting held January 23, 1978, and presented a plan to increase the Energy Cost Adjustment Factor for the City of Vernon by 1.7993, effective as of February 6, 1978; recommending that such Energy Cost Adjustment Factor increase be approved, was presented. 076 -2- 1-26-78 I Resolution No. 4530 - A Resolution of the City Council of the City of Vernon Changing the Energy Cost Adjustment Billing Factor Charged for Electrical Energy Distributed and Supplied to its Electrical Consumers, was presented. It was moved by Kaeser, seconded by Gonzales, that Resolution No. 4530 be approved and adopted. MOtion carried. Nelson, Jr., Director of Pub- lic Works/Building, dated January 23, 1978, requesting authority for Lewis R. Adams to attend the Emergency Preparedness Commis- sion's Fourth Annual Seminar for Government Officials to be held in MOntebe1101 California, on February 8, 1978, with an expense allowance of ~15.00, was presented. It was moved by Gonzales, seconded by Kaeser, that the request of the Director of Public Works/Building, dated January 23, 1978, be approved, and authority granted to issue warrant in the sum of $15.00 to Lewis R. Adams. MOtion carried. I Communication from A. E. Nelson, Jr., Director of Pub- lic Works/Building, dated January 23, 1978, requesting authority to attend a New Trends in Employee Relations Seminar at California State University/Long Beach, from February 16 - 17, 1978, with an expense allowance of $40.00, was presented. It was moved by Ybarra, seconded by Kaeser, that the request of the Director of Public Works/Building, dated January 23, 1978, be approved and authority granted to issue warrant in the sum of $40.00 to A. ,E. Nelson, Jr. Motion carried. Communication from A. E. Nelson Jr., Director of Pub- lic Works/Building, dated January 26, 1978, advising that Oscar Mayer & Company wish to make application for permit for trailer for use as offices; recommending that authority be granted to issue this permit, was presented. It was moved by Ybarra, seconded by Gonzales, that the recommendation of the Director of Public Works/Building, dated January 26, 1978, be approved. MOtion carried. At this ti~, S. E. Hogan, Police Chief, L. S. Rosen- krantz, Po1iee Lieutenant and the City Attorney, David B. Brearley, appeared before the Committee to discuss the current internal Police Department investigation regarding Police Officer Larry Eldridge, and in accordance with the request of Police Lieutenant L. S. Rosen- krantz, the City Attorney made a recommendation to subpoena certain records from Corky's Pest Control. It was moved by Kaeser, seconded by Ybarra, that the recommendation of the City Attorney, be approved. MOtion carried. At this time, 4:50 o'clock p.m., it was moved by Kaeser, seconded by Ybarra, that the City Council go into Executive Ses- sion in accordance with Section 54957.6 MOtion carried. Ayes: Gonzales, Kaeser, Malburg, Ybarra Noes: None Absent: MCCormick All persons, with the exception of the City Clerk and the City Attorney, were excluded from the Executive Session. Mayor Malburg ordered that all communications to and from the Executive Session were deemed private. At this time, 5:35 o'clock p.m., it was moved by Ybarra, seconded by Kaeser, that the Council go out of Executive Session. Motion carried. I I O?? -3- 1-26-78 I I Discussion was held with regard to City owned property and the possessory interest tax. No formal action taken. At this time, 5:45 o'clock p.m., Councilman McCormick arrived and was seated. After discussion, it was moved by Gonzales, seconded by Ybarra, that Councilman McCormick be authorized to attend the Emergency Preparedness Commission's Fourth Annual Seminar for Gov- ernment Officials, to be held in MOntebello, California, on Febru- ary 8, 1978, with an expense allowance of $15.00~ MOtion carried. There being no further business to come before the meet- ing, it was moved by Ybarra, seconded by Gonzales, that the meeting be adjourned. MOtion carried. ~.
