MINUTES OF AN ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF VERNON
HELD DECEMBER 26, 1978, AT 4:20 O'CLOCK P. M.
IN THE COUNCIL CHAMBER OF THE CITY HALL,
LOCATED AT 4305 SANTA FE AVENUE, VERNON,
CALIFORNIA.

COUNCIL PRESENT: Ybarra, Kaeser, McCormick, Gonzales, Malburg
COUNCIL ABSENT : None

The meeting was called to order by Mayor Leonis C. Malburg.
David B. Brearley, City Attorney, informed the City Council that the
Grand Jury of the County of Los Angeles, State of California, had returned an
Indictment and an Accusation against himself and Bruce V. Malkenhorst, alleging
willful misconduct in office in violation of Section 3060 of the Government Code.
David B. Brearley, City Attorney, submitted a letter dated December
26, 1978, which requested in part that:
(1) The City, pursuant to Section 995.8 of the Government Code pro-
vide the costs of the defense of the Accusation and Indictment;
(2) He be released from the confidentiality of the Attorney/Client
privilege if said information is necessary for the defense of
said proceedings;
(3) _He be authorized to divulge the contents of any conversations which
transpired in any of the executive sessions which he attended, if
said information is necessary for the defense of said proceedings.
Bruce V. Malkenhorst, City Administrator/City Clerk, also submitted
a letter dated December 26, 1978, which requested in part that:
(1) The City, pursuant to Section 995.8 of the Government Code, pro-
vide the costs of defense of the Accusation and Indictment;
(2) He be authorized to divulge the contents of any conversations
which transpired in any of the Attorney/Client sessions or execu-
tive sessions which he attended, if said information is necessary
for the defense of said proceedings.
At this time, 5:20 o'clock, p. m., it was moved by Kaeser, seconded
by Ybarra, that the City Council go into executive session in accordance with
the provisions of the Government Code, Section 54957. Motion carried.
All persons were excluded from the executive session, except the
members of the City Council.
At this time, 5:49 o'clock, p. m., it was moved by Kaeser, seconded
by Gonzales, that the City Council go out of executive session and resume
regular session. Motion carried.
It was moved by Kaeser, seconded by Gonzales, that the City of
Vernon provide the costs of the defense for Bruce V. Malkenhorst and David B.
Brearley, pursuant to Section 995.8 of the Government Code, as requested and
that the furth.er request contained in their letters of December 26, 1978, be
authorized and approved. Motion carried.
It was moved by Kaeser, seconded by Ybarra, that a vote of confidence
and support be given to Mayor Leonis C. Malburg, Bruce V. Malkenhorst and
David B. Brearley. Motion carried.
Resolution No. 4614 - A Resolution of the City Council of the City of
Vernon, HOnorrng'"'JOliilD:-"Parkhurst, Chief Engineer and General Manager for
the County Sanitation Districts of Los Angeles County, was presented.
It was moved by Ybarra, seconded by Kaeser, that Resolution No.
4614, be approved and adopted. Motion carried.

There being no further business to come before the meeting, it was
moved by Kaeser, seconded by Ybarra, that the meeting be adjourned to the
next regularly scheduled meeting, January 2, 1979, in the Council Chamber
of the City Hall, located at 4305 Santa Fe Avenue, Vernon, California.
Motion carried.
