CITY COUNCIL OF THE CITY OF VERNON HELD

The meeting was called to order by Mayor pro tem Ybarra.
It was moved by Kaeser, seconded by Gonzales, that the minutes of
the meetings held January 2, and 11, 1979, be approved as submitted. Motion
carried.
It was moved by Gonzales, seconded by McCormick, that the minutes
of the meeting held January 16, 1979, be approved as corrected. Motion
carried.
Public Hearing to consider forfeiture of Union Pacific Railroad fran-
chises for crossings that require repair or maintenance, as listed in com-
munication from Arthur E. Nelson, Jr., Director of Public Works/Building,
dated March 13, 1978. (Deferred from the meeting of January 16, 1979)
It was moved by Gonzales, seconded by Kaeser, that the Public Hearing
above mentioned bJ deferred to the next regularly scheduled meeting of the
City Council. Motion carried.
Report from Arthur E. Nelson, Jr., on advisability of acquiring the
L. A. County Road Department property on Bandini Boulevard, behind Fire
Station #4, up for sale, with the Department's appraisal in the amount of
$180,000.00. (Deferred at the meeting of January 2, 1979)
It was moved by Gonzales, seconded by Kaeser, that the report on
advisability of acquiring L. A. County Road Department property on Bandini
Boulevard, be deferred to the next regularly schaduled meeting of the City
Council. Motion carried.
Communication from Arthur E. Nelson, Jr., Dire ctor of Public Works/
Building, dated January 16, 1979, enclosing letter from Frank M. Muniz, dated
January 12, 1979, advising that he will retire from employment with the City
effective close of business February 28, 1979, was presented.
It was moved by Gonzales, seconded by Kaeser, that the resignation
for service retirement, effective February 28, 1979, of Frank M. Muniz, be
accepted. Motion carried.
Resolution No. 4625 - A Resolution of the City Council of the City of
Vernon COmmenafrig""Fraiik-ml. Muniz For His Many Years of Service to the
City of Vernon, was presented.
It was moved by Gonzales, seconded by Kaeser, that Resolution No.
4625 be approved and adopted. Motion carried.

Communication from Arthur E. Nelson, Jr., Director of Public
Works/Building, dated January 16, 1979, transmitting for consideration pro-
posed ordinance amending the City Code, by adopting the 1978 Edition of the
National Electric Code and to clarify Section 7.9-4, Administrative Authority,
recommending that the ordinance be adopted, was presented.

Ordinance No. 889 - An Ordinance of the City Council of the City of
Vernon, Amenamgffie-C-ooeof the City of Vernon, California 1959, By Amend-
ing Sections 7.9-1 And 7.9-4 of Said Code, Establishing The Regulations For
The Installation, Arrangement, Alteration, Repair, Use and Operation of Electrical
Wiring, Connections, Fixtures, and Other Electrical Applicances and Equipment
on Premises Within the City of Vernon; Adopting By Reference the National
Electric Code 1978 Edition; Prescribing Penalties For the Vi olation of Any
Provision of This Ordinance and Repealing All Ordinances and Parts of Ordinances

Communication from Arthur E. Nelson, Jr., Director of Public Works/
Building, dated January 17,1 1979, that the bids received and opened at the Council
meeting on January 16, 19'/9, for Contract No. 427, have been reviewed, recom-
mending that the contract be awarded to Traffic Engineer ing, Inc., on the basis of
their bid $16,956.93, was presented.
Resolution No. 4623 - A Resolution of the City Council of the City of
Vernon Acceptffig 1I1e-nwoT"'Traffic Engineering, Inc., For Traffic Pavement
Striping - 1979, In Accordance With Contract No. 427 of the City of Vernon And
Approving the Execution of said Contract, was presented.
It was moved by Kaeser, seconded by Gonzales, that Resolution No.
4623 be approved and adopted. Motion carried.

Communication from S. E. Hogan, Chief of Police, dated January 15,
1979, requesting authority and funds for Sgt. R. L. Anderson to attend California
Homicide Investigators Association Training Seminar, Monterey, CUifornia,
March 1 to March 2, 1979, with an expense allowance of $209.00, was presented.
It was moved by Gonzales, seconded by McCormick, that the request of
S. E. Hogan, Police Chief, be approved and authority granted to issue warrant in
the amount of $209. 00 to Sgt. R. L. Anderson. Motion carried.
Communication from S. E. Hogan, Chief of Police, dated January 24,
1979, requesting authority and funds to attend California Police Chiefs Associ-
ation, Inc., Annual Conference, Monterey, California.z February 14to February
17, 1979, inclusive, with an expense allowance of $36::>.00
It was moved by McCormick that the request of the Police Chief be
approved. Motion failed to pass due to lack of a second.

CommWlication from Arthur E. Nelson, Jr., Health Officer, dated
January 26, 1979, requesting authority and funds for Louis S. Hauger, Director
of Environmental Health, to attend Annual Meeting - California Conference of
Directors of Environmental Health, at Milbrae, California, February 27 to
March 1, 1979, inclusive, with an expense allowance of $253.50.
It was moved by Kaeser, seconded by Gonzales,. that the request of
the Health Officer for authority and funds for Louis S. Hauger to attend the
conference at Milbrae, California, be approved and authority granted to
issue warrant in the amoWlt of $253.50 to Louis S. Hauger. Motion carried.
1 Claim for damages, filed January 26, 1979, by William J. Roberson,
1874"2 Redondo Boulevard, Los Angeles, California, 90019, for damage to his
parked automobile, struck by Fire Engine #22, at 4501 Santa Fe Avenue,
Vernon, California; date of loss October 30, 1978; accompanied with two
estimates, one for $66.85 and one for $69.78, was presented.
It was moved by Kaeser seconded by Gonz1les, that the claim of
William J. Roberson be referred to the Joint Powers Insurance Authority,
the City Attorney, and Fire Chief Bass for investigation, report and recom-
mendation. Motion carried.

CommWlication from George F. Bass, Fire Chief, dated January
29, 1979, requesting authority and funds to attend U. S. Department of Com-
merce National Fire Academy Seminar, Operational Risk Analysis, in San
Francisco, California,t February 9 - February 11, 1979, inclusive, with an
expense allowance of ~316. 50, was presented.
It was moved by Kaeser, seconded by Gonzales, that the request of
Fire Chief Basst. be approved and authority granted to issue warrant in the
amoWlt of $316. :>0 to Fire Chief George F. Bass. Motion carried.
Claim for damages, filed January 29, 1979, by Richard Robins,
attorney for Laura Ascencio and Diana Ascencio, 930 West College, Los
Angeles, California 90012, alleging estimated amoWlt of property damage
and personal injury in the amoWlt of $27,000.00, date of loss October 21,
1978, as a result of a traffic accident, Santa Fe Avenue and Pacific Boulevard,
Vernon, California, was presented.
It was moved by Gonzales, seconded by Kaeser, that the claim for
damages filed January 29, 1979 by Richard Robins on behalf of Laura Ascencio
and Diana Ascencio, be referred to the City Attorney and the Police Depart-
ment for investigation, report and recommendation. Motion carried.
Activity Log of the Police Department for the period January 16 -
31, 1979, was presented.
It was moved by Kaeser, seconded by Gonzales that the Activity Log
of the Police Department, January 16-31, 1979, be received and filed.
''Warrant Register No. 518" covering claims and demands presented
during the period January 16 to 31, which includes Demands Nos. 9-203 to
9-316 (both inclusive) drawn on the United California Bank, totaling $172,902.89
(Light and Power Warrants $38, 566.71) (Accounting Period February 1979),
was presented.
It was moved by Gonzales, seconded by Kaeser, that "Warrant
Register No. 518" be approved and payment authorized for Demands Nos.
9-203 to 9-316 (both inclusive), with no exceptions. Motion carried.
CommWlication from Lon S. Herman, Senior Public Utility Accountant,
Light & Power Department, dated January 15, 1979, advising that his last work-
ing day wi th the City will be March 30, 1979, as he has filed for service retire-
ment with P. E. R. S., effective May 2, 1979, after 21 years of employment with
the City, was presented.

It was moved by Kaeser, seconded by Gonzales, that the resignation
of Lon S. Herman, effective close of business March 30, 1979, be accepted,
and that the City Attorney be instructed to prepare a resolution commending
Lon S. Herman for his many years of service to the City of Vernon. Motion
carried.
Communication from Arthur E. Nelson, Jr., Director of Public Works/
Building, dated January 31, 1979, requesting authority and funds for Victor Vaits
to attend California Building Officials 17th Annual Meeting, San Jose, February
22 to February 24, 1979, with an expense allowance of $297.00, was presented.
It was moved by Kaeser, seconded by Gonzales, that the request of
the Director of Public Works, be approved and authority granted to issue warrant
in the amount of $297.00 to Victor Vaits. Motion carried.
Communication from Arthur E. Nelson, Jr., Director of Public Works/
Building, dated February 1, 1979, enclosing letter dated January 26, 1979, con-
cerning requested "lot line adjustment" between Gogian Enterprises (PaCific
Cold Storage) and McCoy Meat Company, recommending adoption of a resolution
approving the "lot line adjustment", under Section 66412(d) of the Subdivision
Map Act, was presented.

Resolution No. 4624 - A Resolution of the City Council of the City of
Vernon Dec1arfiigl:tsmrennon to Approve An Amendment to Its Contract With
the Board of Administration of the Public Employees' Retirement System, was
presented.
It was moved by Kaeser, seconded by Gonzales, that Resolution No.
4624 be approved and adopted. Motion carried.

It was moved by Gonzales, seoonded by Kaeser, that the resolution
to amend contract with P. E. R. S., be referred to the Vernon Police Officers
Benefit Association to determine their approval or disapproval of this proposal,
by election of the safety members thereof, and the return of Certification of
Employee Election by the Secretary of said Association to the City Administrator/
City Clerk, for further administrative processing, if necessary. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/City
Clerk, dated February 1, 1979, advising that the contract with Cable Data is
being terminated as they are unable to provide the services, requesting $2,000.
to purchase soft ware from Tamas & Associates to process the water billing,
was presented.
It was moved by Kaeser, seconded by Gonzales, that the request of
the City Clerk for funds to purchase soft ware from Tamas & Associates to
process water billing, be appro veda Motion carried.
Communication from Marshall and Stevens, Inc., dated January 9,
1979 to Booth and Simpson, advising that they are pleased to again work with
the City of Vernon on a re-appraisal of city-owned properties, however costs
having increased since May 1978 when a fee requirement of $7, 500. for this
study was estimated, they will honor it for another thirty days from the date of
this communication, but that the fee estimate will need to be re-negotiated
after February 9, 1979, was presented.
It was moved by Gonzales, seconded by Kaeser, that the proposal of
Marshall and Stevens, Inc., for re-appraisal of city-owned properties study,
be approved, and funds authorized as specified for this project. Motion carried.

Communication from Arthur E. Nelson Jr., Director of Public Works/
Building, dated November 27, 1978, that Patrick Darcyof Olympic Machinery
Company, Inc., 2916 Santa Fe Avenue continues to report a parking problem,
the building occupying the entire lot and no off-street parking is available at
this address, and advising that the City Council may desire to instruct the City
Attorney to prepare an Ordinance to allow perpendicular parking on the North
side of 30th Street, between Santa Fe Avenue to the public alley, except at
doorways the owner wishes to be accessible a distance of approximately 150
feet. (Referred to City Attorney at December 5, 1978, 2 :00 o'clock meeting,
for preparation of Ordinance).

Santa Fe Avenue and the Public Alley, was read by title for a first reading.
It was moved by Gonzales, seconded by Kaeser, that Ordinm ce No.
888 receive and pass a first reading. Motion carried.

Communication from Southern California Gas Company, dated January
18, 1978, by David B. Follett, Attorney, to California Public Utilities Commission,
with copy of same to all parties of record, enclosing conformed copy of Brief of
Southern California Gas Company in Case No. 10032, was presented.
It was moved by Gonzales, seconded by Kaeser, that the communication
and conformed copy of the brief from Southern California Gas Company in
Case No. 10032, before the Public Utilities Commission, be received and filed.

Claim for Damages on behalf of Richard J. Silber, Arising out of un-
lawful interference with contractual relationship by city employees and officials
and by members of the City Council, filed January 29, 1979, was presented.
It was moved by Kaeser, seconded by Gonzales, that the claim for
damages, alleging tortious interference with contractual relationship, filed by
Richard J. Silber, be referred to the City Attorney and the City Clerk for
review and recomIre ndation. Motion carried.
Communication from Genevieve Anderson, former city council member,
to the President and Board Members of the Vernon Chaplber of Commerce,
dated December 26t 1978, copy of same to the City Council, taking exception to
a remark attributea to an official of the Vernon Chamber of Commerce in the
article which was published in the Los Angeles Times, Sunday, December 24,
1978, and detailing her experience as a member of the Vernon City Council
from 1945 to 1974, expressing the dedication and tIE accomplishments of the
City Officials, voicing her support to them, was presented.
It was moved by Kaeser, seconded by Gonzales, that the communication
from former Councilwoman Genevieve Anderson, be received and filed.
At this time, 2:30 o'clock, p. m., it was moved by Gonzales, seconded
by Kaeser, that the City Council go into executive session under the provisions
of Section 54957 of the Government Code. Motion carried.
All persons with the exception of the City Clerk, the City Attorney and
Fire Chief George F. Bass were excluded from the executive session.
Mayor pro tern Ybarra ordered that all communications to and from
the executive session were deemed private.
At this time, 2:56 o'clock, p. m., it was moved by Kaeser, seconded
by Gonzales, that the City Council go out of executive session and resume
regular session. Motion carried.

It was moved by McCormick, seconded by Gonzales, that Jean Hoffman
be suspended, withOlt pay} effective February 7, 1979, and to hold a hearing
during the regularly scheauled meeting of February 20, 1979, to allow Jean
Hoffman to respond to the allegations presented to the City Council by Chief
Bass. Motion carried.
At this time, 3:00 o'clock, p. m., it was moved by McCormick, seconded
by Gonzalesl that the City Council go into executive session under the provisions
of Section 54957 of the Government Code. Motion carried.
All persons with the exception of the City Clerk and the City Attorrey
were excluded from the executive session.
Mayor pro tern Ybarra ordered that all communications to and from
the executive session were deemed private.
At this time, 3:10 o'clock, p. m., it was moved by Gonzales, seconded
by Kaeser, that the City Council go out of executive session and resume regular
session. Moti on carried.
Resolution No. 4626 - A Resolution of the City Council of the City of

Member Employed by the City of Vernon (Sec. 21024 and 21025 of the Govern-
ment Code), was presented.
It was moved by Gonzales, seconded by McCormick that Resolution No.
4626 be approved and adopted. Motion carried.

Communication from Don E. Combs, dated February 1, 1979, sub-
mitting his resignation, effective February 1, 1979, from the City of Vernon's
employ.
It was moved by Gonzales, seconded by Kaeser, that the resignation
of Don E. Combs from the City of Vernon Fire Department, be accepted.
Motion carried.
It was moved by Gonzales, seconded by Kaeser, that Captain L. F.
Ely be named temporary Acting Chief of Police, until such time as Chief of
Police S. E. Hogan is released for full duty. Motion carried.
It was moved by Gonzales, seconded by Kaeser, that Mayor Malburg
be excused from attendance at this meeting of the City Council. Motion carried.
There being no further business to come before the meeting, it was
moved by Gonzales, seconded by McCormick, that the meeting adjourn. Motion
