M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Gonzales, Kaeser, McCormick, Ybarra MEMBERS ABSENT: Malburg The meeting was called to order by Mayor pro tem Thomas A. Ybarra. It was moved by Kaeser, seconded by Gonzales, that the minutes of the meetings held February 1 and February 6, 1979, be approved as submitted. Motion carried. Ordinance No. 888 - An Ordinance of the City Council of the City of Vernon Aaafiig"Bearon'.7~T5 to the Vernon City Code Regulating Angle Parking Along the Northerly Side of 30th Street Easterly of Santa Fe Avenue, Between Santa Fe Aven ue and the Public Alley. It was moved by Gonzales, seconded by Kaeser, that in accordance with Government Code, Section 36934, the reading of Ordinance No. 888 in full be waived and that Ordinance No. 888 receive a second and final reading by title. (Copy to each member of the City Council) Motion carried. It was moved by McCormick, seconded by Gonzales, that in accordance with Government Code Section 36934, the reading of Ordinance No. 889 in full be waived and that Ordinance No. 889 receive a second and final reading by title. (Deferred from the meeting of January 16, 1979) It was moved by Kaeser, seconded by McCormick, that Public Hearing to consider forfeiture of Union Pacific Railroad franchises for crossings that require repair or maintenance, be deferred until the next regularly scheduled meeting of the City Council. Motion carried. CommWlication from Arthur E. Nelson, Jr., Director of Public Works/ Building, dated February 1, 1979, enclosing letter dated January 26, 1979, concerning requested "lot line adjustment" between Gogian Enterprises (Pacific Cold Storage) and McCoy Meat Company, recommending adoption of a resolution approving the "lot line adjustment", Wlder Section 66412(d) of the Subdivision Map Act, (Referred to Police and Fire Departments, for study, report and recommendation at meeting of February 6, 1979) was presented. Resolution No. 4627 - A Resolution of the City COWlcil of the City of Vernon Approvlng''Lof"Lrne-Adjustment'' Requested By Gogian Enterprises (PaCific Cold Storage) and McCoy Meat Company, was presented. It was moved by Kaeser, seconded by McCormick, that Resolution No. 4627 be approved and adopted. Motion carried. Nelson, Jr., Director of Public Works/ Building, advising that Oscar Mayer Company has requested to extend their permit for a temporary office trailer to April 15, 1979; the company presently is constructing a replacement office; the present permit expired February 8, 1979, and has been extended yearly since March 7, 1973, recommending the extension to April 15, 1979 be granted, was presented. It was moved by Kaeser, seconded by Gonzales, that the request of Oscar Mayer Company for extension of their permit for a temporary office trailer to April 15, 1979, be granted. Motion carried. Malkenhorst, City Administrator/City Clerk dated February 20, 1979, requesting authority and funds for Frank Murillo, Purchasing Agent, to attend California Association of Public Purchasing Officers, (Annual Conference), Fresno, California, March 7 to March 9, 1979, with an expense allowance of $331. 00, was presented. It was moved by Gonzales, seconded by Kaeser, that the request of the City Administrator/City Clerk, be approved, and authority granted to issue warrant in the amount of $331. 00 to Frank Murillo. Motion carried. CommWlication from Arthur E. Nelson, Jr., Health Officer, dated February 13, 1979, recommending that Mrs. Eve Wise be advanced one step to City Health Nurse, Grade 3, effective March 1, 1979, on the basis of merit, having been in grade one year, was presented. 254 I I I I I -3- 2/ 20 / 79 It was moved by McCormick, seconded by Kaeser, that the recom- mendation of the Director of Public Works to advance Eve Wise to City He(;tlth Nurse, Grade 3, effective March 1, 1979, on the basis of merit, be approved. Motion carried. Communication from Arthur E. Nelson, Jr., Public Works Department dated February 15, 1979, requesting authority and funds to attend Public Works Officers Institute, Monterey, California, March 14 to March 16, 1979, with an expense allowance of $250.00, was presented. It was moved by Gonzales, seconded by Kaeser, that the request of the Director of Public Works to attend Public Works Officers Institute, Monterey, California, March 14 - March 16, 1979, with an expense allowance of $250.00 be approved and authority granted to issue warrant in the amount of $250.00 to Arthur E. Nelson, Jr. Motion carried. Communication from Arthur E. Nelson, Jr., Director of Public Works/ Building, dated February 15, 1979, requesting authority and funds for Lewis R. Adams to attBnd Emergency Preparedness Seminar, Monte bello, California, March 7, 1979, with seminar materials and luncheon amounting to $20.00, was presented. It was moved by Gonzales, seconded by McCormick, that the request of the Director of Public Works for Lewis R. Adams to attend seminar at Montebello, California, March 7, 1979, wi th an expense allowance of $20.00, be approvedald authority granted to issue warrant in the amount of $20. 00 to Lewis R. Adams. Motion carried. Communication from Arthur E. Nelson, Jr., Director of Public Works/ Building, dated February 15, 1979, advis. ng that the Vl) rk of constructing Water Meter and Pressure Regulation Facility under Contract No. 421 has been com- pleted, recommending that the work be accepted and that authority be granted to pay the contractor, Tennyson Pipeline Company, in accordance with the agree- ment, was presented. Resolution No. 4628 - A Resolution of the City Conncil of the City of Vernon AccepTfiigtne"""'WOrk-on the Installation of a Water Meter and Pressure Regulating Facility at Fruitland Avenue at Downey Road, in Accordance With Contract No. 421 of the City of Vernon, was presented. It was moved by Kaeser, seconded by McCormick, that Resolution No. 4628 be approved and adopted. Motion carried. AYES: NOES: Absent: Kaeser, McCormick, Gonzales, Ybarra None Malburg Communication from Southern California Gas Company, dated February 9, 1979, submitting claim for repair to main located at northeast corner of Downey Road and Fruitland Avenue, date of loss November 15, 1978, in con- nection with work of constructing Water Meter and Pressure Regulation Facility, Contract No. 421, alleged damages amounting to $2,228.66, was presented. It was moved by McCormick, seconded by Gonzales, that the com- munication and claim from Southern California Gas Company, dated February 9, 1979, for damage to gasmain, in the amount of $2,228.66, be referred to the Director of Public Works and the City Attorney, for study, report and recommendation. Motion carried. Report of Health Department Activities for the month of January 1979, was presented. It was moved by Kaeser, seconded by Gonzales, that the Health Depart- ment Activity Report for the month of January 1979 be received and filed. Motion carried. 255 I I I I I -4- 2/20/ 79 "Warrant Register No. 519" covering claims and demands presented during the period February 1 to 15, which includes Demands Nos. 9-317 to 9-478 (both inclusive) drawn on the United California Bank, totaling $4, 475z.. 764. 10 (Light and Power Warrants $4,241,081. 57 (Accounting Period February 19'/9), was examined and audited. It was moved by Gonzales, seconded by Kaeser, that "Warrant Register No. 519" be approved and payment authorized for Demands Nos. 9-317 to 9-478 (both inclusive), with no exceptions. Motion carried. Communication from Arthur E. Nelson, Jr., Director of Public Works/ Building, dated February 16, 1979, advising that the Traffic Signal Installation, Soto Street and 26th Street, Contract No. 424, has been completed, recommending that the work be accepted and that authority be granted to pay the contractor, Signal Maintenance, Inc., in accordance with the agreement, was presented. Resolution No. 4629 - A Resolution of the City Council of the City of Vernon Accepting 111e"""'WOrk- on the Traffic Signal Installation at Soto Street and 26th Street, in Accordance with Contract No.424 Of the City of Vernon, was presented. It was moved by Kaeser, seoonded by McCormick, that Resolution No. 4629 be approved and adopted. Motion carried. AYES: NOES: Absent: Kaeser, McCormick, Gonzales, Ybarra None Malburg At this time, 2:15 o'clock, p. m., it was moved by Kaeser, seconded by Gonzales, that the City Council go into executive session in accordance with Attore.ey /Client privilege. Motion carried. All persons with the exception of the City Clerk and the City Attorney and Paul P. Hendricks, Consulting Electrical Engineer, were excluded from the executive session. Mayor pro tem Ybarra ordered that all communications to and from the executive session were deemed private. At this time, 2 :30 o'clock, p. m., it was moved by McCormick, seconded by Gonzales, that the City Council go out of executive session and resume regular session. Motion carried. Finance Committee minutes, February 13 and 15, 1979 meetings, for consideration and approval of the recommendations contained therein, were presented. Motion carried. All persons with the exception of the City Clerk and the City Attorney were excluded from the executive session. Mayor pro tem Ybarra ordered that all communications to and from the executive session were deemed private. 256 I I -5- 2/ 20/ 79 Councilman Gonzales was excused from further attendance at this meeting at 3:30 o'clock, p. m. At this time, 4:07 o'clock, p. m., it was moved by McCormick, seconded by Kaeser, that the City Council go out of executive session and resume regular session. Motion carried. Communication from Jean Hoffman, dated February 15, 1979, stating that her position is that her termination from employment as an employee of the City of Vernon was without "good cause" and constitutes a denial of due process rights, requesting immediate reinstatement as Secretary to the Chief of the City of Vernon Fire Department, without loss of seniority and other rights and benefits of city employment, was presented. It was moved by McCormick, seconded by Ybarra, that too request of Jean Hoffman for reinstatement as Secretary to the Chief of the Vernon Fire Department, be set for hearing February 28, 1979, at 4:00 o'clock, p. m. Motion carried. It was moved by McCormick, seconded by Kaeser, that an adminis- trative hearing be set for February 28, 1979, at 4:30 o'clock, p. m...l to present the subject of the removal of Officers A. J. Benedetti and Michael u. O'Connor from the City of Vernon payroll. Motion carried. There being no further business to come before the council, it was moved by Kaeser, seconded by McCormick that the city muncil adjourn until February 28, 1979, at four o'clock, p. m.
