19790322 Regular City Council Meeting - Minutes I I I I I MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL, HELD MARCH 22, 1979, AT FOUR O'CLOCK, P. M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. MEMBERS PRESENT: MEMBERS ABSENT : Ybarra, Gonzales, Malburg McCormick, Kaeser The meeting was called to order by Mayor Leonis C. Malburg. Resolution No. 4638 - A Resolution of the City Council of the City of Vernon 't:Ommenofiig"Vern F. Kyckelhahn For His Many Years of Service to the City of Vernon, was presented. It was moved by Gonzales, seconded by Ybarra, that Resolution No. 4638 be approved and adopted. Motion carried. I At this time, 4:10 o'clock, p. m., it was moved by Gonzales, seconded by Ybarra, that the City Council go into executive session under Attorney/ Client privilege. Motion carried. All persons with the exception of the City Administrator arid the City Attorney were excluded from the executive session. Mayor Malburg ordered that all communications to and from the executive session were deemed private. At this time, 6:05 o'CIOCki p. m., it was moved by Gonzales, seconded by Ybarra, that the City Counci go out of executive session and resume regular session.. At this time, 6:05 o'clock, p. m., it was moved by Ybarra, seconded by Gonzales, that the City Council go into executive session under the pro- visions of Section 54957 of the Government Code. Motion carried. All persons with the exception of the City Administrator and the City Attorney were excluded from the executive session. M~yor Malburg ordered that all communications to and from the ex- ecutive session were deemed private. At this time, 7:03 o'clock, p. m., it was moved by Gonzales, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried. Communication from Kenneth M. Simon, attorney for Richard Ferris, President of Hickory's Best, Inc., dated March 19, 1979, filing a claim against the City of Vernon for monetary damages in the sum of $225,000.00, to redress certain wrongs vb ich were allegedly committed against Mr. Ferris by agents of the Vernon Police Department while acting on behalf of and in the course of their duties as authorized agents of the City of Vernon, was presented. It was moved by Gonzales, seconded by Ybarra, that the communic--, ation from Kenneth M. Simon, and the claim for damages of Richard Ferris, be referred to the City Administrator and the City Attorney for study and recom mendation. Motion carried. Communication from Lewis R. Adams, Assistant Director of Civil Defense, dated March 22, 1979, advising that State Office of Emergency Services is requiring that all City Emergency Plans be updated, using their standard format, that Area "E" office is presently in the process of updating the Vernon plan, and that Area "E" office has requested a review of that 272 I I I I I -2- .1.________ 3/ 22 / 79 portion of the Vernon plan concerning direction and control of Vernon's emergency organization in responding to potential emergency situations. In Vernon's present plan the Mayor is the Director of Emergency Services and as such would provide centralized control and coordination in emergency situations. During the absence or inability of the Dire ctor to act, the CUy officer highest on the following list, who is available, would act as Director 11) Assistant Director 2) Chief of Fire Department 3) Chief of Police Department The communication from the Assistant Director of Civil Defense requests any changes in the existing control structure be incorporated in the new plan. It was moved by Ybarra, seconded by Gonzales, that the control structure as set forth above, be approved and submitted to the Area "E" Office, without further change. Motion carried.
