MINUTES OF A REGULAR ADJOURNED MEETING
OF THE CITY COUNCIL OF THE CITY OF VERNON
HELD APRIL 5, 1979, AT TWO O'CLOCK, P. M.,
IN THE COUNCIL CHAMBER OF THE CITY HALL
LOCATED AT 4305 SANTA FE AVENUE, VERNON,
CALIFORNIA
COUNCIL PRESENT: Gonzales, Kaeser, Ybarra, Malburg
COUNCIL ABSENT: McCormick
The meeting was called to order by Mayor Leonis C. Malburg.
It was moved by Kaeser, seconded by Ybarra, that the minutes of
the meetings held March 20 and March 22, 1979, be approved as submitted.
Motion carried.
Communication from Elizabeth A. Belles, 2440 E. 52nd Street,
Los Angeles, California, 90058, advising that over 90% of the property
owners in the area located between 52nd Street - Slauson - M81.abar - Santa
Fe Avenue, Los Angeles County, have petitioned to be annexed to the City
of Vernon; the petition was denied since there was no guarantee that if the
area was not approved for Huntington Park, Vernon would then prezone
and annex the section to Vernon; that if petitioners are successful in having
the decision modified, they will need to request the City of Vernon to start
prezone proceedings, requesting an opportunity to present this matter to
the City Council, was presented.
Elizabeth A. Belles appeared before the council and explained that
if the petitioners had some guarantee that Vernon would prezone the
described area, it would strengthen their position, and requested that the
City Council officially take action to prezone, and the recommendation of
LAFCO could be denied at the County Supervisors' level.
After discussion, the City Attorney advised that any pre zoning
action by Vernon would not per se be binding, and recommended that a pre-
zoning hearing be scheduled for May 1, 1979, and that Arthur E. Nelson, Jr.
Director of Public Works/Building, be instructed to make a study of this
matter and submit same to the next council meeting.
It was moved by Kaeser, seconded by Ybarra, that a prezoning hear-
ing be scheduled for May 1, 1979, and thitt Arthur E. Nelson, Jr., Director
of Public Wo rks/Building, conduct a study of this item under discussion and
submit his findings and recommendation to the City Council at its next regular
meeting April 17, 1979. Motion carried.
Communication from Arthur E. Nelson, Jr., Director of Public
Works/Building, dated March 19, 1979, requesting authority and funds for
Fred A. Tachovsky to attend Quint Chapter Electrical Code Seminar of the
Southwestern Section of the International Association of Electrical Inspectors,
at Carmel, California, April 19 to April 21, 1979, with an expense allowance
of $278.00, was presented.
It was moved by Ybarra, seconded by Kaeser, that the request of
the Director of Public Works for Fred A. Tachovsky to attend the Electrical
Code Seminar at Carmel, April 19 to April 21, 1979, be approved, and
authority granted to issue warrant in the amount of $278.00 to Fred A.
Tachovsky. Motion carried.
Communication from John B. Furay, of the law firm of Lewis and
Marenstein, dated March 20, 1979, attorney for Tomalyn Tavernelli,
requesting a formal hearing before an administrative law officer be con-
ducted to determine the validity of the allegations which have been lodged
against Mrs. Tavernelli, and to weigh the sufficiency of the charges so as
to determine the validity of the City's actions in terminating a long-term
employee from continuance of her employment, was presented.

It was moved by Kaeser, seconded by Ybarra, that the communic-
ation from John B. Furay, dated March 20, 1979, attorney for Tomalyn
Tavernelli, requesting a formal hearing, be received and filed. Motion

Communication from Bruce V. Malkenhorst, City Administrator,
dated March 21, 1979, requesting authority to advance, on the basis of merit,
Cindy Schultz, Communications Operator, Dispatcher, to Step 4, and
Judy Fuller, Communications Operator, Dispatcher, to Step 4, effective
May 1J 1979, both having successfully completed the required probationary
perioa, was presented.
It was moved by Ybarra, seconded by Kaeser, that Cindy Schultz
and Judy Fuller be advanced to Step 4 of t he Communications Operator,
Dispatcher classification, effective May 1, 1979. Motion carried.
Communication from Arthur E. Nason Jr., Director of Public Works/
Building dated March 26, 1979, advising that the work on 38th Street, Ross
Street and Irving Street Resurfacing, under Contract No. 426 has been com-
pleted, recommending that the work be accepted and that authority be granted
to pay the Contractor, Vernon Paving Company, in accordance with the
agreement, was presented.
Resolution No. 4639 -A Resolution of the City Council of the City of
Vernon ACC13PtmglllEfWork-on the Resurfacing of 38th Street, Ross Street,
and Irving Street, in Accordance with Contract No. 426 of the City of Vernon,
was presented.
It was moved by Ybarra, seconded by Gonzales, that Resolution No.
4639 be approved and adopted. Motion carried.
Staff Report of the Local Agency Formation Commission, Los ~eles
County, to be considered at 9:00 a. m., meeting, March 28, 1979 (Agenda
Nos. 18, 19 & 20) detailing the proposals, plan for services, benefits and
conclusion and recommendation; that the recommendation of the Staff are:
(21) That the Vernon Santa Fe Avenue Annexation No.7 be dmied.
( ) That the Commission find for Huntington Park Slauson Annexation #1,
and Slauson Annexation No.2;
(3) That upon adoption of the revised legal description for each proposal,
the Commission adopt resolutions approving Huntington Park Slauson
Annexations 1 and 2, directing the Board of Supervisors to initiate pro-
ceedings in compliance with the Commission's resolutions no later than
35 days from the March 28, 1979 meeting date, pursuant to Government
Code Sec. 35150(f).

LA FC 0, above referred to, be received and filed. Motion carried.
Communication from Arthur E. Nelson, Jr., Health Officer, dated
March 26, 1979, requesting authority and funds for John G. Anderson to
attend California Environmental Health Association Annual Education Sym-
pOSium, Pasadena, California, April 19 to April 20, 1979, inclusive, with_
an expense allowance of $66. 00, was presented.
It was moved by ~arra, seconded by Gonzales, that theJl'equest of
the Director of Public Works for John G. Anderson to attend Annual Education
Symposium, Pasadena, April 19 to April 29, be approved and authority granted
to issue warrant in the amount of $66.00 to John G. Anderson. Motion carried.
Police Department Activity Log for the period March 16 - 31, 1979,
was presented.
It was moved by Kaeser, seconded by Gonzales, that the Activity Log
of the Police Department, March 16 - 31, 1979, be received and filed.

"Payroll Warrant Register No. 261" covering claims and deImnds
presented during the period February 1 - 28, 1979, which includes Demtnds
Nos. 2778 to 2790 (both inclusive), drawn on the Crocker National Bank,
totaling $471,353.89 (Accounting Period February 1979) was examined and
audited.

It was moved by Ybarra, seconded by Kaeser, that 'PayrollW arrant
Register No. 261" be approved and payment authorized for Demands Nos.
2778 to 2790 (both inclusive), with no exceptions. Motion carried.
"Warrant Register No. 522" covering claims and demands presented
during the period Mar~ 16 - 31, which includes Demands Nos. 9-722 to
9-808 (both inclusive) drawn on the United California Bank, totaling
$111,275. 15 (Light and Power Warrants $40,028.51) (Accounting Period
April, 1979) was examined and audited.
It was moved by Ybarra, seconded by Kaeser that "Warrant Register
No. 522" be approved and payment authorized for Demands Nos. 9-722 to
9-808 (both inclusive), with no exceptions. Motion carried.
Communication from Officer Konrad B. Raschke, dated March 23,
1979 submitting his resignation from the Vernon Police Department,
effective close of business March 25, 1979, was presented.
It was moved by Kaeser, seconded byGonzales, that the resignation
of Officer Konrad B. Raschke, effective close of business March 25, 1979,
be accepted. Motion carried.
Memorandum from Frank Murillo, Purchasing Agent, dated March
27, 1979, requesting authority to solicit bids for replacement of No.2
air conditioner-compressor, City Hall, with a bid opening date of May 1,
1979, was presented;
It was moved by Ybarra, seconded by Kaeser, that authority to
solicit bids for No.2 air conditioner-compressor, City Hall, be granted.
Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator /
City Clerk, dated March 28, 1979, requesting authority to advance J. R.
Ormesher, to Clerk, Grade 2, effective April 1, 1979, onthe basis of
merit, having served one year in her present grade, was presented.
It was moved by Kaeser, seconded by Ybarra, that the request of
the City Administrator to advance J. R. Ormesher to Clerk, Grade 2, effective
April 1, 1979, be approved. Motion carried.
Communication from Berman and Goodfried Inc., Attorneys at
Law, dated March 28, 1979, submitting claim for damtges on behalf of
Victor Cervantes, as a result of accident March 5, 1979, Santa Fe and
Vernon Avenues, Vernon, California, asking $10,000.00 on presentation
of claim, other damages.undetermined at this time, was presented.
It was moved by Ybarra, seconded by Kaeser, that the claim on
behalf of Victor Cervantes for damages, be referred to the City Adminis-
trator and the City Attorney for study and recommendation. Motion carried.
Communication from Frank MurillQ, Purchasing Agent, dated March
29, 1979, requesting authorization to dispose of the following City vehicles
that are no longer being used by the City: 2 FireDepartment, B/C vehicles
(1970) each over 63,000 miles; 2 Police Department Patrol vehicles (1977)
each over 55,000 miles, was presented.

granted to dispose of the vehicles referred to in the communication from

Communication from S. E. Hdgan, Chief of Police, dated March 16,
1979, requesting authority and funds for L. S. Rosenkrantz to attend
National LEIU Conference1 Phoenix, Arizona, May 8 to May 11, 1979, with
an expense allowance of $;177.00, was presented.
It was moved by Kaeser, seconded by Gonzales, to defer the request
of the Police Chief for L. S. Rosenkrantz to attend LEIU Conference,
Phoenix, Arizona, May 8 - 11, 1979, to the meeting of the council on May
1, 1979. Motion carried.
Communication from Capt. L. A. Espinoza, Commander, Patrol
Division, dated March 29, 1979, recommending that Dispatcher Joanne
Carkhuff be advanced to the pOSition of Senior Dispatcher, Step 5, effective
April 1, 1979, in order to provide needed supervision in the communic-
ations center, was presented.
It was moved by Ybarra, seconded by Kaeser, that the request of
Capt. L. A. Espinoza, to advance Joanne Carkhuff to the position of Senior
Dispatcher, Step 5, effective April 1, 1979, be approved. Motion carried.
Communication from S. E. Hogan, Chief of Police, dated March
29, 1979, requesting authority and funds to attend California Police Officers
Association Conference, San Francisco, California, M~y 20 to May 24, 1979
(inclusive), with an expense allowance of $439.00, was presented.
It was moved by Gonzales, seconded by Ybarra, that the request of
the Chief of Police to attend California Police Officers Association Con-
ference, San Francisco, May 20 to May 24, 1979, be deferred to tIE meet-
ing of the council on May 1, 1979. Motion carried.
Communication from S. E. Hogan, Chief of Police, dated March 16,
1979, requesting authority and funds for Lieutenant Brad Bunker to attend
Annual Spring Conference of California Association of Police Training
Officers, Santa Barbara, April 19, to April 21, 1979, with an expense
allowance of $147.50, was presented. .
It was moved by Gonzales, seconded by Ybarra, that the request of
the Chief of Police for Lt. Brad Bunker to attend Conference of California
Police Training Officersi Santa Barbara, April 19 to April 21, 1979, be
deferred until the counci meeting of Ajm;117, 1979. Motion carried.
Communication from John G. Joham, Jr., General Manager, Central
Basin Municipal Water District, dated March 30, 1979, advising that future
water shortages in the State Water Project are now projected; due to the
delay in constructing the Peripheral Canal, urging all cities within the
District to adopt a resolution to assure and expedite construction of said
canal, was presented.
It was moved byYbarra, seconded by Gonzales, that the communic-
ation from John G. Joham, Jr., General Manager, Central Basin Municipal
Water District, dated March 30, 1979, be received and filed; and that the
City of Vernon adopt a resolution urging assurance and expedition of the
Peripheral Canal. Motion carried.
Communication from Richard A. Shinee, Attorney for Vernon Fire
Fighters Association, dated March 29, 1979, requesting that tIE consider-
ation of the City's proposed intent to revoke the Fire Fighters Association's
recognition, be continued for a period of thirty days, was presented.
Mr. Richard A. Shinee appeared before the City Council and explained
that since his law firm was jus t recently engaged by the Vernon Fire Fighters,
they have not had adequate time to respond, and requested a continuance of
thirty days, or any continuance the council deemed appropriate.

It was moved by Kaeser, seconded by Ybarra, that tbis item be
deferred until executive session of the council this same day. Motion

Communication from Guy W. Behrick, Senior Claims Represent-
ative, Employers National Insurance Company, dated March 29, 1979,
advising that Dolores Villa, wife of their insured, Alfred A. Villa, was
involved in an accident at the corner of Slauson and Boyle Avenues, March
29, 1979; from investigation, it appears that the accident was caused by
signal light malfunction, serving notice of intent to pursue subrogation in
this matter against the City of Vernon, submitting appraisal of damage
amounting to $2,550.00.
It was moved by Ybarra, seconded by Kaeser, that the communic-
ation from Employers National Insurance Company, and the appraisal of
damage, be referred to the City Administrator and the City Attorney, for .
review and recommendation. Motion carried.

Communication from Ruth Bennell, Executive Officer, Local Agency
Formation Commission, dated March 29, 1979, to Harold M. Campbell,
Administrative Officer, City of Huntington Park, with copy to City of Vernon,
advising that the Commission at its meeting of March 28, 1979, closed the
public hearing on "Slauson Amaxation No.1" and took the matter under sub-
mission until its meeting of April 25, 1979. (Copy of Resolution No. C-
1979-31 of the Commission dated March 28, 1979, disapproving the pro-
posed annexation of territory, designated as "Santa Fe Avenue Annexation
No.7" attached), was presented.
It was moved by Gonzales, seconded by Kaeser, that the communic-
ation from LAFCO, dated March 29, 1979, and the Resolution C-1979-31,
be received and filed. Motion carried.
Communication from Chief of Police S. E. Hogan, dated March 14,
1979, that it is his understanding Councilman Kaeser brought to the atten-
tion of Capt. Ely that the combination to tte security door and employee door
of the Police Department was distributed to other people, expressing his
contention that the Chief of Police has the authority to distribute this in-
formation to employees that have reason or necessity for same, including
all miscellaneous employees, officers and any other person that has the
proper security clearance who may have need for said information, which
includes any City Councilman or Police Commissioner, upon request, was
presented.
It was moved by Ybarra, seconded by Kaeser, that the communication
of Chief S. E. Hogan, be referred to executive session of the City Council,
later this same day. Motion carried.
Summons and Complaint, SUJ;?erior Court Case No. C-277059, Lone
Star Building Centers (Western Inc.) as successor in interest to Sun Lunb er
Company, Ward & Harrington Lumber Company and W.E. Cooper Lumber
Company; and Lumidor Manufacturing Company vs. County ci Los Angeles,
Cities of Los Angeles] Long Beach, Glendale, Vernon, Commerce, El Segundo,
Inglewood, and Does 1 - 100, and Notice and Acknowledgment of Receipt dated
March 29, 1979, was presented.
It was moved by Ybarra, seconded by Gonzales, that the City Admin-
istrator be authorized to execute the Notice and Acknowledgement of Receipt,
and that the City Attorney be authorized to request the County Counsel to
defend said action on behalf of the City of Vernon. Motion carried.
At this time, 2:59 o'clock, p. m., it was moved by Gonzales seconded
by Ybarra~ that the City Council go into executive session in accordance with
Section 54~57. 6 of the Government Code. Motion carried.

by Ybarra, that the City Council go out of executive session and resume
regular session. Motion carried.
It was moved by Gonzales, seconded by Ybarra, that consideration of
the M. E. R. R. 's recommendation to revoke the Fire Fighters Association's
recognition, be set for hearing at 4:00 o'clock, p. m., April 16, 1979.
Motion carried.
It was moved by Ybarra, seconded by Kaeser, that a proclamation be
signed and adopted designating April 22 - 28, 1979 as Secretaries' Week.
Motion carried.
At this time, 3:45 o'clock, p. m., it was moved by Kaeser, seconded
by Ybarra, that the City Council go into executive session in accordance with
Attorney /Client privilege. Motion carried.
All persons, with the exception of the City Administrator and the City
Attorney were excluded from the executive session.
Mayor Malburg ordered that all communications to and from the
executive session were deemed private.
At this time, 3:50 o'clock, p. m., it was moved by Gonzales, seconded
by Kaeser, that the City Council go out of executive session and resume
regular session.
It was moved by Gonzales, seconded by Ybarra, that the recommend-
ation of the City Attorney that an additional $7, 500. 00 be authorized for
William Eyers, Deloitte, Haskins & Sells, to review the Edison filing for
increased re-sale rates, be referred to the Finance Committee. Motion
carried.
At this time, 3:55 o'clock, p. m., the City Council recessed for five
minutes.
At this time, 4:00 o'clock, p. m., the City Council reconvened, all
members present before the recess, again in attendance.
The City Administrator announced that the hearing to consider the
recommendation that Jean Hoffman be terminated from employment with the
City of Vernon had previously been continued and was set for 4:00 o'clock,
p. m. ,
The City of Vernon was represented by Richard Whitmore of the law
firm of Whitmoreatd Kay. Mrs. Jean Hoffman was present and represented
by MollieE. Wilson, of the law firm of Richard J. Silber.
Rosemary S. Treher was II' esent as a Certified Shorthand Reporter
to record the proceedings verbatim, for reduction to a transcript.
The proceedings continued until 6:10 o'clock, p. m., at which tiIre it
was moved by Kaeser, secondEld by Ybarra, to adjourn the hearing until
3:00 o'clock, p. m., May 1, 1979. Motion carried.
At this time, 6:12 o'clock, p. m., it was moved by Gonzales seconded
by Kaeser, that the City Council go into executive session in accordance with
Attorney /Client privilege. Motion carried.
All persons, with the exception of the City Administrator, the City
Attorney, Special Counsel Richard Whitmore, and Fire Chief George Bass
were excluded from the executive session.
Mayor Malburg ordered all communications to and from the executive

Communication dated April 5, 1979, jointly signed by Bruce V. Malken-
horst, City Administrator/City Clerk, and David B. Brearley, City Attorney,
regarding settlement of law suits by and between Vernon Fire Fighters Local
#2312 end the City of Vernon - Letter of Intent - Superior Court Cases No. C196-
116, C236-970 - C253-368 and C254-696, was presented.
It was moved by Kaeser, seconded by Ybarra, that the recommendations
contained in said communication, and hereinafter set forth, be approved.

from performing fire fighting activities during the period of
the illegal strike (August 23 through October 31, 1978);

(12) Items No. 16 and 17 of the attached Letter of Intent provided
that no wage increase shall be given prior to July 1, 1979,
and that the wages shall be increased after July 1, 1979
because of Proposition 13. Since the execution of the Letter
of Intent, the Supreme Court of the State of California has
issued a final decision interpreting Proposition 13 which
modified said legislation by removing restrictions on granting
municipal wage increases. Therefore, employees in the Fire
Department may receive a portion of the wage increase which
was to go into effect on July 1, 1979 yrior to said date.
Therefore, it is recommended that 6% of said proposed wage
increase be adopted effective on May 1, 1979 and the balance
of said increase as proposed in Item No. 17, be effective as
of July 1, 1979. Further, said increase of 6% shall be in
conformance with Item No. 33 and will be added to the curre nt
step range, as follows:

$20,000.00 be appropriated and authorized as overtime for the Police De-
partment. Motion carried.
It was moved by Kaeser, seconded by Ybarra, that the disciplinary
hearing for Officer R. L. Michalski, for violation of Sections 400.1,

Police Ethics and Procedure, be held at 4:00 o'clock, p. m., April 17, 1979.
Motion carried.
It was moved by Gonzales, seconded by Kaeser, in accordance with
the recommendation of Bruce V. Malkenhorst, City Administrator/City Clerk,
that the hearing to consider discipline against Michael Farrier, Dean White,
Ron Hedlund, Frank ClaWlch, Ron Cummings, Ron Beaver,:nd Robert Ros-
prim, officials and members of Vernon Fire Fighters, Local 2312, for violation
of Section 1962 of the Labor Code of the State of California, and City of Vernon
Resolution No. 4027, be held at 4:00 o'clock, p. m., on April 24, 1979.
Motion carried.
There being no further business to come before the Ire eting, it was
moved by Kaeser, seconded by Ybarra, that the meeting adjourn. Motien
carried.
