19790605 Regular City Council Meeting - Minutes MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL, HELD JUNE 5, 1979, AT TWO O'CLOCK, P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA I MEMBERS PRESENT: Malburg, Ybarra, Kaeser MEMBERS ABSENT: Gonzales, McCormick I The meeting was called to order by Mayor Malburg. It was moved by Ybarra, seconded by Kaeser, that the minutes of the meetings held April 24 and May 15, 1979, be approved as written and submitted. Motion carried. The City Administrator/City Clerk announced that this was the time and place for opening of bids received for Janitorial Services, Vernon city Hall, Contract No. 002. It was moved by Kaeser, seconded by Ybarra, that the City Administrator/City Clerk be instructed to open and read the bids submitted. Motion carried. The City Administrator/City Clerk opened and read the following bid: I American Building Maintenance Co. Executive Suite Services, Inc. No Bid $18,840.00 It was moved by Kaeser, seconded by Ybarra, that the bids received for Janitorial Services, Vernon City Hall, Contract No. 002, be referred to the Purchasing Agent and the City Attorney for study and recommendation. Motion carried. Communication from Arthur E. Nelson, dated May 30, 1979, recommending Contract to deliver No. 2 compressor, City Hall Air Conditioner, be awarded to Cal-Air Conditioning Service, due to better delivery time. I After discussion, it was moved by Kaeser, seconded by Ybarra, that the contract to deliver No. 2 compressor, City Hall Air Conditioner be awarded to Cal-Pacific Refrigeration, Inc., on the basis of their bid, which was approximately $437.00 lower than Cal-Sir Conditioning Service, with a delivery time of approximately six weeks. Motion carried. I Resolution No. 4646 - A Resolution of the City Council of the City of Vernon Awarding Contract for Delivery of Compressor Unit, City Hall Air Conditioner to Cal-Pacific Refrigeration, Inc. It was moved by Kaeser, seconded by Ybarra, that Resolution No. 4646 be approved and adopted. Motion carried. Nelson, dated May 21, 1979, advising that the bids received and opened at the meeting of May 15, 1979 for 44th and 46th Street Slurry Sealing, Soto Street to Alcoa Avenue, and Soto Street to Boyle Avenue, according to Con- tract No. 431 have been reviewed, recommending that the contract be awarded to Ron Allen, Slurry Seal Contractor, on the basis of their bid, $8,826.40, was presented. Resolution No. 4652 - A Resolution of the City Council of the City of Vernon Accepting the Bid of Ron Allen, Slurry Seal Contractor, For Slurry Sealing on 44th and 46th Street, from Soto Street to Alcoa Avenue and From Soto Street to Boyle Avenue, Respectively in Accordance with Contract No. 431 of the City of Vernon and Approving the Execution of Said Contract, was presented. It was moved by Kaeser, seconded by Ybarra, that Resolution No. 4652 be approved and adopted. Motion carried. Gilstrap, General Manager, Southern California Rapid Transit District, dated April 30, 1979, enclosing Energy Shortage Contingency plan which was adopted by SCRTD Board of Directors on April 10, 1979, requesting comments on the Plan and inviting any proposals prepared by the City of Vernon, was presented. I It was moved by Kaeser, seconded by Ybarra, that the com- munication from Jack R. Gilstrap, and the Energy Shortage Con- tingency Plan adopted by SCRTD Board of Directors, be received and filed. Motion carried. Communication from George F. Bass, Fire Chief, dated May 17, 1979, requesting that R. A. Garcia be reimbursed $10.00 from the Education and Training Fund, for tuition in the Fire Tactics and Strategy course, Rio Hondo College, was presented. 308 -3- 6/ 5/ 79 It was moved by Kaeser, seconded by Ybarra, that the request of Fire Chief Bass for reimbursement to R. A. Garcia, be approved, and authority granted to issue warrant in the amount of $10.00 to R. A. Garcia. Motion carried. I Complaint and Summons, Superior Court Case #SEC22751, Andrew Blanchard, a minor, by Frederick W. Blanchard, his guardian ad litem, vs. Jean Horton Violett, MTSS Leasing, A California corporation; Bural Incorporated, a California corporation, doing business as Vernon Motor Parts; Nestor Joe Baluja, City of Vernon, a municipal entity, and Does I thru X, inclusive, received May 18, 1979, alleging traffic contrel signal lights at the inter- section of Leonis Boulevard and Boyle Avenue were not operating, and as a result of an accident at said location, plaintiffs seek general damages, medical and incidental expenses and costs of suit, was presented. I It was moved by Kaeser, seconded by Ybarra, that the Com- plaint and Summons, Andrew Blanchard, a minor, by Frederick W. Blanchard, his guardian ad litem, vs. City of Vernon, et al., be referred to the City Attorney and the City Administrator for review and recommendation. Motion carried. Claim for Damages, dated May 17, 1979, Automobile Club of Southern California, subrogee of Mohamed A. Harned, alleging damage as a result of collision due to malfunction of traffic signals at intersection of Boyle and Slauson Avenues (repair bills to follow), was presented. I It was moved by Kaeser, seconded by Ybarra, that the Claim for Damages, Automobile Club of Southern California, subrogee of Mohamed A. Harned, be referred to the City Attorney and the City Administrator for study and recommendation. Motion carried. Claim for Damages dated May 9, 1979, submiteed by Pereyda and Delnick, Attorneys at Law, on behalf of their clients Liz- andro Cruz (Casteneda) and Antonio Perez, alleging personal injuries and property damage sustained in accident occurring on March 10, 1979, when struck by 197B FordLTD Police vehicle operated by Officer Michael W. Dixon, was presented. I It was moved by Ybarra, seconded by Kaeser, that the Claim for Damages submitted by Pereyda and Delnick, on behalf of their clients Lizandro Cruz (Castensda) and Antonio Perez, be referred to the City Attorney and the City Administrator for review and recommendation. Communication from Joanne Carkhuff, Senior Dispatcher, dated May 18, 1979, submitting her resignation from the Communications Center, Vernon Police Department, effective end of the business day, June 18, 1979, was presented. I It was moved by Kaeser, seconded by Ybarra, that the resignation of Joanne Carkhuff, Senior Dispatcher, effective end of the business day June 18, 1979, be accepted. Motion carried. Communication from Acting Chief of Police L. F. Ely, dated May 24, 1979, advising that Officer S. L. McClellan submitted his written resignation from the Vernon Police Department, effective May 24, 1979, was presented. It was moved by Kaeser, seconded by Ybarra that the resign- ation of Officer McClellan, effective May 24, 1979, be accepted. Motion carried. 309 31-0 -4- 61 51 79 Communication from Arthu~ E. Nelson, Director of Public Worksl Building, dated May 25, 1979, submitting for consideration a pro- posed License Agreement to Filtrol Corporation for the construction and operation of an effluent measuring device in Washington Boule- vard, recommending that the License Agreement be approved and that the Mayor and the City Clerk be authorized to execute the agree- ment, was presented. I I It was moved by Ybarra, seconded by Kaeser, that the License Agreement with Filtrol Corporation be approved and that the Mayor and City Clerk be authorized to execute the agreement on behalf of the City. Motion carried. Police Department Activity Log for the period May 16 - 31, 1979, was presented. It was moved by Ybarra, seconded by Kaeser, that the Police Department Activity Log, May 16 - 31, 1979, be received and filed. Motion carried. "Warrant Register No. 526" covering claims and demands pre- sented during the period May 16 - 31, which includes Demands Nos. 9-1145 to 9-1251 (both inclusive) drawn on the united California Bank, totaling $173,362.95 (Light and Power Warrants $3,069.95) Accounting Period June 1979, was examined and audited. I It was moved by Ybarra, seconded by Kaeser, that "Warrant Register No. 526" be approved and payment authorized for Demands Nos. 9-1145 to 9-1251 (both inclusive), with no exceptions. Motion carried. Communication from Chief of Police S. E. Hogan, dated May 30, 1979, requesting reimbursement from the City's Training and Education Fund, to Officer R. Santos, in the amount of $95.16 to cover cost of tuitimn and books for police science courses at California State University, Winter Quarter, was presented. It was moved by Kaeser, seconded by Ybarra, that the request of Chief of Police S. E. Hogan, be approved, and authority granted to issue warrant in the amount of $95.16 to R. Santos. Motion carried. I Communication from George F. Bass, Fire Chief, dated May 24, 1979, requesting reimbursement to Thomas Stevenson for driver's license medical examination, in the amount of $15.00 was presented. I It was moved by Kaeser, seconded by Ybarra, that the request of Fire Chief George F. Bass be approved, and authority granted to issue warrant in the amount of $15.00 to Thomas Stevenson. Motion carried. Claim for Damages, dated May 29, 1979, submitted by Rick Edwards on behalf of Mohamed A. Hamed, alleging personal injury, lost wages, property damage and loss, sustained in accident at the intersection of Slauson and Boyle Avenues, February 21, 1979, due to alleged malfunction of traffic signals; amount specified as of date of presentation of claim $900.00 medical bills, pain, suffering and their projected continuation, $40,000.00 total; estimated amount on account of each item of prospective injury or damage unde~ermined and unknown at the present time, was presentea. Glassner, dated May 27, 1979, advising that he will not be returning to duty with the Vernon Fire Department on June 4, 1979, as he is applying for deferred retirement, was presented. I It was moved by Kaeser, seconded by Ybarra, that the resignation of R. J. Glassner effective June 4, 1979, be accepted. Motion carried. I Communication from Arthur E. Nelson, Director of Public works/Building, requesting authority and funds for vict~r H. Vaits to attend Subdivision Map Act Seminar, U.C.L.A. June 15, 1979, with an expense allowance of $62.00, was presented. It was moved by Kaeser, seconded by Ybarra, that the request of the Director of Public Works be approved, and authority granted to issue warrant in the amount of $62.00 to Victor vaits. Claim for Damages, dated May 25, 1979, submitted by Ralph Bencangey, Attorney at Law, on behalf of Dolores Villa, alleging personal injury, sustained in accident at the intersection of Slauson-Boyle Avenues, February 21, 1979, due to alleged malfunction of traffic signals, asking special damages, as may:b-e proven, and general damages in the amount of $100,000.00, was presented. It was moved by Ybarra, seconded by Kaeser, that the Claim for Damages on behalf of Anna Mayorga, a minor, by her parent and guardian, Dolores Villa, be referred to the City AttorBey and City Administrator, for review and recommendation. I Summons, Complaint and Notice & Acknowledgment of Receipt Southern Pacific Transportation Company, et al, vs. Board of Equalization, City of Vernon, et al., Sacramento County Superior Court Case #281434, received June 1, 1979, for refund of property tax for fiscal year 7/1/77 - 6/30/78, was presented. It was moved by Ybarra, seconded by Kaeser, that the City Administrator/City Clerk be authorized to si.gn and return the Notice and Acknowledgment of Receipt of Summons and Complaint, in the case of Southern Pacific Transportation Company, et al, vs. Board of Equalization, City of Vernon, et al., and that the matter be referred to the City Attorney for study, report and recommendation. It was moved by Kaeser, seconded by Ybarra, that the request of Carlton E. Claunch, dated May 30, 1979, be received and filed. Motion carried. I Minutes of the Finance Committee meeting held May 24, 1979 were presented. (Copy to each member of the City Council). I It was moved by Ybarra, seconded by Kaeser, that the minutes of the Finance Committee, May 24, 1979 meeting, be approved, and the recommendations contained therein adopted. Motion carried. Communication from Louis Hauger, Director of Environmental Health, dated June 4, 1979, recommending that the Animal Control Contract with Los Angelep County be renewed for an additional year, July 1, 1979 - June 30, 1980, at the rates established by Los Angeles County, was presented. It was moved by Kaeser, seconded by Ybarra, that the recom- mendation submitted by the Director of Environmental Health be approved and adopted. Motion carried. I Communication from Fire Chief George F. Bass, dated June 5, 1979, advising that Mobil oil has extended an invitation to the three battalion chiefs and himself to attend the Hazardous Material Seminar conducted by the National Fire Protection Association at their Torrance facility June 19, 20 and 21, 1979, free of charge (normal cost would be $230.00 per person), recommending approval of the use of a city vehicle, plus funds to cover cost of lunches, the battalion chiefs would be attending two of the sessions on their off duty time, was presented. It was moved by Kaeser, seconded by Ybarra, that the request of the Fire Chief be granted, and that funds to cover the cost of lunches and a city-owned vehicle be authorized for the Fire Chief and three battalion chiefs to attend the Hazardous Material Seminar in Torrance, June 19, 20 and 21, 1979. Motion carried. Communication from Fire Chief George F. Bass, dated June 5, 1979, submitting for consideration and approval, the adoption of "Service to Industry" as the official motto for the City of Vernon Fire Department, was presented. (Referred to the City Council from the Police and Fire Commission). I It was moved by Kaeser, seconded by Ybarra, that the motto "Service to Industry" be adopted as the official motto for the City of Vernon Fire Department. Motion carried. I Ground Lease by and between Kal Kan Foods, Inc., and the City of Vernon, for landscaping at well No. 10 site, was presented. It was moved by Ybarra, seconded by Kaeser that Ground Lease for Landscaping at Well No. 10 Site be approved, and that the Mayor execute said lease on behalf of the City of Vernon. Paul P. Hendricks reported that he is in receipt of a com- munication from the Department of Transportation, dated June 1, 1979 that they are sponsoring a program, in cooperation with the Southern California Rapid Transit District to demonstrate the 313 31-4 -8- 6/ 5/ 79 I benefits of an Automatic Vehicle Monitoring System in transit applications, requiring small "signpost" transmitters be mounted to existing utility poles which transmit digital location codes to passing busses, requesting that Gould Information Identification, Inc., the prime contractor be permitted to install approximately 20 signposts on street lighting poles in the City of Vernon. Mr. Hendricks stated that he did not see any objection to the City participating in the program, and that there would be no cost to the city. I After discussion, it was moved by Kaeser, seconded by Ybarra, that the proposal detailed by Mr. Hendricks be referred to the City Administrator, the City Attorney, the Director of Public Works, the Police Department and the Fire Department for study, review and recommendation. Motion carried. At this time, 3:05 o'clock, p.m., it was moved by Kaeser, seconded by Ybarra, that the City Council go into executive session under the provisions of Section 54957 of the Government Code. Motion carried. All persons with the exception of the City Administrator and the City Attorney were excluded from the executive session. Mayor Malburg ordered that all communications to and from the executive session were deemed private. I At this time, 3:25 o'clock, p.m., it was moved by Kaeser, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried. It was moved by Kaeser, seconded by Ybarra that the hearing to consider the recommendation that Jean Hoffman be terminated from employment with the City of Vernon be continued until June 19, 1979. Motion carried. Resolution No. 4653 - A Resolution of the City Council of the City of Vernon Determining the Nonindustrial Disability of Artie E. Chrisman, a Local Safety Member Employed by the City of Vernon (Sec. 21024 and 21025 of the Government Code) was presented. It was moved by Ybarra, seconded by Kaeser, that Resolution No. 4653 be approved and adopted. Motion carried. Lee be received and filed. Motion carried. I Resolution No. 4654 - A Resolution of the City Council of the City of Vernon Determining the Disability of Michael R. Lee A Local Safety Member Employed by the City of Vernon (Sec. 21024 and 21025 of the Government Code) was presented. I It was moved by Kaeser, seconded by Ybarra, that Resolution No. 4654 be approved and adopted. Motion carried. AYES: NOES: Absent: Kaeser, Ybarra, Malburg None McCormick, Gonzales An Agreement for the background investigations of prospective Police Department Employees was presented. I It was moved by Ybarra, seconded by Kaeser, that the agreement with the County of Los Angeles, to contract for background investi- gations of prospective Police Department employees, through the Sheriff's Department, be executed by the Mayor and the City Admin- istrator/City Clerk, on behalf of the City of Vernon. Motion carried. Communication from S. E. Hogan, Chief of Police, submitting his resignation as Chief of Police, City of Vernon, effective October 1, 1979, was presented. It was moved by Kaeser, seconded by Ybarra, that the resign- ation of S. E. Hogan as Chief of Police, effective October 1, 1979, be accepted. Motion carried. It was moved by Ybarra, seconded by Kaeser, that a resolution be adopted by the City Council commending Chief of Police S. E. Hogan for his many years of service to the City of Vernon. Motion carried. I At this time, 3:40 o'clock, p.m., it was moved by Kaeser, seconded by Ybarra, that the City Council go into executive session under the Attorney/Client privilege. Motion carried. All persons with the exception of the City Administrator/City Clerk and the City Attorney were excluded from the executive session. I Mayor Malburg ordered that all communications to and from the executive session were deemed private. At this time, 3:45 o'clock, p.m., it was moved by Ybarra, seconded by Kaeser, that the City Council go out of executive session and resume regular session. Motion carried. The City Att@rney recommended to the City Council that the Claim for Damages filed by W & L Sales Co. dba J & A Sales Co., received May 3, 1979, and signed by Victor Cervantes, employee of J & A Sales, be denied. 3~5 -10- 6/ 5/ 79 It was moved by Kaeser, seconded by Ybarra, that the Claim for Damages filed May 3, 1979 by Victor Cervantes, employee of J & A Sales, be denied. Motion carried. I It was moved by Ybarra, seconded by Kaeser, that the City Council recess until the hour of 4:15 o'clock, p.m. Motion carried. Councilman Gonzales assumed his seat on the council when it resumed session at 4:25 o'clock, p.m. I Fire Chief George F. Bass discussed autofiremen and manning. This subject was referred to the Finance Committee. Communication from S. E. Hogan, Chief of Police, dated June 4, 1979, requesting authority and funds for Capt. L. F. Ely to pick up one prisoner in Colusa and one prisoner in San Francisco and return to Vernon, June 5, 1979, with an expense allowance of $261.00, was presented. It was moved by Gonzales, seconded by Ybarra, that the request of Chief Hogan be approved, and authority granted to issue warrant in the amount of $261.00 to Capt. L. F. Ely. Motion carned. ' The City Administrator/City Clerk presented to the council a statement from the law firm of Ball, Hunt, Hart, Brown and Baerwitz, in the amount of $2600.50, Ior legal services. I It was moved by Kaeser, seconded by for services rendered in the quo warranto and authority granted to issue warrant in to Ball, Hunt, Hart, Brown and Baerwitz. Mayor Malburg abstained from voting Ybarra that the invoice proceedings be approved the amount of $2600.50 Motion carried. on this motion. At this time, 5:10 o'clock, p.m., it was moved by Gonzales, seconded by Kaeser, that the City Council go into executive session under the provision of Attorney/Client privilege. Motion carried. All persons with the exception of the City Administrator and the city Attorney were excluded from the executive session. Mayor Malburg ordered that all communications to and from the executive session were deemed private. I At this time, 5:25 o'clock, p.m., it was moved by Kaeser, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried. I It was moved by Ybarra, seconded by Gonzales, after due deliberation and consideration of all of the evidence presented to the City Council during the Public Hearings held on April 16, 24, 30, May 15 and June 4, 1979, that the City Council hereby finds and determines that the evidence presented during said hearings establishes that Vernon Fire Fighters Association, Local #2312 violated Section l3A of Resolution 4027, during August, September and October, 1978, and therefore the recognition of said Association is hereby revoked. Michalski be denied, and that he be terminated effective March 16, 1979. Motion carried. On recommendation of the City Administrator/City Clerk, It was moved by Ybarra, seconded by Kaeser, that the lease agreement for ~he premises located at 4322 Furlong Place, Art E. Chrisman, tenant, be terminated; and that the lease agreement for the premises located at 3380 E. 50th Street, Marge Garcia, tenant, be terminated. Motion carried.
