MINUTES OF A REGULAR MEETING OF THE
CIlY COUNCIL, HELD JULY 3, 1979, AT TWO
O'CLOCK, P.M., IN THE COUNCIL CHAMBER
OF THE CITY HALL, LOCATED AT 4305 SANTA
FE AVENUE, VERNON, CALIFORNIA.

The meeting was called to order by Mayor Malburg.
It was moved by Kaeser, seconded by Ybarra, that the minutes of
the meetings held June 19, 26 and 29, 1979, be approved as submitted and
corrected. Motion carried.

It was moved by Gonzales, seconded by Kaeser, that the minutes
of the Finance Committee meetings held June 11, 18, 19 and 25, be approved
as written and submitted, and that the recommendations contained therein be
adopted. Motion carried.
Communication from Fran k Murillo, Purchasing Agent, dated June
26, 1979, requesting authorization to advertise for bids for the Power Im-
pactor, Hydraulic Hammer, Allied Model 33 Hy-Ram, for the Street and
Water Department, was presented.
Resolution No. 4663 - A Resolution of the City Council of the City
of Vernon ApprovmgTfie "PUrchase of A Quantity I Power Impactor-Hydraulic
Hammer, Allied Model 33 Hy-Ram For tIE Street and Water Department And
Authorizing Notice Inviting Sealed Proposals or Bids for the Purchase Thereof,
was presented.
It was moved by Kaeser, seconded by Ybarra, that Resolution No.
4663, be approved and adopted. Motion carried.

Absent: None
Communication from S. E. Hogan, Chief of Police, dated June 29,
1979, requesting that authorization be given to have the radio antenna tower
grounded, to avoid lightning strikes; price quoted a year ago approximately
$200.00, to remedy this situation.
This item was referred to the Director of Public Works for report
to the Council at the July 3, 1979 meeting.
Arthur E. Nelson reported that he did not have a complete report
for this council meeting, but what was needed was a copper conductor from the
base of the pole down into the gro und, and theoretically provide an easier path
if lightning were to strike. He reported that he will be getting the details in a
statement as to what will determine the price to remedy this situation, and that
the work will be done as soon as possible.
It was moved by McCormick, seconded by Gonzales, that the DiE ctor
of Public Works be authorized to proceed to correct the situation discussed.
Motion carried.

Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk,requesting authority to employ Barbara D. Salmon as Dispatcher,
Communications Operator, Step 6, effective July 9, 1979.
It was moved by Ybarra, seconded by Kaeser, that the request of
the City Administrator to employ Barbara D. Salmon as Dispatcher, Com-
munications Operator, Step 6, effective July 9, 1979, be approved. Motion
carried.

I
Claim of Ernest T. Brazil vs. City of Vernon, Small Claims Divi-
sion, Southeast Judicial District, filed June 20, 1979, in the amount of
$750.00 for vacation pay, was presented.
The City Attorney reported that this claim was denied by the City
Council when it was presented in January or February; that he would not be
able to appear for the City to defend this claim in the Small Claims Division,
but that a memaer of the City Clerk's Office, the City Administrator or his
designee may appear on behalf of the City, and in case of an appeal from the
decision rendered, a new trial in a new court would be in order.
It was moved by Gonzales, seconded by Ybarra, that the City
Administrator, or his designee, be authorized to appear on this City's be-
half in the Small Claims Division, Southeast Judicial District, on July 19,
1979, Division 4, at 8:30 a. m. Motion carried.
Police Department Activity Log for the period June 16 - 30, 1979,
was presented.
It was moved by Kaeser, seconded byYbarra, that the Police
Department Activity Log for the period June 16 - 30, 1979 be received and
filed. Motion carried.

"Warrant Register No. 528" covering claims and demands pre-
sented during'-; the period June 16 - 30, 1979, which includes Demands Nos.
9-1396 to 9-1442 (both inclusive) drawn on the United California Bank,
totaling $3,588,615.56 (Light and Power Warrants $3,447,072.85) Accounting
Period July 1979, was presented.
It was moved by Ybarra, seconded by Kaeser, that "Warrant Register
No. 528" be approved and payment authorized for Demands Nos. 9-1396 to
9-1442 (both inclusive), with no exceptions. Motion carried.
Claim for Damages submitted by Jerome F. Berger, July 2, 1979,
on behalf of Bertha Jiminez, Oliverio Jiminez, Cuauhtemoc Jiminez, Ilde-
fonso Seranno vs. City of Vernon, alleging injuries as a result of traffic
collision May 9, 1979, at Slauson and Boyle Avenues; extent of monetary
damages unknown at this time, was presented.
It was moved by Gonzales, seconded by McCormick, that the Claim
for Damages submitted by Jerome F. Berger, July 2, 1979, on behalf of
Bertha Jiminez, Oliverio Jiminez, Cuauhtemoc Jiminez, Ildefonso Seranno
against the City of Vernon, alleging injuries as a result of traffic collision
May 9, 1979, at Slauson and Boyle Avenues, be Ie ferred to the City Attorney
for review and recommendation. Motion carried.

Communication from Frank Murillo, Purchasing Agent, dated July
2, 1979, requesting authorization to advertise for bids for one (1) electronic
cash register for the City Clerk's Office was presented.
Resolution No. 4664 - A Resolution of the City Council of the City

For the City Clerk's Office and Authorizing Notice Inviting Sealed Proposals
or Bids for the Purchase Thereof, was presented.
It was moved by Kaeser, seconded by Ybarra, that Resolution No.
4664, be approved and adopted. Motion carried.

Communication from Fire Chief George F. Bass, dated Jul y 3, 1979,
requesting that thirteen Autofire.en be appointed to the position of Engineer
Grade II, effective July 1, 1979, with certain stipulations, was presented.
Chief Bass submitted an oral presentation in justification of the
request.

Motion was made by Kaeser, seconded byYbarra, and carried, that
the request of Fire Chief Bass to appoint the existing thirteen Autofiremen
listed below, to the position of Engineer Grade TI, effective July 1, 1979, be
approved, with tIE following stipulations:

That each shall serve a probationary period of one year.
Shall have completed 6 units of college credit in Fire Science
Courses before advancement to Engineer Grade I.
Shall have completed a full semester, 3 unit course in Fire
Science Hydraulics before advancement to Engineer Grade I.

It was moved by Gonzales, seconded by Kaeser, that this item be
continued to the next regularly scheduled meeting of the City Council, July
17, 1979.

Communication from Richard A. Shinee, attorney for Vernon Police
Officers Benefit Association, requesting that the hearing to consider revocation
of VPBOA recognition, set for hearing at this session of the council, be con-
tinued until August 7, 1979.
It was moved by Ybarra, seconded by McCormick, that the request of
Mr. Shinee be granted and the hearing on the recommendation to revoke the
recognition of Vernon Police Officers 'Benefit Association be continued until the
regular meeting of the City Council, August 7, 1979, at 4:00 o'clock, p. m.,
Motion carried.

Communication from George F. Bass, Fire Chief, requesting authority
and funds to attend a two-day Fire Officers Command School sponsored by the
National Fire Protection Association in San Francisco, July 14 and 15, 1979,
with an expense allowance of $287.00, was presented.
It was moved by McCormick, seconded by Ybarra, that the request
of Fire Chief Bass to attend a two-day Fire Officers Command School, spon-
sored by the National Fire Protection Association in San Francisco, July 14
and 15, 1979, be approved and that authority be granted to issue warrant in
the amount of $287.00 to George F. Bass. Motion carried.
ORDINANCE NO. 891 - An Ordinance of the City Council of the City
of VernonAmend'ingflie--C-ooeof the City of Vernon, California 1959, by Amend-
ing Sections 25. 1, 25.2, 25.3, 25.5 and 25.8 of said Code, Establishing the
Rates for the Sale of Water in Said City; Prescribing Penalties for the Violation
of Any Provision of This Ordinance and Repealing All Ordinances and Parts of
Ordinances in Conflict Therein, Specifically Ordinance No. 870, was presented.
It was moved by Gonzales, seconded by Ybarra that Ordinance No.
891 receive and pass a first reading. Motion carried.

At this time, .2:42 o'ClOCk, p. m., it was moved by Ybarra secomed
by G.onzale~ that the City Council go into executive session in accdrdance with
SectIOn 54907 of the Government Code. Motion carried.

All persons with the exception of the City Administrator and the
Ci.ty Attorney were excluded from the executive session.
Mayor Malburg ordered that all communications to and from the
executive session were deemed private.
At this time, 3:10 o'clock, p. m., it was moved by McCormick,
seconded by Ybarra, that the City Council go out of executive session and
resume regular session.

It was moved by McCormick, seconded by Ybarra, that the recom-
mendation of the Personnel Committee to the City Council, as a result of the
hearing of the Committee on July 2, 1979, be approved; and it be the order of
the City Council that the request on behalf of the six former Vernon Fire
Fighters for re-instatement be denied. Motion carried.
It w~ moved by Gonzales, seconded by McCormick that Sandy Sims
be terminated from City employment effective at the close of business July
5, 1979. Motion carried.
At this time, 3:15 o'clock, p. m., it was moved by Kaeser seconded
by Gonzales, that the City Council go into executive session under Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Administrator and the City
Attorney were eXCluded from the executive session.
Mayor Malburg ordered that all ill mmunications to and from the
executive session were deemed private.
At this time, 3:21 o'clock, p. m., it was moved by McCormick,
seconded by Gonzales, that the City Council go out of executive session and
resume regular session. Motion carried.
There being no further business to come before the Council, it
was moved by McCormick, seconded by Kaeser, that the meeting adjourn
to July 10, 1979, at 4:00 o'clock, p. m. Motion carried.
