The meeting was called to order by Mayor Malburg.
It was moved by Ybarra, seconded by Kaeser, that the minutes of the
meeting of September 4, 1979, be approved as written and submitted. Motion
carried.

It was moved by Gonzales, seconded by Kaeser, that the minutes of
the Finance Committee meeting held September 11, 1979, be approved and
the recommendations contained there in adopted. Motion carried.
Councilman McCormick opposed this motion. No abstentions.
Communication from Chief of Police S. E. Hogan, dated September
6, 1979, submitting resignation of Officer R. F. D'Alessandro from the Police
Department, effective end of business day September 15, 1979, was presented.
It was moved by Kaeser, seconded by Ybarra, that the resignation of
Officer R. F. D'Alessandro from the Police Department, be accepted, effective
end of business day September 15, 1979. Motion carried.
Communication from Arthur E. Nelson, birector of Public Works/
Building, dated September 6, 1979, advising that the work for Slurry Sealing
44th and 46th Street, from Soto Street toAlcoa Avenue and Soto Street to
Boyle Avenue, has been completed, recommending that authority be granted
to pay the contractor, Roy Allen Slurry Seal, in accordance with Contract No.
431, was presented.
Resolution No. 4673 - A Resolution of the City Council of the City of
Vernon ACceplIiigthe-wQfk-of Slurry Sealing on 44th and 46th Street, From
Soto Street to Alcoa Avenue and From Soto Street to Boyle Avenue Respectively,
In Accordance With Contract No. 431 of the City of Vernon, was presented.
It was moved by Gonzales, seconded by Ybarra, that Resolution No.
4673 be approved and adopted. Motion carried.

Communication from Chief of Police S. E. Hogan, cited September 5,
1979, submitting the resignation of Officer Dennis Tavernelli, effective close
of business September 15, 1979, was presented.
It was moved by Kaeser, seconded by Ybarra, that the resignation of
Officer Dennis Tavernelli from the PoliceDepartment, be accepted, effective
close of business September 15, 1979. Motion carried.
Communication from California Municipal Utilities Association, dated
August 22, 1979, enclosing request from the Turlock and Modesto Irrigation
Districts seeking support of the Clavey-Wards Ferry Hydroelectric Project,
was pre sented.
It was moved by Ybarra, seconded by Gonzales, that a re solution be
prepared suppQrting the Clavey-Wards Ferry Hydroelectric Project. Motion
carried.

I
Claim for Damages of Morris Schwartzman" served on the City of
Vernon May 9, 1979, seeking $113,000.00 damages as of date of presBntation
of claim, and $6, 500.00 estimated medical expenses and $10,000.00 loss of
earnings, other expenditures unknown at this time, date of loss February 20,
1979, was presented.
It was moved by Kaeser, seconded by Ybarra, that the claim for dam-
ages of Morris Schwartzman, as detailed above, be denied. Motion carried.
Communication from Arthur E. Nelson, Director of Public Works/
Building dated September 5, 1979, recommending that a sectibn be added to
the Encroachment Ordinance enabling the City Council to establish franchise
fees by resolution, was presented.
ORDINANCE NO. 893 - An Ordinance of the City Council of the City
of Vernon:AodingS"ectwn "22":-89 to the Code of the City of Vernon, California
1959, Enabling the City Council of the City d. Vernon to Establish Franchise
Fees From Time to Time By Resolution, was presented.
It was moved by Gonzales, seconded by McCormick, that Ordinance
No. 893 receive and pass a first reading. Motion carried.

Communication from City Administrator, dated September 13, 1979,
recommending that SWEDA International be awarded the contract for supplying
the City of Vernon with Model 4620 Electronic Cash Register, was presented.
Resolution No. 4672 - A Resolution of the City Council of the City of
Vernon Awarffi.ngtlE7urcn.ase Contract For Model 4620 Electronic Cash
Register to SWEDA International and Approving the Execution of said Contract,
was presented.
It was moved by Kaeser, seconded by Gonzales, that Resohtion No.
4672 be approved and adopted. Motion carried.

Police Department Activity Log, September 1 - 15, 1979, was presented.
It was moved by Ybarra, seconded by Kaeser, that the Police Depart-
ment Activity Log, September 1 - 15, 1979, be received and filed. Motion
carried.

''Warrant Register No. 533" covering claims and demands presented
during' the period September 1 to September 15, 1979, which includes Demands
Nos. 91409 to 91552 (both inclusive) excluding voided Derm nd No. 91550, drawn
on the United California Bank, totaling $4,001,689. 12 (Light & Power Warrants
$3,900,478.49 (Accounting Period September 1979), was examined and audited.
It was moved by Ybarra, seconded by Gonzales, that ''Warrant Register
No. 533" be approved and payment authorized for Demands Nos. 91409 to 91552
(both inclusive) excluding voided Demand No. 91550, with no other exceptions.
Motion carried.
Communication from Arthur E. Nelson, Director of Public Works/
Building, dated September 13, 1979, submitting print of Parcel Map No.
11987 and report thereon, advising that the City of Vernon adopted the open
space element of the general plan on May 29, 1973 and other elements were
adopted September 3, 1974, recommending that the City Council determine
the consistency between the general plan and Parcel Map No. 11987, was
presented.

It was moved by Gonzales, seconded by Ybarra, that the proposed sub-
division, together with the provisions for its design and improvement, is con-
sistent with the open space element of the general plan adopted on May 29,
1973, and other elements that were adopted September 3, 1974. Motion ca rried.
It was moved by McCormick, seconded by Gonzales, that Parcel Map No.
11987 and report thereon, be approved and adopted. Motion carried.
Health Department Activity Report, Month of August 1979, was presented.
It was moved by Kaeser, seconded by Ybarra, that Health Department
Activity Report for the month of August 1979, be received and filed. Motion
carried.
Communication from Arthur E. Nelson, Dire ctor of Public Works/
Building, dated September 13, 1979, advising that Arthur C. Withrow, Company
is desirous of covering an existing dock with canopy-type roof to connect two
existing structures at 5511 District Boulevard, recommending that a variance
be granted from Ordinance No. 801, under certain conditions, was presented
It was moved by Kaeser, seconded by Ybarra, that the recommendation
of the Director of Public Works be approved, and the Arthur C. "W.throw Com-
pany be granted the variance above described. Motion carried.
Resolution No. 4674 - A Resolution of the City COWlcil of the City of
Vernon Thncurrrng-WUh-Amendment No.2 To the Los Angeles County Solid
Waste Management Plan, was presented.
It was moved by Gonzales, seconded by Ybarra, that Resolution No.
4674 be approved and adopted. Motion carried.

Resolution No. 4675 - A Resolution of the City Council of the City of
Vernon "upposlilg-CIasSlIimtion of the Tuolomne River as A Wild and Scenic
River and Supporting the Clavey-Wards Ferry Project, was presented.
It was moved by Gonzales, seconded by Kaeser, that Resolution No.
4675 be approved and adopted. Motion m rried.

Communication from Arthur E. Nelson, Director of Public Works/
Building; dated September 17, 1979, transmitting for consideration a fully
executeaEasement Deed for a portion of Vernon Avenue from Geldin Meat
Company, recommending that the Easement Deed be accepted and the grantor
advised of the official recordation, was presented.
It was moved by Kaeser, seconded by Ybarra, that the Easement Deed
for a portion of Vernon Avenue from Geldin Meat Company, be accepted upon
approval of the City Attorney. Motion carried.
"Payroll Warrant Register No. 268" covering claims and demands
presented during the period July 29 to August 25, which includes Demands
Nos. 2888 to 2905 (both inclusive), drawn on the Crocker National Bank, total-
ing $448,852.65 (Accounting Period August 1979) was examined and audited.
It was moved by Gonzales, seconded by Ybarra, that "Payroll Warrant
Register No. 268" be :pproved and payment authorized for Demands Nos. 2888
to 2905(both inclusive) with no exceptions. Motion aarried.
Communication from Fire Chief George F. Bass, requesting approval
for Battalion Chief L. D. Schultz and Captain L. M. Jackson to serve as Fire
Service Instructors in the 10th Area E Fire Academy Training Class scheduled
to start October 8, 1979, and continue for approximately ten weeks; both would
serve as instructors in their off duty time and receive compensation dire ctly
from Rio Hondo College, as credentialed instructors but because of schedules

would also be needed on some duty days for period not to exceed 9 hours; the
duty days/City time, would be the City's continued contribution te the AreaE
Training Academy, was presented.
It was moved by McC ormick, seconded by Gonzales, that the request
of Fire Chief Bass be approved, in accordance with the plan demiled above.
Motion carried.
Communication from Chief of Police S. E. Hogan, dated September 18,
1979, submitting the resignation of Officer D. E. Bates from the Police Depart-
ment, effective October 2, 1979, was presented.
It was moved by Kaeser, seconded by Gonzales, that the re signation of
Officer D. E. Bates from the Police Department, be accepted, effective October
2, 1979. Motion carried.
At this time, 2 :30 o'clock, p. m., it was moved by Kaeser, seconded by
Ybarra, that the City Council go into executive session under the Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Administrator/City Clerk, the
City Attorney and Fire Chief George F. Bass, were excluded from the executive
session.
Mayor Malburg ordered that all communications to and from the executive
session were deemed private.

Fire Chief Bass was excused from further' atteridance at the executive
session at 2 :50 o'clock, p. m. ,
Councilman McCormick voluntarily excused himself from the oo.lance
of the executive session at 2 :55 o'clock, p. m.
Councilman Gonzales was excused from attendance for the remainder of
this meeting, at 3 :30 o'clock, p. m. ,
At this time, 3:45 o'clock, p. m., it was moved by Kaeser, seconded by
Ybarra, that the City Council go out of executive session and re sume regular
session. Motion carried.
Councilman McCormick resumed his seat for the reIlR inder of the
meeting .
It was moved by Kaeser, seconded by McCormick, that case of Jolm
C. Marx (Fire Department) aI1:l Randall Bertz (Police Department) pending
. before the Workmen's Compensation Appeals Board, be referred to the Finance
Committee for review and discussion. Motion carried.
It was moved by Kaeser, seconded by Ybarra, that the request of Fire
Chief Bass, dated September 17, 1979, for approval of emergency overtime
in the approximate amount of $2500.00, be granted. This overtime was caused
by the request for mutual aid from the Los Angeles County Fire Department.
Motion carried.
There being no further business to come before the City Council, it
was moved byYbarra, seconded by Kaeser, that the meeting adjourn. Motion
carried.
