MINUTES OF A REGULAR MEETING OF THE CITY
COUNCIL, HELD OCTOBER 2, 1979, AT TWO
O'CLOCK, P. M., IN THE COUNCIL CHAMBER OF
THE CITY HALL, LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Gonzales, Kaeser, McCormick, Ybarra, Malburg
MEMBERS ABSENT : None
The meeting was called to order by Mayor Malburg.
It was moved by Kaeser, seconded by Ybarra, that the minutes of the
meeting of September 18, 1979, be approved as written and submitted.
Motion carried.
At this time, 2:10 o'clock, p. m., it was moved by Kaeser, seconded
by Gonzales, that the City Council go into executive session under Attorney I
Client privilege. Motion carried.
All persons with the exception of the City Administrator ICi ty Clerk
and the City Attorney were excluded from the executive session.
Mayor Malburg ordered that all communications to and from the
executive session were deemed private.
At this time, 2:25 o'clock, p. m., it was moved by Kaeser, seconded
by Ybarra, that the City Council go out of executive session and resume
regular session. Motion carried.
It was moved by Kaeser, seconded by Gonzales, that the City
Attorney be authorized to institute an unlawful detainer action against
S. E. Hogan. Motion carried.
Councilman McCormick abstained from voting on this motion.
ORDINANCE NO. 893 - An Ordinance of the City Council of the City
of VernonA.adingSec1iOii"22":lJ9 to the Code of the City of Vernon, California
1959, Enabling the City Council of the City of Vernon to Establish Franchise
Fees from TinE to Titre by Resolution, was presented.
It was moved by Gonzales, seconded by Ybarra, that Ordinance No.
893 receive and pass a second reading and be adopted. Motion carried.

Communication from Arthur E. Nelson, Director of Public Worksl
Building, dated S~ptember 13, 1979, requesting authority and funds for
Lewis R. Adams to attend Fall Conference, California-Nevada Section,
American Water Works Association, to be held in Coronado, California,
from October 24 to October 26, 1979, with an expense allowance of $267.00,
was presented.
It was moved by Gonzales, seconded by McCormick, that the request
of Arthur E. Nelson be approved and authority granted to issue warrant in
the amount of $267.00 to Lewis R. Adams. Motion carried.
Communication from S. E. Hogan, Chief of Police, dated September
18, 1979 requesting reimbursement for Officer L. W. Brown from the
Training and Education Fund in the amount of $57. 11, to cover cost of
tuition and books for police science courses at Mt. San Antonio College,
was presented.

It was moved by Kaeser, seconded by Ybarra, that the request of S.
E. Hogan, Police Chief, be approved and authority granted to issue warrant
in the amount of $57. 11 to Officer L. W. Brown. Motion carried.
Communication from Woods Electric Company, 4511 Produce Plaza,
Vernon, California, dated September 24, 1979, suggesting that the City
Council appoint an Energy Conservation Commission, comprised of a gas
company representative, an Edison Company representative and the City
Electrical Engineer, plus two or three larger firms tbat do not sell a major
portion of their products to government, was presented.
It was moved by Gonzales, seconded by McCormick, that the com-
munication from Woods Electric Company be received and filed. Motion
carried.
Communication from David L. Hirsch, Senior Corporate Counsel,
Norris In dustries, dated September 24, 1979, property owner in the unin-
corporated portion of Los Angeles County, adjacent to the cities of Com-
merce, Vernon, Maywood and Bell; requesting that the property be annexed
to the City of Vernon, rather than the City of Maywood, and asking that legal
procedures be taknn for the annexation of such property, was presented.
After discussion, it was moved by Gonzales, seconded by Ybarra,
that the City Administrator notify Mr. David Hirsch to present his petition
for annexation to the Los Angeles County Formation Commission or to the
Board of Supervisors, on whose agenda this matter is set for a decision.
Motion carried.
Summons and Complaint, Municipal Court for the Southeast Judicial
District, Victor Cervantes vs. City of Vernon; Vernon Police Department;
Scott A. Miedecke; and Does I through XX, inclusive, Case No. 52179,
served September 26, 1979, alleging as a result of a collision March 5, 1979,
plaintiff sustained bodily injury; seeking $15,000.00 general damages;
medical and incidental expenses; loss of earnings; costs of suit incurred
herein and for such other and further relief as the court deems just and proper,
was presented.
It was moved by Kaeser, seconded by McCormick that complaint and
summons in the above-entitled court and cause be referred to Soothern Cali-
fornia Joint Powers Insurance Authority for review, report am recommend-
ation. Motion carried. Claim for Damages by Victor Cervantes filed May
3, 1979, was rejected by the City Council on June 5, 1979.
Police Department Activity Log, September 16 - 30, 1979, was pre-
sented.
It was moved by Ybarra, seconded by Kaeser, that the Police Depart-
ment Activity Log be received and filed. Motion carried.
Communication from Arthur E. Nelson, Director of Public Works/
Building, dated September 25, 1979, requesting reimbursement for Luke
Salerno from the Training and Education Fund in the amount of $38.05, to
cover registration,WeldingCourse\ A-730 and books at Tri-Community
Adult School, Glendora, was presented.
It was moved by Kaeser, seconded by Gonzales that the request of
Arthur E. Nelson be approved and that authority be granted to issue warrant
in the amount of $38.05 to Luke Salerno. Motion carried.
'.'Warrant Register No. 534" covering claims and demands presented
during the period September 16 to 30, which includes Demands Nos. 91553
to 91621 (both inclusive) excluding voided Demand No. 91555, drawn on the
United California Bank, totaling $241, 687.07 (Light and Power Warrants
$172,999.55) (Accounting Period October, 1979), was examined and audited.
It was moved by Ybarra, seconded by Kaeser that ''Warrant Register
No. 534" be approved and payment authorized for Demands Nos. 91553 to
91621 (both inclusive) excluding voided Demand No. 91555, with no other
exceptions. Motion carried.

Claim for Damages submitted by Jerome F. Berger, July 2, 1979,
on behalf of Bertha Jiminez, Oliverio Jiminez, Cuauhtemoc Jiminez, Ilde-
fonso Seranno against the City of Vernon, alleging injuries as a result of
traffic collision May 9, 1979, at Slauson and Boyle Avenues, extent of
monetary damages unknown at this time, was presented.
It was moved by Kaeser, seconded by Gonzales that claim for ch mages
as detailed above, be denied, and that a notice of rejection be mailed to the
claimants and their attorney. Motion carried.
Communication from S. E. Hogan, Chief of Police, dated June 21,
1979, requesting authority and funds for Lt. G. W. Wilcox to attend California
Law Enforcement Warrant Officers Association, State Training Seminar,
Fresno, October 25-26, with an expense allowance of $201. 00 was presented.
It was moved by Kaeser, seconded by Ybarra, that the request of Chief
Hogan for Lt. G. W. Wilcox to attend the State Training Seminar at Fresno,
be denied. Motionearried.
Communication from S. E. Hogan, Chief of Police, dated September
26, 1979, requesting permission for Lt.L. S. Rosenkrantz and Sgt. J. E.
Mason to attend Public Employees Labor Dispute Training Seminar, Anaheim,
October 17, 1979, at a cost of $15.00 each, for lunch and registration.
It was moved by Gonzales, seconded by McCormick. that the request of
the Police Chief be approved and authority granted to issue warrant in the
amount of $15.00 to LieUl:'i". L. S. Rosenkrantz and Sgt. J. E. Mason. Motion
carried. .
Communication from L. A. Espinoza, Acting Chief of Police, dated
September 5, 1979, requesting authority and funds for Lt. Brad Bunker to
attend Annual California Association of Police Training Officers Conference
San Diego, California, October 16 - 19, 1979, with an expanse allov ance of
$211. 00, was presented.
It was moved by Kaeser, seconded by Gonzales, that the request of
the Acting Chief of Police be approved and authority granted to issue warrant
in the amount of $211. 00 to Lt. Brad Bunker. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/City
Clerk"z transmitting minutes of the Personnel Committee meeting held October
1, 19'/9, requesting approval of the recommendations contained therein, was
presented.
It was moved by Gonzales, seconded by Kaeser, that the minutes of
the Personnel Committee be approved, and that the recommendations con-
tained therein adopted. Motion carried.
It was moved by Gonzales, seconded by Kaeser, that the hER ring on
the recommendation to terminate Jean Hoffman be deferred until the first
regularly scheduled meeting of the City Council in November, 1979. Motion
carried.
It was moved by Ybarra, seconded by McCormick, that the hearing
on the recommendation to revoke the recognition of the Vernon Police Officers
Benefit Association be deferred until the first regularly scheduled meeting of
the City Council in November, 1979. Motion carried.
Chief George F. Bass submitted a letter of commendation for Battalion
Chief Robert L. Simensen, and the officers and firefighters who \\0 rked under
his command to control and extinguish the fire at the Phillip A. Hunt Chemical
Company, 4265 Charter Street, on August 23, 1979.
It was the order of the City Council that the letter of commendation for
Battalion Chief R. L. Simensen, and the officers and firefighters who \\Orked
under his comm and, as above mentioned, be made a matter of record, and that
the council members also join in the commendation.

Arthur E. Nelson introduced Jerry Jordan, Director of the California
Municipal Utilities Association, to the members of the City Council, and had
a tour of the City of Vernon arranged for Mr. Jordan later in the day.
At this time, 3:00 o'clock, p. m., it was moved by Ybarra, seconded
by Kaeser, that the City Council go into executive session under the Attorney /
Client privilege. Motion carried.
All persons with the exception of the City Administrator/City Clerk,
and the City Attorney were excluded from the executive session.
Mayor Malburg ordered that all communications to and from the ex-
ecutive session were deemed private.
At this time, 3:50 o'clock, p. m., Councilman McCormick was excused
from further attendance at this session.
At this time, 4:20 o'clock, p. m., it was moved by Kaeser, seconded
by Ybarra, that the City Council go out of executive session and re sume re gular
session. Motion carried.
Councilman McCormick resumed his seat for the remainder of the
meeting.
It was moved by Gonzales, seconded by Kaeser, that the City Attorney
be authorized to file a Petition for Re-Hearing in the Court of Appeals, in the
case of Vernon Fire Fighters, et al., (Donald E. Podlas). Motion carried.
It was moved by Ybarra, seconded by Gonzales, that the City Attorney
and the City Administrator, be authorized to attend a settlement conference in
the matter of Southern California Edison Company's rate increase, in Washington,
D. C., October 18, 1979. Motion carried.
Councilman Kaeser abstained from voting on this motion.
It was moved by Kaeser, seconded by Ybarra, that Application No.
59146, Advi.ee Letter No. 1184 in the matter of the Application of Southern
California Gas Company before the Public Utilities Commission of the State
of California to increase revenues to offset changed gas costs under its
approved purchased gas adjustment procedures resulting from adjustments
in the price of natural gas purchased from Transwestern Pipeline Company,
El Paso Natural Gas Company and Pacific Interstate Transmission Company;
and to adjust revenues under the supply adjustment mechanism to reflect
greater than anticipated collection of revenue due to increases in natural gas
supplied, be received and filed. Motion carried.
It was moved by McCormick, seconded by Ybarra, that a resolution
be adopted expressing condolences and regrets on the death of Edward
Valliere, former City Manager for the City of Lynwood, and that a floral
tribute be sent by the City of Vernon. Motion carried.
It was moved by McCormikk, seconded by Gonzales that Captains
Stickel, Graffio, Salisbury, Dressen, Beltowski, Kruse, Raabe, Garcia and
Dunn, be excused to attend promotional examinations October 6, 1979; and
that Engineers Barlag, Manolovits, Shelton, Winfrey, Claunch, Simon,
Gierhan, Weaver, and Wiles be excused for promotional examinations on
October 13, 1979, and that an overtime allowance in the amount of $2,000.00
be approved. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated October 2, 1979, requesting that Renee Michelle Doull be
employed as Switchboard Operator, Step 6, was presented.
It was moved by Kaeser, seconded by Ybarra, that the request of the
City Administrator be approved, and that Renee Michelle Doull, be employed
effective October 3, 1979, as Switchqoa;rd Operator, Step 6. Motion carried.

There being no further business to come before the City Council, it
was moved by Kaeser, seconded by Ybarra, that the meeting adjourn. Motion
carried.
